Abstract

Today's social assistance is one of the government's obligations to the underprivileged or the inability to maintain a maximum standard of living for those affected by the COVID-19 pandemic that is currently engulfing Indonesia. This is also in line with various regulations issued by the government during the COVID-19 pandemic. The purpose of writing this thesis: First, to find out the arrangements for providing social assistance to people affected by the COVID-19 pandemic in the city of Pekanbaru. Second, to find out the implementation and distribution of social assistance in the city of Pekanbaru.The type of research used in this legal research is sociological legal research. The research was conducted in the city of Pekanbaru. Analysis of the data used is the author analyzes the data qualitatively. In drawing conclusions, the writer uses deductive thinking method.From the research results, there are two main things that can be concluded. First, the regulation regarding the punishment of discriminatory health service actors is divided into five points, including: (1) Presidential Instruction Number 4 of 2020 concerning Refocussing Activities, Budget Reallocation and Procurement of Goods and Services in the Context of Accelerating Handling of Corona Virus Disease 2019 (Covid-19). , (2) Regulation of the Minister of Home Affairs Number 20 of 2020 concerning Handling Covid-19, (3) Regulation of the Minister of Home Affairs Number 39 of 2020 concerning Prioritizing the Use of Budget Allocations for Certain Activities, Allocation Changes, and Use of Regional Budgets, (4) Minister of Finance Regulation Number 254/PMK.05/2015 as amended by PMK Number 228/PMK.05/2016 concerning Social Assistance Expenditures at State Ministries/Institutions, Minister of Finance Regulation Number 43/PMK.05/2020 concerning Budget Execution Mechanisms State in Handling the Covid-19 Pandemic, (5) Riau Governor Regulation Number 29 of 2020 concerning Guidelines for Financial Aid Special Charity to Regencies or Cities to Improve the Quality of Social Safety Nets in handling the Impact of Covid-19 Sourced from the Riau Province Regional Revenue and Expenditure Budget for Fiscal Year 2020. Framework Convention on Tobacco Control (FCTC) is an international treaty for tobacco control efforts for world health under the WHO. Abstract

Penelitian ini dilatar belakangi atas hadirnya sistem pemerintahan adat di Kabupaten Rokan Hulu, ditengah-tengah sistem pemerintahan desa pada saat ini yang menjadi sistem pemerintahan terkecil. Adapaun tujuan dari penelitian ini adalah untuk melihat kebijakan pemerintah terhadap penguatan eksistensi  sistem Pernerintahan Adat di Luhak Rokan IV Koto Kabupaten Rokan Hulu untuk menjaga kelestarian salah satu nilai adat dan aset budaya melayu. Adapaun metode dalam penelitian ini adalah penelitian kualitatif dengan pendekatan penelitian empiris (yuridis sosiologis), penelitian hukum sosiologi atau ernpiris. Pengumpulan data dalam penelitian ini yaitu dengan observasi, wawancara dan tinjauan pustaka.  Adapaun hasil penelitian ini bahwa kebijakan pemerintah cukup mendukung dalam memperkuat eksistensi sistem pemerintahan adat di Luhak Rokan IV Koto Kabupaten Rokan Hulu dapat dilihat bahwa terdapat kerajaan/kesultanan yang berdiri di Wilayah Kabupaten Rokan Hulu sebelum era kemerdekaan, kemudian masih terdapatnya struktur organisasi Pemerintahan Kerajaan/Kesultanan di Kabupaten Rokan  Hulu Luhak Rokan IV Koto dan masih berpengaruhnya sistem pemerintahan dan hukum adat dan masih terdapat nilai-nilai kerajaan terdahulu di Kabupaten Rokan Hulu sampai saat ini.

