Abstract

This study aims to determine the implementation of Credit Agreement with the guarantee of Mortgage Right made by Notary of Land Deed Officials at PT. Bank Jateng Branch Slawi, Tegal Regency, to know the role of Notary Land Deed Officials, to know the constraints faced by Notary and what the solutions can be considered to solve the problem. This legal investigation included a descriptive type of empirical legal research. Research location was at PT. Bank Jateng Branch Slawi, Tegal Regency and the Notary office of Dewi Milasari, S. Sos., S.H., M.Kn as Notary PPAT partner. Based on this research, it found that credit granting mechanism in PT. Bank Jateng Branch Slawi, Tegal Regency is done through 5 stages: stage of loan application, credit analysis, credit decision, credit agreement and credit binding stage. Before credit agreement is executed, Notary as a partner is obliged to check the validity of guarantee of Mortgage Rights, Notary PPAT in credit agreement with guarantee of Mortgage right provides legal certainty for parties holding credit agreement. The constraint faced by Notary in making credit with Mortgage Right is the credit agreement draft which has been prepared by bank (creditor). However, the contents are unfair or more disadvantageous to the customer (the debtor), and the banking party often (creditor) absent in the signing of the deed.Keywords: Role of Land Deed Officials; Credit Agreement; Mortgage Rights

Abstract

This study aims to conduct a study that jurisdiction over on mudharabah at. Bank Tabungan Negara (BTN) Tbk. SBU Branch of Semarang and to know mudharabah implementation constraints on PT. Bank BTN Tbk. SBU Branch of Semarang and how to overcome them. The research method used is normative, the source of the data used are secondary data gathered through identification and inventory of legislation and library books interviews as supporting data, then the data is analyzed by qualitative normative method.Based on the results of research and discussion we concluded that the Agreement Mudharabah is a partnership contract by PT. Bank Tabungan Negara (BTN) Tbk. Sharia Business Unit (SBU) Branch of Semarang to customers of PT. Bank Tabungan Negara (BTN) Tbk. Sharia Business Unit (SBU) Branch of Semarang as shahibul maal finance, hundred percent of funds to the client (mudharib). Implementation mudharabah in PT. Bank Tabungan Negara (BTN) Tbk. Sharia Business Unit (SBU) the new branch also complies with Islamic legal theory and the theory of legal certainty.Keywords: Mudharabah; Islamic Banking.

Abstract

This study aims to investigate the Implementation Of Notary Liability In The Making Of Deed Based Act No. 2 Of 2014 On  Notary Position and how protection Notary Notaries in deed.This study uses normative legal or sociological approach, as this study does not only include the Legislation and legal materials in the library, but also to the practice field as the supporting data. Also in this study are also used as the primary data source supporting data in a finding that will be examined with regard to liability notarized under Act No. 2 of 2014 concerning Notary.The results of this study ultimately provide answers form of accountability in the manufacture of a notarial deed notary if a notary to make mistakes as well as a form of protection notary if one were sued by applicant. Implementation responsibilities of office owned by a Notary is not done, then it could result in a deed made void, canceled by the parties or the deed only a proofing tool contract under hand. Because the deed deed null and void, the reason for the parties who suffered damages to sue replacement costs, damages and interest to the Notary. MKN Notary protection given to the Notary that if one made the call by the court to a Public Notary, must request permission in advance to MKN, should be make coordination with INI organization or Competent Senior Notary.Keywords: Notaries; Public Notary Accountability; Deeds.

Abstract

The purpose of this research are: 1) To determine the role of the Notary in the implementation of the agreement rented farmland in the village of Tungu Godong District of Grobogan. 2) To know the rental renting Agricultural Land In the village Tungu Godong District of Grobogan. 3) To know the constraints in the implementation of the lease meyewa farmland and the solution of these constraints. The method in this research sociological juridical This study is based on positive law in Indonesia and is based on existing practices in the community. So paties directly relate to both parties, including the people who do agricultural land lease agreement.Based on the analysis of this study concluded that the role of the Notary in the lease agreement of agricultural land is the agreement made before a Notary with the deed of lease agreement, the lease which is carried out in the village Tungu done by those who do the lease agreement in line of sight crushing price to be agreed , if it is agreed the lease agreement was publishes an agreement in the agreement, such as a lease, the lease payments. The obstacles in the process of leasing such as crop failure, it is also common pests and the solution of these problems are minimized losses by means of land rent farmers cultivating land in addition to the main cropping namely rice, do matcher other crops such as corn.Keywords: Role of the Notary; Rent Agreement; Land of Agriculture.

