Abstract

This article discusses some of the contemporary issues and challenges related to handling victims killed in contemporary armed conflicts and situations of violence and other natural disasters within the framework of international humanitarianism in a review of Islamic law. Forensic professionals face problems and challenges in contemporary Muslim contexts, cases, and law: mass burials, quick burials, exhumations, and autopsies. Contemporary scientific discoveries in intensive care units and the rise of industry, which aid in the successful transplantation of organs from cadavers, but reveal new problems from legal, humanitarian, ethical, and judicial perspectives: such as issues of determining the time of death, matters of life (or brain death), and boundaries artificial resuscitation limits, by conducting a literature study and a qualitative descriptive analysis approach, new problems were found in the handling of this corpse, namely, those related to a merciful death, how to injure corpses, the extent of a person's rights over his body after death, cloning of the dead, and so on. Other. These are all doctrinal and not medical matters. The final opinion on this matter is for the jurists; Because that is their specialty, and doctors' views on it are for clarification and reference only. The article concludes that both legal systems have established provisions designed to protect the dignity and respect of the dead and complement each other to achieve this protection in specific contexts and situations involving Muslim parties. Abstract

In the fall of 1994, a group calling itself the Taliban endorsed Afghanistan from what it called warlords and criminals. Is that assumption correct? They were seeking to establish an Islamic government according to their interpretation of Sharia. Most Taliban leaders were Mujahideen, while the soldiers were Afghan refugees studying in Pakistani religious schools. The schools are run by the Pakistan Muslim Scholars Association, the conservative wing of the religious, political party, led by Maulana Fazlur Rahman Grim Qazi Hussain Ahmed, the Jamaat al-Islam party leader. In the discussion of this article, we conducted a literature study and a descriptive-analytical approach   after   reviewing   all   the   available   literature   and   starting   with collecting data holistically and then verifying and analyzing the data, after that, we tried to interpret the relationship between the attitude of the Taliban and the Hanafi school, which is considered to make the Taliban radical. After examining the existing groups and schools, the Hanafi school is not entirely responsible for the extremes of the Taliban because there are also Shia and Ismaili schools that are known to be violent and radical. Even in the past, the Shi'ite Ismaili school acted as assassins and spreaders of terror and killed the rulers. At the same time, the other group is Ahmadiyah and several other Islamic splinter groups.

Abstract

Knowledge of the Maqasid of Sharia comes from the texts of the Qur'an and Sunnah, and its roots are deeply rooted in the consciousness of the first generations of Muslims, especially in the first centuries. The verses of the Qur'an are rich in statements of statutory regulations, and the hadiths of the Prophet are full of clarifications of importance arising from the commands and instructions of the Maqashid of Sharia. Text is the first, strongest, and highest way to express the will of Allah S.W.T. Therefore, this study aims to collect "all" explanations regulated in the Qur'an in the field of finance and wealth. Money is useful in realizing four main interests: primary, secondary, and tertiary needs that support each other with problems and Maqashid shari'ah. By conducting a study of the opinions of some scholars through literature studies and qualitative approaches, the principles of Maqashid Sharia in the Qur'an are obtained with various dimensions of interpretation originating from the Sunnah of the Prophet and the opinions of scholars, such as as-Syatibiy, Raisuni, and other scholars. Money is the basis of religion and worship. One of the five pillars is zakat, worship in financial management because other worship will be disrupted without being supported by financial elements. Asset management in Islamic Mashasid is also aimed at various types of investments that bring five benefits to Muslims in multiple activities, including growing wealth for the benefit of the people and preventing environmental damage and global warming that is currently happening. Abstract

 Ottoman Turkey is a country based on Islamic Shari'a in which all cases that will decide must refer to Islamic shari'a. The door of Ijtihad has been closed for a long time, thus opening the opportunity for the authorities to issue legal decisions after being investigated by scholars. The design process is complicated because the books of fiqh do not instantly explain the laws required. The legal drafting process in principle based on the Qur'an and al-Hadith which are manifested by the mufti or Syaik al-Islam after being proposed by the sultan through the prime minister. After obtaining syaikh al-Islam's approval, the law or law is deemed legitimate. With a qualitative approach, the author conducted a literature study and analyzed the data collected and interpreted legal drafting during the Ottoman period. The decline of the Ottoman Empire in various fields has led to renewal including reforms in the areas of legislation, law, and justice which demanded legal codification in the form of majallah Al-Ahkam Al-Adliyah. This Majallah contains the law mu'amalah, which leads to ahwal As-syakhsiyah and serves to maintain Islamic law, which almost eliminated due to secularity that occurred.

Abstract

Syajar al Durr is a controversial figure who has been instrumental in saving Egypt and the two holy cities of makkah and madina from the western military in the seventh crusade. The victors of the Crusades and the emergence of Mamalik have changed legal decisions against the leadership of women who were previously taboo in the Middle East. Siyasah Syar'iyah is adapted to benefit purposes, although Syajar al Durr has many shortcomings but the legal status has changed with him due to his ability and intelligence. By using historical approaching, the researcher conducted a literature study on politics and Islamic law in women's leadership.In a descriptive way, this study explains about the differences in legal viewpoints, between classical scholars such as at-Tabari, Izzudin bin Abdissalam with the opinions of contemporary scholars such as al-Qardhawi and Ali Jumu'ah which allow women to become heads of state and not priests (caliphs). This research shows that there were some contradictions between the traditional laws and social contemporary perspectives.

