Abstract

The purpose of this study is to analyze universal values in Islamic law and their relationship to the religiosity of society. This research uses qualitative research with a phenomenological analysis approach. The type of data used in this research is secondary data. This research develops the research flow from various points of view, first, by researching universal values and high legal awareness. Next is to examine the effectiveness of the regulations contained in the legislation. The third is to explore the universal values that exist in the teachings of Islam, and the last is to look for the causality of all these things with the level of religiosity of the Indonesian people. Based on the analysis results, it can be concluded that all Islamic teachings contain and are relevant to universal values. Islamic law regulates all aspects of life, both aspects of worship (human relations with God) and aspects of mu'amalah (relationships between humans and their environment, but this is still not implemented by the Indonesian community, although it affects the level of community religiosity.

Abstract

The Compilation of Islamic Law has stipulated that all forms of income obtained by a married couple will become joint property regardless of who made the effort to obtain the income. On the other hand, the Compilation of Islamic Law has also stipulated that the husband is obliged to bear the wife's maintenance. So the question arises from which assets the husband takes to fulfill this maintenance. From these two rules, it seems that there is a normative contradiction. This has implications for the decision of the Religious Court in the case of Nafkah Madhiyah. This qualitative research is conducted by studying the primary data sources of the decision documents of the Talu Religious Court Number 440/Pdt.G/2020/PA. Talu and the Padang Religious High Court Number 6/Pdt.G/2021/PTA.Pdg and the Compilation of Islamic Law (KHI). The focus of this research examines the judge's legal logic towards the fulfilment of the wife's right to nafkah madhiyah in a divorce case in the decision of the Talu Religious Court (PA) which was then appealed to the Padang Religious High Court (PTA). The results of this study indicate that the decision of the PTA Padang judge who rejected and cancelled the PA Talu judge's decision regarding nafkah madhiyah was more appropriate because the husband left the house with only the clothes he was wearing, while the wife could still fulfil her minimum living needs with the joint property left by her husband.

Abstract

Abstract. This research examines childfree according to the fatwa of Dar Al-Ifta' Jordan and the Egyptian PCINU Bahtsul Masail Institute in maqasid sharia. Childfree is an agreement between husband and wife not to have children in marriage. Using a normative analysis approach, it can be seen that childfree in the view of the Dar Al-Ifta' Jordan Egypt fatwa which is reviewed by maqasid sharia is closer to the value of maqasid sharia, while the Egyptian LBM PCINU allows the practice of childfree by analogizing it with 'azl, whereas the permissibility of 'azl is only temporary, not to be permanent, then here LBM PCINU Egypt's decision regarding childfree is not in line with maqasid sharia values. Because Childfree's decision is contrary to the purpose of marriage in Islam, namely to continue the offspring and human population, as in the words of the QS. An-Nahl:72 and Hadith Abu Dawud 2050.

Abstract

Penelitian ini bertujuan untuk menganalisis penerapan al-maqashid al-khamsah (perlindungan agama, jiwa, akal, keturunan, dan harta) dalam kerangka al-dharuriyah (kebutuhan mendasar), al-hajiyah (kebutuhan sekunder), al-tahsiniyah (penyempurnaan), dan al-mukmilat (pelengkap). Penelitian ini menggunakan metode kualitatif dengan pendekatan kajian literatur dan analisis pemikiran hukum Islam kontemporer. Hasil penelitian menunjukkan bahwa maqashid al-khamsah menjadi landasan utama bagi hukum Islam, di mana setiap tujuan berperan penting dalam memenuhi berbagai tingkatan kebutuhan manusia. Struktur hierarki ini memberikan kerangka kerja yang fleksibel namun komprehensif untuk memahami dan menerapkan hukum Islam dalam berbagai konteks. Penelitian ini menyimpulkan bahwa integrasi maqashid dari tingkat mendasar hingga pelengkap memperkuat sifat holistik hukum Islam, serta memberikan panduan praktis dalam menghadapi tantangan masyarakat modern. Abstract

Differences of opinion among scholars in the fields of Islamic law actually occurred during the time of the Companions of the Prophet. However, these differences can still be overcome with political policies and the legality of ijmak. However, at the end of the Companion period, known as the Tabi'in period (approximately starting in 41 AH), differences of opinion could not be resolved like they were resolved during the Companion period. This is where the process of transitioning Islamic law began from a form of ijtihad which was based on the greatness of friends to a scientific and measurable process until the birth of school imams who codified the results of their legal thinking in the form of fiqh books. Ahl al-Hadith and Ahl al-ra'y are two forms of legal thought that ushered in this transition process. That period was the time when efforts to shape Islamic law began to suit societal conditions and rationality. The school of thought is the main idea or basis used by the mujtahid Imam in solving problems; or adhere to Islamic law. The emergence of the school of thought, as part of the historical process of establishing Islamic law, was neatly arranged from generations of friends, tabi'in, until it reached its golden age in the Abbasid Caliphate, but it must be acknowledged that the school of thought has made a major contribution to thinking in establishing Islamic jurisprudence law. The reasons for the differences opinion/school of thought due to differences in perception in ushul fiqh and fiqh as well as differences in interpretation or interpretation of mujtahids. Adhering to the understanding of bermahzab, due to factors Our "inability" to explore Sharia law itself directly from its sources (the Koran and Sunnah). The source of Islamic law is the most basic thing in the process of establishing a law. In Islam, the main sources of law are the Al-Quran and Sunnah.

