Abstract

Sengketa laut China Selatan telah dimulai sejak tahun 1947, pada tahun tersebut Negara China membuat garis putus-putus untuk mengklaim semua kepulauan yang ada di Laut China Selatan. Permasalahan ini dilatarbelakangi oleh dua factor penting, yaitu : pertama, letak yang strategis yakni laut China Selatan merupakan jalur Pelayaran perdagangan dan jalur komunikasi internasional yang menghubungkan samudra Hindia dan samudra Fasifik, beruntung dari segi Geografi karena dikelilingi oleh sepuluh Negara pantai. Kedua, sumber daya alam yakni kekayaan alam yang terkandung di wilayah Kepulauan Spartly memiliki kandungan minyak dan gas alam yang besar. Sumber daya alam ini merupakan salah satu produk yang sangat penting bagi pembangunan ekonomi Negara. Yang menjadi objek focus utama sengketa antara Negara-negara sekawasan (China, Taiwan, Singapura, Philipina, Vietnam, Malaysia, Brunei Darrusalam) yaitu dua pulau utama yang terdapat di wilayah laut tersebut, terkhususnya Kepulauan Spartly. Tujuan penulisan skripsi ini yakni ; Pertama, Penyelesaian Sengketa Kepemilikan Kepulauan Spartly Berdasarkan UNCLOS III Tahun 1982, Kedua, Upaya-upaya yang di Lakukan Oleh Negara-negara Sengketa Dalam Menyelesaikan Sengketa Kepemilikan Kepulauan Spartly di Laut China SelatanJenis Penelitian ini dapat digolongkan dalam penellitian hukum normative, yaitu penelitian yang dilakukan dengan cara meneliti bahan sekunder atau penelitian yang berdasarkan aturan-aturan baku yang telah dibukukan atau dapat juga disebut dengan penelitian kepustakaan.Dari hasil penelitian masalah ada dua hal pokok yang dapat disimpulkan. Pertama, penyelesaian sengketa kepemilikan Kepulauan Spratly berdasarkan UNCLOS III Tahun 1982 yakni pada Pasal 279 menyebutkan penyelesaian sengketa secara damai. Pasal ini memberikan penjelasan bahwasanya penyelesaian sengketa dengan jalan damai merupakan penyelesaian sengketa yang harus lebih dahulu ditempuh dan yang sangat dianjurkan dalam Konvensi Hukum Laut Internasional dalam penyelesaian suatu konflik Hukum Laut Internasional. Kedua, Upaya penyelesaian konflik ini sudah dilakukan sejak tahun 1970an baik melalui upaya-upaya bilateral maupun multilateral. Dalam upaya-upaya tersebut telah disepakati beberapa hal seperti kerjasama pengelolaan wilayah Kepulauan Spratly, maupun pembagian sumber daya alam. Akan tetapi konflik ini belum selesai karena belum ada kesepakantan mengenai hak kepemilikan wilayah Kepulauan tersebut. ASEAN sebagai organisasi regional Asia Tenggara ikut berperan aktif dalam upaya penyelesaian konflik di wilayah tersebut.Kata Kunci : Penyelesaian Sengketa – Secara Damai – UNCLOS

Abstract

Terrorism as a crime has expanded to cross country crime taking place in a country not only seen as the jurisdiction of a single the state but it can claimed including jurisdiction crimes more than one country.With progress then it could create conflicts jurisdiction that can interfere with intemational relations between countries in handle cases dangerous crimes. Isis ( islamic state of iraq and syria is an organization having the objective of establish the state islam.gerakan this the first time born in the middle eastern regions led by ashes two al-baghdadi.The purpose of campaign times this is conquer and uniting areas syria, iraq, egypt, lebanon, jordan, and israel of being a state unity under flag caliphate, an empire apply the law the faith in full in run the administration the state.This type of research can be classified in the type of normative research, because in this study the authors find data in books and legal journal of the problems studied. The nature of descriptive research with primary data sources, secondary data and tertiary data, while the population and sample are the parties in the cooperation agreement examined in this study. Data collection techniques are interviews and literature review.From the results of research problems there are two main things that can be concluded.First, International community on view of criminal acts of terrorism done isis had violated international law norms .Violation of human rights , imposition ideology and terror who break balance and peace .International law having the international community namely the state of being agreed that isis is a threat so that required resolusi-resolution at the security council pursue the united nations to crack down on terrorism movement isis, Second, The role of the un security council poured in resolution 2253 acting in a military fashion, and all kinds of a manner to remove terrorist group isis immediately, with the role of all member states the un security council and all state member the united nations and borders before controlled isis narrowed so as to make isis depressed.Keyword : Terrorist – ISIS – UN Security Council

