Abstract

development Orientation that more attention to the mainland area needed to be changed in view of the sea is a source of livelihood in the future. Paradigm of development in the marine sector that holds tremendous natural wealth became a chore for the government to restore the glory of this nation as a maritime nation. Especially is to realize Indonesia to the shaft of the maritime world. Indonesian sea contains many diverse resources both renewable such as fisheries, coral reefs, mangrove forests, sea grass, and germplasm and others or resources that are not renewable, such as oil and gas, , mineral, and ocean energy such as waves, wind, and OTEC (Ocean Thermal Energy Conversion) is being developed today. The amount of the economic opportunities of the utilization of marine resources is so large it has been dully contributed greatly to the improvement of the nation's economy, also even it is fitting into the driving sector of the national economy is dominant. But in fact the fisheries and marine sector nationally is still not used optimally, it is shown from the data in plain view that coastal communities are communities closest to the coastal and marine resources is generally still classified as poor or categorized as a people with the welfare of the low , The formulation of his problem is how the utilization of Indonesia's marine wealth in an effort to realize the efforts of Indonesia towards the shaft of the maritime world? There are several factors that led to the use of the sea as a potential powerful nation was neglected among them are weak security, weak supervision, and weak coordination of the country. Actually, Indonesia has a Maritime Surveillance System (maritime surveillance systems) at a military institution whose domain is the sea. Our country needs to have a clear maritime policy and visionary as geopolitical concerns and basic policies on the management of marine resources. Abstract

Indonesia has a vision World Maritime Poros. The government's agenda corresponds with the vision include the construction of a maritime culture, maritime resource management, infrastructure development and connectivity maritime, maritime security and defense diplomacy. Marine resources has great potential for the development of the national economy in order to realize Indonesia as the shaft maritime world, however, the setting and its use should be undertaken with caution in order to avoid destruction of the population, habitat and ecosystem. As a developing country, Indonesia must establish closer cooperation with technologically advanced countries to explore the marine resources. In addition, to realize the ideals of Indonesia as the World Maritime shaft must be able to ensure that safety and security in the sea area a top priority.

Abstract

Always related to the provision granting franchise rights to use and or use of certain intellectual property rights, which in this case embodied in the brand, which covers both trademarks and service marks, or indications of origin (indication of origin) and a specific format, formula, characteristics, methods, procedures, procedures, systems etc. that are typically associated with, and which can not be separated from each output or product that is produced and then sold, delivered or traded by using the trademarks, service marks or indications of origin mentioned above, called a trade secret.The problem is how the legal protection of intellectual property rights for the franchisor (the Franchisor) and Franchisee (the Franchisee) in franchise agreements in Indonesia.Franchise agreements is one aspect of legal protection to the parties of the actions harm others, including in providing legal protection for intellectual property rights. This is because the agreement can be a strong legal basis to enforce legal protections for the parties involved in the franchise system. If either party violates the agreement, then the other party can sue the infringing party in accordance with applicable law. Legal protection of intellectual property rights owned by the Parties to the Franchisor (the franchisor) will be better protected if the Franchise Agreement has been set up specifically on IPR protection, which is a pledge of certain restrictions that must be adhered to by the Franchisee (the franchisee), which directly or not directly intended to protect intellectual property rights of the Parties to the Franchisor (the franchisor). The Franchise Agreement which provides IP protection provisions also set Franchisee shall protect trade secrets provided by the franchisor during the term at least 2 (two) years after the franchise period expires. Franchisee shall maintain the rights and interests as holders of rights to the franchisor's brand. Franchisee is prohibited to run any other business which directly competes with the franchisor during the term of business and franchise and for a period of at least 2 (two) years after the franchise period expires. Intellectual Property Rights in the franchise business is also highly protected by the laws relating to intellectual property rights, namely: Copyright Law, Trademark Law, and the Trade Secrets Act.Key words: Franchise Agreement, Legal Protection.

Abstract

In this research author wants make scientific work on fiduciary crimes, If the debitor which transfers goods or mortgaging goods which is a fiduciary guarantee without permission kreditor then the debitor may be subject to fiduciary crime, this research aims to determine: 1).How the role of investigator at the Demak Police station in cracking down on fiduciary crimes in the jurisdiction of demak2).what are the obstacles of an investigator at the Demak Police station in the investigation of fiduciary crime 3).overcoming obstacles in the investigation of fiduciary crime conducted by the investigator at the Demak Police station in the conduct of fiduciary investigation. Abstract

