Abstract

In Indonesia, the legal rules regarding Franchise are not yet complete. Wecan observe this indicator from the legal provisions governing franchise business,which so far have only been regulated in one (1) Government Regulation and one(1) Ministerial Regulation, as mentioned above. The regulation through law hasnot been touched by the government. Ignorance of business actors to the laws andregulations is the responsibility of the government on this issue.This type of research can be classified in the type of sociological lawresearch (empirical), because in this study the author directly conducts researchon the location or place studied. This research was conducted in the city ofPekanbaru. While the population and sample are the cheese tea franchisebusiness group and the Head of the Pekanbaru City Industry and Trade Office.Sources of data used are primary data, and secondary data. Data collectiontechniques in this study were interviews, and literature review.The conclusions that can be obtained from the results of the study are: First, thelegal awareness of franchise business actors in the implementation of a localcheese tea drink franchise business in the city of Pekanbaru in terms of theMinister of Trade Regulation Number 71 of 2019 concerning FranchiseOperators is still very low. This can be seen from the Regulation of the Minister ofTrade Number 71 of 2019 concerning the Implementation of Franchising as a newlegal basis in regulating franchise businesses in Indonesia in Article 2 paragraph(2) has determined that Franchising must meet several criteria. the criteria inArticle 2 paragraph (2) of the Regulation of the Minister of Trade Number 71 of2019 concerning Franchise Operators. Second, good faith in carrying out theobligations of the agreement by the franchisee but not being carried out inaccordance with the agreement and Regulation of the Minister of Trade Number71 of 2019 concerning Franchise Organizers, which has a detrimental effect onthe franchisee and consumers.Keywords: Implementation, Franchise, Cheese Tea Drink

Abstract

Indonesia has a well-known tradition of hunting whales in Lamalera Village, LembataIsland, East Nusa Tenggara, which has been carried out for hundreds of years for food needs.However, unlike countries where people also hunt lagoons, Indonesia does not have regulationsgoverning traditional hunting. In fact, Indonesia does not yet have regulations that provide adefinition of what traditional hunting is, either legally or customary law, and whether traditionalhunters may catch protected species.The type of research conducted can be classified as normative-juridical research wherethis research is more specific on the importance of the Indonesian state to ratify the InternationalWhaling Commission and the legal systematics of regional conventions and rules. The authoralso uses the principle of Free Prior and Informed Consent to ensure that the law and the rightsof indigenous and tribal peoples are guaranteed and respected.From the results of the research it was found that, first, there is no regulation regardingcustomary hunting in Indonesia so that the status of whaling carried out by the Lamalera peopleis still illegal. Abstract

Protection of labor is a form of government interference in the field oflabor aimed at realizing a fair labor. The Manpower Law became a legalumbrella for the protection of labor, even more so for female labor. Consideringthat there is a uniqueness possessed by women both in terms of physical, psychic,and biological, so that more special protection is given. Special protections areprovided to the female workforce such as menstrual leave, maternity andmaternity leave, and the right to breastfeed children. Legal protection of women'slabor rights becomes an obligation for employers to do so. But in itsimplementation, the legal protection that should be provided by entrepreneurs isstill not carried out perfectly, due to the presence of several obstacles forentrepreneurs. In this thesis, the researcher tried to examine how theimplementation of legal protection for female workers at Bank Syariah IndonesiaKCP Ahmad Yani Pekanbaru and addressed what obstacles the companyexperienced to provide full legal protection. The purpose of writing this thesis isto find out how the implementation of the provision of legal protection for femaleworkers funds pa obstacles faced by companies to carry it out.The research method used in this thesis is the sociological legal researchmethod. This research is descriptive, that is, it defines and describessystematically, the facts and characteristics of objects that are preciselycontextualized. The data sources used are primary, secondary, and tertiary datasources. The data collection technique used in the study in this study was to usethe interview method and literature study.Based on the results of the study, there are special rights of women's laborthat have not been fully realized by the company, where there are obstaclesstemming from internal company factors in providing legal protection guaranteesfor female workers.Keywords : Legal Protection, Women's Labor Rights, Company Obligations

