Abstract

This research discusses the Effectiveness of the Ombudsman of the Republic of Indonesia Representatives of the Province of Lampung in Completing Reports Regarding the Distribution of Social Assistance for Communities Affected by the Covid-19 National Disaster in Lampung Province. With the formulation of the problem 1) How is the Effectiveness of the Ombudsman of the Republic of Indonesia Representatives of the Province of Lampung in Completing Reports Regarding the Distribution of Social Assistance for Communities Affected by the Covid-19 National Disaster in Lampung Province? 2) What were the inhibiting factors experienced and the efforts made by the Ombudsman of the Republic of Indonesia representatives of the province of Lampung in completing the report? The conclusions of this study are 1) Completion of reports related to the distribution of social assistance to communities affected by the Covid-19 national disaster in Lampung Province carried out by the Ombudsman of the Republic of Indonesia Representatives of the Province of Lampung is quite effective but not maximized, this is because the settlement regulatory mechanism is only based on in the Circular that has differences with the Ombudsman Regulations of the Republic of Indonesia 2) The main obstacle to the completion of public reports experienced by the Ombudsman of the Republic of Indonesia Representatives of the Province of Lampung is the issuance of the Circular of the Chairman of the Ombudsman of the Republic of Indonesia which overrides higher Regulations, and efforts made to overcome obstacles The Head of the Ombudsman Representative of the Republic of Indonesia, Lampung Province, took another policy in the form of continuing to use several requirements stipulated in the Ombudsman Regulation of the Republic of Indonesia.

Abstract

AbstractState of Indonesia is in the form of the republic, which consists of several islands. So called archipelago that has outstanding cultural richness and are not owned by another country, one of the Indonesian national pride by having a diversity of ethnic, tribal customs that have high values inherited by our ancestors to be conserved and have value quite high as a tool to build character as a nation and is the capital of local wisdom very proud of each region through provincial and district/city in the archipelago along still recognized and not contrary to the values of national wisdom that the values of pancasila . Indigenous people ( MAHUdAT ) and customs / traditional culture is still recognized its existence ( living law) as mandated by Article 18 B in conjunction with Article 32The  1945  constitution jo permendagri No. 39 of 2007 , for it needs to be implemented and used as the basic capital development in all fields in order of regional autonomy . Empowering Indigenous leader and kinship to participate in governance , which made the subsequent government policy areas outlined in the regulations . Thus is one way in the course of the Autonomous regional government through the area can be achieved good government.Key words: Urgency, indigenous, people autonomous regional government.AbstrakNegara Indonesia adalah Negara Kesatuan yang berbentuk Republik, yang terdiri dari beberapa pulau. Sehingga disebut dengan Nusantara yang memiliki kekayaan budaya yang luar biasa dan tidak dimiliki oleh negara lain, salah satu kebanggaan bangsa Indonesia dengan memiliki keanekaragaman etnis, suku budaya/ adat istiadat yang mempunyai nilai-nilai luhur yang diwariskan oleh nenek moyang untuk dilestarikan dan mempunyai nilai yang cukup tinggi  sebagai alat untuk membangun karakter bangsa dan merupakan modal sebagai Kearifan lokal yang sangat dibanggakan oleh masing-masing daerah melalui Provinsi dan kabupaten/kota di seluruh Nusantara sepanjang masih diakui dan tidak bertentangan dengan nilai-nilai Kearifan nasional yaitu nilai-nilai Pancasila. Masyarakat Hukum Adat ( MAHUDAT) beserta adat istiadat/budaya tradisionalnya hingga saat ini masih diakui keberadaannya (living law) sebagaimana yang diamanatkan oleh Pasal 18 B jo Pasal 32 UUD Negara Republik Indonesia Tahun 1945 jo Permendagri No 39 Tahun 2007, untuk itu perlu diimplementasikan dan digunakan sebagai modal dasar pembangunan di segala bidang dalam rangka penyelenggaraan otonomi daerah. Pemberdayaan Tokoh Adat dan Kekerabatannya untuk dapat berpartisipasi dalam penyelenggaraan pemerintahan, yang dibuat sebagai kebijakan Pemerintah Daerah selanjutnya dituangkan dalam Peraturan daerah. Sehingga dengan demikian merupakan salah satu cara dalam rangka penyelenggaraan Pemerintahan di Daerah melalui Otonomi daerah dapat tercapai Good governmentKata kunci: Urgensi, kearifan lokal, otonomi daerah.