Abstract

The emergence of sects and their diversity in Islam is caused by the differences in thought and visions of those who follow these sects. When the differences between the followers of these sects is limited to a mere difference of views on this or jurisprudential issue, it is a disagreement or an acceptable difference. Because there is more than one opinion on one jurisprudential issue, so whoever works with this opinion on the issue, his action is permissible. And, whoever works on the same issue with another thought, his movement is also acceptable, and this is from the capacity of Islam and its mercy to the nation. By examining several books related to the views of the ulama on the schools of thought, it has opened the way for us to verify. The article carried out a descriptive analysis approach and a comparative study of the opinions of scholars in different schools of thought and the fatwas issued by our official fatwa institutions. The article find the fanaticism of the sects is one of the causes of the nation's weakness. So, its unity was torn, and its humiliation intensified for the people. And that, they agree on what they agreed upon of the fixed principles, although various problems arise from time to time.

Abstract

This paper aims to describe the socio-economic justice concept taught by Islam, which wants a proportional income distribution. It can also be said that the Islamic economy is an economy based on togetherness. Therefore, it is not strange if the assumption of the Islamic socio-economic justice principle is similar to the socialist system. There has even been an opinion stating that if the socialist system is added and incorporated Islamic elements into it, it will become Islamic. I conducted a literature study and a descriptive analysis approach to the literature and existing sources. Some perspectives and opinions stated that the similarity of the socio-Islamic justice system with socialism was not entirely true; there were more mistakes. The economic principle of socialism, which rejects individual ownership and wants an even income distribution, differs from Islamic economic principles. Islamic economics, the enforcement of socio-economic justice, is based on a sense of brotherhood (ukhuwah), mutual love (mahabah), shoulder to shoulder (takaful), and mutual help (ta'awun), both between the rich and the poor and between the rulers and the people.

Abstract

This article aims to explain the role of Bektashi Sufism. It was practiced for centuries in the Ottoman Empire and is considered a branch of the Ja’fari school of Shia. The Imams of the Ahl al-Bayt (Shia) had developed and adapted to the style of Sufism that surrounded them. So far, the Shiites have conflicted with the Sunnis. Social penetration was successful, and many Bektashi followers declared that they had converted to Islam, like Christians and Jews. The problem of the sect adhered to by Bektashi is still being debated. Who is the Bektashi group? Are these groups Shiites or Sunnis? By analyzing and applying the theory of interpersonal relations and openness by the Bektashi group, which ruled out the Ja’fari Fiqh thinking to abolish differences in Sufism, Bektashi penetrated Sunni bodies. The writers used a literature study. It employed a descriptive and qualitative analysis to conduct a historical discussion of this unique Bektashi school of thought. The teachings of Bektashi affected the spirit of jihad of the Ottoman Turkish troops, who came from Christian prisoners of war. They won many victories with the guidance and support of the Bektashi group. Bektashi’s teachings are also compatible with religious tolerance, openness, and moderation inspired by various styles of thought and philosophy.

Abstract

This article aims to provide an overview of Islamic banking, which has shed light on Muslims in avoiding usury with inflation and oppression. The negative impact of cartels can be reduced. Suppose traditional banks have only one way to work, interest-bearing loans, although in many forms. The problem inherent in Islamic banking activities is whether they can be separated from the influence of conventional banks in various activities carried out, given the interrelationships between Islamic banks and traditional banks. By conducting a literature study, we analyzed banking data contained in documents, books, and journals using a qualitative approach using descriptive analysis methods. We try to provide an interpretation of the work of Islamic banks operating in various Islamic worlds and Indonesia. We found Islamic banks to be less compliant with the fatwas and instructions given by the existing Islamic boards. We find that Islamic banks have difficulty complying with shari'ah rules because they are constrained by the conventional banking financial system full of usurious Mu'amalah. Constrained by capital from the central bank, high operating costs, investment problems in the real sector, risk of loss and others. The focus of this research is the causes of the condition of Islamic banks in the Islamic world, which are trapped in a Ribawi labyrinth

Abstract

Andalusian civilization was formed by a combination of complex societies consisting of Arabs, Berbers, Goths, Israelis, Africans, and Salsabes. Logically it is difficult for multi-ethnic communities to coexist peacefully. This social mosaic is a challenge when Islam entered Andalusia. That is because Islam was born in the Arabian Peninsula which has a different culture from Andalusia. Based on the problem of how the influence of Islamic and Muslim tolerance on freedom of religion, culture and thought in Andalusia and through literature study with a historical approach; data collection (heuristic), verification, interpretation and historiography, the authors get the conclusion that cultural assimilation has interacted with tolerance as an influence of Islamic teachings. The influence is not only limited to the development of teachings, but the life of the Andalusian people. For example the birth of the Moor and Mozarabic groups, the development of linguistics and politics. Another indication is the attitude of the Andalusian community and especially Muslims who tolerate religious schools, sects that are different from Islam. Andalusian people lived side by side peacefully for centuries. Educated Jewish and Christian communities are satisfied with their situation under Islamic hegemony and its laws.