Abstract

Studi ini bertujuan untuk menganalisis pertimbangan hakim dalam Putusan Nomor: 0004/Pdt.G/2017/PA.Lpk, perkawinan merupakan hubungan antara laki-laki dan perempuan, Namun, terkadang terjadi penyimpangan seksual antara laki-laki dan perempuan ketika telah melangsungkan pernikahan, setelah menjalin pernikahan cukup lama laki-laki mendapati perempuan memiliki perilaku seksual yang menyimpang, yaitunya perempuan menyukai sesama jenis (Lesbian). Apabila persoalan perilaku seksual menyimpang ini di pertahankan dalam rumah tangga, maka akan mendatangkan kemudharatan. Penelitian ini penelitian hukum normative dilakukan dengan cara analisis bahan hukum utama yaitu Putusan Pengadilan Agama Lubuk Pakam perkara Cerai Talak, serta bahan hukum sekunder lainnya seperti keputusan pengadilan, perundang-undangan, teori hukum. Hasil kajian ini menunjukkan bahwa perilaku penyimpangan seksual perempuan sebelum menikah tidak diketahui laki-laki hingga sampai menjalin kehidupan rumah tangga. Setelah menjalin pernikahan cukup lama laki-laki tersebut mendapati perempuanya memiliki perilaku seksual yang menyimpang, yaitunya menyukai sesama jenis (Lesbian), sehingga pihak laki-laki sebagai pemohon berada pada pihak yang dirugikan dengan alasan perempuan tersebut memiliki perilaku seksual yang menyimpang. Kata Kunci: Lesbian, Putusan Nomor: 0004/Pdt.G/2017/PA.Lpk.

Abstract

Perselingkuhan sebagai alasan perceraian merupakan isu penting dalam konteks hukum pernikahan di Indonesia. Artikel ini membahas putusan Nomor 1552/Pdt.G/2016/PA.Smd, yang menyoroti dampak perselingkuhan terhadap hubungan suami-istri dan alasan perceraian. Studi ini menggunakan metode yuridis-normatif untuk menganalisis keputusan pengadilan dan norma hukum yang mengatur perceraian akibat perselingkuhan. Data diperoleh dari dokumen putusan dan literatur hukum terkait. Hasil analisis menunjukkan bahwa perselingkuhan Penggugat menjadi faktor utama dalam perselisihan, yang mengarah pada keputusan perceraian. Upaya mediasi yang tidak berhasil dan ketidakcocokan hubungan menguatkan keputusan pengadilan untuk mengabulkan gugatan cerai. Temuan ini menekankan pentingnya keadilan emosional dan kesadaran hukum bagi pasangan yang bercerai. Keputusan pengadilan mencerminkan pemahaman bahwa perceraian dapat menjadi solusi ketika hubungan tidak lagi memenuhi tujuan pernikahan. Hal ini juga menggarisbawahi perlunya perhatian terhadap kesejahteraan anak dalam proses perceraian. Kata Kunci : Perceraian,Perselingkuhan, Putusan Pengadilan Agama

Abstract

A mandatory will is a gift of inheritance given to heirs who do not get a share of the inheritance left by the heir. Usually those who get a share of the inheritance are adopted children or adoptive parents, but in jurisprudence Number 16K/AG/2010 wives who are non-religious Muslims by the supreme court receive a share of the inheritance in the form of a mandatory will. This type of research is normative legal research, namely legal research carried out by examining library materials or secondary data. This research is descriptive analysis with the method used in this research, namely normative juridical. The data source is primary legal material originating from Supreme Court decision Number 16 K/AG/2010, and secondary legal material comes from books, journals and articles related to this research topic RI Supreme Court Decision No.16 K/AG/2010 , the Supreme Court of Justice is of the opinion that the Decision of the Makasar High Religious Court Number 59/Pdt.G/2009 which upholds the decision of the Makasar Religious Court Number 732/Pdt.G/2008 is cancelled. Furthermore, the Panel of Judges of the Supreme Court decided to try this case themselves. The Supreme Court judge stated that Evie Lany Mosintah (wife) received 1/2 part of the joint assets and the other 1/2 part was the inheritance which became the share of the deceased's heirs. Evie Lany Mosintah, who initially did not receive an inheritance from the deceased through the decision of the Makasar Religious Court and the Makasar Religious High Court, was determined by the Panel of Judges at the Supreme Court that Evie Lany Mosintoh received a share of the inheritance through a mandatory will, whose share was ¼.

Abstract

The patients of HIV-AIDS tend to commit deviant behavior, such as homosexual, bisexual, drugs abuse, and sex workers, though there are other causing factors. The government, however, has provided them with a free-of-charge treatment. This kind of treatment is allocated through one hospital in each province. The present study aims to investigate (1) the objective conditions of HIV-AIDS patients receiving antiretroviral (ARV) treatment at M.Djamil General Hospital (RSUP) Padang, (2) various treatments provided to the patients in the perspective of Islamic law, and (3) the free-of- charge ARV treatment received by the patients from the Islamic law perspective. Designed in a research-based community service, the study employed four strategies, namely: planning, action, observation, and reflection. The data were analyzed descriptively with data reduction, display, and conclusion verification. The findings promote that firstly, the objective conditions of HIV-AIDS patients receiving the ARV treatment at the M.Djamil RSUP Padang until December 2018 comprised 1805 people. They were mainly infected with HIV-AIDS through homosexual and bisexual behavior, the use of drug syringes, and prostitution. After receiving the ARV treatment, they still committed the deviant behavior. Secondly, practically, their behavior was categorized into hudud (penal presciptions) and could not be addressed a punishment for the perpetrators since it was not stipulated in regulations. Thus, taubat (repentance) approach is fostered to deal with.
