Abstract

A structural learning model that can use several methods, techniques and learning strategies at once, the learning model must be student-centered so that learning objectives can be achieved. However, the reality is that learning in the classroom tends to be centered on the teacher (teacher centered learning) so that students are more dominant passive than active, this has an impact on student learning outcomes to be low. The research questions in this study are how the teacher's activities, student activities, and how to improve student learning outcomes in class V-A UPT. SD Negeri 01 Limo Kaum. This research is a field research using quantitative and qualitative methods. Data were collected through observation and tests, then the data were analyzed using a percentage formula. The results of the study found that the activity of the teacher in cycle I reached 71.88%, in cycle II reached 76.56% and cycle III reached 95.31%. Student activity in cycle I reached 70.31%, cycle II reached 75%, and in cycle III 87.5%. The learning outcomes of students who completed the first cycle reached 68.57%, the second cycle reached 82.86%, and the third cycle reached 91.43%. Thematic learning is getting better with the Visualization Auditory Kinesthetic (VAK) model to improve student learning outcomes because this learning model combines the three learning modalities to make students feel comfortable and the learning perceived by students feels more meaningful.

Abstract

Elderly or Elderly is someone who, even though he is said to be old, still has rights and obligations.So that the elderly are also included as subjects of criminal law. An elderly person is not impossible tocommit a criminal act. Many elderly people have reported that those who commit criminal acts are anelderly person.And as a legal subject who fulfills the requirements to be held accountable for crimes, an elderlyperson must be held accountable for criminal acts. By looking at the physical and mental condition of anelderly person, it is difficult for the law to provide fair punishment.Because the imposition of a criminal offense is not merely revenge for an act that has been violated,but rather an attempt to provide guidance to the perpetrator of a crime. It becomes very difficult if anelderly person who is old and in poor condition must undergo a process of punishment that takes not a littletime and the mental stresses are there. Abstract

One form of crime that is still very common in society is fraud. For the unscrupulous, the crime is not so difficult to do. Fraud can be done simply by using good communication skills so that someone can convince others. Crimes in the form of fraud and embezzlement are threatened with criminal sanctions, the enforcement still lacks a deterrent effect on violations, because in criminal law enforcement it is not only sufficient to regulate an act regulated in the law, but it also requires the law enforcement agencies to implement the provisions of the lawThis type of research can be classified in the type of sociological (empirical) legal research, because in this study the authors directly conduct research at the location or place of study in order to provide a complete and clear picture of the problem under study. This research was conducted in the Tembilahan City Region of Indragiri Hilir Regency, Riau Province. The population and sample are the head of the police criminal detective unit in Tembilahan, the Tembilahan police auxiliary investigator, the Chairman of the Tembilahan District Court, Perpetrators of fraud and Victims of fraud. Data sources used are primary data and secondary data.The conclusion that can be obtained from the results of the study is the enforcement of criminal law against fraud in the Tembilahan City Region, Indragiri Hilir Regency, Riau Province, which is still not going well and there are still many frauds that occur. Fraud criminal acts that occur today can be done in various ways from simple to complex. The panel of judges who handed down the conviction verdict referred to the facts of the trial. So that some of the victims were disappointed and judged unfairly against the verdict handed down. The obstacles experienced by criminal law enforcement against fraud in the Tembilahan City Region of Indragiri Hilir Regency, Riau Province consist of law enforcement officers, legal factors and community factors. The factor of law enforcement officers is professional and understanding of fraud that has undergone development. The legal factor is difficult in terms of proof if law enforcement officers are only guided by articles in the Criminal Code. and community factors, namely the community does not fully know and understand various modes of crime, one of which is fraud. Abstract

