Abstract

Tulisan ini mencoba mengungkap trasformasi al-islah terhadap keberagaman konflik dengan menganalisis epistemologi hukum Islam dalam al-Qur’an, menggunakan pendekatan teologis normatif, yuridis dan sosiologis. Hukum Islam sangat mengedepankan nilai al-islah dengan melarang tindakan tercela, memelihara perdamaian, harmonisasi dalam masyarakat dan bangsa sebaimana tercantum dalam al-Qur’an. Al-Islah adalah meniadakan setiap konflik dalam hubungan yang rusak.Keadilan dalam al-islah adalah sangat penting ditransformasikan dalam kehidupan berhukum dengan meletakkan hukum Islam sebagai panglima dalammenyelesaikan beragam konflik untuk mewujudkan ketertiban, kepastian hukum dan keadilan.

Abstract

This study aims to explain the contextualization of utility in law and maqasid al-shariah towards the halal lifestyle in Makassar City. The study is field research using a normative juridical approach. Data collection procedures were conducted by observing several malls, drug stores, markets, and restaurants, in-depth interviews with Islamic jurists, and documentation. Data analysis by strengthening the utility theory proposed by Jeremy Bentham and maqasid al-shariah put forward by Abu Ishaq al-Syatibi. The study's findings are that the cultural transformation of the halal lifestyle is a form of commitment by the Muslim community in Makassar City to obeying and implementing Islamic law. The contextualization of utility in law and maqasid al-shariah towards the halal lifestyle is to maintain and safeguard religion, human intellect, and soul (nafs). Following up on the findings in this study, a halal lifestyle culture in Makassar recommends further research to optimize living laws in society and the legal system in laws and regulations.

Abstract

This research analyzes forced marriage's impact in the Campalagian District. Marriage is not just an inner and outer meeting of a man and a woman but is intended to achieve happiness, tranquility, and peace of mind. All humans want a lasting marriage. The method used in this research is empirical normative legal research, the research object of which includes both normative and practical aspects. Normative in this research has positive legal norms and Islamic legal norms. Furthermore, normative legal analysis or Islamic legal norms can be legal norms and legal behavior, and Islamic legal research can be divided into two, namely normative and sociological or empirical. The research results show that: 1) forced marriage in Campalagian District still occurs frequently. From 2019 to 2019, there were 14 cases. 2) The impact of forced marriages in Campalagian District is that they end in divorce and impact family conflict and infidelity.

Abstract

This study aimed to know about the flexibility of women's rights in divorce at Parepare Religious Court and how the judge resolved divorce case. This study was conducted with qualitative research with a focus on case studies, with a juridical, socio-anthropological, philosophical and psychological approach. The results of this study shows; 1) Judge's decision in Case No.171/Pdt.G/2019/PA.Pare is flexible in deciding divorce case. The case of divorce is a reflection of equality and justice in women's rights to law enforcement in the Religious Courts. Divorced as well as eliminating patriarchal culture by placing women as second class; 2) The judge at Religious Court in Parepare can approve in a divorce case for several reasons as follows; disputes and quarrels occur between husband and wife, the husband persecutes and hurts his wife's body, the husband betrays his wife to another woman.

Abstract

The purpose of this study is to reveal that divorce is contested as a result of domestic violence that has exceeded the limit, so that it is considered a crisis and crucial in family problems. There are two problems, namely how the judge considers in making a decision on a contested divorce case, and how to uphold the law and justice in a contested divorce case. Data analysis was carried out using the theory of law enforcement and gender justice, using a socio-anthropological approach. The results show that the consideration of judges in deciding divorce cases as harmonization in law enforcement is that the husband's position in the household. He cannot commit arbitrary acts and physical, psychological, sexual and financial violence, excessive burdens on wives, as the implementation of gender justice. Harmonization of law enforcement and gender justice in divorce cases is realizing and protecting the rights of wives with equal position with husband so they don't continue to be victims of violence, not in a marginal position in the household. This research can be recommended to continue to do research that is more perfect in uncovering cases of divorce due to domestic violence.

