Abstract

This study discusses the principle of legal protection in health services with a socio-legal approach. which integrates normative and sociological legal studies. The main focus of the study is on legal protection for patients and medical personnel in the context of health services in Indonesia. Optimal health services require legal certainty. especially related to the rights and obligations of all parties involved. In practice. many disputes arise due to negligence or certain medical actions. which shows a gap between normative rules and implementation in the field. The results of the study indicate that legal protection in health services does not only refer to statutory regulations such as the Health and Medical Law. but must also consider social aspects. culture. and ethics that apply in society. The socio-legal approach offers a comprehensive solution by integrating legal perspectives with social reality. so that it can create substantive justice for patients and medical personnel. From the analysis conducted. it was found that the application of a restorative justice-based approach can be an effective alternative in resolving medical disputes. in addition to formal litigation mechanisms. This is because this approach is more capable of fulfilling a sense of justice for victims. perpetrators. and the wider community. This study concludes that strengthening regulations and implementing legal principles in health services. by considering social aspects. is an important step to achieving a fair. effective. and sustainable health system

Abstract

Transnational crime, particularly human smuggling and trafficking, pose a serious threat to national and international stability. The increase in these crime cases in Indonesia shows the importance of the role of related agencies, such as Immigration. This study aims to analyze the role of the Class I Immigration Office of TPI Polonia in the prevention and control of transnational crimes. Using a sociological juridical approach, identifying and conceptualizing the law with real life, this study explores the challenges, successes, and steps that have been taken by the Immigration Office in dealing with this issue. The results of the study show that supervision of the issuance of travel documents, cooperation with related institutions, and socialization to the public are strategic steps in dealing with transnational crimes. However, obstacles such as data falsification and dishonesty of passport applicants remain challenges. To overcome this, the TPI Polonia Class I Immigration Office implements biometric technology, collaborates with the Population and Civil Registration Office (Disdukcapil), and conducts comprehensive interviews to ensure the authenticity of the applicant's data.

Abstract

This paper aims to discuss the importance of alternative dispute resolution in resolving health disputes through mediation as stated in Law Number 17 of 2023 concerning Health. Health disputes involve conflicts between patients and medical personnel, health workers or hospitals. This paper will discuss the urgency of alternative dispute resolution through mediation in resolving health disputes after the enactment of Law Number 17 of 2023 concerning Health. The results of this paper can provide benefits on how important it is to resolve health disputes through mediation without going through the role of the courts which are expected to create a win-win solution for all parties.

Abstract

This study discusses the implementation of Presidential Regulation (Perpres) Number 125 of 2016 on the handling of foreign refugees at the Medan Immigration Detention Center. Indonesia, as a transit country for international refugees, faces various challenges in handling the increasing number of refugees from Afghanistan, Myanmar, Sri Lanka, Somalia, and other countries. This study uses a normative legal method, by analyzing the legal framework, especially the relevance of Perpres No. 125 of 2016, which is the basis for government policy in providing protection and management of refugees. The results of the study show that the policy of handling refugees in Indonesia still faces a number of obstacles, including the lack of facilities and infrastructure, limited human resources, and budget support. Although Presidential Regulation No. 125 of 2016 is an important legal guideline, its implementation at the Medan Immigration Detention Center is considered not yet fully effective. This Presidential Regulation has not been able to accommodate the needs of refugees comprehensively, especially in terms of human rights protection, social integration, and providing access to education and health. This study recommends strengthening international cooperation with UNHCR and IOM, improving coordination between agencies, and optimizing the role of local governments in providing adequate facilities and protection for refugees. With the implementation of more effective policies oriented to human rights principles, it is hoped that the handling of refugees at the Medan Immigration Detention Center can run better and more sustainably.

