Abstract

Abstract: It is important to procure a circuit court to achieve Justice for All, considering that a circuit court is like a trial like in a court office, except that a circuit court is outside the court building. The circuit court is held with the aim of making it easier for the public to take legal steps or seek justice. The community does not need to come to the court but simply comes to the place where circuit courts are held, which is usually held in the sub-district. This is based on the Supreme Court Circular Letter No. 10 of 2010 concerning guidelines for legal aid reform within the Religious Courts. The circuit court held at the Nganjuk Religious Court is very helpful for parties who are far from the Nganjuk Religious Court office and the middle and lower class in carrying out the proceedings. The circuit court can save time and money, this is in line with the principles of maqashid syari'ah, namely hifdzu al-nafs and hifdzu al-mal.Keywords: circuit court, divorce talak, divorce lawsuit, Nganjuk Religious Court.   Abstrak: Pengadaan sidang keliling untuk tercapainya Justice for All penting dilakukan mengingat sidang keliling merupakan layaknya sidang seperti di kantor pengadilan, hanya saja sidang keliling di luar gedung pengadilan. Sidang keliling dilakukan dengan tujuan untuk memudahkan masyarakat untuk menempuh jalur hukum atau mencari keadilan. Masyarakat tidak perlu datang ke pengadilan tetapi cukup datang ke tempat sidang keliling dilaksanakan yang biasanya dilaksanakan di kecamatan. Hal tersebut didasarkan pada Surat Edaran Mahkamah Agung RI No. 10 Tahun 2010 tentang pedoman pembaruan bantuan hukum di lingkungan Pengadilan Agama. Sidang keliling yang dilaksanakan di Pengadilan Agama Nganjuk sangat membantu para pihak yang berada jauh dari kantor Pengadilan Agama Nganjuk serta masyarakat menengah ke bawah dalam melaksanakan proses beracara. Sidang keliling bisa menghemat waktu dan biaya, hal ini sejalan dengan prinsip maqashid syari’ah, yaitu hifdzu al-nafs dan hifdzu al-mal. Kata kunci: Sidang keliling, cerai talak, cerai gugat, Pengadilan Agama Nganjuk.

Abstract

As a hidden crime, violence against wives is considered a disgrace to be discussed in public, especially reported to state and non-state actors. At first, victims feel able to resolve violence without outside intervention from outside their household, but repetition after repetition of violence requires them to choose what kind of resolution is right for them. This choice should be made after they have the support of individuals in their social environment. This study aims to explore the knowledge and experience of victims of violence against wives in choosing one among legal norms favorable to them. This study uses a critical realist approach by collecting qualitative data with dialogue techniques and observations of three women who were victims and six people who provided support to victims. We conclude that victims experience a dynamic psychological state, where initially, they always try to maintain the integrity of their household. The dominance of men and the subordination of women as a reality of cultural norms are essential factors in choosing ways of resolving conflicts at the community level, and we consider that the community has succeeded in providing social support to victims so that victims feel they get help and defense. However, we hope that this social support can be carried out through structured, systematic, and massive protection of victims of violence from State and non-state actors while considering the cultural norms of the community and supporting the identification of violence.

Abstract

The implementation of a Village Information System (SID) in public services is regulated in Law Number 6 of 2014 concerning Villages. However, many villages in Lamongan regency have not used the application due to various factors, even though in Lamongan there is a SID application called SIGENDUK (Superior Village Movement Information System with Character). This article discusses assistance in the use of the SIGENDUK application to improve public services in Lamongan district. Assistance was carried out in three villages in Lamongan regency, namely RejoTengah, Kendalkemlagi and Menongo, because the three villages have not used the SIGENDUK application in public services. Assistance is carried out using the Participatory Action Research (PAR) method. The assistance results concluded that the village government did not use the SID application because there was no socialization and training on SID, there was a lack of human resources who were technology experts and because of costs. On the other hand, the Lamongan Regency Government has a SID application called SIGENDUK which can be used for free. Based on this, socialization and training on the SIGENDUK application were held for residents and village officials. With this socialization and training, the village government has access rights to use the SIGENDUK application and devices to serve various administrative and data storage services.

