Abstract

Abstrak - Pasal 26 ayat (1) Qanun Kota Banda Aceh Nomor 1 Tahun 2017 tentang Pengelolaan Sampah menyebutkan bahwa “Pemerintah Kota memberikan kompensasi kepada setiap orang sebagai akibat dampak negatif yang ditimbulkan oleh kegiatan di TPS, TPST dan TPA”. Kompensasi tersebut dapat diberikan dalam bentuk relokasi, pemulihan kualitas lingkungan, biaya Kesehatan dan pengobatan, dan dukungan terhadap kegiatan sosial masyarakat. Pada kenyataannya, pemberian kompensasi kepada masyarakat yang terdampak di Gampong Jawa masih belum dilaksanakan sepenuhnya. Hasil penelitian menunjukkan bahwa kompensasi diberikan dalam bentuk penyaluran biogas gratis dan pembebasan biaya retrebusi, serta pelayanan kesehatan berupa program BPJS Kesehatan dan Rumoh Gizi Gampong. Faktor penghambat dalam pelaksanaan pemberian kompensasi yaitu faktor yuridis, pengaturan dalam qanun yang kurang lengkap dan belum ada peraturan pelaksana dalam bentuk peraturan walikota. Faktor penghambat lain adalah faktor empiris, tidak ada upaya hukum yang dilakukan masyarakat penerima dampak dan kurangnya inisiatif pengelola TPA. Disarankan kepada Pemerintah Kota Banda Aceh untuk membentuk Peraturan Walikota tentang tata cara pemberian kompensasi dan melakukan analisis kepastian dampak negatif yang ditimbulkan kegiatan di TPA Gampong Jawa. Kata Kunci: dampak negatif, kompensasi, pemerintah kota, TPA.

Abstract

Diterbitkannya Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja (UUCK) memperkenalkan ketentuan baru khususnya pada bidang penataan ruang berupa Kesesuaian Kegiatan Pemanfaatan Ruang (KKPR). Sehingga dilakukan penyesuaian dan diatur dalam peraturan perundang-undangan hingga tingkat daerah. Adapun dalam Qanun RTRWK dan Perwal RDTRK didalamnya masih mengatur ketentuan lama perihal perizinan pemanfaatan ruang yang telah diubah oleh UUCK sedangkan dalam praktik lapangan KKPR di Kota Banda Aceh telah dilaksanakan. Tujuan dari penelitian ini ialah untuk menjelaskan kedudukan Qanun RTRWK dan Perwal RDTRK terhadap UUCK dan aturan pelaksananya, menganalisis penyebab dan akibat dari terjadinya disinkronisasi antara Qanun RTRWK dan Perwal RDTRK terhadap UUCK dan aturan pelaksananya. Penelitian ini bersifat yuridis normatif dengan pendekatan kepustakaan. Hasil penelitian: (1) Secara hierarki peraturan perundang-undangan Qanun RTRWK dan Perwal RDTRK berkedudukan lebih rendah dan merupakan amanat dari peraturan tingkat nasional, (2) Disinkronisasi terjadi karena Perwal RDTRK mengacu pada Qanun RTRWK yang telah lebih dahulu terbit dari UUCK namun pasca UUCK tidak dilakukan penyesuaian, dan (3) Akibatnya, terjadi dualisme hukum yang berlaku di Kota Banda Aceh. Disarankan kepada Pemerintah Kota Banda Aceh untuk melakukan sinkronisasi Qanun RTRWK dan Perwal RDTRK agar sesuai dengan peraturan perundang-undangan yang lebih tinggi, dapat lebih teliti dalam menyusun produk hukum daerah dan dapat membuat peraturan pedoman mengenai tata cara pembentukan dan  penyelesaian ketidaksesuaian pengaturan dalam produk hukum daerah.

Abstract

ABSTRACT: This article aim is to describe concerning the existency of customary rights to the land for the further named hak ulayat in the structure of the power rights acces to the land. The requirements so that it can be recognized as hak ulayat to the land based on the national agrarian law. The study in tihis article is a normative study by using analyse any kind of nasional law, research result and also the expert insight in relation to issue studied. The analyse result shows that hak ulayat in which as the Indiginous rights has position as an entity of rights to the land in Indonesia’s agrarian national law. The rights of those indigenous peopleis recognized its existency if it fulfills two requirements cumulatively are as follow: 1) that indigenous people’s rights are still available/exist, not have ever been, and 2) The application of those rights of indigenous people has to be pro- to Indonesia’s insight. The symbolization of the state recognition to rights of indigenous people is: 1) the legalization into regional law (Qanun) in Districts level; or president decree depends on the location of that indigenous right present; or in kind of related regional leader decree, 2) compensation for hak ulayat which is used for public and even personal needs/interrest.    The Structure and Recognation of Customary Rights to the Land / Hak Ulayat on Indonesia’s Agrarian National Legal System

Abstract

ABSTRACT: This article is aimed to explore the rules relating to the limit of maximum land wide owning in terms of balancing land owning fairly. In regard with such purpose, the study on rules and experts perspective is conducted. The findings are that although there are rules regulate the limit of the land owning for agriculture, the rules are providing the chance for imbalance owning that has been put under personal title right and for the corporation with exploration rights. The rule on the limit for buildings is limited to title right for home, and it is based on the minister decree. The rules are tend to imbalance the owning of the land and difficult to fulfill fair ownership. Thus, it is required for the rule regulating the maximum limit of the land either for agriculture or building by looking at the availability and need of it for several necessary.  Maximum Wide Limit of Owning Land