Abstract

Penulisan ini bertujuan untuk menganalisis penerapan restorative justice dalam sistem peradilan pidana di Indonesia serta menguraikan konsep utamanya dalam konteks hukum pidana. Metode yang digunakan adalah yuridis normatif, dengan pendekatan yang berlandaskan pada norma-norma hukum, peraturan perundang-undangan, teori dan doktrin hukum, yurisprudensi, serta literatur yang relevan. Penerapan restorative justice merupakan respons terhadap kelemahan sistem peradilan pidana konvensional yang cenderung menitikberatkan pada penghukuman pelaku, tanpa mempertimbangkan kepentingan korban dan masyarakat. Restorative justice menawarkan pendekatan yang lebih humanis dengan memfokuskan pada pemulihan kerugian korban, pertanggungjawaban pelaku, serta partisipasi aktif dari keluarga dan masyarakat. Pada hakikatnya, konsep ini bertumpu pada kesadaran, keinsafan, dan upaya rekonsiliasi sebagai dasar pemulihan hubungan sosial yang terganggu akibat tindak pidana.

Abstract

Proses registrasi dan klasifikasi narapidana merupakan tahapan awal yang sangat krusial dalam sistem pemasyarakatan, karena menentukan dasar bagi pelaksanaan pembinaan yang efektif. Penelitian ini bertujuan untuk menganalisis efektivitas penerapan standar registrasi dan klasifikasi di Lembaga Pemasyarakatan Narkotika Langkat, dengan fokus pada bagaimana sistem tersebut mendukung pembinaan serta rehabilitasi narapidana secara optimal. Melalui pendekatan normatif-empiris, data diperoleh melalui studi pustaka dan wawancara dengan petugas Unit Pelaksana Teknis (UPT) Lapas. Hasil penelitian menunjukkan bahwa penerapan standar registrasi dan klasifikasi masih menghadapi berbagai kendala, seperti keterbatasan sumber daya manusia, infrastruktur, serta tingginya kompleksitas kasus narkotika. Di sisi lain, sistem klasifikasi yang dilakukan berdasarkan jenis kejahatan, risiko keamanan, usia, dan kondisi kesehatan belum sepenuhnya berjalan maksimal dalam menunjang proses pembinaan individual. Oleh karena itu, diperlukan evaluasi berkala dan penguatan kebijakan teknis agar pelaksanaan registrasi dan klasifikasi dapat benar-benar mencerminkan kebutuhan rehabilitasi narapidana dan mendorong keberhasilan reintegrasi sosial mereka setelah menjalani masa pidana.

Abstract

supervising public policies, particularly in the context of preventing corruption in village funds. Village funds are a source of development financing that are vulnerable to misuse if not monitored transparently and participatively. Mothers, as part of an active community element that is close to the social dynamics of the village, have great potential to encourage accountability and openness in the management of village funds. This research uses a qualitative approach with in-depth interviews, participatory observation, and documentation studies. The results show that the involvement of women in village deliberation forums, budget socialization activities, and monitoring of physical projects contributes significantly to reducing the potential for corruption practices. Additionally, their role in building collective awareness and having the courage to voice alleged irregularities is an important asset in shaping an anti-corruption culture at the village level. However, challenges remain, such as limited access to information, budget literacy capacity, and resistance from certain individuals. Therefore, capacity building and institutional support are key to strengthening the role of women as public oversight agents at the village level.

