Abstract

al-Qur’an yang diwahyukan dalam bahasa Arab tidak dapat dilepaskan dari visi gender dalam bahasa Arab. Artikel ini membahas pada aspek-aspek isu-isu gender yang terkandung dalam ayat-ayat Al-Quran, yang memberikan bias gender,baik secara tekstual maupun kontekstual. Melalui metode kualitatif, penelitian ini menemukan bias gender bahasaArab dalam Al-Qur’an. Bias gender ini juga mempengaruhi penafsiran. Ini membutuhkan pemahaman yang mendalam dan sangat sistematis, dengan menggunakan metodologi penafsiran yang tepat sebagai penafsiran Al-Qur’ankata kunci: Maskulin, Kajian Gender, Tafsir Al-Qur’an. In this simple article, the researcher will be more orientedon those aspects of gender issues contained in the verses of the Koran, which provides gender bias, both in textual and contextual. Through qualitative method, thisresearch will find the gender bias in the Arabic languagein the Qur’an. It is because the Qur’an, religious texts(text) has chosen the Arabic language in which aspects of gender bias in the Arabic language (as language choice inthe Lord Mediation), also affect the interpretation. Thisrequires an understanding of a very systematic and indepth by using the proper interpretation methodology as the interpretation of the Qur’anKeywords: Masculine, Gender Studies, interpretation ofal-Qur’an.

Abstract

This article explores the fact of harmony and religious tolerance values of the culture assimilation of Tionghoa ethnic dan local people in Lasem. Tionghoa ethnic have lived in Lasem since XI Century. Their existence bear new culture and plurarity for Lasem people that leads to a religiocity and social harmony within the people. The harmonius relation is proven when their both fight against Dutch Collonials in Lasem. The harmonious and tolerance of Lasem moslems can be seen in the interaction of the local people and the newcomer (Tionghoa ethnic), whether they are muslim or not

Abstract

The hermeneutic study about discourse before the existence of Paul Ricoeur was around three points: romantic hermeneutics, onology hermeneutics, and dialectical hermeneutics. They have characteristics that other mainsteams do not have. Ricoeur’s thought style cannot be included in any of those three hermeneutic thoughts. In fact, his thought covers almost all contemporary philosophical topics. One of the points of Ricoeur’s contemporary hermeneutics is how to combine the phenomenology of Husserl’s metaphysical tendencies with Heidegger’s existential phenomenology. The text is essentially autonomous to carry out “de-contextualization” (the process of liberating oneself from context) and “re-contextualization” (the process of returning to context). Ricoeur’s thought patterns cannot be included in one of the three hermeneutic thought. In fact, his thought allegedly covers almost all contemporary philosophical topics. One of Ricoeur’s contemporary hermeneutics is how to combine the phenomenology of Husserl’s metaphysical tendencies with Heidegger’s existential phenomenology.

Abstract

In essence, marriage is a religious order that is governed by Islamic law and is the only authoritative sexual relations in Islam. As rahmatan lil ‘alamin, Islam has determined that the only way to meet the biological needs of individuals living just by marriage, marriage is one thing that is very interesting if we look more closely at the content of the meaning of this marriage problem. The Qur’an has explained that among the purpose of marriage is to find peace in one’s life both for men and women (litaskunu ilaiha). Islam ordained marriage as a vehicle of family to achieve happiness in life. Therefore, in this article, the author explores the notion of marriage, the legal basis, as well as the terms and harmonious marriage’s wisdom that prescribed.Keywords: marriage, Saqinah, law and Islam

Abstract

The article discusses mantuq and mafhum in drawing the laws from Qur’an and Sunnah. The author begins with the understanding of manthuq and mafhum. According to Al-Qatthan (2002: 358) manthuq is a meaning that is indicated by lafadh according to its words, the meaning is based on the spoken letters. On the other hand, mafhum is meaning indicated by lafadh based on other than its sound. The ushuliyyin differentiates mafhum into two kinds, namely: a) mafhum muwafaqah or dilalah nash, meaning the law in accordance with manthuq, and b) mafhum mukhalafah means unspoken meaning which is drawn from manthuq but the opposite. There are dispute among scholars over manthuq and mafhum. Scholars agree on using manthuq as hujjah (proof), but most of them have different opinions about using mafhum as hujjah. They agree on the validity of mafhum muwafaqah as proof (hujjah) except Zahiri schools. However, mafhum mukhalafah is allowed and recognized only by Maliki, Shafi’i and Hanbali. Abstract

ABSTRAKThis article describes method in the study of ushul fiqh on contradictory dalil and the ways ushuliyyin solved this problem. In fact, there is no contradiction in the law, rather, sometimes mujtahid disputed over two arguments. Mujtahid of the classic era has been working in many ways to find solution of the problems. They are jam’u wa at-taufiq (comprise and compromise), tarjih (favor) and nasakh (abrogating). If al-jam’u is not possible to compromise among dalil, then mujtahid used tarjih (favoring one of them). However, should tarjih is impossible, then the last method is naskh, ie the first coming text is cancelled by the later one in chronological order. If they did not know which text came first, then tawaqquf was applied.