Pedophilia occurs in various places, in several acts and various types ofperpetrators. Resolutions of this problem have not stop in one form. Using theconcept of Restorative Justice to achieve humanitarian justice is a concept thatwill be a progressive step in the settlement of non-criminal pedophilia. Thisresearch aims to: first, understand the current regulations for pedophiles inIndonesia, second, to find out the relevance of Restorative Justice to be applied inthe criminal prosecution of pedophilia in Indonesia.This type of research is classified as a normative study using concept ofRestorative Justice and correlation principle to approach the issues, secondarydata is used by collecting data from library research, analyzed by qualitativejuridical analysis and concluded using descriptive analytical methods.From this research we can conclude two main things. First, the currentregulations for pedophiles in Indonesia can now be found in the Criminal Code(KUHP) and Law Number 23 Year 2002 concerning Child Protection, which ischanged into Law Number 35 Year 2014 junto Act Number 23 of 2002 concerningChild Protection, which then underwent a second change with Act Number 17 of2016 concerning the Establishment of Perpu Number 1 of 2016 into Law.However, in this regulation, the punishment only focus on the detention of theperpetrators without considering other factors behind their actions, and did notprovide definitive protection for victims. Second, the relevance of restorativejustice (Restorative Justice) to be applied in Indonesia to pedophilia criminalcases in terms of several aspects such as; ethics and values of the Pancasila andIndonesia’s culture are not conflicted and can be coincide. So, the concept ofrestorative justice against pedophile perpetrators can be applied in Indonesiawith the right and appropriate arrangements.Keywords: Pedophilia, Restorative Justice, Children

Abstract

Sexual violence is a violation of human rights, crimes against human dignity, and forms of discrimination. One form of sexual violence is sexual harassment. Sexual harassment is the behavior of approaches related to unwanted sex, including requests for sex, and other behaviors that verbally or physically refer to sex. One of the problems regarding sexual harassment is verbal sexual abuse which is increasingly widespread considering there is no awareness of being able to reduce or ensnare perpetrators into a sentence.This type of research can be classified in normative legal research, namely legal research conducted by examining library materials. In this research, we focus on legal principles. Data collection techniques used in hormonal law research is a library research method that is utilizing the library as a means of collecting data, by studying books as reference material related to the problem to be examined.The conclusions that can be obtained from the results of the study are First, a clear and unequivocal arrangement does not yet exist against verbal sexual harassment in the renewal of criminal law in Indonesia. This is due to verbal or sexual abuse in the Criminal Code (KUHP) or other regulations that still do not regulate verbal sexual abuse or sexual abuse as a criminal act that occurs in the community. so the impact is also still there and law enforcement cannot yet be done. Second, the limitation on the criteria for verbal sexual harassment in criminal law reform in Indonesia still does not provide certainty related to the criteria for verbal sexual harassment. This can be seen in the Criminal Code (KUHP) and other regulations. When seen in the Criminal Code (KUHP), sexual harassment cannot be internalized. Abstract

Children as the gold of the future and future generations of the ideals of national development Indonesia have human rights that must be protected from crimes, especially immoral acts in accordance with Article 1 point 2 of the Basic Law Number 35 Year 2914 concerning Amendments to Law No. 23 of 2022 concerning child protection. The large number of cases of sexual abuse against children has made the central and local governments only think about sanctions by the perpetrators, political parties are everywhere and even indifferent to the increasing cases of child abuse without thinking about how to provide protection and rehabilitation both psychologically and socially to children and their families victims of social acts. The purpose of writing this thesis, namely: first, to find out how the government's obligation to provide special protection for child victims of sexual crimes based on Law Number 35 of 2014 concerning Amendments to Law Number 23 of 2002 concerning Child Protection. Second, to identify obstacles and government efforts in providing special protection for child victims of sexual violence.  This type of research can be classified in the type of sociological judicial research, because in this study the author directly conducted research at the location or place under study to provide a complete and clear picture of the problem under study. This research was conducted at the Department of Women's Empowerment and Child Protection in Pekanbaru City at Jln. Dagang No. 78 Pekanbaru, while the population and sample are all parties related to the problem studied. Sources of data used include primary, secondary and tertiary data. Abstract

