Abstract

The purpose of this study was to determine: 1) The legal force under hand deed that has been approved by Notary as proof of the authentic deed in civil cases in District Court of Cirebon 2) The weakness of the legal strength under hand deed that has been approved by Notary as proof of the authentic deed in civil cases in District Court of CirebonThe approach used in this paper is empirical juridical with the help of primary data or empirical data as the main data. Sources of primary data obtained through interviews, while secondary data obtained rehabilitated and reconstructed by literature. Data analysis techniques with descriptive analysis.The final conclusion is:1.) The legal force under hand deed that has been approved by Notary as proof of the authentic deed in a civil case in court is not the same strength as the authentic deed, but the under hand deed could be evidence in a civil case in court, and the strength of the deed under hand legalized (legalization) Notary Having strength in numbers, the date, and the certainty of the signature of the parties. Under hand deed strength will be strong ruling legalizing if a Notary was brought to trial a witness to the truth of the deed under his hand legalized. 2) The weakness of the under hand deed, and that, if someone in the under hand deed does not admit the truth of the under hand deed strength is lost, but with the legalization of under hand deed can have the strength law even not same as authentic deed which has the perfect law strength.Keywords : Deed under hand; Legalization; and Strength of evidence.

Abstract

The purpose of this study was to: 1) to assess and analyze the implementation of nullification and cancellation Deed in the perspective of Act No. 2 of 2014 concerning Notary, 2) to assess the implications of the law, and 3) to identify and analyze the barriers and solutions regarding nullification and cancellation of the Deed. The data used in this study are primary data, secondary data, and data that can uphold tertiary study, which was then analyzed by descriptive analytic method.Based on the results of data analysis can be concluded that: 1) notarial deed nullification and cancellation can occur for non-fulfillment of objective conditions; terpenuhiya not subjective terms of a contract, and can be canceled by the parties themselves. 2) The legal implications as a result of nullification and cancellation Deed is a notarial deed which can be canceled by the parties themselves, the notarial deed null and void, the notarial deed only has the strength of evidence deed under hand. 3) Obstacles and solutions that not all Notaries know and understand the terms of authenticity, validity and causes nullification and cancellation of a notarial deed. Notaries who do not understand the need to study the causes nullification and cancellation deed refers mainly to provisions UUJN and the Civil Code.Keywords: Deed; Nullification and Cancellation.

Abstract

Research on the role of the notary in the establishment of a Foreign Investment Limited Company (PMA) in Semarang aims to determine the role of a notary in the establishment PT.PMA. The research method is normative with library research and regulatory legislation in the field of investment include field research. This study uses a technique of direct communication with the tool in the form of interview guidelines. Interviews are used is free unstructured but questions that do not come out of the subject matter. Based on the results of the study concluded that the role of the notary in the establishment of PT. PMA is based on Act No. 25 of 2007 on Investment in Semarang are procedures that should be implemented is the submission of PMA addressed to the Investment Coordinating Board (BKPM), with regard to this case, the task of the notary help the government provide legal counseling for the parties to the establishment, make Joint Venture Agreement in accordance with applicable legislation and in charge of manufacture of a limited liability company's certificate of incorporation approved by the Minister of Justice and Human Rights of the Republic of Indonesia. In the event of an error PT.PMA establishment, the notary is responsible for the deed change, but the responsibility of the notary in the case of the fraud perpetrated by the founder of the company who act in bad faith, then it becomes the responsibility of the founders of the company. Constraints faced by thebusiness licensing constraints, constraints business domicile, the determination of business areas, administrative requirements and constraints lack of capital to start build a company.Keywords: Role of the Notary; Foreign Investment; Limited Company.

Abstract

The purpose of this study was to: 1) To know and analyze the role of the Notary / PPAT in deed and deed granting the credit agreement Mortgage in Regional Development Bank (BPD) Branch Slawi, Tegal. 2) To determine and analyze the role of the Notary / PPAT in manufacturing Manufacture Giving Credit Agreement and the Deed of Guarantee Rights at the National Land Agency (BPN) Tegal. 3) What are the obstacles and solutions Notary / PPAT in manufacturing Manufacture Giving Credit Agreement and the Deed of Guarantee Rights at the National Land Agency (BPN) Tegal. The data used in this study are primary data, secondary data and data tertiary to support the assessment, which was then analyzed qualitative descriptive method.Based on this study showed that the implementation of the provision of credit at PT. Bank Central Java Slawi, Tegal Branch conducted through five stages: stage of credit application, credit analysis, credit decision, the stage of manufacture of the credit agreement and the binding phase of credit with credit guarantees, loan agreements executed before Notary as a partner is obliged to check the validity of the guarantee Mortgage.Notary PPAT role in the loan agreement with collateral Mortgage provides legal certainty for the parties to the credit agreement.challenges and solutions faced by the Notary in conducting the manufacture of credit with security rights that is located on the non-disciplinary debtor Bank in the administration of the application for credit and the absence of the debtor or the bank on the signing of the Deed of Credit Agreement, the Deed of credit agreements already prepared draft by the banks (creditor) that it is unfair or detrimental to the customer (debtor), then often the banks (creditors) are not present in deed signatories.Keywords: The Role Of The Notary; Mortgage Guarantee; BPD.