Abstract

Para aktor negara memiliki peran dan kontribusi yang sangat penting dalam penyelesaian kasus pernikahan siri di Indonesia. Saat ini Dukcapil menerbitkan KK untuk pernikahan siri, sebab dalam undang-undang perkawinan nikah yang tidak tercatat tidak mendapatkan legalitas hukum. Artinya, negara tidak dapat memberikan jaminan hukum atas perkawinan tersebut Tujuan penulisan untuk menganalisis Implikasi Kebijakan Penerbitan Kartu Keluarga bagi Nikah Siri terhadap UU No. 1 Tahun 1974 tentang Perkawinan. Metode hukum normative, Bahan hukum sekunder, yaitu studi kepustakaan berupa literature-literature berkenaan permasalahan penelitian dengan pendekatan kasus dan bersifat deskriptif guna memberikan penjelasan secara sistematis dan cermat mengenai fakta-fakta actual detail. Kesimpulan kebijakan nikah siri mendapat KK yang tidak lain bertujuan untuk menjamin perlindungan istri dan anak tidak efektif karena seharusnya yang perlu dilakukan adalah memperbaiki mekanisme penegakan hukum yang lebih baik seperti memperkuat peraturan isbat nikah dalam hal keberlakuannya juga berlaku untuk perkawinan setelah Undang-Undang No. 1 Tahun 1974 Tentang Perkawinan. Hal ini jelas memberikan kepastian dan perlindungan hukum bagi istri dan anak dari perkawinan siri.

Abstract

This article discusses the development of Islamic jurisprudence at the expiration of Islamic thought which known as a taqlid period, i.e. the stagnation and static period that lasted from the mid-fourth century of Hijriyah (351 H). The growth of taqlid mentality in this period is due to several factors, the internal and external factors. Among these factors are social and political instability, legal definition of Islamic thought, fanaticism to certain Islamic thought, weakening the spirit of ijtihad, and closure of the gate of ijtihad. Currently, the Muslim scholars’ activity is summarizing the classical books (mukhtasar). Among the many classical books caused many questions, then they started to compile the book explanations. Despite this circumstance, there are still some people who remain dynamic and creative thinking, even if they are dealing with the challenge of the ruler, who are ready to throw into prison for their firm stance. Among the scholars who are attempting to break the rigidity of this period are Shaykh al-Islam Ibn Taymiyyah (d. 728 AH) and Ibn Qayyim al-Jauziyah (d. 751 AH). [Artikel ini membahas tentang perkembangan fikih pada masa berakhirnya madhhab yang biasa dieknal dengan periode taqlīd, yaitu periode kebekuan dan statis yang berlangsung mulai pertengahan abad empat hijriah (351 H). Tumbuh dan berkembangnya mentalitas taqlīd pada periode ini disebabkan oleh beberapa faktor, baik internal atau eksternal. Di antara sebagian kecil faktor tersebut ialah; Instabilitas sosial politik, rumusan hukum madhhab fiqh dianggap sudah pari purna, fanatisme bermadhhab ta'assub), melemahnya semangat ijtihad, dan tertutupnya pintu ijtihad. Aktifitas ulama dalam zaman ini antara lain menyusun ringkasan ringkasan kitab (mukhtasar). Di antara kitab mukhtashar ternyata banyak pula yang menimbulkan pertanyaan, maka disusun pula kitab sharhnya (penjelasan). Meskipun demikian tidak menutup mata ada satu atau dua orang yang tetap berfikir dinamis dan kreatif sekalipun mereka berhadapan dengan tantangan tantangan dari para penguasa, yang siap menjebloskan ke dalam penjara karena keteguhan pendiriannya. Di antara ulama yang berupaya mendobrak kebekuan masa ini antara lain: Syaikh al-Islām Ibn Taimiyah (w. 728 H.) dan Ibn Qayyim al-Jauziyah (w. 751 H.).]