Abstract

Indonesia is the largest archipelago in Southeast Asia which borderswith Malaysia and Singapore. As a state directly adjacent, not infrequenlyIndonesia seized conflict with the neighboring countries, including borderconflicts. Singapore has conducted reclamation activities sice 1966. The case ofreclamation conducted by Singapore is related to the Law of Sea Convention1982. As the one reference for countries experiencing problem or conflict overmarine areas. Indonesia as one of the countries that have ratified UNCLOS in1982, of course, can make a reference in the 1982 UNCLOS reclamation issue.The purpose of this thesis are; First, to determine the settings reclamation ininternational maritime law; Second, to determine the reclamation by Singaporecould threaten the sovereignty of the Republic Indonesia based on theInternational Law of theSea.Type of research used in this study, using a normative legal research. Atthis research the author concentrated on research that examines the level ofsynchronization law more in the case of sea reclamation in accordance withInternational Law and the connected the bilateral agreements between Indonesiaand Singapore with UNCLOS 1982.The result of the research, conclude two main points, First, in the UnitedNations on the Law of Sea in 1982 there were four of Article related toreclamation activities namely, Article 11, Article 56, pargraph 1, letter b, Article60, and Article 80. Abstract

South East Asia Regions are one of most region that have big potency. To keep harmonization in this region ASEAN has a rules to keep saffety in South East Asia Regions. But untill now the growwth of transnational crime especially terorism be a important issues because Indonesia, Malaysia, Singapore and Filiphina. So needed coordination between all of countries in South East Asia Region to counter on terorism.The problem of this research are how rule of ASEAN to counter on terorism in South East Asia Region based on Convetion of ASEAN on Counter Terorism and what the obstructed of ASEAN to counter on terorism in South East Asia Region based on Convetion of ASEAN on Counter Terorism.This reasearch use decriptions methodes or normative of law research, source of data from 3 data that: primer data, secunder data and tertier data, and technic collecting data with interview and library research after collect data then analize by qualitative to answer the research problem with deduktif analize.This research have a result that of ASEAN to counter on terorism in South East Asia Region based on Convetion of ASEAN on Counter Terorism are with make a dealing with the ASEAN Countries. Some of agreements are Asean regional Forum, Conference of Ministrial Meeting, ASEANAPOL, ASEAN Counter on Terorism with European Union and ASEAN + 3. In order the obstructed of ASEAN to counter on terorism in South East Asia Region are ASEAN principall that non interventions, ASEAN still focus in social and culture issues, conflict of politic domestic in ASEAN countries like Thailand, Myanmar and conflict between the state in ASEAN Region like Indonesia and Malaysia about the borderless cause.Keywords :Counter on Terorism – ASEAN – Rule

Abstract

Indonesian sailors generally work as fishermen on foreign vessels. Fishing is themost dangerous, dirty and difficult job in the world. About 15 million are involved in marinefishing. The practice of violating human rights in the form of modern slavery often occursand is experienced by crew members on foreign fishing vessels. In this case, in 2020Indonesian crew members worked on Chinese ships. In detail, there are 46 Indonesian crewmembers working on the ship. Cases experienced by Indonesian crew members includeunpaid salaries, threats and intimidation during work, inappropriate working conditions,physical violence or inhumane treatment or violations of human rights. Preventive efforts from Indonesia can be carried out by supervising the manningagency as a company for placing ABK on Chinese ships by strengthening institutionalstrengthening, which can be done by affirming the authority to issue permits for companiesto recruit and place crew members by the Ministry of Manpower and BP2MI through theGovernment Regulation on the Placement and Protection of Crews on Fishing Vessels. . Therepressive efforts are by pursuing diplomatic and consular efforts as well as ratification ofthe ILO Number 188 of 2007 concerning Work in Fishing and ratifying the convention thatregulates the protection of crew related to ship safety (CTA 2012). This type of research is normative legal research using research methods on legalprinciples, namely the principle of passive nationality. The data collection technique in thisresearch is literature study, reviewing, analyzing and analyzing the data qualitatively anddrawing conclusions deductively. From the results of the research problem, there are threemain things that can be concluded. First, the regulation of international legal protection forIndonesian crew members who work and experience modern slavery on foreign fishingvessels, namely preventive legal protection and repressive legal protection. Second, theregulation of international legal protection for Indonesian crew members who work andexperience modern slavery on foreign fishing vessels. Abstract

