Abstract

Penelitian ini menjelaskan mengenai permasalahan dalam pelaksanaan pengadaan tanah jalur kereta api Bandara Soekarno-Hatta yang berkeadilan berdasarkan prinsip keadilan kompensatoris dan keadilan distributif, dimana termasuk ke dalam penelitian hukum normatif dengan bersifat perspektif. Untuk itu digunakan cara pendekatan pada undang-undang dan kasus serta menggunakan data sekunder yaitu bahan hukum primer, sekunder, dan tersier. Hasil penelitian ini mewujudkan bahwa pengaturan pengadaan tanah jalur kereta api Bandara Soekarno-Hatta secara hukum sudah memenuhi prinsip keadilan kompensatoris, walaupun dalam prosesnya masih terdapat kendala berupa bentuk penolakan dari warga di Kelurahan Tanah Tinggi. Proses pemberian kompensasi juga sudah sesuai dengan hasil penilaian dan beberapa langkah yang dilakukan oleh PT. KAI agar pemberian kompensasi tersebut tidak merugikan warga yang bidang tanahnya menjadi objek pengadaan tanah.Kata kunci: Pengadaan Tanah, Ganti Rugi, Keadilan Kompensatoris, Keadilan Distributif

Abstract

This research intend to determine and resolve the process of dispute settlement of industrial relations between employee and PT Suzuki Finance Indonesia Branch Office Purwokerto on mediation step that was held at Dinas Tenaga Kerja, Koperasi dan UKM Kab. Banyumas. This research using normative and empirical methods which use primary and secondary legal materials. Also using interview data sources with the mediator of Dinnakerkop UKM Kab. Banyumas and documentary study. The conclusion of this research is the dispute settlement of industrial relations on this case already in accordance with PPHI Law, but there are obstacles that cause the solution of industrial relation can not to be done in the mediation step.

Abstract

This study aims to analyze the implementation of local government policies in the management of the Setu Babakan Betawi Cultural Village from the perspective of spatial planning law. The research method employed is empirical legal research with a descriptive nature and a qualitative approach, involving document studies and interviews. The results show that the policy implementation has been carried out through various regulations; however, it still faces challenges such as fragmented authority among agencies, lack of coordination, and limited resources. To optimize the management and preservation of the area, strategic efforts are needed, including strengthening regulations, preparing a Detailed Spatial Plan (RDTR), increasing resources and budget allocation, involving the local community, and utilizing technology. Through these measures, the Setu Babakan Betawi Cultural Village is expected to remain a sustainable center for cultural preservation amidst Jakarta’s urban development.

Abstract

The practice of dentists in Indonesia is an important concern in the health care system, especially regarding consumer protection. Dentists often provide services that exceed the limits of their authority, potentially endangering public health. This article aims to analyze the urgency of legal protection for consumers of health services in dental practices based on a normative perspective and the implementation of applicable regulations. This research uses normative juridical methods with statutory, conceptual and case approaches. The research results show that even though there are regulations such as Law no. 8 of 1999 concerning Consumer Protection and Minister of Health Regulation no. 39 of 2014, implementation is still less effective. This is caused by weak supervision, minimal public knowledge regarding consumer rights, and non-compliance by some dentists with regulations. Therefore, it is necessary to strengthen regulations, increase supervision by the government, and educate the public to realize optimal legal protection for consumers of health services.

Abstract

This research aims to analyze the compatibility of the sea sand export policy, as outlined in Government Regulation No. 26 of 2023 and its implementing regulations in Minister of Trade Regulations No. 20 and 21, with the principles of ecological justice. The research is driven by concerns over the ecological impacts of sea sand exploitation and the potential conflict between economic interests and environmental protection. Using a normative juridical approach and analysis of prevailing laws and regulations, the study finds that the current regulatory framework does not fully reflect the principles of ecological justice. The policy fails to ensure equitable protection for coastal communities and the marine environment. Government Regulation No. 26/2023 does not explicitly mandate Environmental Impact Assessments (AMDAL), does not emphasize conservation as a fundamental principle, and allows room for exploitation in vulnerable coastal and small island areas. Moreover, historical data reveals that similar policies in the past have led to coastal erosion, the loss of outermost islands, and state losses due to illegal practices. Therefore, without proper reassessment and alignment with environmental justice principles, this policy risks exacerbating ecological inequalities.

Abstract

This research aims to examine the legal protection against employment termination (PHK) in Temanggung and the obstacles encountered in the process of providing such legal protection. The type of legal research used is empirical and descriptive in nature. The approach employed is qualitative. The types of data used in this research include primary data obtained through interviews with respondents, and secondary data in the form of documents, information, books, journal articles, and facts obtained from official documents and legislation. The results of the study show that legal protection against employment termination (PHK) is carried out by the Department of Industry and Manpower of Temanggung Regency through the development of industrial relations and resolution via mediation. The obstacles faced by the Department of Industry and Manpower of Temanggung Regency in providing legal protection against employment termination (PHK) include limited budget for official travel activities, challenges in implementing industrial relations development with companies, the absence of disputing parties, and the lack of knowledge regarding applicable legal provisions.