Abstract

Understanding of women's fiqh associated with female bleeding (dima' al-mar'ah) is very important to be owned by men especially by women. Syari'ah and Law Faculty’s students are required to understand Shari'ah and law knowledge, one of which is about women's bleeding. However, in the curriculum of study programs in the Faculty of Shari'ah and Law of UINSA no one specifically discussed the matter. Understanding of students related to menstrual blood, childbirth and istihadhah majority is still at the moderate level. They can only define and know the difference in time when the blood comes out. As for the wisdom and legal implications for women who experience bleeding in the implementation of worship, they still do not know and define it. The implications of legal law that they know are only limited to prayer, fasting and carrying, holding and reading the Qur'an. The rest they are still confused or do not know. Of the several factors that influence a person's understanding, there are five main factors that greatly influence students' understanding regarding menstrual blood, childbirth and istihadhah, namely factors of experience, intelligence, gender, education and school environment. Other factors that are age, occupation, socio-culture and economy, and the amount of media information does not affect the students' understanding regarding menstrual blood, childbirth and istihadhah. [Pemahaman tentang fiqh perempuan yang terkait dengan perdarahan perempuan (dima’ al-mar’ah) sangat penting untuk dimiliki, baik oleh laki-laki terutama sekali oleh perempuan. Mahasiswa Fakultas Syari’ah dan Hukum dituntut untuk memahami ilmu syari’ah, salah satunya tentang perdarahan perempuan. Namun, dalam kurikulum prodi-prodi yang ada di Fakultas Syari’ah dan Hukum Universitas Islam Negeri Sunan Ampel Surabaya, tidak ada yang secara spesifik membahas hal tersebut. Pemahaman mahasiswa terkait darah haid, nifas dan istihadhah, mayoritas masih berada pada taraf sedang. Mereka baru dapat mendefinisikan dan mengetahui perbedaan waktu keluarnya darah-darah tersebut, tetapi belum mengetahui dan mendefinisikan hikmah serta implikasi hukum bagi wanita yang mengalami perdarahan tersebut terhadap pelaksanaan ibadah. Implikasi hukum ibadah yang mereka ketahui hanya terbatas pada shalat, puasa dan membawa, memegang serta membaca al-Qur'an. Dari beberapa faktor yang mempengaruhi pamahaman seseorang, ada lima faktor utama yang sangat mempengaruhi pemahaman mahasiswa terkait darah haid, nifas dan istihadhah, yaitu pengalaman, intelegensia, jenis kelamin, pendidikan dan lingkungan sekolah. Faktor lainnya seperti usia, pekerjaan, sosial-budaya dan ekonomi, serta banyaknya media informasi, tidak banyak mempengaruhi pemahaman mahasiswa terkait darah haid, nifas dan istihadhah.]

Abstract

This article is the result of the research on the role of the women's organizations in Sidoarjo in responding to violence against women and children in Sidoarjo. The women's organizations in Sidoarjo referred to in this study are Fatayat of NU Branch Sidoarjo, Muslimat of NU Branch Sidoarjo, Regional Administrators Aisyiyah of Sidoarjo, Student Association of Nahhdlatul Ulama (IPPNU) Branch of Sidoarjo and Nasyi'atul Aisyiyah of Sidoarjo. Domestic violence is any act against a person, especially women, which results in physical, sexual, psychological misery or suffering resulting from neglect of the household, including threats to do illegal acts of deprivation or deprivation of liberty within the household. The results of the study concluded that Fatayat of NU, Muslimat, Aisyiyah, Nasyi'atul Aisyiyah and IPPNU had an important role in participating and handling cases of violence against women and children that occurred in Sidoarjo. They realize that women's organizations must respond to community development and needs. They participated with the government in dealing with victims of violence against women and children in Sidoarjo. The handling of cases of violence against women and children is not only in legal protection, but trauma healing assistance to victims is also done so that victims can return to their activities as before the violence occurred. [Artikel ini merupakan hasil penelitian tentang peran organisasi perempuan Sidoarjo dalam merespon kekerasan terhadap perempuan dan anak di Sidoarjo. Organisasi perempuan di Sidoarjo yang dimaksud dalam penelitian ini adalah Fatayat NU Cabang Sidoarjo, Muslimat NU Cabang Sidoarjo, Pengurus Daerah Aisyiyah Sidoarjo, Ikatan Pelajar Putri Nahhdlatul Ulama’ (IPPNU) Cabang Sidoarjo dan Nasyi’atul Aisyiyah Sidoarjo. Kekerasan rumah tangga adalah setiap perbuatan terhadap seseorang terutama perempuan yang berakibat timbulnya kesengsaraan atau penderitaan secara fisik, seksual, psikologis dan penelantaran rumah tangga termasuk ancaman untuk melakukan perbuatan pemaksaan atau perampasan kemerdekaan secara melawan hukum dalam lingkup rumah tangga. Hasil penelitian menyimpulkan bahwa Fatayat NU, Muslimat NU, Aisyiyah, Nasyi’atul Aisyiyah dan IPPNU mempunyai peran yang penting dalam ikut serta menangani kasus kekerasan terhadap perempuan dan anak yang terjadi di Sidoarjo. Mereka menyadari bahwa organisasi perempuan harus merespon terhadap perkembangan dan kebutuhan masyarakat. Mereka ikut serta bersama pemerintah menangani korban kekerasan terhadap perempuan dan anak yang ada di Sidoarjo. Penanganan kasus kekerasan terhadap perempuan dan anak tidak hanya dalam perlindungan hukum saja, akan tetapi pendampingan trauma healing terhadap korban juga dilakukan agar korban bisa beraktifitas kembali seperti sebelum terjadi kekerasan.]

