Abstract

To find out the legal provisions and consequences of the use of Village Funds Outside the Priority of Village Funds (Development of Village Halls in Adipasir Village, Rakit District, Banjarnegara Regency). To achieve this goal the researcher uses the Normative Juridical Approach method, Research Specification is the application of law in abstracto in cases in concreto (Clinical Legal Research). The method of presenting data is presented in the form of a description arranged systematically, logically, and rationally. Conclusions: - Regulatively the Use of Village Funds Outside Priority for the Development of Adipasir Village Hall, Rakit District, Banjarnegara Regency is in accordance with the provisions in the Banjarnegara Regent's Letter Number: 142.41/148/Setda/2016-R dated April 25, 2016 concerning Recommendations on the Use of Village Funds in Outside the Priority of the Use of Village Funds for Fiscal Year 2016. - The legal consequences of the use of Village Funds outside the Priority of Village Funds for the Development of the Adipasir Village Hall, Rakit District, Banjarnegara Regency, namely there are no legal consequences, due to the approval of the Banjarnegara Regent in accordance with Article 27 Paragraph (1) Regulation of the Minister of Finance Number : 247/PMK.07/2015 concerning Procedures for the Allocation, Distribution, Use, Monitoring and Evaluation of Village Funds.

Abstract

Penelitian ini bertujuan untuk mengetahui, menganalisis, transaksi perbankan melalui internet banking di Indonesia. Penulisan artikel ini menggunakan metode penelitian bersifat yuridis normatif. Dalam pengumpulan data penelitian, dengan menggunakan bahan hukum sekunder berupa buku, jurnal, artikel, dan karya tulis lainnya, baik yang berasal dari media cetak maupun internet yang berhubungan dengan penelitian ini. Hasil penelitian menunjukan bahwa Internet banking merupakan salah satu pelayanan jasa bank yang memungkinkan nasabah untuk memperoleh informasi, melakukan komunikasi dan melakukan transaksi perbankan melalui jaringan internet. Transaksi perbankan melalui internet banking sampai saat ini belum diatur secara khusus dalam sistem perundang-undangan di Indonesia. Pengaturan mengenai transaksi perbankan melalui internet banking di Indonesia yang ada saat ini belum dapat menjamin kepastian hukum dan keadilan bagi para pihak, baik pihak bank maupun nasabah. Upaya perlindungan hukum telah dilakukan oleh pemerintah, namun substansi-substansi dari peraturan-peraturan yang ada belum menunjukkan adanya upaya perlindungan hukum yang optimal bagi para pihak.

Abstract

The issue of maritime boundaries is a fundamental matter that should be resolved and agreed upon by a country. The purpose of this research was to find out how the regulation of the law of the sea convention (UNCLOS 1982) relates to the settlement of maritime disputes between countries and how the authority of the international court of law of the sea (International Tribunal for The Law Of The Sea-ITLOS) in resolving maritime disputes. By using the method normative juridical research, qualitative methods and the concept of national interest, geopolitics and geostrategy are used to analyze this study. In this study, the South China Sea is the border for several countries, including Indonesia, Vietnam, Malaysia, Brunei, the Philippines and China. Because of this, border disputes in the South China Sea have quite high dynamics. This writing uses normative juridical research methods, with primary and secondary data to assist writers in finding research results and discussion. It is the obligation of Indonesia as a sovereign country to be able to play an active role in maintaining world peace in the form of participating in resolving disputes on the border of the Natuna Sea.

Abstract

This community service aims to provide motivation to the people of Tlahab Village, Wanareja District, Purbalingga Regency to carry out waste management with an awareness of good and healthy environmental insight as a right and obligation as citizens and carry out waste sorting methods so that they become efficient, provide economic value as well as developing the circular economy concept as a goal of sustainable development as one of the environmental principles and the main rationale for waste management in Indonesia.

Abstract

This article aims to analyze changes to the decision of the constitutional court in the 2024 general election contestation from the perspective of Indonesian constitutional law. This research uses a normative juridical research method with a type of approach, namely a statutory approach and a conceptual approach. The legal materials used are primary, secondary and tertiary legal materials, obtained by conducting literature studies. The research results show that factors that influence changes in the Constitutional Court's decisions will be taken into account, such as legal developments, social changes and political shifts that may occur over time. Through a review of constitutional law, this article will also consider the influence of constitutionalist thinking and human rights principles in the Constitutional Court's decisions regarding elections. This research pays attention to changes in the constitutional interpretation by the Constitutional Court and their impact on the electoral process.