Abstract

The neglect of the elderly group is still a separate note for the Indonesian state and for local governments. Often we meet this elderly group abandoned alone and very far from a decent life. In fact, according to the mandate of Law Number 10 of 2009 concerning Social Welfare, it really guarantees the poor, neglected orphans and even neglected elderly people without exception. The purpose of writing this thesis: First, to find out the legal politics of the neglected elderly insurance in the perspective of human rights based on Articles 9 and 10 of Law Number 11 Year 2009 concerning Social Welfare in the city of Pekanbaru. Second, to find out the inhibiting factors in the guarantee of neglected elderly people in the perspective of human rights in Pekanbaru City. Third, to find out the efforts that can be made to the Abandoned Elderly Security in the Perspective of Human Rights Based on Articles 9 and 10 of Law Number 11 Year 2009 concerning Social Welfare in Pekanbaru City.The type of research used in this legal research is sociological legal research. The research was conducted in the city of Pekanbaru. Analysis of the data used is the author analyzes the data qualitatively. In drawing conclusions, the writer uses deductive thinking method.From the research results, there are two main things that can be concluded. First, the Legal Politics of Security for Abandoned Elderly Persons in the Perspective of Human Rights Based on Articles 9 and 10 of Law Number 11 Year 2009 concerning Social Welfare in Pekanbaru City, it can be said that it has not run optimally. This is further strengthened by the amount of data obtained by the author, namely as many as 29 neglected elderly groups in the city of Pekanbaru. Second, the inhibiting factors in this case start from the lack of government participation and socialization to directly pay attention to the elderly group, limited human resources in terms of screening the elderly group and the lack of service centers for the elderly in the city of Pekanbaru. Abstract

Child is the biggest gift for family, religion, nation and country. She was born to new generation and continue ambitions the nation. And human resources to national building for protect child authorities so there was constatiun about it. It is constatiun No. 23 tahun 2002. One of the steps to protect child is investigation that do it by investigator in the dissoluto case to get authorities child as a sacrifice criminal. In this case investigator must serve to herself in order to she get her authorities. The purpose of skripsion, first, to know investigation that do it by police resort town Pekanbaru second, to found some problem during investigating process that do it by police resort town Pekanbaru third, to get solve problem in this dissolute case in police resort town Pekanbaru.This research categorize yuridis and sosiologis research, because the writer get the data from location that give describing completely source of datas are primer, skunder and tertier datas. Collecting datas are interview and reading the literatures. From the result of research, there are there result can summarizing, first investigating do it by investigator hasn’t pin the procedure second problem in the investigating process is a difficult problem because suspect run a way and sacrifice silent.Third, to solve the problem, investigator give psychologish give suspect status, look for information from other witness. Abstract

Along with the development of entertainment technology, people have many alternativechoices where to look for entertainment, especially films. The cinema is a democratic public space,whoever has the right to come to access the screen that is currently playing. Even though not allfilms that are produced can be watched by all groups, because there are many contents that are notsuitable to watch, especially for children. However, there are cinema entrepreneurs who allowchildren to access shows with content not intended for children. Talking about human rights, itcannot be separated from children's rights. Regarding the rights and obligations of children wecan see in the Child Protection Law, namely Article 4 to Article 10 of Law No. 35 of 2014concerning amendments to Law No. 23 of 2002 on Child Protection. So in this case there areinherent and unavoidable children's rights. So that parents, society, and the State are expected tobe able to protect a child, because children are a gift as the nation's successor. The behavior of achild whether the child will become the future of the nation depends on the education provided byparents, society and the State.This study uses a typology of normative legal research or what is also called doctrinallegal research, which specifically discusses the level of legal synchronization, because it is relatedto the legal politics of the formation of restrictions on children who watch cinema shows with adultratings from a human rights perspective.The results of the research conducted by the author are, Basically the politics ofregulation regarding cinema, every film shown, circulated, or shown in the cinema must passcensorship. Passing this sensor is evidenced by the existence of a sensor pass certificate. A passcertificate is issued by the Film Censorship Institute (LSF) and signed by the Chairman of the LSF.There are no explicit rules prohibiting cinemas from allowing minors to buy tickets or watch filmswith an "adult" rating. What exists is the sanctions imposed by the LSF for film business actors (inthis case cinema entrepreneurs) who neglect the provisions concerning the inclusion of ageclassification of film viewers. Based on Article 8 paragraph (2) letter d jo. Article 55 of theBroadcasting Law, the sanctions that can be given are limited in nature, namely only limited tosanctions for violating regulations and broadcasting code of conduct as well as broadcast programstandards broadcast by broadcasting institutions that provide broadcasting services both radio andtelevision. So in this case the LSF does not have the authority to impose sanctions on parents orcinemas who allow children to watch cinemas with adult ratings.Keywords: Cinema- Political Law- Human Rights

