Abstract

This research examines the implications of religious moderation on interfaith marriages in the city of Manado. The method used is qualitative with a case study approach; data collection is through observation, interviews, and documentation, which is then processed using the triangulation method. The findings show that religious moderation indirectly influences the sustainability of interfaith marriages in Manado. The implications are realized in the form of religious moderation, which aims to eliminate or minimize violence in the name of religion and uphold diversity through upholding the values of tolerance, thereby increasing guarantees for the continuity of interfaith marriages. These implications become more complex than the laws governing interfaith marriages, especially the Marriage Law (UU Number 16 of 2019) and the Compilation of Islamic Law (KHI). The implications of religious moderation in interfaith marriages underscore the need for legal transformation that recognizes religious diversity as a social asset, encourages interreligious dialogue, and ensures that legal regulations do not hinder individual religious freedom. Encouraging policy reforms that respect differences in beliefs is crucial in creating inclusive spaces and respecting human rights in interfaith marriages.

Abstract

The background of this study highlights significant social changes related to the digitalization of zakat (almsgiving) management, particularly in the context of post-Covid-19 pandemic recovery. The research aimed to examine the digital transformation in zakat management following the pandemic from a maqasid syari'ah perspective. The study employed an empirical legal research approach, with data collected through interviews. Respondents were academics, muzakki, and staff from zakat management organizations (BAZNAS and LAZNAS) in South Kalimantan Province. The interview data were transcribed and analyzed qualitatively using a coding process facilitated by Atlas.ti software, version 8. The findings found that digitalization of zakat management, classified as an element of hajiyyah, serves as a solution to support the fulfillment of Islamic legal obligations, prevent religious violations, provide ease in human life, and expand access to zakat, particularly during the post-pandemic recovery phase.

Abstract

The teachings of Islam and the Indonesian constitution clearly prohibit interfaith marriage. However, some Muslim communities in North Sulawesi as a minority group have entered into interfaith marriages. Therefore, this study aims to analyze the phenomenon of interreligious marriage in North Sulawesi and the achievement of minority fiqh objectives in interfaith families. This research is a field research that uses qualitative methods with a phenomenological approach. Data collection was conducted through interviews with informants consisting of 5 interfaith marriage actors, 1 village official, and 1 religious leader. The results showed that the main motivation for interfaith couples to marry is mutual love. They also tend to get support from their respective extended families so that the marriage runs relatively smoothly and safely. The objectives of minority fiqh are achieved in interfaith marriages in the multicultural society of North Sulawesi. Minority fiqh can be an approach in interfaith marriages in multicultural societies where Muslims are a minority, without losing their Islamic essence, it is based on the fiqh rule that changes in law can occur due to changes in times and places. Minority jurisprudence can be an alternative basis for the sustainability of interfaith families in North Sulawesi that are able to maintain their Islamic identity while still respecting their partner's beliefs.

Abstract

Penelitian ini dilatarbelakangi oleh ketertarikan penulis untuk meneliti apakah masjid-masjid di Kecamatan Lampihong sudah menerapkan peraturan ini dengan tujuan membantu BAZNAS dalam melakukan pengumpulan zakat mengingat sudah lamanya peraturan tersebut disahkan melalui praktik pembentukan kepanitiaan zakat fitrah yang biasa mereka laksanakan. Adapun yang menjadi tujuan dalam penelitian ini adalah untuk mengetahui bagaimana praktik pembentukan kepanitiaan zakat fitrah dan penerapan Pasal 55 Peraturan Pemerintah Nomor 14 Tahun 2014 diterapkan pada masjid-masjid di Kecamatan Lampihong. Jenis penelitian yang digunakan dalam penelitian ini adalah penelitian hukum empiris dengan pendekatan yuridis sosiologis. Hasil penelitian ini menunjukkan dari 13 masjid yang ada di Kecamatan Lampihong, ada 6 masjid yang rutin membentuk kepanitiaan zakat fitrah, adapun praktik kepanitiaan zakat fitrah ini biasanya mereka membentuk satu hari sebelum hari raya Idul Fitri untuk menerima zakat fitrah dari jamaah masjid tersebut, kemudian pada malam harinya akan disalurkan kepada para mustahik di sana, dan 4 masjid dari 6 masjid tersebut sudah terdaftar secara resmi sebagai Unit Pengumpulan Zakat pada KUA Kecamatan Lampihong dan BAZNAS Kabupaten Balangan. Sehingga penulis berpendapat bahwa penerapan Pasal 55 Peraturan Pemerintah Nomor 14 Tahun 2014 dirasa masih belum maksimal, maka perlu dilakukan beberapa penyesuaian dan sinergitas antara BAZNAS Kabupaten Balangan serta para pengurus masjid yang ada di tingkat kecamatan.