Abstract

This study aimed to determine ecological and social justice as the basis for protecting and preserving the marine environment in the Indonesian legal system. This research was empirical normative legal research. The subject of the study was the implementation of favourable legal provisions in every particular legal event that occurred in society to achieve the predetermined goals. If not careful in its application (still characterized by anthropocentrism), this political economy policy could conflict with the social ecology currently developing in Indonesia through the concept of a green economy and a blue economy. The characteristics of the socialism system in the political economy related to environmental justice after the amendment to the 45th Constitution began to shift in the era of globalization so that it began to respond to ecological modernization. However, due to colliding with the concept of socialism, the ecological justice system in the Indonesian legal system had the nuances of social-ecological justice. This concept would significantly affect the fairness of compensation for oil pollution by tanker accidents in Indonesia.

Abstract

This study aims to determine how the implementing legal provisions and utilization of forest land conversion into plantations are oriented towards capitalism. This study uses a normative legal research method with the types of approaches, namely the legislative approach and the conceptual approach. The legal materials used are primary, secondary, and tertiary legal materials, obtained by conducting a literature study. The results of the study indicate that Occupational Safety and Health (OHS) is an integral part of the protection of workers' rights, aims to create a safe and healthy work environment, and prevent work accidents and occupational diseases. In the Indonesian context, OHS is regulated through various legal instruments such as Law Number 1 of 1970 concerning Occupational Safety, Law Number 13 of 2003 concerning Manpower, and other derivative regulations that explain the standards and guidelines for the implementation of OHS. In addition, Indonesia has also ratified a number of international conventions from the International Labor Organization (ILO) which emphasize the importance of OHS protection for every worker. However, in its implementation, OHS regulations in Indonesia still face various challenges that lead to injustice in the protection of workers. Workers in the formal sector, especially those working in large companies, tend to get better OSH protection because the companies have sufficient resources to comply with existing regulations. In contrast, workers in the informal sector and small and medium enterprises (SMEs) often face more vulnerable situations, where OSH protection is minimal or even non-existent.

Abstract

Armed conflict has caused a lot of loss, damage and destruction of a country's cultural heritage. This writing aims to see and explain what International Humanitarian Law provides protection for cultural heritage in conflict. Even though the protection of cultural objects has been regulated through various international conventions, there are behaviors that cause the destruction of these cultural objects in countries in conflict. To obtain data, library research was carried out by studying and analyzing conventions, books, newspapers, scientific writings and relevant literature both online and offline. Then the analysis is carried out using the content analysis method by focusing on what issues are effective in protecting International Humanitarian Law in protecting cultural heritage in conflict areas. The research results show that cultural objects are the identity and cultural heritage of society, so attacks on these objects often increase the escalation of conflict. Attacks by air bombs, bullets and long-range missiles can damage cultural objects as a result of armed conflict.

Abstract

Civil trials on the principle of ius curia novit and rechtsvinding become a breath of fresh air for justice seekers seeking their laws that fulfill the ideè des rechts (rechtssicherheit: legal certainty, zweckmässigkeit: expediency, and gerechtigkeit: justice). The principle of ius curia novit which means that the judge is considered to know the law becomes a space for judges in making legal discoveries (rechtsvinding). The implementation of laws by judges is not merely a matter of logic and proper use of the mind, but rather the provision of juridical forms rather than basing on juridical experience and judgment rather than basing on abstracts, because the law cannot be complete, only one stage in the process of forming a law that is forced to seek its completeness in the legal practice of the judge. The judge's wiggle room in fulfilling the sense of justice for justice seekers in the environment as the decision No. 374 / Pdt.G / LH / 2019 / PN.Jkt.Pst which granted the lawsuit of the plaintiffs (Advocacy Team of the Capital Movement (Initiative to Clean the Air of the Universe Coalition) based the findings of the judge's law, basing on Decision Number: 36 / KMA / SK / II / 2013 concerning the Enactment of guidelines for handling environmental cases. Keyword: ius curia novit, rechtsvinding, onrectmatigedaad, lawsuit, environment.
