Abstract

Performance Detachment 88 combat terrorism lately getting serious attention. Detachment 88 is often indiscriminate action in arresting suspects with terrorism caramelakukan wrongful acts, violent to cause death in which terrorism suspects are still possibilities were not necessarily acts of terrorism. Although terrorism is a form of international crime that is very frightening dimension of the international community and the criminal acts of terrorism can not be justified and inhumane, but the arrest of perpetrators of terrorist acts must also consider that their human rights have been stipulated in the criminal law. The purpose of this thesis research namely; First, the legal protection for victims of wrongful arrests by law in Inodnesia, Second, arrest procedures terrorism cases by Special Detachment 88, Third, weakness Law No. 15 Year 2003 on Eradication of Terrorism.This type of research can be classified in this type of research in which normative legal research this study the authors focus on legal research which examines the legal principles. This study is descriptive, ie a study that aims to create a picture or study in a systematic, timely and accurate based on real facts and to analyze the relationship between the laws and regulations that exist. The purpose of this study found a clear legal basis in putting this issue in the perspective of a special criminal law relating to the protection of victims of wrongful arrests by Detachment 88 in a criminal act of terrorism in Indonesia.From the research, there are three main problems that can be inferred. First, the legal protection for victims of wrongful arrests in Indonesia, namely the presence of the District Court the authority to conduct pretrial, to give; compensation and rehabilitation for someone that case had to be stopped at the second level of investigation, arrest procedures against terrorism suspects in Indonesia consists of: Investigations that can not be separated from the report or complaint, investigation starts from the results of previous investigations where there is preliminary evidence is strong enough, Arrest investigator to the arrest of any person suspected of terrorism is not based on sufficient evidence, detention, for the purpose of investigation is authorized to make arrests. Third, the Policy Act of terrorism must comply with prpsedural mechanism. Advice Author, First, the Act Anti-Terrorism should be immediately amended. Second, the Law Terrorism should consider the principles of sentencing in policy formulation pidanyanya sanctions. Thirdly, It should be in the legislation should also contain strict sanctions for officers of Detachment 88.

Abstract

The issuance of Presidential Decree No. 64 of 2020 concerning HealthInsurance certainly raises question marks in the community. This regulationemerged after the Supreme Court's Decision on Presidential Regulation No. 75 of2020 which has the same substance, namely the increase in BPJS contributions.Presidential Regulation Number 64 of 2020 is considered to have violated theSupreme Court's decision and the laws above it. Therefore, the purpose of writingthisthesis is: first, why does the President continue to issue Presidential RegulationNo. 64 of 2020 concerning Increases in Health Insurance Contributions while theSupreme Court has decided Presidential Decree No. 75 of 2019 with Decision No.7/P/HUM/2020 which contains the same content. . Second, to find out the urgencyof the formation of Presidential Decree No. 64 of 2020.This research is a normative research. This is based on library researchthat takes quotes from reading books, or supporting books related to what theauthor isresearching. The data sourcesthat the researcher uses are secondary datasources consisting of primary, secondary ortertiary legal materials. This study usesqualitative data analysis and produces descriptive data.From the results of the research conducted, there are several conclusionsobtained, namely: First, in this case the President has the right to issue aPresidential Regulation. However, judging from the Supreme Court's decision aswell as the reasons for the rejection of the previous Presidential Regulation, it cancertainly be used as a reason why the President does not need to issue a newPresidential Regulation which basically contains the same content as the previousPresidential Decree. In addition, the President must pay attention to the impact andthe current state of society. Second, the reason for the President in issuing thisPresidential Regulation is in stark contrast to the principles of the social securitysystem, which in the hierarchy should not conflict with the regulations above.Keywords: Presidential Regulation-Health Insurance-Supreme Court Decision

Abstract

Smoke catastrophic events caused by land and forest fires in Riau Province has become a very worrying problem, this situation is like an annual agenda for the people of Riau province that has been exposed to smoke on a regular basis over the last 17 years ie since 1997. Disaster smoke in the Riau Province The background background by burning peat. If the result of fires and peat continued every year, then in the next five years remaining natural forests of Riau only <20%. Event of forest fire occurrence is not the least because of the element of intent, with a view to the opening of oil palm plantations, forest plantations, transmigration and so forth. However, to date, no environmental criminal law enforcement operate effectively even cases of forest fires and land each year show an increase in numbers.The purpose of this thesis, namely: First, to determine the implementation of environmental criminal enforcement by the Directorate of Criminal Investigation Special Riau Police against the perpetrators of forest and land fires. Second, to determine the constraints faced by the Directorate of Criminal Investigation Special Riau Police in environmental criminal enforcement against perpetrators of forest and land fires, and third, to find out the efforts made by the Special Criminal Investigation Directorate Riau Police to overcome obstacles in the enforcement of criminal law environment against the perpetrators of forest and land fires. This type of research is classified in legal studies is defined sociological look at the effectiveness of the law in force to see the correlation between the legal community.From the results of research and discussion, it can be concluded that the First, implementation of environmental criminal enforcement by the Directorate of Criminal Investigation Special Riau Police against the perpetrators of forest and land fires is done by means of preventive and repressive, Second, constraints faced by the Directorate of Criminal Investigation Special Police in Riau environmental criminal enforcement against perpetrators of forest and land fires are internal constraints and external constraints, and the efforts made by the Third Special Criminal Investigation Directorate Riau Police to overcome the obstacles in environmental criminal enforcement against perpetrators of forest and land fires is to maximize internal factors and externally owned by the Directorate of Criminal Investigation Special Riau Police.Keywords: Law Enforcement - Criminal Environment - Land and Forest Fire