Abstract

Indonesian agricultural is in changing times in this era, the potential is still carrying out the manufacture of leases of agricultural land and businesses for agricultural crops is still supported by extensive farmland and irrigation as well as the notary's role in the making of a legal entity farmer groups. The purpose of research is to know and analyze the role of the notary in the manufacture of leases of agricultural land and land revenue sharing farming business. Identify and analyze the impact of what happens if there is a dispute in the lease agreement of agricultural land and businesses for agricultural land in the district of Mojolaban Sukoharjo. The result in this research has been done on the role of the notary in the manufacture of leases farmland and effort for the results of agricultural land, agricultural land lease do-written by hand while sharing agreements of farmland and new notaries role in the making a legal entity that is useful to the farmer groups laden capital receipts of the central government.Keywords: Role of the Notary; Rental Agreement; Profit and Sharing Agreement.

Abstract

ABSTRAKHasil penelitian ini menunjukkan bahwa Pelaksanaan tugas pengawasan jabatan notaris oleh Majelis Pengawas Daerah Kabupaten Sleman mengacu pada Pasal 1 ayat 5 Permen nomor M.02.PR.08.10 tahun 2004 bahwa pengawasan sebagai kegiatan yang bersifat preventif dan kuratif. Kegiatan preventif meliputi kewenangan yang bersifat administratif, sedangkan yang bersifat kuratif adalah kegiatan tentang pengambilan tindakan terhadap dugaan pelanggaran yang dilakukan oleh notaris terhadap UUJN dan kode etik. Hambatan-hambatan dan solusi pelaksanaan tugas pengawasan jabatan notaris oleh Majelis Pengawas Daerah Kabupaten Sleman yang bersifat intern meliputi: anggaran yang minim,sarana penunjang yang terbatas dan kesibukan masing-masing pengurus. lalu yang bersifat ekstern adalah jumlah notaris yang banyak sejumlah 180 notaris, protokol notaris yang tidak tertata rapi, paradigma yang keliru oleh Notaris tentang jabatan notaris sebagai pengusaha akta. Solusi dengan menambah anggaran melengkapi sarana prasarana, sosialisasi, seminar dan rapatSaran kepada MPD untuk meningkatkan pengawasan terhadap Notaris dengan melakukan pemeriksaan rutin secara teratur dan disiplin. Pemberian sanksi terhadap notaris harus diterapkan dan dijalankan dengan benar dan tegas.Kata Kunci : Majelis Pengawas Daerah, Notaris, PengawasanABSTRACTThe results of this study indicate that The implementation of supervisory duties of a notary by the Regional Supervisory Board of Sleman Regency refers to Article 1 paragraph 5 of Candidate number M.02.PR.08.10 in 2004 that supervision as activities that are preventive and curative. Preventive activities include administrative authority, while curative is an activity of taking action against alleged violations committed by notary to UUJN and code of ethics. 2. Obstacles and solutions for the implementation of supervisory duties of notary public by the Regional Supervisory Board of Sleman Regency that are internal include: minimal budget, limited supporting facilities and busyness of each board. then the extern is the number of notaries that many a number of 180 notaries, notary protocols that are not neatly arranged, a paradigm that is not mistaken by notaries about the notary's position as a businessman deed. Solutions by adding budget to equip infrastructure, socialization, seminars and meetingsSuggestion to MPD to increase oversight of Notary by conducting routine inspection regularly and discipline. Abstract

