Abstract

ABSTRAK Penelitian ini bertujuan untuk mengetahui faktor-faktor penyebab terjadinya pelanggaran kampanye diluar jadwal dalam Pemilu Legislatif serta upaya-upaya yang dilakukan untuk menanggulanginya. Penelitian ini dilaksanakan di Kantor Kepolisian Daerah SULSELBAR dan Badan Pengawas Pemilu Provinsi Sulawesi Selatan, dengan melakukan wawancara dengan pihak kepolisian yang menangani kasus pelanggaran pemilu legislatif serta Kantor Badan Pengawas Pemilu Provinsi Sulawesi Selatan Berdasarkan analisis terhadap data dan fakta yang didapatkan, dapat disimpulkan bahwa pelanggaran kampanye di luar jadwal bukan sepenuhnya dilakukan oleh caleg yang bersangkutan saja, tetapi terdapat beberapa faktor lain yang menjadi penyebab seperti faktor lokasi, lingkungan, serta upaya-upaya apa saja yang telah dilakukan oleh aparat penegak hukum dan Badan Pengawas Pemilu untuk menanggulangi seperti diadakannya pengawasan berupa pencegahan dan penindakan. Kata Kunci: hukum, pelanggararan, pemilu. ABSTRACT This study aims to determine the factors that cause the occurrence of campaign violations outside the schedule in the Legislative Election as well as efforts made to overcome them. This research was conducted at the SULSELBAR Regional Police Office and the South Sulawesi Provincial Election Supervisory Board, by conducting interviews with the police who handled cases of violations of legislative elections and the South Sulawesi Provincial Election Supervisory Agency Office. Based on the analysis of data and facts obtained, it was concluded that campaign violations out of schedule is not fully carried out by the relevant legislative candidate, but there are several other factors that are causes such as location, environment, and what efforts have been made by law enforcement officials and the Election Supervisory Board to overcome such as the provision of supervision in the form of prevention and prosecution. Abstract

The development of information technology is not only capable of creating a global world but has also developed space for new life for society, namely the life of virtual society. However, it is undeniable that not all internet activities are always positively charged but the internet also has a negative side. Therefore, there must be countermeasures for the negative impacts of information technology that are more effective and preventive in nature. The aims of this research are: 1) To find out the negative impact of mobile internet usage in Indonesia. 2) To find out legal efforts to prevent the negative impact of information technology in Indonesia. 3) To find out the sanctions and regulations that can be used to ensnare perpetrators of mobile internet abuse in Indonesia. This study uses a normative juridical approach. The method used is a qualitative method. The data sources in this study consist of primary, secondary and tertiary. Data analysis was carried out by studying, interpreting the data that had been collected to draw a research conclusion and using a field approach, namely by conducting discussions on internet crime cases. So that a conclusion can be obtained as an answer to the problems discussed in this study.