Abstract

The implementation of the correctional system as a coaching system is essentially a multidimensional activity, because efforts to restore the unity of relationships are a very complex problem. Realizing that the development of correctional assisted residents based on the correctional system is an interactive activity between the inmate component, officers and the community, community participation is one of the absolute things that is absolutely necessary. The research was conducted in the city of Medan, precisely at the Class I Tanjung Gusta Detention Center (RUTAN) Medan. This study uses an empirical juridical approach method, the data obtained in the field is presented descriptively using the empirical normative approach method. This study is to find out the Analysis of Legal Arrangements in the Development of Correctional Assisted Citizens who commit violations of the rules of order in the Class I Tanjung Gusta Medan Detention House, Obstacles in the Implementation of Guidance for Correctional Assisted Residents Who Violate the Rules of Conduct in the Class I Tanjung Gusta Medan Detention House (RUTAN). Based on the results of the research obtained by the author, the implementation of legal arrangements in the development of correctional inmates who commit violations of order in the Class I Tanjung Gusta Medan Detention House (RUTAN) is a special prison police (polsuspas) based on the regulations of the Regulation of the Minister of Law and Human Rights of the Republic of Indonesia Number 6 of 2013 which was updated to the Regulation of the Minister of Law and Human Rights of the Republic of Indonesia Number 29 2017 concerning the Rules of Conduct of Correctional Institutions and State Prisons and Law Number 22 of 2022 concerning Correctional Services to fulfill the rights of correctional inmates. The obstacle in the implementation of Coaching for Correctional Assisted Residents Who Violate Rules of Conduct at the Class I Tanjung Gusta Medan Detention Center (RUTAN) is if the prisoner has not received a verdict or incriminating verdict from the Court because he is still entrusted to the Tanjung Gusta Medan Class I Detention Center (RUTAN ) because it is still in the process of the investigation stages who are still in the custody of the Police and the Prosecutor's Office.

Abstract

The State of Indonesia is a state of law, which means that all legal regulations in force in the State of Indonesia must be obeyed by citizens and state administrators. However, in fact, there are still many legal regulations that are violated by citizens and state administrators, such as in cases of corruption. Corruption in Indonesia is very rampant from year to year. Therefore, it is necessary to enforce the law on corruption in order to realize upholding the rule of law, upholding justice and realizing peace in society. However, it is very worrying, it turns out that the law enforcement of corruption in Indonesia is classified as very weak. This can be seen from the fact that there are still many lawmakers or law enforcers themselves who commit acts of corruption. The formulation of regulations regarding criminal acts of corruption is a long process that has been going on since the issuance of Law Number 1 of 1946 concerning Criminal Law Regulations on February 26, 1946 which made the legal basis for changing Wetboek van Strafrecht voor Netherlands Indie to Wetboek van Strafrecht (WvS), which later known as the Criminal Code. Until now, the regulations regarding criminal acts of corruption are still undergoing changes, with the latest amendments being through Law Number 20 of 2001 concerning Amendments to Law Number 31 of 1999 concerning Eradication of Corruption Crimes and Law Number 7 of 2006 concerning Ratification of the United Nations Convention Against Corruption , 2003 (United Nations Convention Against Corruption, 2003). From the long journey of formulating regulations regarding criminal acts of corruption, it turns out that legal loopholes are still found, especially in the regulation regarding criminal acts of corruption, bribery and gratuities.

Abstract

In order to prevent the distribution and use of narcotics in detention centers, narcotics dealers are subject to a specific minimum penalty for the type of punishment that can be imposed on criminals. The social issue in giving to prisoners who have committed criminal acts of narcotics abuse is the prisoner's right to receive a reduced sentence if they have good behavior while undergoing training. The nature of the research used is normative legal research and the data collection method used in this research is secondary data obtained through library research, namely by conducting research on various literature such as books, laws, with the aim of to look for concepts or understandings related to the problem of the Family Visiting Service System for Inmates in the Class II B Tanjung Pura Detention Center. Legal Arrangements for the Family Visiting Service System for Inmates in the Class II B Tanjung Pura Detention Center can be interpreted as a place where people are gathered who violate the rules and norms that exist in society. Meanwhile, the principle adopted by correctional institutions is to position prisoners as subjects who are seen as individuals, ordinary citizens, and as creatures of God. Based on this, in prison prisoners receive guidance and guidance with the hope that after completing their sentence, prisoners can socialize with the community and improve their skills so they can live independently in society. Factors Inhibiting the Family Visiting Service System for Inmates in the Class II B Detention Center in Tanjung Pura, from children to adults, are not free from narcotics, in Indonesian law enforcement the morning criminal sanctions for narcotics dealers do not seem to be feared by the dealers because it is proven by Year after year the problem of narcotics always increases.