Abstract

Regent Regulations (Perbup) of Gunungkidul Number 36 Year 2015 Concerning Prevention of Marriage at the Age of Child is a special regulation regarding the efforts, programs, actions, activities used by the government agencies of Gunungkidul Regency in order to prevent and reduce the number of marriages at the age of child. Wonosari Religious Court statistics show a decrease in the number of submissions for marriage dispensations from 2015 to 2017 after the enactment of this regulation. In 2015 there were 109 cases of marriage dispensation, in 2016 there were 85 cases of marriage dispensation, in 2017 there were 65 cases of marriage dispensation. In its implementation, this regulation has benefits because it forms the basis of human life (maslahah dharuriyyah). This regulation has also answered the problems that humans need to eliminate the difficulties they face (maslahah hajiyyah). In addition, this regulation has preserved the wisdom and goodness of manners and social and cultural beauty (maslahah tahsiniyyah). Seen from its implementation, Perbup Gunungkidul Number 36 of 2015 concerning Prevention of Marriage at the Age of Child is in accordance with the principles of problem solving. [Implementasi Perbup Gunungkidul Nomor 36 Tahun 2015 Tentang Pencegahan Perkawinan Pada Usia Anak merupakan peraturan khusus berupa upaya-upaya, program, aksi, kegiatan yang digunakan instansi pemerintahan Kabupaten Gunungkidul dalam rangka mencegah terjadinya perkawinan pada usia anak dan menurunkan angka perkawinan pada usia anak. Peraturan ini memiliki sisi kebaikan dan kemanfaatan dimana peraturan ini memang telah menjadi dasar tegaknya kehidupan asasi manusia (maslahah dharuriyyah), peraturan ini juga telah menjawab persoalan yang dibutuhkan manusia untuk menghilangkan kesulitan dan kesusahan yang dihadapi (maslahah hajiyyah), selain itu peraturan ini telah memelihara kebagusan dan kebaikan budi pekerti serta keindahan sosial budaya (maslahah tahsiniyyah). Sesuai dengan penelitian ini maka Perbup Gunungkidul Nomor 36 Tahun 2015 Tentang Pencegahan Perkawinan Pada Usia Anak telah sesuai dengan prinsip-prinsip maslahah mursalah. Oleh sebab itu, maka disarankan peraturan ini bisa dijadikan percontohan untuk ditiru dan diterapkan oleh daerah di sekitarnya baik secara skala dalam provinsi maupun skala luar provinsi se-Indonesia.]

Abstract

This study explores the interpretation of false dawn (fajr kādhib) and true dawn (fajr ṣādiq) in al-Shāfi’ī fiqh texts through the lenses of hadith and astronomy. It compares classical definitions by al-Rāfi'ī and al-Nawawī with contemporary scientific and hadith-based perspectives. Using documentation and descriptive-critical analysis, the research finds that fajr kādhib is described as vertical light (mustathil) resembling a wolf's tail, appearing briefly and vanishing. In contrast, fajr ṣādiq is horizontal light (mustaṭīr) spreading across the horizon, gradually brightening. From a hadith perspective, this aligns with al-mu'taridh (true dawn) and al-mustathil (false dawn). Astronomically, fajr kādhib matches zodiacal light, which doesn’t disappear, and fajr ṣādiq corresponds to sunlight scattering. Thus, the disappearance of fajr kādhib, as described in classical texts, lacks modern scientific support.
