Abstract

Tujuan penelitian adalah untuk menganalisis Peran Pemerintah, hambatan-hambatan serta solusi dalam Pengembangan Koperasi Modern dan UMKM Berdasarkan PP No. 7 Tahun 2021. Metode Penelitan adalah yuridis empiris. Hasil penelitian didapat bahwa dengan adanya UU Cipta Kerja yang dijabarkan dalam PP No. 7 Tahun 2021 bagi koperasi dan UMKM, secara subtansi bertujuan untuk kemudahan dan efisiensi biaya dalam pendirian koperasi, mendorong koperasi melakukan modernisasi dan digitalisasi, pemenuhan kebutuhan masyarakat dalam melaksanakan kegiatan koperasi berdasarkan prinsip syariah, menciptakan dan menumbuhkan wirausaha baru, integrasi UMKM dalam Global Value Chain, serta mendorong UMKM naik kelas. Adapun bentuk kemudahan dan penyederhanaan yang diberikan berupa Keringanan biaya Perizinan Berusaha, Pembiayaan dan penjaminan bagi UMKM, Pemberian insentif kepada Usaha Besar dan Menengah, UMK diberi kemudahan/penyederhanaan administrasi perpajakan, pendaftaran dan pembiayaan Hak Kekayaan Intelektual (HKI), Pembebasan biaya untuk mendapatkan Sertifikasi Halal, Pemerintah pusat mengalokasikan Dana Alokasi Khusus (DAK), Penyediaan tempat promosi bagi UMK di infrastruktur publik, dan Penyediaan layanan bantuan dan pendampingan hukum. Hambatan-hambatan bagi UMKM dan Koperasi untuk dapat berkembang antara lain Tingkat produktivitas rendah, Rendahnya kualitas operasional organisasi, UMKM yang beroperasi sesuai dengan peraturan hukum yang terkait masih sangat sedikit, Rendahnya kualitas koperasi, Iklim usaha yang tidak kondusif, dan banyaknya UMKM yang tidak berbentuk usaha formal. Solusinya adalah perlunya sosialisasi dan pemahaman terhadap UMKM dan Koperasi agar dapat bersaing.

Abstract

The establishment of the Consumer Dispute Settlement Agency (here and after, we will use the acronym BPSK) is to protect consumers and entrepreneurs by designing a Consumer Protection system that contains legal certainty and transparency. The purpose of this study was to determine the procedure for resolving consumer disputes through BPSK. This research uses doctrinal and non-doctrinal approaches. The result of the research is that the procedure for resolving consumer disputes carried out by BPSK is through 2 (two) processes or paths that must be passed if consumers want to resolve consumer disputes with business actors, namely: Dispute Resolution outside the court, namely the process of making a complaint or claim for losses carried out by business actors to BPSK or Non-Governmental Consumer Protection Agency (LPKSM). From these complaints, BPSK is obliged to issue a decision no later than 21 (twenty-one) working days after the claim is received and Dispute Settlement Through the court, namely the process Consumers who feel aggrieved report to the authorities, namely to the police for follow-up as in the dispute resolution process in court. There are 3 (three) ways to settle consumer disputes, namely conciliation, arbitration, and mediation.

Abstract

The purpose of this study was to identify and analyze the role of the notary honorary council in the confiscation of the minutes of deed by the Southeast Sulawesi regional police investigators. And to find out and analyze the process of examining a criminal case allegedly carried out by a notary with the offense of entering false information in an authentic deed. The research method usedis a sociological juridical method. The sociological juridical research method is legal research that uses secondary data as initial data which is then continued with primary data in the field or on the community, examines the effectiveness of a ministerial regulation and research that wants to find a relationship (correlation) between various symptoms or variables, as a data collection tool consists of from the study of documents or library materials and interviews. The results of this study found that: first, the Regional Notary Honorary Council from the results of the examination by the examining council could not give approval for the confiscation of the minutes of the notary deed but gave permission to the investigator to take a photocopy of the minutes of the notary deed. Second, from the results of the examination by the examining board, there was also no offense of entering false information into the minutes of the deed. Even from the results of the examination it was also found that the complainant did not question the contents of the deed, but what was questioned was his absence at the General Meeting of Shareholders (GMS), and in the minutes of the GMS there was the signature of the reporter which indicated that the reporter was present at the GMS and the Reporting Party itself was also present.