Abstract

Artikel ini akan mengeksplorasikan tentang otentitas kesejarahan Sunnah Nabi Saw. Di awal, penulis mencoba melacak otentitas kesejarahan hadis Nabi dengan menggali akar sejarah perekaman dan penulisan hadis Nabi dari generasi pertama Islam hingga dibukukannya hadis dalam bentuknya yang sistematis. Penulis juga akan menjelaskan konsep isnad hadis sebagai penghubung masa silam, dan mengungkap teori common link yang meragukan otentitas hadis-hadis yang mempunyai periwayatan yang menyendiri (infirad), serta kritik para sarjana muslim dan teori kebenaran filsafat terhadapnya. Secara khusus, penulis juga akan menjelaskan teori common link yang diprakarsai oleh Joseph Schacht dan dikembangkan oleh G.H.A. Juynboll, serta perdebatan mereka dengan M. Musthafa Azami tentang teori tersebut yang berimplikasi pada otentitas hadis-hadis Nabi dalam kitab-kitab hadis kanonik (al-kutub al-sittah dan al-kutub al-tis’ah). Tujuan penulisan artikel ini adalah untuk mengeksplorasi dan mendapatkan pengetahuan yang meyakinkan bahwa hadis sebagai bagian dari sejarah bisa diketahui secara otentik dengan menggunakan jembatan yang bisa mengantarkan kepada masa silam secara benar.

Abstract

This article describes the thinking of al-Qaradhawi on methods to understand the hadith to distinguish between means and goals remain unchanged in the hadith. This article begins the biography setting of al-Qaradhawi. Al-Qaradhawi has the full name of Abdullah Yusuf al-Qaradhawi. Saft} Tura>b is the birthplace of al-Qaradhawi, a small village which is one of the beautiful villages of Egypt contained in Gharbiyah province, its capital is Tanta. The work of al-Qaradhawi’s “Kaifa Nata’a> mal ma’a al-Sunnah al-Nabawiyya” is a magnum opus in the study of hadith. In this work, al-Qaradhawi sparked about the various methods and principles to understand the traditions of the Prophet with a proper understanding. Hadith as an interpretation of the Qur’an in the practice or application of Islamic teachings in a factual and ideal, has a way of a comprehensive, balanced and facilitating (taisi>r). In the end, this article specifically describes methods of al-Qaradhawi, and their application in examples of hadith of the Prophet. The purpose of writing this article is to understand the tradition, should be able to distinguish between means and goals or objectives. Most errors are usually considered. That is what should be the purpose of our guidance is not a means, which can be changed at any time.

Abstract

Artikel ini mengeksplorasikan tentang tarji>h} yang dilakukan oleh asy-Syaukani dalam tafsir Fath al-Qadir dengan penelusuran terhadap hadis-hadis Nabi. Tarji>h} dengan hadis Nabi sudah biasa dilakukan oleh para ulama untuk mendapatkan kebenaran yang dipedomani oleh seorang mufassir maupun muhaddis terhadap berbagai pendapat dalam memahami ayat al-Qur’an maupun hadis Nabi. Dalam makalah ini, al-Syaukani mencoba melakukan tarji>h} pada ayat-ayat al-Qur’an tertentu kemudian dicarikan dalil dari hadis sebagai alat pembantu dalam memperoleh pendapat yang kuat dari adanya perbedaan pendapat dari ulama-ulama sebelumnya. Sehingga, dengan memahami ayat al-Qur’an dengan pendekatan hadis ini, asy-Syauka>ni> yakin betul bahwa tarji>h} dengan hadis Nabi ini dapat dipedomani untuk diyakini kebenarannya dan diamalkan dalam kehidupan beragama.

Abstract

Artikel ini menjelaskan tentang metode tarjih dalam hadis Nabi. Tarjih dilakukan apabila terdapat beberapa nash yang saling bertentangan (ta’arudl). Ta’arudl dapat terjadi diantara nash-nash (ayat ataupun hadis), atau antara qiyas dengan qiyas. Melakukan tarjih pada hadis berarti melakukan pengunggulan kepada sesuatu yang disandarkan kepada Rasulillah Saw. pentarjihan bisa dilakukan dengan berbagai cara (metode). Cara-cara tersebut tergantung pada kajian dan ijtihad para mujtahid. Pada dasarnya, banyak cara untuk mentarjih suatu hadis yang nampak bertentangan. Namun, artikel ini hanya membatasi pada empat hal yang berkaitan dengan unsur-unsur hadis, yaitu: Pertama, tarjih dari segi sanad dan rawi; kedua, tarjih dari segi matan; ketiga, tarjih dari segi hukum atau kandungan hukum (madlul); keempat, tarjih dengan menggunakan faktor (dalil) lain di luar nash