Abstract

Polmas adalah  suatu  kegiatan  untuk mengajak masyarakat melalui kemitraan antara anggota polri dan masyarakat, sehingga mampu mendeteksi dan mengidentifikasi permasalahan Keamanan dan Ketertiban Masyarakat (Kamtibmas) di lingkungan serta menemukan pemecahan masalahnya. Bagaimanakah Implementasi Pasal 26 Ayat (1) Huruf B Peraturan Kapolri Nomor 3 Tahun 2015 tentang Pemolisian Masyarakat di Wilayah Hukum Polres Lampung Barat, 2). Apa yang menjadi faktor penghambat dalam implementasi tersebut? Metode penelitian yang digunakan adalah yuridis normatif dan empiris, menggunakan data sekunder dan primer, diperoleh dari studi literatur dan studi lapangan, serta analisis data dengan analisis yuridis kualitatif. Hasil penelitian yaitu Implementasi Pasal 26 Ayat (1) Huruf B Peraturan Kapolri Nomor 3 Tahun 2015 tentang Pemolisian Masyarakat di Wilayah Hukum Polres Lampung Barat saat ini sudah dilakukan namun masih belum berjalan dengan efektif  dan  maksimal,  Faktor  diantaranya  yaitu:  kurangnya  jumlah  personel anggota Bhabinkabtimas di Polres Lampung Barat, masih minimnya sarana dan prasarana, belum optimalnya sosialisasi dan penyuluhan di bidang hukum dan keamanan kepada masyarakat kondisi alam yang cukup sulit ditempuh dan belum optimalnya  penerapanya. Disarankan hendaknya dapat lebih meningkatkan sosialisasi dan penyuluhan di bidang hukum khususnya para pemuda di  wilayah  Polres Lampung Barat sehingga dapat  menekan  dan meminimalisir terjadinya pelanggaran hukum.

Abstract

Berdasarkan data dari Kementrian Kominfo yang di lansir oleh Kompas.com per 11 September 2018 sudah ada 16.678 laporan yang masuk merupakan tindak kejahatan penipuan transaksi online. Permasalahan dari tesis ini yaitu 1. Bagaimana implementasi dari Pasal 10 Undang-Undang Nomor 19 Tahun 2016 tentang Informasi dan Transaksi Elektronik  terhadap  Lembaga Sertifikasi Keandalan Sebagai Upaya Perlindungan Hukum bagi konsumen e-commerce dan 2. Apa saja faktor penghambat dibentuknya Lembaga Sertifikasi Keandalan sebagai upaya perlindungan hukum bagi konsumen e-commerce.Metode penelitian ini adalah melalui pendekatan yuridis normatif dan empiris. Data sekunder diperoleh melalui studi pustaka, data primer diperoleh melalui studi lapangan dengan cara observasi dan wawancara yang kemudian analisa data dilakukan dengan cara analisis kualitatif.Hasil penelitian yaitu 1. Implementasi dari pasal 10 UU ITE tentang Lembaga Sertifikasi Keandalan sebagai salah satu upaya perlindungan hukum bagi konsumen e-commerce sampai saat ini belum terbentuk. 2. Faktor – faktor penghambat terbentuknya Lembaga Sertifikasi Keandalan adalah kurangnya sumberdaya, baik dana maupun tenaga ahli, adanya biaya yang dikenakan pada pelaku usaha untuk memperoleh Sertifikat Keandalan, tidak adanya keharusan untuk memakai sertifikat keandalan bagi pelaku usaha dan tidak adanya sosialisasi tentang Sertifikat Keandalan.Saran yang diberikan yaitu pemerintah hendaknya berinisiatif untuk menjadi perintis (pioneer) sebuah Lembaga Sertifikasi Keandalan pertama yang terpercaya dengan membangun infrastruktur memadai dan mendorong seluruh pelaku usaha online menggunakan Sertifikat Keandalan serta membangun iklim kesadaran pada masyarakat dan pelaku usaha online mengenai pentingnya keamanan informasi dalam transaksi elektronik.