Abstract

The case regarding liquid excise took place at the Regional Office of the Directorate General of Customs and Excise, Pekanbaru City Type B, where they destroyed the results of the customs and excise action in the parking lot. One of the illegal products that were destroyed was liquid vape or e-cigarettes. During the last three years, Customs and Excise took 838 actions related to 6,580 illegal liquid bottles with the value of goods resulting from prosecution reaching Rp 1.5 billion.This type of research can be classified in the type of sociological (empirical) legal research. However, although there is an element of field research (Sociological) in this study, the data analysis method is carried out with a qualitative approach, because the dominant data used is secondary data or library data with field data as a complement. This research was conducted in the jurisdiction of the Directorate General of Customs and Excise, Type B Intermediate Customs, Pekanbaru City.The conclusions that can be obtained from the results of the study are First, Law enforcement carried out by the Pekanbaru City Customs and Excise is still controlling and is designed to reduce the circulation of illegal liquids because so far the perpetrators of the crime of excise bands have not been followed up to the examination process at court. Even though the criminal acts of illegal liquid circulation without excise stamps for the perpetrators and even liquid traders have fulfilled the elements of offense contained in Law Number 39 of 2007 concerning Excise. Second, the obstacle in law enforcement of illegal liquid circulation without excise in Pekanbaru City is the lack of tips that improve the eradication of illegal liquid circulation, such as providing punishment according to the provisions of the excise law so that it can ensnare perpetrators and create a deterrent effect.Keywords: Policy, Criminal Law, Sexual Violence, Chemical Castration, Criminalization.

Abstract

Abstract— Covid-19 pandemic in 2020 is a prove that pandemic is something that continues in human history, start from the black death, cholera, and Spain flu. Those out�breaks had been classified as pandemic through any decision in the past and became a regulation that has affected international law development. Through qualitative method, these research-based paper, using seconder historical data founds that the response of the state that affected by pandemic required state to make sanitation regulation, conducted a quarantine and other related methods in control and prevention that applied to interna�tional scope aimed not to effect international traffic and trade. Those all had become a base to regulate the global public health law in controlling and preventing diseases as a form of preparedness of the global community to face another event that might be pandem�ic in the future. Abstract

The producer of chilli chips in the city of Dumai does not include an expired label in marketing the chilli chip product in violation of Article 8 paragraph (1) letter g of Law Number 8 of 1999 concerning Consumer Protection, the giving of the mark or label is intended so that consumers get correct information about the product. , because the decision of the correct choice of consumers regarding the goods or services needed really depends on the correctness and responsibility of the information provided by the parties concerned, so there is no legal certainty regarding the expiration of Home Industry products circulating in the city of Dumai. The purpose of writing this thesis, namely: First, to find out how the implementation of the related consumer protection law does not include expired labels in the packaging of chilli chips in Dumai and law enforcement in order to provide protection for consumers. Second, to find out how legal certainty is about the chili chips Home Industry product without including an expired label.This type of research used by the author is normative legal research. Normative legal research is literature legal research, because it makes book material the main foundation in conducting this research. This research was conducted based on normative law because this study examines the problem of legal certainty for household food products that do not have an expired label, so this study discusses more analysis regarding the implementation of the law on these products. The data collection technique in this research is literature study.From the research results, there are two main points that can be concluded. First, producers of chilli chips in the city of Dumai do not include an expired label in marketing chilli chip products that have violated Article 8 Paragraph (1) Letter g of Law Number 8 Year 1999 concerning Consumer Protection, producers do not include expiration labels because the product does not use sweeteners and food preservative, they use natural ingredients in making these chilli crackers. Second, there is no legal certainty regarding the expiration of Home Industry products circulating in the city of Dumai. Where the determination of the expiration of a product is determined subjectively, besides that the role of BPOM Dumai City has not been optimal in providing consumer protection in inclusion of expired labels on Home Industry products in the city of Dumai.Keywords: Consumer Protection - Household Production - ChipsCabe - Label Expiration