Abstract

This research aims to know e-commerce systems, sellers and buyers do not meet in person, but meet in cyberspace with the goods to be transacted usually displayed in the catalog. This kind of transaction is actually quite profitable for both buyers and sellers. Although e-commerce has spread throughout the world, there are still many Muslims who do not know the status of their online buying and selling transactions from the perspective of Islamic law. The approach method used in this research is normative juridical. The e-commerce transactions as a new business trend in this modern economic era, are not an economic activity that is prohibited by Islamic law. The conclusion, the benefit of consumers, it can be seen in Act No. 8 of 1999 concerning Consumer Protection by providing administrative sanctions against the seller/business actor if he commits certain actions that are not in accordance with the provisions stipulated in the Act

Abstract

Penelitian ini, berjudul Perlindungan Hukum Bagi Tenaga Kesehatan Di Rumah Sakit Islam GigiDan Mulut Sultan Agung Semarang Pada Masa Pandemi Covid-19, penelitian ini bertujuanUntuk mengetahui Perlindungan Hukum bagi Tenaga Kesehatan di Rumah Sakit Islam Gigi danMulut Sultan Agung Semarang pada masa pandemi Covid-19 serta untuk mengetahui kendaladan solusi dalam Perlindungan Hukum bagi Tenaga Kesehatan di Ruma Sakit Islam Gigi danMulut Sultan Agung Semarang pada masa pandemi Covid-19Metode penelitian menggunakan pendekatan yuridis sosiologis.Sumber data diperoleh daribeberapa tahapan yaitu melalui penelitian lapangan (wawancara) dan penelitian pustaka.analisis data dengan cara sistematis melipui reduksi data, penyajian Data serta penarikankesimpulan.Berdasarkan hasil penelitian dapat ditarik kesimpulan bahwa Perlindungan Hukum bagi TenagaKesehatan di Rumah Sakit Islam Gigi dan Mulut Sultan Agung Semarang pada masa pandemiCovid-19 yaitu terdiri dari upaya perlindungan preventif dan upaya perlindugan represif. Dalamupayaperlindungan preventif, Tenaga kesehatan telah mendapatkan jaminan keselamatan kerjaberupa perolehan APD lengkap dan juga pemberian Vaksinasi. Dalam upaya perlindunganrepresif, Pemerintahtelah memberikan insentif dan santunan kematian kepada tenaga kesehatan.Sedangkan kendala dan solusi dalam Perlindungan Hukum bagi Tenaga Kesehatan di RumahSakit Islam Gigi dan Mulut SultanAgung Semarang pada masa pandemi Covid-19, kendala yangterjadi adalah adanya Kelangkaan APD solusi yang diberikan yaitu memaksimalkan APD yangada serta melakukan pengajuan kepada pemerintah agar memperbanyak supply dari APDtersebut, kendala selanjutnya adalah pemberian insentif yang berbelit-belit solusinya adalahmemberikan semangat moral serta fasilitas dari RSIGM itu sendiri jika ada tenaga kesehatanyang terjangkit Covid-19

Abstract

The Constitutional Court stated that the Irah-irah for the sake of justice based on belief in the One and Only God does not automatically have executive power. The research objective is to analyze the Execution of Fiduciary Guarantees Post Constitutional Court Decision No.2/PUU-XIX/2021 and analyze the obstacles and solutions in implementing the Execution of Fiduciary Guarantees Post Constitutional Court Decision No.2/PUU-XIX/2021. The research method is empirical juridical, supported by primary data and secondary data, with data collection techniques in the form of literature and interviews. Execution of Fiduciary Guarantees Post Constitutional Court Decision No.2/PUU-XIX/2021, namely that creditors cannot carry out forced executions themselves, for example by asking for assistance from the police, if there is a breach of contract (default) by the fiduciary right giver (debtor) against the creditor which are still not recognized by the debtor and the debtor objects to voluntarily handing over objects that are the object of the fiduciary agreement. The Court has reaffirmed in the Constitutional Court Decision Number 2/PUU-XIX/2021 that creditors must submit a request for execution to the District Court. and analyzing the obstacles and solutions in implementing the Execution of Fiduciary Guarantees after the Constitutional Court Decision No.2/PUU-XIX/2021. that is, many consumers do not understand that when they enter into a leasing agreement, they will only lease, they are actually renting their vehicle, they have to pay the rent every month, so when they are in arrears, even if they only have three months left, their vehicle must be taken by the creditor. This is an unfair regulation for consumers. On the one hand, the consumer has paid the specified down payment, on the other hand, the vehicle can be picked up at any time, regardless of how many months the remaining arrears are. There are deficiencies in Article 15 paragraphs (2) and (3) of the Fiduciary Guarantee Law which do not explain the procedure for executing the Fiduciary Guarantee Certificate, and do not regulate the mechanism for determining "default debtor". Thus giving rise to the understanding that this article gives legitimacy to creditors to carry out executions immediately without proper legal procedures and creates arbitrariness on the part of recipients of fiduciary guarantees.