ABSTRAKPenelitian ini berjudul Efektifitas Penyidikan Pidana Dalam Rangka Pencegahan Gugatan Praperadilan Pada Satuan Reserse Kriminal Polrestabes Semarang. Tujuan Penelitian ini: 1) Untuk mengetahui dan menganalisis Efektifitas Penyidikan Tindak Pidana Dalam Rangka Pencegahan Gugatan Praperadilan Pada Satuan Reserse Kriminal Polrestabes Semarang. 2) Untuk mengetahui dan menganalisis kendala-kendala dan solusi Penyidikan Tindak Pidana Dalam Rangka Pencegahan Gugatan Praperadilan Pada Satuan Reserse Kriminal Polrestabes Semarang.Hasil Penelitian: 1) Peranan praperadilan adalah dalam rangka penegakan aturan yang ada untuk memberi perlindungan terhadap harkat dan martabat manusia agar aparat penegak hukum tidak  sewenang-wenang dalam menjalankan tugasnya. Tidak terlalu berbeda antara fungsi dan  peranan praperadilan. Jika fungsi dari praperadilan adalah sebagai kontrol bagi penegakan hukum atas aparat penegakan hukum itu sendiri untuk melindungi hak-hak dari tersangka atau terdakwa, peranan praperadilan muncul dalam rangka penegakan aturan yang ada untuk melindungi hak dari tersangka. 2) Kendala-kendala yang  dihadapi  polisi  dalam  menghormati  hak tersangka sangat bervariasi seperti faktor pengalaman kerja lapangan (menyidik), tersangka yang benar-benar sakit ataupun yang pura-pura sakit. Itu merupakan kendala paling berat yang dihadapi polisi, karena tersangka yang pura-pura sakit ataupun yang benar-benar sakit, itu sangat menguras tenaga seorang polisi. Kendala lain adalah tersangka yang tidak mengakui melakukan tindak pidana. Kendala ini tidak begitu berat karena polisi tidak perlu memaksa seorang tersangka untuk mengakui kesalahannya, polisi hanya perlu mengumpulkan bukti-bukti sesuai Pasal 184 KUHAP. Ada juga kendala yaitu tersangka yang mempunyai cacat fisik. Dari kendala ini, polisi memerlukan bantuan dari seorang ahli untuk bisa mendapatkan keterangan dari tersangka tersebut.Kata Kunci : Efektifitas Penyidikan, Tindak Pidana, Gugatan Praperadilan. ABSTRACTThis study entitled Effectiveness of Criminal Investigation in Prevention of Pretrial Claim In Criminal Investigation Unit of Polrestabes Semarang. The purpose of this study: 1) To know and analyze the Effectiveness of Criminal Investigation in Prevention of Pretrial Claims In Criminal Investigation Unit Polrestabes Semarang. 2) To know and analyze the constraints and solutions of Criminal Investigation in Prevention of Pretrial Claims in Criminal Investigation Unit of Polrestabes Semarang.Research Result: 1) Pretrial role is in the framework of enforcement of existing rules to provide protection to the dignity and human dignity so that law enforcement officers are not arbitrary in carrying out their duties. Not too different between the function and role of pretrial. If the function of pre-trial is as a control for law enforcement of the law enforcement apparatus itself to protect the rights of suspects or defendants, the role of pretrial arises in the context of enforcing existing rules to protect the rights of suspects. 2) The obstacles faced by the police in respecting the rights of suspects vary widely as factors of field work experience (investigation), a sick or sickly suspect. It is the most serious obstacle facing the police, because the suspect is ill-treated or really sick, it is very draining of a cop. Another obstacle is a suspect who does not recognize committing a crime. This obstacle is not so heavy because the police do not have to force a suspect to admit his mistake, the police only need to collect evidence according to Article 184 KUHAP. There are also constraints that the suspect has a physical disability. Abstract

Indonesia is a God-given country and has a philosophy of the Godhead, therefore realizing the peace of religious life is a legal interest as well as public interest that is duly protected. Thus the legal protection of the existence of legal interest for every citizen, then the provisions on blasphemy of religion should be regulated and protected in criminal law. Based on the above ideas then it can be formulated some problems that is how the current criminal law formulation policy in an effort to overcome religious blasphemy. And what is the future criminal law formulation policy towards the prevention of religious blasphemy in the framework of reform of criminal law in Indonesia. This research is analytical descriptive research with normative juridical approach. The data used are secondary data in the form of primary legal materials, secondary legal materials, tertiary law materials hence data collection techniques used are literature study and documentary of secondary data that has been analyzed. From the result of the research, it can be concluded that the current criminal law used in the effort to overcome the blasphemy is the Criminal Code (KUHP) but contains some weaknesses in the substance of the regulation ie blasphemy is categorized as a crime against public order and there is disharmony between status and explanation staining with text or staining formulation. The effort to overcome the blasphemy of religion in the concept of KUHP 2005 is formulated as a crime against religion and related to religion or to religious life. The upcoming criminal law formulation which specifically regulates the blasphemy of religion should be formulated by considering the integration of religious blasphemy in the concept of the Indonesian Criminal Code 2005 by considering the following matters: 1) the harmonization of material / substance of crime, 2) formulation policy of criminal responsibility, and 3) formulation policy of criminal system and punishment. Keywords: Formulation Policy, Desecration Of Religion, Legal Perspective