Abstract

The village is the unity of the legal community with the original order based on the privileged right of origin. The typical principles of village government are diversity, participation, autonomy, democracy and community empowerment. This research aims to find out the implementation of village fund governance in improving village welfare levels in Pekon Gunung Ratu, Bandar Negeri Suoh District, West Lampung Regency which is currently in accordance with the concerns of legislation but not yet maximal in its implementation. The problem is the lack of human resources, the pekon apparatus lack of understanding of village fund management rules, lack of understanding of the main tasks and functions of each office of the pekon apparatus, lack of aspirations and role of the community and the communication of the community and the lack of communication between the community and the government. The research method used is qualitative method. This means that the results of this study are described in the form of explanations and descriptions in sentences, so that it is easy to interpret and understand, then drawn conclusions that are general based on facts specific to the research subject. Qualitative research methods are research procedures that produce descriptive data in the form of writing and oral writing of a person and observable behavior. Where the results obtained are data obtained from the field obtained from the collection of primary data which include interviews, observations, literature studies, archives / documents, and writing literature related to research

Abstract

The Regional Head election event which is expected to be held in September has to be postponed until December of course the postponement of the schedule is not without reason, the widespread spread of the Covid-19 pandemic virus outbreak is a separate obstacle for the General Election Commission to be able to hold Regional Head Elections because Public safety is the main thing that must be considered by the General Election Commission because this virus can attack anyone and the worst impact is the death of a person, therefore the General Election Commission made a new method related to regional head elections, namely by implementing health protocols in place. voting which will be applied to all officers to people who already have voting rights under the law this mechanism will be applied to voters from normal body temperature, body temperature 37.3 degrees Celsius to voters exposed to Covid-19 In addition to a more complicated mechanism, the impact resulting from Covid-19 is a more complicated election than before and the cost of organizing it is more expensive because it has to use a health protocol tool that must be given to all officers and the public.

Abstract

A land certificate is important in a rule of law because it is the strongest proof of ownership owned by a person if the status of the land is to be recognized by the law, without a certificate it can be ascertained that the person who claims the land can be canceled. In addition, land certificates can also be sold or transferred to other people or inherited to their children. In the Making of Land Deeds / Certificates in Kuta Besi Village, Batu Brak District, West Lampung Regency, currently many people do not have official land certificates from BPN, therefore People who are aware of the law establish a Pokmas organization that collaborates directly with the West Lampung BPN as an effort to assist the community in making land certificates that are more efficient and effective, and also the purpose of establishing a community group organization is to provide direct socialization to the community regarding community rights to land ownership, methods This research uses a normative juridical approach using legislation related to Land Registration and an empirical approach, which is carried out by looking directly at the object of research by means of observation and interviews.

Abstract

Election Oversight Body or Bawaslu is demanded to be more active in following up on all findings and reports of alleged violations of the election both in the case of election disputes from one stage to another so that elections can run smoothly, safely and in an orderly manner, which Bawaslu also has the authority to adjudicate the election dispute process so that Bawaslu has the power to make a decision on the election dispute process as well as in resolving disputes between the General Election Commission or KPU and the Indonesian Solidarity Party or PSI. The problem to be discussed in this study is how the process of electoral dispute resolution between the Indonesian Solidarity Party and the Bandar Lampung KPU in the Bandar Lampung City Bawaslu is? And what is the authority of Bawaslu in the process of resolving disputes between PSI and KPU? The research results showed that the Dispute Resolution Mechanism between the Bandar Lampung City KPU and PSI on the Bawaslu Decision Number: 01.PS.REG.BWSL.BDL.08.01.VIII.2018 was by the 2017 election law Article 103 letter c and Agency Regulations Election Oversight Number 18 of 2017. The authority of the Bandar Lampung City Bawaslu in deciding an election dispute case is in accordance with the 1945 Constitution and applicable regulations so that justice and human rights can be upheld relatively, and the equality of gender that already exists in the provisions of the legislation can be carried out correctly and adequately so that the election stages can run smoothly. It is in line with the tagline of the Election Oversight Body "Together with the People Oversee the General Election Bawaslu Enforce Election Justice".