Abstract

Abstract: Legal Conflict in Zakat Management in the Prismatic Communities of Kapuas Regency, Central of Kalimantan. This study is aimed at analyzing the legal conflict in the management of zakat (charity) among prismatic communities in Kapuas Regency, Central of Kalimantan. This intersection occurs between Islamic law relating to the management of zakat and the tradition, or customary law held by the local community. This phenomenon gives rise to poly normativism (legal overlap) between formal rules and living traditions in the local community. This research is empirical-normative in nature, using a combination of several approaches, i.e., the empirical, historical, normative, and conceptual approaches. The data were obtained through interviews, documentation, and direct observation of zakat management institutions and community behavior supported by the tradition of local society. The results of the study indicate that there is an intersection between the rules used in the management of zakat and the customary laws that live in a prismatic society in Kapuas Regency. For this reason, it is necessary to make adjustments in the regulation of zakat management while raising public awareness of the importance of optimizing zakat to support the interests of the state, in general, and in particular, for the interests of the local Muslims themselves.

Abstract

Productive zakat in South Kalimantan is still relatively low. This is caused by several factors, such as the lack of public understanding of productive zakat, the lack of innovative productive zakat programs, and weaknesses in productive zakat management. This research aims to understand the role of Ulama and Baznas South Kalimantan in increasing productive zakat in South Kalimantan. This research uses a qualitative approach with a case study method. The results showed that Ulama and Baznas South Kalimantan have an important role in increasing productive zakat. In the division of tasks, principles, and functions, Ulama plays a role in providing education and socialization about productive zakat to the community, while Baznas plays a role in managing and distributing productive zakat to productive mustahiq. Through the involvement and figure of Ulama (Tuan Guru) in the promotion and invitation to give zakat in Baznas South Kalimantan, is one of the factors that cause the increase in the ratio of zakat collection every year which will be explained in more detail in this paper.

Abstract

During the Covid-19 pandemic, zakat played a crucial role in mitigating the community’s economicrisks. Although technological developments have encouraged the emergence of digital zakat paymentplatforms, their adoption in South Kalimantan has been relatively slow. Many zakat payers (muzaki) continue to prefer traditional methods of zakat payment. This study aims to understand the reasons behind this preference by examining muzaki’s perceptions, subjective norms,and attitudes, as well as their relation to the spiritual comfort they experience. Using a qualitative approach,data were collected through in-depth interviews with academics, zakat payers, and staff from Zakat Management Organizations (BAZNAS and LAZNAS) in South Kalimantan. The findings reveal that muzaki’s perceptions of traditional zakat payment are driven by several key factors, including proximity to zakatreceiving institutions, deeply rooted habits, ease of implementation, and negative perceptions of digital zakat methods. Muzaki’s subjective norms regarding zakatare shaped by various sources of knowledge, such as digital media, BAZNAS services, government initiatives,print media, banking institutions, self-initiative, family,religious scholars, digital literacy, and peers. Muzaki’s attitudes in the re-actualization of zakat managementare reflected in efforts to explain zakat payment methods at BAZNAS, provide information about zakat institutions,encourage others to pay zakat, and describe zakat distribution and utilization programs. In addition, the study finds that factors influencing muzaki’s decision to pay zakat directly include the perceived importance of akad (contract) in zakat payment, satisfaction, the use of bank accounts, the lack of legal endorsementand socialization from the Indonesian Ulema Council (MUI), as well as limited communication about zakat digitalization, which leads some muzaki to reject digital zakat payments. Theoretically, these findings reinforce the Theory of Planned Behavior, the concept of maslahah in Islamic economics, and the Spiritual Well-being Theory in explaining the interconnectedness of religious values, culture, and spiritual comfort with muzaki behavior. Practically, the results provide insights for zakat institutions to design digitalization strategies that are sensitive to spiritual and local cultural values,ensuring that technological innovation aligns with the preservation of meaningful religious practices.