Abstract

Nominee agreement is an agreement made between someone who by law can not be the subject of rights to certain lands (property rights), in this case that foreigners (WNA) and Indonesian Citizen (citizen), with the intention that the foreigners can master land de facto property rights, but legal-formal (de jure) land property rights are assigned to his Indonesian citizen. The purpose of this paper isto assess the position of the nominee agreement in Indonesia's legal system and the legal consequences arising in terms of the draft Civil Code and the Law on Agrarian. Agreement is an agreement unnamed nominee made based on the principle of freedom of contract and good faith of the parties. However, it should be noted that the law prohibits foreigners make agreements / related statement stock wealth / property (land) for and on behalf of others, sehingga the legal consequences of the agreement is the nominee of the agreement is not legally enforceable because the agreement was made on a false causa.Keywords: Nominee Agreement; Property Rights; Foreigners.

Abstract

The purpose of this study was to: 1) to analyze the implementation of standard operating procedures and service settings (SPOPP) notary in the deed of Shariah  is based on article 15 paragraph (1) Law No. 2 of 2014 on the notary office. 2) to analyze the legal consequences shari’a deed made by the notary pursuant to Article 15 paragraph (1) Law No. 2 of 2014 on the notary office. The data used in this study are primary data, secondary data and data that can support tertiary study, which was then analyzed by qualitative descriptive method.Based on the analysis of data concluded that: 1) the execution of a deed notarized by a notary Shari’ah-based, there are two models in the inclusion of Bismillahhirrohmanirrohim writing. The first one is the inclusion of the article after the title, and the second inclusion Lafadz Bismillahhirromanirrohim/writing there were no written or written and included in the premise. 2) the legal effect of Shariah -based of authentic act by a notary depends on the placement Bissmilahhirrohmanirrohim writing. The first in the inclusion of the text at the beginning of the deed would have violated the rules of the article 38 of Law Notary, that at the beginning consists of the title deed deed, certificate number, full name and place of notary. Abstract

Indonesia as the country with the largest Muslim population in the world, since approximately 25 years ago trying to get out of the slump economic problems. One effort in doing it is to fix the economic system we particularly of financial institutions with a switch using Sharia system. Banking financial institution as the economic backbone of Indonesia sought to apply Islamic principles in accordance with the provisions of the Qur'an and Al Hadith and what is regulated in the Law Compilation of Islamic Economics. The application of Sharia principles in this new start in 1992, namely by in the operation of Bank Muamalat Indonesia. Prior to 1992, the Indonesian economy are not familiar with Islamic principles in accordance with the Qur 'syariah principle has been applied by the banking institutions including Bank Muamalat Indonesia is in a start since its establishment, the principle is divided into three areas : 1. Sharing System (avoid riba) 2. Buying and selling on margin system Advantages 3. system Services In general principles that must be enforced by Islamic banks is to avoid the usury and uses a system of revenue sharing as well as buying and selling. In order upholding Islamic principles that must be run by Islamic banks need supervision that have until now run by the Sharia Supervisory Board (DPS). DPS task as the supervisory board on Islamic banking is the attribution of authority. DPS is authorized by the original authority derived directly from Article 27 PBI No. 6/24 / PBI / 2004, which outlines the duties, powers and responsibilities of DPS, DPS Presence is what differentiates it from conventional banks. Abstract

The research objective is to identify and analyze the implementation of Diversion in order to realize Restorative Justice in the Juvenile Criminal Justice System in an effort to provide legal protection for child criminal offenders. The approach method used in this research is normative juridical or library law research or doctrinal law research, namely legal research by examining library materials and secondary materials, the results of the study found that the obligation to seek diversion with the Restorative Justice approach at every stage in the criminal justice process Children must be carried out in the Criminal Justice System, Diversion as a step towards transferring the settlement of children's cases from the criminal justice process to non-criminal justice processes by prioritizing the Restorative Justice approach which can be carried out by way of deliberation or mediation which emphasizes efforts to restore back to its original state in a friendly manner.