Abstract

Island rentals in Indonesia to foreign parties violate the principles of an island nation that emphasizes the integration between land, sea and air dimensions in carrying out national development. It can also eliminate the integration of the sea dimension or waters in national development. in the National Long-Term Development Plan (RPJPN), one of the points of the long-term development mission is to realize Indonesia as an archipelago / maritime country, while the nation's predecessors have fought steadily so that the principles of the island nation are recognized byinternational world as stated in UNCLOS 1982.This type of research used in writing this law is normative legal research that focuses on principles by formulating legal principles, both from social data and from positive written legal data. Whereas when viewed from the nature of this research is descriptive. this study uses secondary data, namely data that has been prepared.The results of this study are island leasing in the territory of the Republic of Indonesia sovereignty against foreign parties based on the 1982 United Nations Convention on Law of the Sea (UNCLOS) in the form of usufructuary rights and leases based on legislation that applies in the Republican sovereignty Indonesia. Indonesian foreign parties are given authority over island rentals as limited as managers. However, some foreign parties have exceeded the authority given to the detriment of the local people who are the people of Indonesia. Island leasing in the territory of the Republic of Indonesia sovereignty against foreign parties based on positive law in Indonesia has not been able to accommodate the interests of the Indonesian people in accordance with the 1945 ConstitutionIsland leasing to foreign parties is more oriented towards seeking profits to increase state income and naturally eliminate the rights of local communities over natural resources of Indonesian waters.Keywords: Island Rental, Foreign Parties, UNCLOS 1982

Abstract

Aviation Security is a condition that provides protection to aviation from unlawful acts through the integration of the utilization of human resources, facilities, and procedures. One of the threats to the safety and security of aviation is the presence of information that is threatening to safety and security. Threats to the security and safety of civil aviation against acts of terrorism and its derivatives, including information on threats to the safety and security of aviation either verbally, through social media, telephone, mail kites, packages, or otherwise. Threats received by airlines on threats and terror information will be taken seriously to ensure the safety and security of aviation. The purpose of writing this skrisi is; First, to find out how the application of the law to criminal acts conveys false information that endangers aviation. Secondly, to find out how the application of law to perpetrators who claim to jokingly convey false information that endanger the flight.This type of research can be classified in the type of normative juridical research, namely research that discusses the principles of law, legal system, level of legal synchronization, in this case researchers discuss the principles of law. This research is done by examining library materials or secondary data in the form of legislation and books written by legal experts related to research titles, articles, journals and various other sources. The data source used is secondary data source. Secondary data is divided into three types, namely: primary legal materials, secondary legal materials and tertiary legal materials, data collection techniques in this study used literature review method or documentary study.From the results of research problems there are two main things that can be concluded. First, Delivering False Information that jeopardizes flights under the Terrorism Act is called an act of terrorism because it has caused fear of the crowd. Second, the application of the law to the perpetrator conveying false information claiming to joke that endanger the flight may be subject to article 437 paragraph (1) of Law Number 1 of 2009 on Aviation. Until now the application of criminal sanctions Article 437 paragraph (1) Law No. 1 of 2009 on Aviation for perpetrators has not been done. The author's suggestion, Firstly, the Elements of Regulation No. 15 of 2003 on the Eradication of Terrorism Crime and Law Number 1 of 2009 on Aviation to make it more clear that the application of its law can be executed in accordance with the actions of the perpetrator to convey false information that endanger Aviation . Secondly, criminal sanctions for perpetrators passing false information that endangers flights should be more assertive.Keywords: Implementation-False Information