Hak Tanggungan adalah Hak Jaminan yang dibebankan pada hak atas tanah sebagaimana dimaksud dalam Undang-undang Nomor 5 Tahun 1960 Tentang Peraturan dasar Pokok-Pokok Agraria, berikut atas benda-benda lain yang merupakan satu kesatuan dengan tanah itu, untuk pelunasan utang tertentu, yang memberikan kedudukan yang diutamakan kepada kreditor tertentu terhadap kreditor-kreditor lainnya.Terhadap Pemasangan Hak Tanggungan masih ada yang menggunakan Nama Sertifikat Hak Milik yang telah Meninggal Dunia. Disinilah Peran Pejabat Pembuat Akta Tanah berlaku.Tujuan dilaksanakannya Penelitian ini karena untuk mengetahui Peran Pejabat Pembuat Akta Tanah terhadap Pemasangan Hak Tanggungan dengan Nama Sertifikat Hak Milik yang telah Meninggal Dunia yang dilakukan proses Turun Waris kepada Ahli Waris Berbasis Keadilan, Problematika Peran Pejabat Pembuat Akta Tanah terhadap Pemasangan Hak Tanggungan dengan Nama Sertifikat Hak Milik yang telah Meninggal Dunia yang dilakukan proses Turun Waris kepada Ahli Waris Berbasis Keadilan, dan Cara mengatasi Problematika Peran Pejabat Pembuat Akta Tanah terhadap Pemasangan Hak Tanggungan dengan Nama Sertifikat Hak Milik yang telah Meninggal Dunia yang dilakukan proses Turun Waris kepada Ahli Waris Berbasis Keadilan.Penelitian ini menggunakan metode pendekatan yuridis normative, dalam pengumpulan data lebih ditekankan pada penguraian dan penafsiran data-data yang dikaitkan dengan kaidah-kaidah hukum, yakni berupa peraturan perundang-undangan, menelaah kaidah-kaidah hukum maupun teori ilmu hukum serta di tambah dengan wawancara kepada para pihak yang terkait dengan masalah yang di teliti.Berdasarkan hasil penelitian yang penulis lakukan, maka diperoleh hasil sebagai berikut : Peran Pejabat Pembuat Akta Tanah terhadap Pemasangan Hak Tanggungan dengan Nama Sertifikat Hak Milik yang telah Meninggal Dunia yang dilakukan proses Turun Waris kepada Ahli Waris Berbasis Keadilan, Problematika dan Cara Mengatasi Problematikan Peran Pejabat Pembuat Akta Tanah terhadap Pemasangan Hak Tanggungan dengan Nama Sertifikat Hak Milik yang telah Meninggal Dunia yang dilakukan proses Turun Waris kepada Ahli Waris Berbasis.Kata  kunci :  Pejabat Pembuat Akta Tanah, Hak Tanggungan, Sertifikat hak Milik, Turun Waris

Abstract

Notary deed can be canceled and void by law because of an error when a deed is contrary to the Act either intentionally or unintentionally by the parties who made it. Deed can be canceled, remain valid and binding as long as there has been no judicial decisions have permanent legal force canceling the deed. Unlike the deed can be canceled due to the manufacturing process does not satisfy the subjective element as set forth in Article 1320 paragraph (1) and (2) of the Civil Code. Deed null and void occurs due to the mechanism of making abuse substance UUJN Regarding the authority of notary in making authentic act and Article 1320 paragraph (3) and (4) of the Civil Code which is the objective conditions in performing an agreement, which is about a certain thing and the cause or causes of the allowed. In UUJN that as a notary in running his offense is proven, the notary must responsibility by way of sanction or sanctions, in the form of civil sanctions, administrative sanctions, criminal sanctions, the code of conduct or a combination of office notary witnesses. In Article 84 UUJN which reads: Actions violations committed by the notary of the provisions referred to in Article 16 paragraph (1) letter i, Article 16 paragraph (1) letter k, Article 41, Article 44, Article 48, Article 49, Article 50 Article 51 or Article 52 that resulted in a deed only has the strength of evidence as the deed under the hand or a certificate becomes null and void may be the reason for the injured party to demand reimbursement of losses, damages, and interest to the notary.Keywords: Notary Deed, Canceled, Cancel By The Law, Responsibility, Notary.