Abstract

The development of illegal peer to peer lending financial technology inIndonesia has resulted in legal problems experienced by the community asvictims, this is because there is no specific law or regulation that regulates illegalpeer to peer lending financial technology. What was done to overcome this illegalpeer to peer lending financial technology was the blocking of applications,websites carried out by the Investment Alert Task Force together with Kominfo,this blocking sanction was not effective this was due to the ease with which peerto peer lending technology financial applications and websites were created back,while the existing rules, namely POJK No. 77/POJK 01/2016 which regulatestechnology-based lending and borrowing services only applies to peer to peerlending technology financials registered with the OJK so that strict sanctions areneeded in the form of rules or laws that have criminal sanctions in place.This study uses a normative juridical research type, namely research that isfocused on examining the application of the rules or norms in law to legalprinciples. The data collection technique in this research is literature study. Theapproach used in this research is to use a normative approach, namely librarylaw research.The results of the research conducted by the author are, first, criminalizinga peer to peer lending technology financial service provider is urgent/importantthis is because in its implementation activities there are many legal violationssuch as threats, extortion to the dissemination of personal data experienced by thepublic as Second, in overcoming the financial problems of illegal peer to peerlending technology, rules or laws are needed that have criminal sanctions thatcan ensnare this illegal peer to peer lending technology service provider.Keywords: Financial Technology Peer to Peer Lending, Online Loan

Abstract

The corruption case in the case of decision Number 19/Pid.Sus-TPK/2018/PN Pbrthe application of the criminal sanctions given in this decision did not provide a deterrenteffect for the perpetrators and seemed selective. The DAS defendant was sentenced to 17months in prison and paid a fine of Rp. 50 million subsidiary 1 month in prison and paycompensation for state losses of Rp. 80 million. The judge's decision was lower than thedemands of the public prosecutor, namely 2 years in prison. The formulation of theproblem in the research are: 1) How is the application of criminal sanctions in thedecision Number 19/Pid.Sus-TPK/2018/PN Pbr?, 2) What are the judges' considerationsin the decision Number 19/Pid.Sus-TPK/2018/PN Pbr?.The results of this study are the application of criminal sanctions in the decisionNumber 19/Pid.Sus-TPK/2018/PN Pbr which is lighter than the prosecutor's demands.The sanctions given to the perpetrators do not show a deterrent effect on the perpetrators.The judge's consideration in the decision Number 19/Pid.Sus-TPK/2018/PN Pbr oncriminal acts of corruption in the green open space project and the construction of ananti-corruption monument in Riau Province juridically, the judge looked at the statutoryprovisions that were used as the basis for the indictment. Abstract

Recruitment of children as part of the armed conflict has enormous impacts, suchas the recruitment of children who are recruited by the Boko Haram group, manychildren are recruited as spies, suicide bombers, cooks, messengers and others. Therecruitment of these children which is the involvement of children in armed conflicts is aviolation of children's rights, so the UN as an international organization gives amandate, namely to UN agencies specifically having one special organ that deals withchildren, namely UNICEF. UNICEF is a place to protect children so that they canremain free and obtain their rights. UNICEF and the UNICEF program will protectchildren from serious violations of their rights. So that the purpose of writing this thesis,namely: First to find out violations of the rights of children who become ChildProtection against the recruitment of children by the Boko Haram group, Second, therole of UNICEF as child protection for children recruited by the Boko Haram group innon armed conflicts in Nigeria, the three obstacles of UNICEF in carrying out its roleas child protection for children recruited by the Boko Haram group in non-internationalarmed conflicts in Nigeria.This type of research can be classified into this type of research, namelynormative legal research, namely a legal research conducted by examining librarymaterials with secondary data. Then, the data that has been collected will be processedand analyzed using descriptive methods by sorting the data so that a conclusion can bedrawnThe results of the research problem there are three main things that can beconcluded. First, there are many violations of children's rights against recruitment byBoko Haram. Both UNICEF as an international organization has an important positionas an IGO, and an international legal subject that has a role as an independent actorand UNICEF is carrying out its role with various efforts to protect children recruited bythe Boko Haram group by asking the Nigerian authorities to sign the Optional ProtocolThe Convention on the Rights of the Child concerning the Involvement of Children inarmed conflicts also prohibits the forced recruitment or conscription of children and thesigning of an action plan to end and prevent the recruitment and use of children. Abstract

Self-defense is the right of self-defense granted by the UN Security Councilcontained in Article 51 of the UN Charter. This right can be used by a state inorder to defend itself from an attack from another country. It is well known thatthe development of theories about state self-defense rights has overridden theconcepts of anticipatory self-defense and pre-emtive self-defense that override theprovisions requiring armed attacks before state self-defense rights arise. Article51 of the UN Charter clearly states that the right to self-defense of UN memberstates, individually as well as collectively, only arises "if an armed attack occurs".Thus a new state can exercise its martial rights if it has happened or is happening.Normative Legal Research Methods use normative juridical approachmethods. The normative approach in juridical is an approach that refers to theapplicable laws and regulations. Furthermore, normative legal research is a typeof legal research methodology that bases its analysis on applicable laws andregulations and is relevant to the legal issues that are the focus of the research.Topics of legal issues that are relevant to be researched using Normative LegalResearch Methods, including regarding; Intentarization of positive law, legalprinciples, etc.The results of the research that have been obtained prove that first ; there isa lot of neglect of the use of this principle by many countries which has resulted inmany violations that have been committed by the State. Abstract