Abstract

ABSTRAKPenyediaan pangan harus memenuhi kebutuhan gizi, keamanan pangan dan terjangkau seluruh individu setiap saat. Jurnal ini mendiskusikan  kebijakan  Pemerintah Daerah Kabupaten Jepara terkait Bahan Tambahan Pangan Jajanan Anak Sekolah menurut Permenkes No. 033 Tahun 2012. Penelitian ini menggunakan metode kualitatif dan penelitian hukum normatif. Hasil Penelitiannya adalah Kebijakan Pemerintah Daerah Kabupaten Jepara tertuang dalam Rencana Strategis (Renstra) yaitu Pembinaan dan Pengawasan Makanan Di Lingkungan Sekolah. Dalam hal ini, kebijakan yang dibuat adalah Subtantive and Procedural Policies. Kebijakan pemerintah dalam Permenkes Nomor 33 Tahun 2012, telah mengatur penetapan persyaratan BTP secara terperinci dan menyeluruh. Perlindungan hukum yang diberikan hanya sebatas pengawasan dan pembinaan terhadap anak-anak sekolah, pihak sekolah, dan pedagang di sekolah yang bersangkutan.Kata Kunci : Kebijakan Daerah, Bahan Tambahan Pangan, Perlindungan Hukum.ABSTRACTSThe provision of food should meet the nutritional, food security and affordable needs of all individuals at all times. This research was discused the policy of Jepara’s Government related to Food Additives Snack of School Children according to the Regulation of the Minister of  Health No. 33 of 2012. This research was conducted using qualitative method. The result of the research are The policy of Jepara’s Government is contained in the Strategic Plan (Renstra)  was the Development and Supervision of Food in School Environment. In this case, the policy made is the Subtantive Policy and Procedural Policies. Government policy in the Regulation of the Minister of Health No. 33 of 2012, has set the determination of BTP requirements in detail and thorough. Legal protection provided is limited to supervision and coaching of school children, school staffs and traders.Key words: Policy, food additives, and Legal Protection.

Abstract

Economic activity in the entire world with the existence of existence is increasingly dependent telematic technology. The development of Information technology giving influence on the validity of contracts in electronic commerce (E-Commerce) in the era of globalization and the what’s factors constraints on the validity of contracts in electronic commerce (E-Commerce) in the era of globalization. Article 1320 Civil Code is the principal instrument to test the validity of contracts made by the parties. Article 1320 Civil Code there are four legal conditions of contract, namely: agreements, the ability to create engagement, a certain thing, and a lawful reason. Abstract

Writing is entitled "Rehabilitation Policy Against Narcotics Users As A Study Of Act Number 35 Of 2009 Concerning Narcotics". Based on the description in this thesis, that will be examined are: 1). How social rehabilitation program policies towards drug users that have been set by the Act Number 35 of 2009 on narcotics? 2). How social rehabilitation constraints against drug users and measures taken to address them? 3). How social rehabilitation program policies against drug users in the future from the study of Act Number 35 of 2009 on narcotics? The study concluded that: 1). Seeing the criminal provisions of Article 127 paragraph (2) and (3), it can be concluded that the judge in deciding the case mentioned in Article 127 paragraph (1) is obliged to pay attention to clauses governing the provision of rehabilitation so that later addicts and victims abusers of narcotics can The rehabilitation of both medical rehabilitation and social rehabilitation and no longer subject to imprisonment or imprisonment for rehabilitation is counted as time serving his sentence. 2). Constraints that come from this government by mentioning that there are five (5) constraints, namely: there is no stipulation of a special place for addicts and victims of abusers of narcotics for the rehabilitation, rehabilitation cost problem for convicted drug abuse, no rehab appointed by the Government, the differences between the testimony of the defendant, witnesses and Criminal laboratory results, there is a problem of execution. While the solution of the problems are: Need to immediately set a special place for addicts and victims of drug abuse for the rehabilitation, the Government should have the extra funds to finance all decisions rehabilitation for victims of substance abuse, the Government should have the scale of priority to the problem of rehabilitation, Investigator and the authorities in handling should be more careful in handling the problem of drug abuse and have proof of accurate, execution issue should be considered from the extent of the offense. 3). Abstract

The problem of this research is what strategies do for Boosting Regional Income Tax By Sector as well as what are the constraints and solutions in practice the tax collection. The method used in this study is a sociological juridical approach, in this case the authors emphasize research aimed at obtaining legal knowledge empirically by going directly to the field to see the condition of the actual tax collection practices.Based on the results of this study concluded that to streamline the management of taxes, some of the steps taken, among others, in addition to institutional changes also include improvements in the quality of human resources, with more technical personnel engage in structural and functional training. Meanwhile provided at taxpayer administer tax (especially payment) then checkouts cultivated close as possible to the location of taxes. Measures that have been done partly by making payments at BRI every district office, or can be deposited directly to the official tax collector. Obstacles encountered include the tax system is not maximized and necessary repairs, because it is still limited to the tax are estimated to have less control levels, whereas other tax sector is still using the old system (eg street lighting tax). The advice can be given in this study included the need for rigor in the implementation of tax legislation, this condition is manifested in the existence of a compromise in the tax collection system. In addition to the limited human resources, it is necessary to find a way out as soon as possible, whether fixed using existing human resources, cooperation with third parties in collecting taxes or empowering the village and district level personnel during the tax collection, especially for taxes routine. HR management is urgently needed, because given that if the tax levy can be optimally then tax receipts will always increase every year which will impact on the development of a local maximum.Keywords: Taxes; Autonomous Region; Local Revenue.
