Abstract

The current outbreak and the increasing number of Covid-19 cases inIndonesia are indeed very influential on the political sector in particular.Considering that this pandemic case is becoming more widespread, thegovernment has issued a policy regarding the postponement of the RegionalHead/Pilkada election in 2020. Indonesia has an agenda to hold a regional headelection on 23 September 2020. However, through a government regulation inlieu of Law (Perpu) Number 2 of 2020. 2020 Regarding the 3rd Amendment toLaw Number 1 of 2015 concerning the Stipulation of Government Regulations inLieu of Law Number 1 of 2014 concerning the Election of Governors, Regents,and Mayors into Law, the Government of Indonesia has decided to reschedule theelections to December 9 2020.The aim of this research is to find out the implications of the coronavirusdisease 2019 (covid-19) pandemic for the election supervisory body (generalelection) in the 2020 simultaneous local elections (regional head elections) inRiau province, by using a research methodology, namely sociological orempirical legal research, which where sociological legal research is research onlaw observing what characterizes a community's behavior in an area in an aspectof social life.The data analysis used by the researcher is qualitative data analysis,namely the analysis which does not use statistics or other things. However,researchers simply describe descriptively from the data obtained. The results ofthis study can be concluded into 3 main things. First, the inhibiting factor for theCOVID-19 pandemic on the supervision of simultaneous regional elections inRiau Province, namely when conducting surveillance during the pandemic, whenthere was an alleged violation, there was clarification via online so thatclarification was not optimal due to online, ineffective reports from the publicabout alleged violations of the candidate pair due to the system.Keywords: Simultaneous Pilkada, Bawaslu, General Election, Covid-19

Abstract

Immunities and privileges of change offices aim to support performance and to avoidintervention from parties. Being unable to be arrested and immune from the power of law,whether criminal, civil law, or administrative law, is a form of impunity for destruction. Inthis thesis the case of protecting the rights of protection that occurred in England involvedthe replacement of a Saudi Arabian gun named Khalid Basfar. The official who overlaid ithad protected his right of immunity for exploiting his right to licence and traffic in humanbeings to his domestic worker named Josephine Wong. The domestic worker from thePhilippines also did not receive her wages while working at Basfar's residence. Freedom toprotect protections like this makes it necessary for the sending country to take legalresponsibility for the reduction.The research method used in this research is normative legal research. This researchis library law research. The focus of the discussion of this research is related to legalprinciples. The data sources used are primary, secondary and tertiary legal sources. In thislegal research, researchers use a case approach which will examine the 1961 ViennaConvention on Diplomatic Relations, the 1961 Vienna Optional Protocol, to the 2000Palermo Protocol on Trafficking in Persons.The result obtained is that there is an urgency for the responsibility of the sendingcountry in responding to the issue of securing immunity which can create better relationsbetween the receiving country and the sending country and the victim country. The forms thatare expressed in simple terms are the responsibility of the sending country, both in the formof recalling and removing the immunity from restrictions. This research also describes thelegal remedies that can be taken by the receiving country and the victim country.Keywords: Diplomatic Immunity, Slavery, State Accountability

Abstract

Political parties have a role in providing political education as stated in law number 2of 2008 concerning political parties. Political education is very important for society,especially for beginner voters, considering that beginner voters are emotionally unstable andhave minimal political knowledge.This type of research is empirical (sociological), which uses empirical facts taken fromKPU and high school data as well as interviews with political parties and first-time voters.The problem that the author raises is how to provide political education for beginnervoters in Meranti Islands Regency based on law number 2 of 2008, what are the supportingand inhibiting factors in providing political education for beginner voters in Meranti IslandsRegency, and what efforts to increase community participation especially new voters inMeranti Islands Regency in politics.The results of the research show that in Meranti Islands Regency political parties aresaid to not be running optimally and there are still shortcomings. It can be said that most ofthe political parties in the Meranti Islands Regency only focus on providing political educationto cadres or internal party members without involving the community, especially first-timevoters. The inhibiting factor for Political Parties in Kepuluan Meranti Regency in providingpolitical education is the public's distrust of Political Parties, that when participating inpolitical party events people think they will be said to be members of a Political Party. Lack ofenthusiasm from the public. And several political parties said that there were no obstacles, butpolitical education was not being implemented in the community. This means that there is alack of understanding of Political Party administrators in their function and role in providingpolitical education to the community. Author's suggestion: It is hoped that there will be anoversight institution for Political Parties in carrying out their roles and responsibilities toprovide political education, and it is hoped that Political Parties can implement the rules,duties, functions and authority of Political Parties in providing political education inaccordance with the updated Law Number 2 of 2008 again becomes Law Number 2 of 2011concerning Political Parties. And it is hoped that there will be real action from political partiesand the government, so that people are not anti-politics and it does not become a trust issuefor political parties.Keywords: novice voters, political parties, political education.

