Abstract

Penelitian ini bertujuan untuk mengetahui pengaturan hukum terhadap penjualan produk obral menurut Undang-undang perlindungan konsumen serta perlindungan konsumen di Kota Mataram. Jenis penelitian ini menggunakan penelitian hukum normatif-empiris dengan pendekatan konseptual, pendekatan Undang-undang, dan pendekatan sosiologis. Dengan sumber datanya berasal dari data primer, sekunder dan tersier, serta analisis data normatif kualitatif yaitu dengan menjabarkan dan menafsirkan data yang akan disusun berdasarkan peraturan perundang-undangan yang berlaku. Dengan pengaturan hukum terhadap penjualan produk obral menurut Undang-undang perlindungan konsumen adalah Pasal 11 UUPK yang menjelaskan bahwa : pelaku usaha dalam hal penjualan melalui cara obral atau lelang, dilarang mengelabui konsumen. Pelaku Usaha dilarang menaikkan harga barang/jasa sebelum melakukan obral. Sedangkan bentuk perlindungan hukum terhadap konsumen dalam di kota mataram menurut Undang-undang No 8 Tahun 1999 diatur dalam Pasal 3 dijelaskan bahwa: konsumen berhak mendapatkan perlindungan yang mengandung kepastian hukum, keterbukaan informasi produk serta akses untuk mendapatkan informasi produk. Pemerintah daerah dan Lembaga Perlindungan Konsumen di kota Mataram telah memberikan perlindungan hukum terhadap konsumen yang dirugikan oleh produk obral dengan pengawasan terhadap kualitas barang, memberikan teguran dan sanksi denda terhadap pelaku usaha.

Abstract

Debtors as legal subjects are entitled to legal protection, both preventive and repressive, written or unwritten. The legal protection provided is an implementation of the principle of recognition and dignity that is rooted in Pancasila and the Constitution. This study aims to analyze the protection and legal remedies of the debtor in withdrawing the confiscation of fiduciary guarantees without going through a court auction. This research is a normative legal research. The results of this study include: The debtor's legal effort in withdrawing a fiduciary guarantee without going through a court auction is to ask the creditor to show a Fiduciary Guarantee Certificate issued by the Fiduciary Registration Office. If the creditor cannot show a fiduciary guarantee certificate, then the debtor does not need to submit the collateral, because the creditor does not have the right to execute the collateral.

Abstract

The persistently high divorce rate in Indonesia indicates a lack of effective psychological frameworks for sustaining marital stability. Despite numerous interventions, few have integrated philosophical approaches to strengthen emotional resilience in marriage. This study aims to address this gap by exploring the application of Stoic principles as a means of reducing divorce rates through the enhancement of couples’ psychological and emotional endurance. Employing a qualitative design, while qualitative insights were obtained via in-depth interviews and case studies. The findings reveal that Stoic value significantly contribute to constructive conflict management, effective communication, and greater tolerance of differences. Moreover, statistical analysis shows a positive correlation between the application of Stoic principles and marital satisfaction, accompanied by a reduction in divorce intentions. The study concludes by recommending the integration of Stoic-based emotional training into premarital education and marriage counseling programs to promote emotionally resilient and harmonious families in the complexities of modern life.