Law enforcement can be interpreted as an effort to implement the law as it should, supervisethe implementation of the law so that there is no violation if there is a violation so there are otherefforts to restore the violated law to be re-enforced. Law enforcement against debt collectors whocommit criminal acts in the withdrawal of fiduciary objects can be done through a legal mechanism,where the debtor feels disadvantaged to be able to report a criminal act committed by a debt collectorto hold accountable.As for the formulation of the problem in this study is how law enforcement against debtcollectors who commit criminal acts in the withdrawal of goods or objects fiduciary collateral andconstraints in the debt collector law enforcement who commit a crime in the withdrawal of goods orfiduciary collateral.The research method used in this case is sociological juridical by direct field survey to obtainprimary data, where this study looks at the continuity between law and society, while the nature of thisresearch is descriptive, namely describing the problems to be studied.Based on the results of the study, it can be seen that law enforcement against debt collectorswho commit criminal acts in the withdrawal of goods or fiduciary collateral objects in the TampbaruPekan Polsek is that the community as a debtor can report any form of crime committed by the debtcollector on the police if the debt collector acts debt collection raises losses to the debtor, whilecriminal acts that can occur include article 369, article 378, article 335 of criminal law, acts of thedebtor who are not cooperative in dealing with debt collectors in general are the cause of theseproblems so that reports on actions a criminal offense that is detrimental to the debtor who mustsurrender the motorized vehicle unit that is used as collateral for the fiduciary and the debtor isunable to avoid the obligation.Constraints in law enforcement against debt collectors who commit criminal acts in thewithdrawal of goods or fiduciary collateral objects can be legal factors where the existence of debtcollectors are not specifically regulated in legislation, making debt collector actions difficult toprocess legally, law enforcement factors or police officers who are weak in responding to criminalacts reported by disadvantaged debtors and community factors which are the most dominant factors ininhibiting law enforcement against debt collectors because debtors are negligent in fulfilling theirachievements in general the community does not know how to do default and avoid collecting debt bydebt collectors.Keywords: Law Enforcement-Debt Collector - Fiduciary Guarantee

Abstract

Waiver of criminal cases for the sake of public interest or can be referred to as “deponering” is the embodiment of the opportunistic principle that has been legitimized by the state through Article 35 letter c of Law No. 16 of 2004 concerning the Republic of Indonesia Attorney General's Office and Article 14 letter h of the Law Code. Criminal Procedure. In fact, what should be an important note for the government and law enforcement officials is that from the perspective of the general public who do not understand the law comprehensively.This type of research is normative juridical research. In this research, the researcher discusses the principles of law, namely the principle of equality before the law, namely equality before the law. Then also using the legality principle which is the principle that determines that no action is prohibited and punishable if it is determined in advance in legislation, known in Latin as Nullum Delictum Nulla Poena Sine Praevia Lege Poenali (no offense, no punishment without advance regulation).The conclusions that can be obtained from the research results are: First, there is no derivative regulation in interpreting the meaning of the "public interest" so that it becomes a multi-interpretation area and contradicts the legality principle where the legality principle requires rules first, because the regulation does not can be applied if legality is not written about the derivative rules. This means that there are misinterpretations and legal findings that occur in interpreting waivers in the public interest so that it is not relevant to our ideals as a rule of law. Second, the criteria for the Attorney General to link legal interests and public interests in granting deponering basically do not have standard rules and contradict the principle of legality which requires prior rules in order to achieve legal certainty. If it is in the public interest basically the Attorney General, before making a waiver of the case in the public interest, he first discusses it with the state power bodies that are related to the case, either directly or indirectly.Keywords: Deponering, General Attorney, Equality Before The Law, Attorney