Abstract

This research focuses on the implementation of the 3R (Reduce, Reuse, and Recycle)programme in Pekanbaru City Regional Regulation Number 08 of 2014 concerning WasteManagement in Pekanbaru City Parks. The 3R programme is the government's effort toovercome the waste problem which is one of the biggest problems in the environment ofPekanbaru city. The goal is to reduce the amount of waste, foster public awareness, andprovide benefits for community empowerment. This research examines the extent of publicawareness in implementing the 3R programme and how the government supports theprogramme in public places such as city parks in accordance with applicable regionalregulations.This type of research is sociological research and descriptive in nature. The researchlocation was conducted in 4 locations, namely the Pekanbaru City Environment and HygieneOffice, Pekanbaru Mayang Glass Park, Pekanbaru Tunjuk Integritas Park, and PekanbaruCity Park. The population of this research is park visitors and parties related to parkmanagement in Pekanbaru City. Samples were taken by simple randomisation from thepopulation of park visitors. Data sources consist of primary data through observation,interviews, and questionnaires to the government, related agencies, janitors, and visitors tocity parks. Secondary data is obtained from laws and regulations, books, and previous researchresults. Data collection techniques were carried out through observation, interviews,questionnaires, and document studies. Data analysis uses qualitative analysis by describingand interpreting data and drawing conclusions deductively.From the results of the study it can be concluded that public awareness in implementingthe 3R Programme in Pekanbaru City Park is still lacking. There are still many visitors whothrow garbage not in the place that has been provided. In addition, the lack of personal hygieneofficers also affects the running of the 3R programme in Pekanbaru City Park. Second, theimplementation of the Pekanbaru City Regional Regulation number 8 of 2014 concerningWaste Management in Pekanbaru City, on the Communication indicator in the implementationof waste management in Pekanbaru related to socialisation, the value is not yet optimal but theagency will make maximum efforts to provide understanding to the public about the impact ofthe dangers of littering, secondly on the Resource indicator related to the lack of personnel inwaste management due to the limited budget owned by the agency. However, in the nextindicator, the role of the government has been carried out well.Keywords: Implementation, 3R Program, PERDA.

Abstract

The Japanese Antarctic Research Program II is a special permit based on the provisions of Article 8 paragraph 1 of the International Convention for the Regulation of Whaling 1946. In 2014 the International Court of Justice issued a ruling that the Japanese Antarctic Research Program II was not included in the provisions of Article 8 paragraph 1 of the International Convention for the Regulation of Whaling 1946, caused the Japanese Antarctic Research Program II to violate international environmental law. The purpose of this study was to determine the existence of the Japanese Antarctic Research Program II based on the perspective of international environmental law and to determine the responsibility of the Japanese state in scientific whaling activities based on the perspective of international environmental law. This type of research is normative legal research using a case approach by conducting a study based on the decision of the International Court of Justice No. 226 of 2014 (Australia v. Japan: New Zealand Intervening). The results of this study, the existence of a special permit for Japanese Antarctic Research Program II is allowed under the provisions of the International Convention for the Regulation of Whaling 1946 and the review of the scientific committee of the International Whaling Commission, but in practice the special permit for this research is not in accordance with the research plan and has many weaknesses so that the Japanese Antarctic Research Program II does not include a special permit for scientific research as contained in Article 8 paragraph 1 of the International Convention of the Regulation of Whaling 1946. Based on the perspective of international environmental law, Japan has subjective responsibility in the form of restitution of the Antarctic Ocean nature reserve for whale conservation and whale sustainability.

Abstract

implementasi sanksi pidana dalam perlindungan terbatas jenis ikan terubuk di provinsi riau. Metodologi menggunakan metode sosiologis. Proses pelaksanaan Keputusan Menteri Kelautan dan Perikanan di provinsi riau masih hanya berupa pemberian teguran baik secara lisan maupun tertulis disertai dengan dilakukannnya proses sosialisasi secara berkelanjutan dengan melakukan penempelan stiker kepada kapal-kapal nelayan dan pembagian brosur tentang pelarangan pnagkapan ikan terubuk pada tempat tertentu dan pada waktu tertentu. Diharapkan dari adanya proses pemberian teguran dan sosialisasi secara berkelanjutan dapat dicapainya tujuan dari Keputusan Menteri Kelautan dan Perikanan berupa perlindungan ikan terubuk.