Abstract

Notary is apublic official who runs most of the public functionsin the state, especially in the civil law. Notary has authority to make authentic certificate of all deeds, agreements, and regulations which is obligated by legislation or which is desired by an interested party, to be declared in the deed authentic, guaranteeing deed date, saving certificates, giving grosse, copies and citations of certificates, all along the deed is not assigned or excluded to the officer or other person which is specified by law.In the authority need to carry out surveillance and MPD is the only aut horized institution to implement surveillance, inspection and giving punishment toward notaries in the district/city. The institution exists of Region Supervisor Council and the Central Supervisors Council.MPD has a special authority which can be run to check notary relate to the investigators request, prosecutors or judges to take a photocopy minuta or other documents which is attached to the minuta or protocols in Notary storage, calling the Notary related to deed which has been made or notary protocols which are in Notary storage.Keywords: Notary, MPD, Lawyer

Abstract

AbstractThe Commercial Court authority as set out in Article 300 Law Number 37 of 2004  on The Bankruptcy and Delay of Debt Payments was unique, because this court is authorized also to examine the case in connection with the bankruptcy case containing the arbitration clause. Article 303 of the Bankruptcy Act states that the Court remains authorized to investigate and resolve the bankruptcy petition, all the debt on which the bankruptcy petition has complied with the provisions of Article 2 paragraph ( 1 ) of this Act .Regulations on the absolute authority possessed by the Commercial Court in the case of bankruptcy is really in the context of absolute meaning, although existing arbitration clause in the basic agreement between the parties nonetheless Commercial Court is authorized to examine and decide perkara. Base contained in Article 1338 of the Civil Code be respected, so that the corresponding theory against absolutism which is owned by the Commercial Court is the theory of authority .Bankruptcy decision by the court have implications for companies pailit. Some juridical result of a bankruptcy, the legal consequences occur if the debtor bankrupt, and some legal consequences if the debtor bankrupt among others should be compensated, then the presence of counter-reciprocity should be continued, applicable general encumbrances over the entire property of the debtor, debtor loses the right care of, and engagement after bankruptcy debtor can not pay. This uses the theories of legal protection. The focus of this theoretical study on people who are in a weak position, in this case legally weak.Keywords: Bankruptcy , Commercial Court , legal consequences. AbstrakKewenangan Pengadilan Niaga sebagaimana yang tertuang dalam Pasal 300 Undang-Undang No. 37 Tahun 2004 tentang Kepailitan dan Penundaan Kewajiban Pembayaran Utang (PKPU) ini terasa unik, karena pengadilan ini berwenang juga untuk memeriksa perkara sehubungan dengan perkara pailit yang mengandung klausula arbitrase. Pasal 303 Undang-Undang Kepailitan menyebutkan bahwa pengadilan tetap berwenang memeriksa dan menyelesaikan permohonan pernyataan pailit, sepanjang utang yang menjadi dasar permohonan pernyataan pailit telah memenuhi ketentuan sebagaimana dalam Pasal 2 ayat (1) undang-undang ini.Peraturan tentang kewenangan absolut yang dimiliki oleh Pengadilan Niaga dalam perkara kepailitan adalah benar-benar dalam konteks absolut, meskipun sudah ada klausula arbitrase di dalam perjanjian pokok antar pihak tetap saja Pengadilan Niaga berwenang untuk memeriksa dan memutus perkara. Asas yang terdapat di dalam Pasal 1338 KUHPerdata menjadi tidak dihormati, sehingga teori yang sesuai terhadap absolutisme yang dimiliki oleh Pengadilan Niaga tersebut adalah  Teori kewenangan.Putusan pailit oleh Pengadilan memberikan implikasi bagi perusahaan pailit. Ada beberapa akibat yuridis dari suatu kepailitan, yaitu akibat hukum yang terjadi jika debitur dipailitkan dan beberapa akibat hukum jika debitur dipailitkan yaitu antara lain boleh dilakukan kompensasi, kemudian terdapatnya kontra timbal balik boleh dilanjutkan, berlaku sitaan umum atas seluruh harta debitur, debitur kehilangan hak mengurus, dan perikatan setelah debitur pailit tidak dapat dibayar. Adapun teori yang digunakan adalah menggunakan teori perlindungan hukum. Fokus dari kajian teori ini pada masyarakat yang berada pada posisi yang lemah, dalam hal ini lemah secara yuridis.Kata Kunci: Kepailitan, Pengadilan Niaga, akibat hukum.