Abstract

Sistem Pemerintahan di Indonesia berdasarkan ketentuan Un-dang-Undang Dasar 1945 dapat dibagi menjadi dua bagian, yaitu pemerintahan yang berada di pusat dan pemerintahan yang ada di daerah. Pemerintahan daerah adalah daerah otonom yang dapat menjalankan urusan pemerintahan di daerah dan membuat suatu peraturan yang lebih dikenal dengan Peraturan daerah.. Masalah Lingkungan Hidup yang masih menjadi perhatian banyak masyarakat dunia adalah mengenai sampah. Khusus mengenai masalah Lingkungan Hidup yaitu sampah, Pemerintah Daerah Kota Bandar Lampung member perhatian, salah satunya yaitu dibentuknya Peraturan Daerah Kota Bandar Lampung Nomor 1 Tahun 2020 tentang Perlindungan dan Pengelolaan Lingkungan Hidup. Tujuan penulisan ini adalah untuk mengetahui Implementasi Peraturan Daerah Kota Bandar Lampung Nomor 1 Tahun 2020 terhadap sampah terbuka (Open Dumping) serta faktor  penghambat  dalam  pelaksanaan Peraturan Daerah  Kota Bandar Lampung Nomor 1 Tahun 2020. Hasil penelitian menunjukkan bahwa di dalam Peraturan Daerah Kota Bandar Lampung Nomor 1 Tahun 2020, jenis sampah yang hanya diatur adalah sampah Berbahaya atau sampah beracun (B3). Faktor penghambat Peraturan Daerah Kota Bandar Lampung Nomor 1 Tahun 2020 yaitu faktor sumber daya serta faktor kondisi sosial masyarakat.   Open Dumping Based on Regional Regulatiobs of Bandar Lampung City. The system of government in Indonesia based on the provisions of the 1945 Constitution can be divided into two parts, namely the central government and regional governments. Regional government is an autonomous region that can carry out government affairs in the region and make regulations which are better known as regional regulations. Environmental problems that are still the concern of many people in the world are waste. Specifically regarding environmental issues, namely waste, the Bandar Lampung City Government pays attention, one of which is the establishment of the Bandar Lampung City Regional Regulation Number 1 of 2020 concerning Environmental Protection and Management. The purpose of this paper is to find out the implementation of the Bandar Lampung City Regional Regulation Number 1 of 2020 for Open Dumping and the inhibiting factors in the implementation of the Bandar Lampung City Regional Regulation Number 1 of 2020. The results show that in the Bandar Lampung City Regional Regulation Number 1 of 2020, the type of waste that is only regulated is hazardous waste or toxic waste (B3). The inhibiting factors for the Bandar Lampung City Regulation Number 1 of 2020 are the resource factor and the social condition of the community.

Abstract

Pemerintah dan pemerintah daerah bersinergi dalam upaya penanganan Covid-19 dengan mengoptimalkan sistem pelayanan kesehatan guna mengerahkan seluruh sumber daya yang ada termasuk tenaga kesehatan secara terarah, terpadu dan efektif, untuk menangani berbagai kasus Covid-19. Permasalahan dalam penelitian ini adalah bagaimana implementasi SK Bupati Tulang Bawang Barat Nomor B/215/II.02/HK/TUBABA/2020 Tentang Perpanjangan Insentif Tenaga Kesehatan Dalam Penanganan Wabah Corona Virus Disease 2019? Apa kendala dalam pelaksanaan SK Bupati Tulang Bawang Barat Nomor B/215/II.02/HK/TUBABA/2020 tentang Perpanjangan Insentif Tenaga Kesehatan Dalam Penanganan Bencana Wabah Corona Virus Disease 2019 (Covid-19) ? Metode penelitian yang digunakan adalah pendekatan yuridis normatif dan pendekatan empiris, data yang digunakan adalah data sekunder dan data primer dengan analisis kualitatif agar diperoleh hasil penelitian yang benar dan objektif. Hasil penelitian adalah implementasi SK Bupati Tulang Bawang Barat Nomor B/215/II.02/HK/TUBABA/2020 tentang Perpanjangan Pemberian Insentif Bagi Tenaga Kesehatan Dalam Penanganan Corona Virus Disease 2019 wabah (Covid-19) di Unit Pelaksana Teknis Pelayanan Puskesmas dan Dinas Kesehatan. Dinas Kesehatan Tulang Bawang Barat saat ini belum efektif. Kendala dalam melaksanakan SK Bupati Tulang Bawang Barat Nomor B/215/II.02/HK/TUBABA/2020 yaitu kurangnya pemahaman Aparatur Daerah di UPT Pelayanan Puskesmas dan Dinas Kesehatan Dinas Kabupaten Tulang Bawang Barat terhadap SK Bupati Tulang Bawang Barat Nomor B/215 /II.02/HK/TUBABA/2020, SDM yang kurang terampil Saran penulis agar Kabupaten Tulang Bawang Barat sebaiknya lebih memperhatikan dan lebih meningkatkan reward atau remunerasi kepada karyawan, hal ini dimaksudkan agar semangat kerja karyawan dapat meningkat.