Reservior has encouraged others to commit crimes, it does not, if no one is willing to accept the proceeds of crime. If this can't be fixed of course like any society very disturbing feat. Then this is the role of the police force in tackling crime reservior is indispensable because the criminal action have trasnasional reservior is made with a "modus operandi" advanced technology, and supported by the organization. Therefore law enforcement agencies especially the Police Department Criminal Reserse expected to address and provides penindakan in accordance with the regulations to the perpetrators of criminal acts, to improve the comfort of the reservior, prosperity among the people.In accordance with the explanation above, the authors are interested in doing research with the title role of criminal police unit Reserse Resort Pekanbaru in tackling crime Reservior motor vehicle in the city of Pekanbaru. Where this thesis aim here, the first one to know the role of the police in addressing and overcoming the evil Criminal Reservior Reserse in Pekanbaru police resort. The second obstacle to find out what happened to the Police Resort town of Pekan Baru.Third attempt to find out what was done by the police in this Resort City of Pekanbaru. This type of research in sociological research classify types of juridical, for penenelitian the author of research directly on a location or place that is examined to provide a complete and clear picture of the problems in accurate. This research was conducted in the city of Pekanbaru Polres especially in the Unit, while the population of Reserse criminal and samples from all the parties concerned with issues that are examined in this study, the data source using the data, secondary data, and the data tertier, the primary data gathered in this study with interviews, kusioner, and the study of librarianship.The results of the discussion in this study is the role of the Criminal Police Unit Reserse Resort Pekanbaru in handling crime reservior in the city of Pekanbaru, where in the process of tackling financial crime police unit reservior role in preventative and repressive. Prevention activities carried out patrol and legal guidance on societies, and repressive activities do Criminal Police Unit another Reserse education do the observation, arrest, Search, seizure and anchoring. Abstract

The development of the era in the life of society in a region will always be accompanied by the increase of various criminal acts that occurred in the region, this also happens in the jurisdiction of the Police Sector Tenayan Raya where there is a mass problem that judges the person allegedly committing criminal act of theft resulting in death (case study of theft at the Alfamart Alfamart Street Kuantan Raya District Limapuluh) that occurred in 2016, but in 2017 a mass case that judges a person suspected of committing the crime of burglary that resulted in the death has not been resolved completely and is still under investigation by the police.In the investigation conducted by the Police Sector Tenayan Raya on mass cases that judge people suspected of committing the act of theft resulting in death (case study theft in Alfama Street Alfamart Jalan Kuantan Raya District Limapuluh) experienced bebagai kind of kedala or inhibiting factors in the investigation of one of the lack The source of information in the community around the place of the occurrence of vigilante action does not know the occurrence of such vigilante acts. Therefore, the investigation of criminal acts against mass cases that judge people suspected of committing criminal acts of theft resulting in death (the case of theft in Alfamart Street Kuantan Raya District Limapuluh) has not been resolved thoroughly.From the results of research problems encountered by the Police Sector Tenayan Raya can be concluded, namely: First, the investigation conducted by the Police Sector Tenayan Raya on mass cases that judge people suspected of committing criminal theft (case study theft in supermarkets Alfamart Street Kuantan Raya District Limapuluh). Second, the obstacle or the inhibiting factor experienced by the Police Sector Tenayan Raya in conducting the investigation is the lack of information considering the location of the theft occurred in the territory of the Police Sector Limapuluh. Abstract

Indonesia is an archipelagic country. As an archipelagic country, most of the Indonesian people's income comes from the marine sector. Utilization of marine sector by using the concept of blue economy can create sustainable development in Indonesia. Where the blue economy is defined as an economic model that promotes the implementation of sustainable development (sustainability), an economic model that develops marine and fisheries industry that emphasizes growth, job creation, and encourages innovation of environmentally friendly technologies. From the explanation of the archipelago and the blue economy that is being built in Indonesia, of course Indonesia is very profitable in that aspect. However, this still gets doubts and problems such as, first, how is the concept of blue economy in the marine sector within the framework of sustainable development in Indonesia ?. Second, what are the goals and solutions of marine design in Indonesia? Third, is the concept of a blind economy advancing the sustainable development of the marine sector in Indonesia? The purpose of this research is to find out the concept of blue economy in marine sector in the framework of sustainable development in Indonesia and see the sustainable development of marine sector in Indonesia, and to know the shape of the concept of blue economy affects sustainable development of marine sector of Indonesia. The type of research used in this study using normative legal approach method. In this study, the authors conducted a study of the principles of law that started at UNCLOS 1982. From the results of the research, there are three main points that can be concluded, first, the concept of Blue Economy in the marine sector can form the development of the gap in Indonesia. Second, the configuration in sustainable development in Indonesian marine sector is a form of regulation and attention that exists, the government should pay more attention to the marine sector, both policy making and others. Third, the concept of blue economy is maritime sector of Indonesia is still applied in some areas and is expected to be wider than before. Abstract