Abstract

Dampak pengelolaan wakaf sangatlah besar terhadap pembangunan umat, terutama jika melihat data BWI bulan Januari Tahun 2021 menyebutkan bahwa total wakaf di Indonesia mencapai nilai 180 Triliun Rupiah. Nilai wakaf yang sangat besar ini memerlukan pengelolaan yang benar dan terperinci, sehingga wakaf dapat dimanfaatkan untuk kesejahteraan umat secara optimal. Namun dalam pengelolaan dana wakaf oleh BWI tidak terlepas dari berbagai macam problematika, dalam penelitan ini terangkum pada tiga permasalahan utama yaitu permasalahan dalam perhimpunan wakaf uang, pendayagunaan wakaf uang, dan pendistribusian hasil manfaat wakaf uang. Penelitian ini bertujuan untuk memberikan solusi pada problematika pengelolaan wakaf uang pada perwakilan BWI Kalimantan Selatan. Metode yang digunakan dalam penelitian ini adalah deskriptif kualitatif, dengan jenis field research. Data yang digunakan adalah data primer dan sekunder, data primer yaitu dengan wawancara langsung kepada pihak pengelola wakaf perwakilan BWI Kalimantan Selatan dan data sekunder mengambil dari data yang diterbitkan oleh BWI. Hasil penelitian menjelaskan bahwa BWI Kalimantan Selatan dalam penghimpunan wakaf uang perlu meningkatkan sosialisasi mengenai wakaf uang pada level masyarakat umum dan level pemerintahan, dalam hal pengelolaan wakaf uang di Kalimantan Selatan pihak BWI perlu meningkatkan tingkat kompetensi sebagai nazhir sehingga dana wakaf dapat terus bertumbuh bukan malah berkurang. Adapun dalam permasalahan pendistribusian wakaf, perlu kiranya BWI meningkatkan koordinasi kepada yayasan atau lembaga yang bergerak dibidang sosial, lembaga amil zakat sehingga manfaat dari wakaf dapat terdistribusikan secara optimal.

Abstract

This study describes how sharia siyasah is carried out by Muslims in Indonesia. Of course, it cannot be separated from the history of Islamic law developing and becoming an important part of positive law in Indonesia. Efforts to promote Islamic law have been on the agenda of Muslims throughout history. The regulation on zakat is one of the long journeys of sharia siyasah in Indonesia. In its formation cannot be separated from the debates in the legislature and the executive, which necessarily affect the material in the regulations formed. This research method is qualitative, by conducting library research, using a philosophical approach and a statutory approach. The result of this research is that in the material, zakat regulation tends to follow the renewal of zakat law, by not being shackled to one school but preferring the concepts of takhayur and talfiq. Material on the subject of zakat, the principles of zakat management, mustahik zakat, and the object of zakat is proof that there is takhayur in the selection of zakat law in Indonesia. This is because the discussion in the legislature does not put forward fanatics in one school, and uses the concept of mâ lâ yudraku kulluhu lâ yutraku kulluhu.