Abstract

Penal mediation is one form of dispute resolution outside the judiciary (non litigation) with the helpof other people or third parties who are neutral and do not take sides with either party. There are severallegal bases for the application of penal mediation in Indonesia, namely: National Police Letter of theRepublic of Indonesia No Pol: B / 3022 / XXI / 2009 / SDEOPS, December 14, 2009, Regarding CaseHandling Through Alternative Dispute Resolution (ADR), this letter becomes a reference for the Police tosettle criminal cases through the principle of deliberation and consensus, and respect for social / customarylegal norms and based on justice for the parties, if a case is still in the process of investigation andinvestigation.This research is sociological or empirical research, namely the type of research that uses communityassumptions in looking for facts that occur in the field to answer an existing problem. This research wascarried out in the Riau High Prosecutor's jurisdiction. While the population and sample are parties relatedto the problems examined in this study, the data sources used, primary data, secondary data, and tertiarydata. The technique of collecting data in this study was through interviews and literature review.From the results of the research the authors concluded, the first Settlement of a criminal offense inthe Bantan Sector Police of Bengkalis Regency still uses deliberations between victims and perpetratorsattended by people in the village to reach a decision based on the provisions set by the people In the village,if the reasoning mediation process is carried out, the investigation process in the police of the bus sector isstopped and will not proceed to the Court. Second, the reasons for the police officers to carry out criminalmediation in criminal cases include because in general the perpetrators or the families of the perpetratorsask the investigators that the case is not processed further, the perpetrators / families of the perpetratorsgenerally provide compensation to the victims, so that this is an effort take the victim's heart so as not to suefurther.Keywords: Penal Mediation - Case Handling - Crime.

Abstract

Salah satu problem yang dihadapi bangsa Indonesia saat ini adalah kelebihan muatan atau ruang yang tidak cukup di Lembaga Pemasyarakatan (LAPAS) karena pemidanaan yang selalu berujung penjara dan masuk LAPAS. Bahkan beberapa kasus tindak pidana ringan sekalipun terkadang juga berujung masuk Lapas. Para narapidana yang sudah bebas dari tahanan yang tidak memiliki kemampuan atau keahlihan apapun selain melakukan kejahatan, saat bebas maka tetap akan mengulang kembali tindak pidana yang pernah dilakukannya (residivis) dan kembali masuk Rutan atau Rumah tahanan. Harusnya kondisi Rumah Tahanan sudah ada pengurangan narapidana namun akibat residivis maka bertambah lagi. Kelebihan muatan dari ruang yang disediakan di Lembaga Pemasyarakatan di Indonesia sudah banyak terjadi. Untuk itu pidana berujung penjara yaitu beberapa tindak pidana ringan harapannya bisa diahlikan ke alternatif lain yaitu pidana kerja sosial.Penelitian ini adalah penelitian hukum Normatif, dimana penelitian hukum normatif ini dilakukan dengan cara meneliti bahan pustaka atau data sekunder yang terdiri dari bahan hukum primer, sekunder dan tersier, yaitu mengkaji mengenai perbandingan hukum antara pidana penjara dengan pidana kerja sosial sehingga dapat diformulasikan di Indonesia. Pidana. Penelitian ini menggunakan sifat peneltian deskriptif, karena penulis bermaksud memberikan gambaran secara jelas dan rinci mengenai pidana kerja sosial.Dari hasil penelitian, disimpulkan bahwa pidana kerja sosial dapat diterapkan atau dicoba untuk diformulasikan juga di Indonesia. Beberapa negara seperti Belanda, Jerman dan Denmark yang telah mengenal pidana kerja sosial sejak lama namun dikatakan sebagai hukuman kerja sosial. Meskipun dalam Kitab undang-undang hukum pidana negara Indonesia Pasal 10 belum diatur mengenai pemidanaan jenis pidana kerja sosial, namun di RKUHP Indonesia telah disinggung mengenai menerapkan pidana kerja sosial ini sebagai salah satu jenis pemidanaan yang dapat diberlakukan. Mempelajari beberapa keahlihan atau tambahan keterampilan di luar Lapas perlu dilakukan sehingga tujuan pemidanaan juga dapat terwujud yaitu memperbaiki si terpidana dan mencegah terjadinya kejahatan di masa mendatang.Kata kunci: Formulasi, Kapasitas, Lembaga Pemasyarakatan