Abstract

Bagi pelaku usaha mikro kecil dan menengah (UMKM) untuk memulai usahanya perlu memikirkan perlindungan Hak Kekayaan Intelektual (selanjutnya disebut HKI). Jikalau, para pelaku usaha mikro kecil dan menengah (UMKM) tidak memikirkan perlindungan HKI, maka karya para pelaku usaha dapat mudah terjadi pelanggaran HKI. Oleh karena itu, pada masa awal memulai bisnisnya, mereka seharusnya sudah memberikan perlindungan HKI-nya, sebab HKI sejatinya dapat menjadi aset berharga yang bisa menyelamatkan perusahaan di masamasa sulit. HKI sejatinya adalah hak yang muncul dari hasil oleh pikir atau kreasi manusia yang pada akhirnya menghasilkan suatu produk atau proses yang berguna bagi manusia. Dalam dunia bisnis, HKI bisa menjadi elemen penting karena dapat memberikan keunggulan berkompetisi ketika bermain di pasar yang dibidik bagi pemiliknya. Bahkan, tak menutup kemungkinan pula HKI ini dapat menjadi pemicu untuk memunculkan berbagai inovasi baru bagi pelaku usaha mikro kecil dan menengah (UMKM) yang pada akhirnya dapat menguntungkan publik juga para pelaku usaha itu sendiri, misalnya dalam menghadapi perdagangan bebas ASEAN. Tujuan dilaksanakan kegiatan pengabdian masyarakat ini adalah sosialisasi aspek HKI bagi para pelaku UMKM di Kabupaten Kampar. Metode penerapan yang dipilih adalah sosialisasi atau desiminasi ilmu pengetahuan, dalam hal ini adalah penyebaran informasi tentang HKI dan tata cara pendaftaran HKI. Dari kegiatan pengabdian ini, pelaku usaha UMKM di Kabupaten Kampar menyadari penting aspek HKI untuk kemajuan usaha.

Abstract

With the increasing number of Covid-19 cases in Indonesia, including in Riau Province, it is necessary to implement Large-Scale Social Restrictions (PSBB). PSBB is one way to reduce the impact of Covid-19. PSBB has currently been implemented in 10 regions in Indonesia as part of efforts to prevent the corona virus. The Central Government through the Ministry of Health has approved Pekanbaru to implement the PSBB. The main reason for implementing PSBB in dealing with the Covid-19 corona virus is because physical distancing, which has been carried out so far, is ineffective in the community. On that basis, the government strengthened the policy of physical restrictions for the community by implementing PSBB in the regions. It is necessary to do the socialization of PSBB and this Perwako, so that the public knows the Rules about PSBB. The service activity aims to provide guidance to the people of Pekanbaru City regarding Corona and PSBB, because Pekanbaru City is one of the cities that is a transit point. The implementation of activities to increase public knowledge about PSBB and Perwako was successful. This can be seen from changes in the behavior of people who were previously reluctant to wear masks, then have started wearing masks when they go out, as can be seen from the behavior of people who have avoided people's hassles and tried to keep their distance. The community also complies with large-scale social restrictions set by the government, this can be seen from the minimum community activity at night outside the home.

Abstract

Riau Province's Dumai City is a popular tourist destination. Since the opening of the Permai (Pekanbaru-Dumai) toll road connecting Pekanbaru City and Dumai City in less than two hours, Dumai has grown in popularity among travelers. The impact of the short journey, one of which is increased mobility among those who travel to Dumai City. Dumai City's souvenir businesses have benefited as a result of this. As a consequence, familiarity with existing provisions is required, particularly in relation to consumer rights to consume food. Several consumer protections provisions have been issued by the government, including Law No. 8 of 1999 and BPOM Regulation No. 31 of 2018. As a result, the purpose of this program is to inform MSME actors about relevant legal provisions. In the field of law, counseling or socialization is used as a method. The socialization was done in collaboration with the City of Dumai's Office of Industry, Cooperatives, and Small and Medium Enterprises. Souvenir makers gain legal knowledge as a result of this socialization, and they are expected to be able to apply that knowledge in their products.

Abstract

Perluasan otonomi pasca reformasi sesungguhnya dimaksudkan untuk meningkatkan kesejahteraan masyarakat. Senyatanya, dibukanya kesempatan penambahan daerah baru dan meluasnya otonomi berdampak pada lingkungan hidup sehingga timbul bencana alam yang nyaris tak kunjung berhenti. Kebijakan otonomi yang tidak dibarengi dengan prinsip pembangunan berwawasan lingkungan hidup telah menyebabkan percepatan pengrusakan dan pencemaran lingkungan hidup. Pemanfaataan SDA sebesar-besarnya tanpa memikirkan dampak jangka panjang kedepan pada akhirnya juga akan menyebabkan kerugian bagi daerah itu sendiri.