Abstract

SPA is a preliminary agreement on the sale and purchase agreement whose existence is recognized by Law No 1 of 2011 on Housing and Settlement (as lex), an agreement of this kind can be allocated to the object of the agreement in the form of fixed objects. The journal aims to determine: 1) Mechanism Creation Act Sale and Purchase Agreement (SPA) by the Public in the process of transfer of rights on the ground. 2) As a result of the Law of Sale and Purchase Agreement (SPA) as an Agreement.The method of this journal Sociological Juridical approach. Data were collected from literature research and field research. Data collection tool is the study of literature and interviews. Data was analyzed using qualitative approach by using inductive-deductive logic thinking.The results showed that: 1) Making mechanism Sale and Purchase Agreement (SPA) by the Public in the transition process of land rights by submitting the data themselves form: ID, KK, Certificate etc. From the data obtained all the documents submitted Copied accordance with the original, which will be attached to the Minutes of Deed Sale and Purchase Agreement (SPA) 2) The legal consequences of the Sale and Purchase Agreement (SPA) as a preliminary agreement (voor overeenkomst) is binding on the party who made it, where the parties both sellers and prospective buyers agreed to purchase land and buildings.Keywords: Transition on Land; Sale; SPA.

Abstract

ABSTRAK Notaris adalah pejabat umum yang berwenang untuk membuat akta otentik dan kewenangan lainnya sebagaimanadimaksud dalam Undang-Undang Jabatan Nomor 2 Tahun 2014 Tentang Jabatan Notaris. Seorang Notaris dituntut untuk bersikap profesional dalam menjalankan jabatannya dengan mengindahkan larangan-larangan yang terdeapat dalam ketentuan yang mengatur mengenai jabatan Notaris tersebut. Dalam dunia bisnis dan perekonomian tidak dapat dipungkiri kemungkinan akan timbulnya sengketa dan perselisihan antara para pihak. Maka dikenal suatu cara lain yang memberikan kemungkinan bagi para pihak yang bersengketa untuk membawa dan menyelesaikan perkara yang timbul di luar jalur kekuasaan pengadilan apabila mereka menghendakinya, yaitu melalui arbitrase. Untuk penyelesaian perkara yang diajukan kepada Arbiter diselesaikan oleh Arbiter. Dalam Notaris merangkap jabatan sebagai Arbiter juga tida dapat lepas dari ketentuan dalam Undang-Undang Nomor 30 tahun 1999 tentang Arbitrase dan Alternatif Penyelesaian Sengketa. Dalam Peraturan yang mengatur mengenai Jabatan Notaris dan peraturan mengenai Arbitrase tidak terdapat Larangan untuk Notaris merangkap jabatan sebagai arbiter. Menurut penulis seorang Notaris yang akan merangkap jabatan senagai arbiter tidak dilarang, karena pada dasarnya kedua jabatan tersebut memilik persamaan anatara lain sama-sama berfungsi untuk menghindari terjadinya sengketa yang lebih jauh anatara para pihak, hanaya saja notaris bersangkutan perlu dengan bijaksana mengatur mekanisme kerjanya dan waktu yang akan digunakan akibat rangkap jabatannya tersebut. Notaris juga perlu memperhatikan kaidah hukum mana yang mengikatnya ketika menjalankan salah satu dari rangkap jabatannya tersebut. Sehingga dapat dicapai suatu keseimbangan dalam menjalankan rangkap jabatan tersebut. Metode penulisan yang digunakan adalah metode penelitian hukum Normatif dan data yang digunakan adalah data primer, data sekunder, dan tertier. Dalam pengolahan data digunakan metode kualitatif.Kata Kunci : Notaris Merangkap Jabatan Sebagai ArbiterABSTARCTNotary are public officials who are authorized to make an authentic deed and other authoroties referred to in the Notary Act No 30 Of 2004. A Notary had to act professional in doing their position, they also had to take attentions to the restrictions where set on the Notary Act. In terms of business and the economy will not be denied the possibility of the emergence of disputes and disputes between the parties. Then known another way that gives the possibility for the parties to the dispute to bring and resolves a case arising out of judicial power lines if they so desire, through arbitration. For the prposed settlement to be completed by the Arbitrators. Also for Notary that had a dual position as an Arbitrator can not be separated from the provisions of Act Number 30 of 1999 on Arbitration and Alternative Dispute Resolution. The Regulation governing the Notary who also become an Arbitrator. According to the author, a Notary who also become an Arbitrator is not prohibited, because basicallt these two position have in common, among others equally serve to avoid further disputes between the parties, but the revelent notary needs to prudently manage its mechanism of action and time that will be used due to the dual position. Notary should also pay attention to legal rules which blind when running one of these dual position. So that it can achieve a balance when running that dual position. Writing method used is a normative legal research methods and data used are primary data, secondary, and tertiary. In processing the data used qualitative methods.Keyword : Notary In Dual Position