Abstract

Legal advocacy and political policy influence on every decision-making related to renewable energy in the government have implications for whether or not the targets and objectives of the policy are achieved to answer the problems and needs that exist in society. In encouraging the development of New Renewable Energy (NRB), Indonesia reflects through the NRB Bill and its derivative regulations. The effectiveness of this policy is influenced by Indonesia's political direction to seek to reduce emissions. Political policies that are implemented based on the effectiveness of renewable energy governance in the form of good governance can encourage Indonesia to achieve targets and efforts in producing energy from NRB in 2030. This effort also encourages the government to achieve the national NRB target of 34% or an increase of 10.6% from the previous target. Legal advocacy efforts encourage the fulfilment of people's rights to obtain, access and benefit from the management of natural resources for renewable energy in the form of the implementation of government policies related to renewable energy.

Abstract

This study aims to examine the regulatory weaknesses in the obligation to implement the PMPJ and the normative conflict between the obligation to report suspicious financial transactions in the context of anti-money laundering efforts and the principle of notarial confidentiality. It further addresses the urgency of reformulating the UUJN to prevent normative ambiguity and to align with the dynamics of contemporary legal developments. The research responds to the normative conflict between the UUJN and the PP Number 43 of 2015, which has led to legal uncertainty in practice. Employing a normative juridical method with statutory and conceptual approaches, this study reveals that the UUJN does not explicitly accommodate the obligation to apply PMPJ as an integral part of notarial professional duties. Moreover, the obligation to report suspicious transactions by notaries creates a normative conflict with PP Number 43 of 2015, particularly concerning the legal hierarchy, thereby undermining public trust in the integrity of notaries in upholding client confidentiality. The novelty of this research lies in the proposal for a legal reform of the UUJN as a structural solution to resolve the existing normative conflict. It concludes that to prevent such conflicts, the UUJN must be reformulated through both vertical and horizontal harmonization with the Anti-Money Laundering and Counter-Terrorism Financing (AML/CTF) regime in Indonesia, thereby enabling full legal integration of the reporting obligations into the notarial regulatory framework.   Penelitian ini bertujuan untuk mengkaji kelemahan pengaturan kewajiban PMPJ dan konflik norma terhadap kewajiban pelaporan transaksi mencurigakan dalam pencegahan TPPU dengan prinsip kerahasiaan jabatan Notaris, serta urgensi reformulasi UUJN dalam mendukung upaya pencegahan TPPU agar tidak menimbulkan multitafsir dan lebih progresif mengikuti perkembangan hukum kontemporer. Penelitian ini hadir untuk mengatasi konflik norma terhadap UUJN dengan PP Nomor 43 Tahun 2015 yang menyebabkan ketidakpastian hukum dalam praktik. Metode  penelitian  yang  digunakan  adalah  yuridis normatif dengan pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach). Temuan penelitian mengungkapkan bahwa UUJN belum secara eksplisit mengakomodasi kewajiban penerapan PMPJ sebagai bagian integral dari kewajiban profesional Notaris dan kewajiban pelaporan transaksi mencurigakan oleh Notaris dalam penerapannya menimbulkan konflik norma antara UUJN dengan PP Nomor 43 Tahun 2015 secara hierarki peraturan perundang-undangan sehingga berimplikasi menurunnya kepercayaan publik terhadap integritas Notaris dalam menjaga rahasia klien. Kebaruan  penelitian  ini  terletak pada kebutuhan reformulasi norma hukum dalam UUJN sebagai perbaikan struktural terhadap konflik norma yang terjadi. Penelitian ini menegaskan untuk menghindari konflik norma perlu adanya reformulasi UUJN melalui harmonisasi hukum secara vertikal dan horizontal terhadap UUJN dengan UU TPPU dalam melakukan integrasi kewajiban terhadap Notaris dengan rezim APU-PPT di Indonesia.

Abstract

This research aims to find out and review the laws and regulations regarding the appointment of Acting Regional Heads from the TNI / Polri elements. This research is a descriptive juridical-empirical legal research with a research approach using a statutory approach, case approach, conceptual approach and elaborates with a qualitative approach. The research data sources come from primary data and secondary data. Primary data is the result of interviews and secondary data is primary legal material and secondary legal material. The analysis technique used in this research uses the deduction method. The results of this study indicate that the appointment of Acting (Pj) regional heads who come from active TNI / Polri elements is a maladministration event because it is contrary to statutory regulations because it does not fulfil the arrangements for filling high leadership positions in accordance with statutory regulations. And in fact, the appointment of Acting Regional Heads from TNI / Polri elements is a form of discretion and does not reflect the concept of public service delivery.