Abstract

The purpose of this study is to analyze investor rights protection arrangements in the analysis of margin transaction financing and the implementation of investor rights protection arrangements in the analysis of margin transaction financing by Stock Exchange Companies when a share sale is forced. The research method applied is sociological juridical.The results of this study show The regulation on the protection of investor rights in the analysis of margin transaction financing by a Stock Exchange Company when a share sale is made by force has actually been regulated in a letter of agreement, which is stated in Bapepam-LK Rule Number VD6. The existence of these regulations has fulfilled the legal protection aspects for investors as regulated in the Civil Code, but has not fulfilled the investor legal protection aspects as regulated in the Capital Market Law and the Consumer Protection Law. The implementation of the protection of investors' rights in the analysis of margin transaction financing by the Stock Exchange Company when a forced sale of shares is carried out has been carried out through a contract accompanied by the implementation of an internal control system and the implementation of haircuts by the IDX.Keywords: protection, margin transactions, forced sell.

Abstract

This study aims to examine and analyze the application of criminal sanctions against perpetrators of narcotics crimes and judges' considerations in the application of sanctions to perpetrators of narcotics crimes in the Batang District Court. The research method used is a Sociological Juridical Approach. Based on the results of the research on the application of criminal sanctions against perpetrators of narcotics crimes, starting from the indictment of the public prosecutor, who charged him with the Subsidarity charge, namely Article 114 paragraph (1), Article 112 (1) and Article 127 of Act No. 35 of 2009 concerning Narcotics. The basis for the examination in court is the Indictment of the Public Prosecutor, then the Panel of Judges conducts an examination of the indictment, in order to prove whether the Defendant has committed the crime as stated in the Article charged by the public prosecutor, whether the description of the defendant's actions is correct, which will be proven based on the applicable legislation. Considering the panel of judges in their decision, the panel of judges in their examination uses the theory of proof and punishment, where in the Aquo case the panel of judges will prove the elements contained in Article 114 paragraph (1), Article 112 (1) and Article 127 of Act No. 35 of 2009 concerning Narcotics as stated in the indictment of the public prosecutor, then examine the statements of witnesses, associated with the statements of the defendant and documentary evidence so that the facts of the trial will be obtained and evidence will be obtained which are mutually compatible and mutually reinforcing, from the results the research according to the authors of the panel of judges in court examinations has been based on the theory of evidence and the theory of punishment.

Abstract

Proficiency in English is a fundamental prerequisite for accessing significant information within the international context. The present study aims to explore teachers’ and students’ experiences and views on the role of gamification in English learning. Utilizing a qualitative case study method, the data were collected from questionnaires distributed to five English teachers using gamification and twenty-one young learners who have participated in English learning using gamification through Google Forms. The results showed that gamification has a crucial role to play in improving the quality of young learners in English learning, which is adjusted to the implementation of gamification into English learning with effective game strategies used. The use of gamification can benefit students by engaging them and stimulating their creativity in learning English. In addition, teachers used strategies in using gamification during the English learning process including using picture guessing games, broken phone games, English crossword games, answering questions, guessing English words and Indonesian games while singing, Simon Says games, and rolling word games to digital games like cooking games, puzzle games, Pou games, and other enjoyable games. At last, the policy recommendation is outlined in this article based on the research findings.

Abstract

Identitas sebuah perusahaan, salah satunya adalah NIB (Nomor Induk Berusaha).  Fungsi NIB menggantikan TDP (Tanda Daftar Perusahaan), API (Angka Pengenal Impor), dan akses kepabeanan. NIB tidak saja mempermudah badan untuk mendapat izin resmi atau legalitas tapi juga memiliki banyak manfaat untuk proses mengelola usaha dalam jangka panjang. Dengan NIB, setiap pelaku usaha dengan bentuk badan usaha/non badan usaha memiliki nomor identitas nasional sebagai pengenal. Kegiatan pengabdian masyarakat ini bertujuan untuk meningkatkan pengetahuan dan ketrampilan warga Sembungharjo Genuk terhadap pentingnya Nomor Induk Berusaha (NIB) guna percepatan pembangunan di Era Pandemi Covid-19. Kegiatan pengabdian dilaksanakan melalui metode focus grup discussion, penyuluhan. Praktek, pendampingan serta evaluasi kegiatan. Partisipasi dan antusiasme warga Sembungharjo Genuk dalam kegiatan ini sangat baik, kelompok mitra berkontribusi aktif dalam pengadaan keperluan pelatihan serta aktif berbagi pengalaman terhadap pentingnya NIB guna percepatan pembangunan di Era Pandemi Covid-19. Dampak dari kegiatan penyuluhan mampu meningkatkan pengetahuan dan ketrampilan warga Sembungharjo  Genuk  terhadap pentingnya NIB guna percepatan pembangunan di Era pandemi Covid-19. Kegiatan penyuluhan terhadap pentingnya N I B guna percepatan pembangunan di era pandemi covid-19 di Kelurahan Sembungharjo Genuk juga untuk pengembangan usaha lebih cepat dan bebas gangguan serta memudahkan pinjaman untuk pembiayaan perusahaan dan diharapkan dapat berkelanjutan