Article 1 point 1 of Law Number 12 of 2011 concerning the Establishment ofLegislation, states that the Formation of laws and regulations is the making of Legislationstarting from the stages of planning, drafting, discussing, validating or stipulating, andenacting. One of the most crucial stages in the formation of a law is the planning stage. Theconcept of planning for the formation of laws so far has been implemented through theNational Legislation Program (Prolegnas) as the only law planning instrument that is set inthe medium term (five years) and annually (one year) and based on a priority scale. Thedelay in establishing the National Legislation Program is a form of non-compliance by thestakeholders in charge of forming the law. And the Legislative Body of the DPR RI as one ofthe complementary tools of the DPR which assists in planning the formation of laws has agreat responsibility for the preparation and coordination of the Prolegnas.The purpose of this study is to find out how the role of the DPR Legislative Body is inthe process of forming laws and what is the ideal concept of the DPR Legislative Body as anorganizer of the process of accelerating the formation of laws in Indonesia. This research isnormative juridical research and is supported by empirical data, research conducted basedon legislation and additional interview data. The approach taken includes a libraryapproach, namely by studying books and laws and regulations and an interview approachwith informants. The type of data used is premier data type, namely data sources obtainedthrough interviews with sources related to the Legislative Body, secondary data sources,namely data sources derived from books and other regulations, which consist of premierlegal materials, secondary legal materials and legal materials. tertiary law.The Legislative Body of the DPR RI as a complementary organ for the council incarrying out its duties in the process of forming laws has a fairly important role in theprocess of planning the formation of laws. And in carrying out its duties, the Legislative Bodyhas constraints and problems that interfere with the Legislation Body's duties. Abstract

AbstractThe authority of the government and regional governments to carry out marine management for the greatest prosperity of the people through the utilization, and exploitation of marine resources by using blue economy principles. This approach aims to improve sustainable marine management, and marine conservation, and coastal resources, and their ecosystems in order to realize economic growth with the principles of community involvement, resource efficiency, minimizing waste and multiple revenue streams. Rupat island, as the outermost island of Indonesia, has local wisdom potential that must be identified in order to be declared to support sustainable development goals. This research aims to find out the local wisdom of coastal communities that have the potential to be a blue economy in order to achieve the sustainable development goals. This research isnormative legal research, using data from literature studies, interviews, and observations. This is descriptive research that aims to provide a detailed and clear description of the problem to be studied. The results of the identification of the local wisdom of coastal communities that have the potential for blue economy are the rituals and processes of fishing procedures and the use of traditional fishing gear, wise management of mangroves and local community cultural arts that support marine tourism. AbstrakKewenangan pemerintah dan pemerintah daerah melakukan pengelolaan kelautan untuk sebesar-besarnya kemakmuran rakyat melalui pemanfaatan dan pengusahaan sumber daya kelautan dengan menggunakan prinsip blue economy. Pendekatan ini bertujuan meningkatkan pengelolaan kelautankerkelanjutan serta konservasi laut dan sumber daya pesisir beserta ekosistemnya dalam rangka mewujudkan pertumbuhan ekonomi dengan prinsip-prinsip keterlibatan masyarakat, efisiensi sumber daya, meminimalkan limbah, dan multiple revenue. Pulau Rupat sebagai pulau terluar Indonesiamemiliki potensi kearifan lokal yang harus diidentifikasi untuk dapat dinyatakan mendukung sustainable development goals. Penelitian ini bertujuan untuk mengetahui kearifan lokal masyarakat pesisir pantai yang berpotensi blue economy dalam rangka pencapaian sustainable development goals. Penelitian ini merupakan penelitian hukum normatif, dengan menggunakan data hasil studi literatur, wawancara dan observasi. Sedangkan sifat penelitian ini adalah penelitian deskriptif yang bertujuan memberikan gambaran secara rinci dan jelas tentang permasalahan yang akan diteliti. Hasil identifikasi kearifan lokal masyarakat pesisir pantai yang berpotensi blue economy adalah ritual dan proses tata cara penangkapan ikan serta penggunaan alat tangkap ikan tradisional, pengelolaan mangrove secara arif dan seni budaya masyarakat lokal yang mendukung wisata bahari.