Abstract

Praktik nikah muhallil (perkawinan yang bertujuan menghalalkan bekas suami setelah talak tiga) masih menjadi persoalan kontroversial dalam hukum keluarga Islam di Indonesia. Kompilasi Hukum Islam (KHI) sebagai hukum positif yang mengatur perkawinan umat Islam di Indonesia tidak mengatur praktik ini secara tegas, sehingga menimbulkan ketidakpastian hukum dan kesenjangan normatif dengan tujuan luhur syariat (maqashid al-syariah). Artikel ini bertujuan untuk menganalisis status hukum nikah muhallil dalam hukum positif Indonesia, khususnya KHI, serta mengkaji kesenjangan normatif antara KHI dan prinsip maqashid al-syariah. Penelitian ini menggunakan metode hukum normatif dengan pendekatan perundang-undangan, konseptual, dan filosofis. Bahan hukum primer meliputi Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan, Kompilasi Hukum Islam (KHI), literatur fikih klasik empat mazhab, serta Fatwa MUI Nomor 3 Tahun 2021. Bahan hukum sekunder berupa jurnal nasional terakreditasi dan jurnal internasional bereputasi dari sepuluh tahun terakhir. Hasil penelitian menunjukkan bahwa KHI tidak secara tegas melarang nikah muhallil. Pasal 39 KHI hanya mendeskripsikan syarat formil perkawinan setelah talak tiga tanpa mengatur niat di baliknya. Kekosongan hukum ini menyebabkan disparitas putusan hakim dan membuka peluang manipulasi hukum. Lebih lanjut, nikah muhallil bertentangan dengan maqashid al-syariah, terutama perlindungan keturunan (hifzh al-nasl) dan pencegahan kerusakan (dar'u al-mafasid). Kesenjangan antara KHI dan maqashid mengindikasikan bahwa hukum positif Indonesia belum sepenuhnya menginternalisasi nilai-nilai substantif hukum Islam. Kesimpulan menekankan urgensi reformasi hukum untuk secara eksplisit melarang nikah muhallil dan menyelaraskan Kompilasi Hukum Islam dengan prinsip maqashid al-syariah.

Abstract

Child adoption is a form of child protection regulated under Indonesian positive law. However, adoption practices in Parepare City are still predominantly carried out through Bugis-Makassar customary mechanisms based on family agreements without formal legal procedures. This practice may create uncertainty regarding the legal status of adopted children, particularly in matters of inheritance, civil registration, and child rights protection. This study aims to analyze the effectiveness of legal status determination in child adoption and identify the factors influencing its implementation in Parepare City. Employing a normative juridical approach and library research method, the study analyzes statutory regulations, legal literature, and the socio-cultural context of the Bugis-Makassar community. The findings indicate that the effectiveness of legal status determination for child adoption remains low. The main obstacles include procedural complexity, limited public awareness, high administrative costs, and the strong influence of customary norms that are often prioritized over state law. These conditions reflect a gap between legal substance and legal culture. The study proposes the Customary-Legal Harmonization-Based Adoption Model (MPAHA), which emphasizes procedural simplification, financial support, collaborative legal awareness programs, and strengthened post-adoption supervision. This model is expected to enhance legal certainty while preserving the familial values of the Parepare community.

Abstract

Penelitian ini mengkaji implementasi Asta Protas (Delapan Program Prioritas Kementerian Agama 2025–2029) dalam revitalisasi layanan Kantor Urusan Agama (KUA) inklusif, dengan fokus analisis hukum keluarga Islam terhadap bimbingan perkawinan (Bimwin) sebagai upaya mewujudkan keluarga sakinah dan pencegahan perceraian dini. Tujuan penelitian adalah menganalisis strategi implementasi Asta Protas pada layanan KUA, kesesuaiannya dengan maqāṣid al-sharī‘ah, serta implikasi Bimwin inklusif terhadap mitigasi faktor pemicu perceraian pada pasangan muda. Metode penelitian menggunakan pendekatan yuridis normatif dengan elemen empiris, melalui analisis regulasi (KMA No. 244 Tahun 2025 dan peraturan terkait), literatur hukum keluarga Islam, serta data sekunder dari Badan Pusat Statistik, laporan Kemenag, dan studi lapangan. Hasil penelitian menunjukkan bahwa Asta Protas berhasil menggeser paradigma KUA menjadi pusat layanan berdampak melalui digitalisasi, penguatan SDM, dan Bimwin inklusif. Kebijakan ini selaras dengan maslahah mursalah serta maqāṣid al-sharī‘ah (khususnya hifẓ al-nasl dan hifẓ al-nafs), dan Bimwin efektif sebagai instrumen preventif yang membangun resiliensi keluarga pasca-pandemi serta berkontribusi pada tren penurunan angka perceraian. Signifikansi penelitian ini terletak pada kontribusi rekomendasi kebijakan bagi Kemenag dalam penguatan layanan inklusif, pengembangan fiqih munakahat yang adaptif, serta upaya nasional membentuk keluarga maslahat yang berkelanjutan di tengah tantangan sosial kontemporer.c.