Abstract

Introduction: The ethnic Rohingya are an ethnic Muslim minority group in Rakhine, which is among the most persecuted, vulnerable, and oppressed minorities in the world. In addition to losing their citizenship, the ethnic Rohingya also lost their home, where they have lived for decades. The United Nations High Commissioners for Refugees or UNHCR is an international organization that deals specifically with refugees. With the function of providing protection and finding long-term solutions for refugees.Purposes of the Research: Analyze Durable Solutions that are suitable to be applied to Stateless Rohingya ethnicity.Methods of the Research: The type of research that will be used is normative law research, which focuses on positive legal norms such as international law instruments relating to the issues contained in this study.Results of the Research: Of the three durable solutions available to UNHCR, the most viable long-term solution for Rohingya refugees is resettlement or relocation to a third country. Because of the conditions and laws relating to the citizenship of Bangladesh as a state of asylum, Rohingya refugees do not allow local integration into the nationality of Bangladesh, while voluntary repatriation is not possible for Rohingyas because of the state of the government of Myanmar and the lack of security and security guarantees as well as citizens' rights for rohingya. The protection and realization of the rights of refugees is the responsibility of UNHCR as an international organization formed and under the auspices of the United Nations (United Nations) specifically designed to deal with the refugee problem under the Statute of the Office of the High Commissioner for Refugees 1951 or the 1951 Convention. But UNHCR's authority is limited to providing protection, assistance, fulfilling the rights of refugees, and seeking solutions. This limitation of authority is what makes it difficult for UNHCR to carry out its tasks and missions.

Abstract

AMLAT pada dasarnya dibentuk untuk menghadapi kejahatan lintas negara yang terjadi di negara ASEAN, dan sesuai dengan namanya, kejahatan lintas negara, maka wilayah operasi para pelaku adalah kawasan Asia Tenggara. Tindak pidana yang bersifat transnasional mengakibatkan timbulnya permasalahan hukum suatu negara dengan negara lain. Sehingga upaya penanggulangan dan pemberantasannya sulit dilakukan tanpa kerjasama dan harmonisasi kebijakan dengan negara lain. Oleh karena itu, untuk menanggulangi dan memberantasnya, memerlukan hubungan baik dan kerjasama antar negara. Jenis penelitian yang digunakan oleh peneliti adalah penelitian hukum normatif, dengan menggunakan teori prinsip resiprositas dan asas double criminality. Kerjasama antar negara diperlukan untuk mempermudah penanganan proses penyidikan, penuntutan, dan pemeriksaan di sidang pengadilan atas suatu masalah pidana yang timbul baik di Negara Peminta maupun Negara Diminta. Dalam hal ini, dirasakan semakin penting perlunya kerjasama internasional secara efektif berkenaan dengan masalah-masalah kejahatan nasional dan transnasional. Salah satu jenis kerja sama internasional yang dapat digunakan dalam penegakan hukum dan dapat saling bertukar informasi adalah bantuan timbal balik pidana. Keberadan MLA sebagai instrumen alternatif dan saling melengkapi terhadap ekstradisi semakin relevan menyusul keberadaan ASEAN Treaty on Mutual Legal Assistance in Criminal Matter 2004 (MLAT 2004) yang sudah ditandatangani oleh semua negara anggota ASEAN. Sebelumnya Indonesia sendiri sudah menandatangni perjanjian ekstradisi bilateral dengan Malaysia, Philipina dan Thailand, sehingga keberadaan MLAT 2004 sejatinya semakin memperkokoh kerjasama hukum dengan negara-negara anggota ASEAN lainnya. Kata Kunci: MLA, Transnasional, Kejahatan.

Abstract

Peristiwa jatuhnya sampah antariksa di Indonesia tersebut menyisakan berbagai pertanyaan, terutama menyangkut keamanan lingkungan dan manusia terhadap dampak langsung jatuhnya sampah antariksa. Namun pada kasus-kasus yang terjadi di Indonesia terutama pada kasus yang terjadi di Sanggau, Kalimantan Barat sampai saat ini belum ada tindak lanjut untuk upaya ganti rugi. Jenis penelitian yang digunakan adalah penelitian hukum normatif. Pengaturan mengenai prosedur tuntutan ganti rugi melalui hukum internasional yang berlaku, maka tuntutann ganti rugi melaui jalur diplomatik dan komisi penuntutan. Proses klaim dilakukan melalui jalur diplomatik antara negara yang terlibat untuk menegoisasikan besar ganti rugi, dimana harus sesuai dengan hukum internasional dan prinsip-prinsip keadilan dan kesetaraan. Bentuk ganti rugi yang ditujukan kepada China sesuai dengan kerugian yang diderita oleh Indonesia ialah restitusi.

Abstract

Introduction: The International Civil Aviation Organization (ICAO) acts as an organization that notifies civilian aircraft that will pass in conflict areas and also cooperates with other countries in increasing ICAO supervision so that similar cases do not occur. Purposes of the Research: To know the role of ICAO (International Civil Aviation Organization) in handling international aviation safety supervision and cases of shooting down civil aircraft in conflict areas. Methods of the Research: This type of research can be classified as a normative research type, this research uses research methods on the principles of international law. This research is a descriptive analysis, namely describing and analyzing the problems that have been put forward to describe an overview of the International Civil Aviation Organization in handling cases of shooting down civil aircraft in conflict areas related to international air law. Results of the Research: International civil aviation, especially when crossing conflict zones while the Civil Aviation Convention (known as the Chicago Convention) establishes a framework for civil aviation investigations, does not provide an appropriate legal and institutional framework for accountability, ICAO's role as a specialized agency of the United Nations which is required from time to time to refrain from violations.