Abstract

The principle of strict liability is a principle used to impose absolute responsibility on corporationsthat commit crimes under the category of violations. But in practice, it is rare to find cases that imposecriminal liability on corporations because law enforcers have difficulty finding valid evidence.The main problems examined are the criminal acts of forest and land burning by corporationscontained in the decision of the District Court Number: 36 / Pid.Sus-LH / 2016 / PN.Tjt and the decision ofthe District Court Number: 393 / Pid.Sus-LH / 2016 /PN.Rhl.This type of research is a normative legal research comparative type of law. The data sources usedin this study are primary data, secondary data and tertiary data, namely library materials that includeofficial documents, library books, legislation, and other documents relating to research issues.In this study it can be concluded that in the decision Number: 36 / Pid.Sus-LH / 2016 / PN.Tjt thedefendant was declared not proven guilty even though the facts presented in the trial showed that thedefendant committed negligence and had a negative impact on the environment and society. While on theverdict Number: 393 / Pid.Sus-LH / 2016 / PN.Rhl was found guilty and sentenced to a fine of Rp.1,000,000,000 (one billion rupiah) for negligence and negative impact on the environment and society.Authors' advice, firstly, for law enforcement officials in upholding the applicable law does not look at thestatus and level of difficulty in gathering valid evidence, especially in the case of forest and land burning bycorporations, because as is known the principle of strict liability can be used as a guideline for holdingcorporations accountable without requiring an element of proof. Second, for corporate management, inconducting business, especially in the fields related to the environment, they must comply with applicablelegal provisions and should be able to protect the surrounding environment so that no damage to theecosystem and the environment in any form. Third, for the community, it should foster self-awareness thatthe environment in general and the state of the forest in particular must be protected and protected in orderto avoid environmental damage.Keywords: Forest and Land Burning - Corporate Liability - Strict Liability

Abstract

Traditional medicine is one of the treatment and care efforts in other ways outside of medicine and nursing. Traditional medicine is usually used drugs that made of traditional of materials - scholarly materials such as spices - spices or commonly known in Indonesia with the term "herbal" as traditional healing. medicine it self has wide - types, benefits and functionality to cure various disease. Traditional medicine is in demand by the community, especially the low income people, because traditional medicine itself than low cost, too easily obtained and its availability is not limited when compared to prescription drugs are relatively limited.Traditional medicine is generally used traditional medicine needs to be fostered and monitored by the government to be able to be directed to the treatment and care that can be justified efficacy and safety. The government in this case the Ministry of Health is responsible for the control and supervision of traditional medicine as stated in the Act - Act No. 36 of 2009 on Health and established official institutions non-departmental government (Officials) which is responsible to the President and coordinated by the Ministry of Health and Social Welfare called the Food and drug Administration, which carry out government duties in the field of food and drug supervision in accordance with applicable regulations.Every traditional medicine in circulation to go through the assessment process, testing and registration in advance. Assessment and testing of traditional medicine is intended to prove the efficacy, safe and reliable, helpful traditional medicine. Therefore unregistered prohibited imported, distributed, stored and consumed, so that traditional medicine is categorized as a dangerous and contrary to regulations. But the fact that many traditional medicine illegal unregistered and considered a dangerous drug, there is a kind of traditional drugs containing chemicals, drugs (BKO) and traditional medicines that do not have a marketing authorization which are sold freely on the market and in pharmacies - pharmacy-by in order to obtain profit for the people, thus leading to losses that can be fatal to those who consume them.Keywords: Role of Investigators - Marketing Authorization - Great Hall of Drug And Food