One of the policies that regulate entertainment in Pekanbaru City is Regional Regulation No. 3 of 2002 concerning Public Entertainment in Pekanbaru City. Based on Article 5, paragraph 7, Regional Regulation No. 3 of 2002, it is explained about the operational timing of video games / play stations. This fact can be seen from how the government regulates public entertainment in Pekanbaru City. Types of entertainment regulated in Regional Regulation No. 3 of 2002 in its implementation there are still violations in its implementation. Therefore, it is necessary to study the first stimulant, the implementation of Article 5 paragraph (7) Pekanbaru City Regional Regulation Number 3 of 2002 concerning public entertainment in Pekanbaru City, Second, obstacles in the implementation of Article 5 paragraph (7) Pekanbaru City Regional Regulation Number 3 Year 2002 Regarding public entertainment in Pekanbaru City. Third, the efforts made by the government to curb the operational hours of public entertainment venues for video game rentals / play stations.This research is a sociological legal research, because it is based on field research, namely by collecting data from interviews, questionnaires, and literature reviews that are related to the problems to be studied assisted by primary, secondary and tertiary data. This study uses qualitative data analysis and produces descriptive data.From the results of the research, it is concluded that, first, the implementation of Article 5 paragraph 7 of Pekanbaru City Regional Regulation Number 3 of 2002 concerning Public Entertainment in Pekanbaru City has not been running optimally. Second, lack of understanding and lack of awareness of video games / play station rental owners towards Regional Regulations Number 3 of 2002 concerning Public Entertainment, Lack of control and supervision of Satpol PP Pekanbaru City, Lack of Service Officers, Third, future efforts are to conduct socialization, add personnel in controlling and supervising every video game rental / play station, optimizing supervision and giving strict sanctions video game / play station rental business actors who do not comply with entertainment operating hours. The author's suggestions are, First, Satpol PP of Pekanbaru City is expected to make effective control and cooperate with the Regional Government in increasing peace for the surrounding community, Second, to increase socialization to business actors, Third, to discuss the effectiveness of local regulations regarding video game rentals / play stations.Keywords: Implementation-Regional Regulation-General Entertainment

Abstract

Until now the criminal act of illegal placement of migrant workers by thebrokers still occur in the area of Kepulauan Riau Police especially in Batam City,because Batam City is used as a transit point for them to go to Singapore orMalaysia through the official international transportation route where using aregular passport with mode that their destination is limited to visiting destinationcountries, this reasoning used to trick immigration officers. The criminal act ofillegal placement of migrant workers conducted by brokers or service providers inthe Kepulauan Riau Police territory in 2015 the number of suspects as many as 4people with the number of victims as many as 17 people, in 2016 the number ofsuspects as many as 13 people with the number of victims of 66 people, and in 2017the number of suspects as many as 4 people with the number of victims as many as22 people.This research is a type of research that is empirical or sociological lawresearch. Legal juridical empirical research or sociological law research is researchconducted directly on site or in the field to obtain data to provide a complete andclear picture of the problem in the perusal. Viewed from its nature describes the factsof symptoms and facts contained in life in a deep social.The results of research conducted by the author is first, the investigation ofthe Indonesian labor supplier in the Batam City handled by Kepulauan Riau Policeis not optimal. Second, obstacles from lack of knowledge and legal awareness of thecommunity, searching for illegal migrant worker recruiters, facilities andinfrastructure, lack of operational budgets, fewer police officers and no legal degree.Third, efforts to overcome these obstacles by increasing participation and knowledgewith the socialization of law to the community, coordinate with local police to lookfor the presence of suspects illegal recruiters, improve facilities and infrastructure,increase operational budget, increase the number of police officers and policeshould have law degree.Keywords: Investigation - Criminal Act - Labor - Illegal