Abstract

ABSTRACT: Based on Article 19 (2) of the Act Number 5, 1960 nd Article 32 of the Government Regulation Number 24, 1997 state that in registering land, the certificate of land functioning as a strong evidence. Whether a freehold right can only be proved by a certificate, and to that extent of such evidence in judicial process. In terms of obtaining the answers from the questions, library research is conducted by exploring, discussing and analysing the laws, research reports and relevant experts views. The findings show that such freehold right certificate is issued by National Land Authority by registration process. If there is a land without certificate hence it can be proved through witnesses statements, prediction, acknowledgemen and oath. The certificate has the strong and complete power of proving can only be admitted if there is no challenge before the court. The challenge towards the certificate can be done if there are a defect on issuing it, good faith of the holder and/or the right holder does not really own the land. A Certificate of Land as an Evidence of Land in Judicial System

Abstract

ABSTRAK. Tulisan ini dimaksudkan untuk mengidentifikasi, menjelaskan dan menganalisis ketentuan perundang-undangan yang mengatur kewenangan pemerintah daerah dalam penyelesaian sengketa tanah. Untuk mendapatkan data bagi kepentingan penulisan ini dilakukan penelitian kepustakaan, dengan cara menelaah ketentuan perundang-undangan dan literatur yang relevan. Hasil penelitian menunjukkan bahwa ketentuan yang secara khusus menentukan kewenangan pemerintah daerah dalam bidang penyelesaian sengketa tanah  terdapat dalam Keppres Nomor 34 Tahun 2003 tentang Kebijakan Nasional Dibidang Pertanahan dan dalam Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah. Berdasarkan ketentuan tersebut pemerintah daerah berwenang; (a) penyelesaian sengketa tanah garapan; (b) penyelesaian masalah ganti kerugian dan santunan tanah untuk pembangunan; (c) penyelesaian masalah tanah ulayat; dan (d)  penyelesaian masalah tanah kosong. The Authority of Legal Government in Solving Land Dispute  ABSTRACT. This research aims to identify, explain and analyse the rules regulating the authority of local government in settling land dispute. In order obtain data library research is conducted by exploring relevant rules and literatures. The research shows that the special rule regulating the authority of local government in settling land dispute ruled in the Presidential Decree Number 34, 2003 on National Policy on Land and the Act Number 23, 2014 on Local Government. Based on these, the local government is eligible to: (a) settling the cultivating land, (b) reparation and remedy for land used for the development, (c) customary land dispute, and (d) unoccupted land.

Abstract

ABSTRACT: In accordance to Article 22 Number 5, 1960 states that the ownership right of land can be issued based on customary law and the procedure of issuing the title right ruled by the law as regulated by Government Regulation. In fact, recently such regulation has not been enacted yet; hence it cause different views on issuing the ownership right of land. Therefore, the problem raised in this research are what is the legal basis regarding the issuance of the title right based on customary law and what is the position such right based on the issuance. To answer the questions, this research is conducted towards the legislation, doctrines, and previous researches that are relevant to this research. The research shows that the legal basis for the issuance of such right is the customary principles found in customary law, the value of customary law in the place. Substantially, the customary ownership right has similar position as ownership right issued based on government decision, the distinction is on the ownership right proof of certificate of the right that is issued based on government decision but the land owned by customary right namely physical owning evidence and the acknowledgement of the people living the in the place where the right issued.  The Study on Ownership Right of Land Issued Based on Customary Law

Abstract

ABSTRAK. BPHTB merupakan jenis pajak properti dikenakan atas perolehan hak atas tanah dan/atau bangunan. Penelitian menggunakan metode yuridis normatif dan yuridis empiris. Hasil penelitian menunjukkan Peranan BPHTB terhadap Pendapatan dari sektor Pajak Daerah tahun 2011-2015 rata-rata sebesar 6,08%, terhadap APBK tahun 2011-2015 rata- rata sebesar 0,06%, terhadap APBG tahun 2015-2016 rata-rata sebesar 6,39%. Upaya untuk mengoptimalkan pendapatan BPHTB yaitu Pemeriksaaan objek BPHTB, meningkatkan kerjasama dan pemberian sanksi, kendala-kendalanya yaitu belum ada SOP BPHTB dan UPTD BPHTB, Kurangnya Pengawasan dan banyaknya jual beli di bawah tangan. BPHTB tetap dipertahankan sebagai pajak daerah dikarenakan memenuhi kriteria Pajak Daerah, meningkatkan PAD, meningkatkan akuntabilitas daerah. Role of Tax Bea Acquisition of Land and Building to Increase Local Revenue District Pidie ABSTRACT. The process fee of Owning Land’s and Building’s Right (BPHTB) is a kind of property tax which is charged due to owning land’s and building’s right process. This is juridical normative and empirical research. The research shows that the role of BPHTB on the income from Regional Tax sector from 2011-2015 is average 6,08%, average the Local Budget of Income and Spending of Pidie District (APBK) between 2011-2015 is 0,06%, average APBG from 2015-2016 is 6,39%. The efforts done to optimize the BPHTB’s income are by checking towards the object of tax of BPHTB, increasing cooperation and providing sanctions, the obstacles faced are lacking of Standard Operating Procedure (SOP) of BPHTB, the Implementing Technical Unit Department (UPTD) of BPHTB, monitoring and there are many unrecorded transactions. BPHTB is kept as a local tax as it fulfills the Regional Tax criteria, increases Local Revenue and district accountability

Abstract

This research aims to explain the position of Aceh Province in the management of natural resources in the field of mineral and coal mining based on the specificities and privileges of Aceh, as well as to explain the authority of the central government in the field of mineral and coal mining as well as explain the authority of the Aceh government in terms of mineral and mining permits. coal in the Aceh Province area. This research is empirical legal research using a statutory approach and a legal sociology approach. The data sources used in this research are primary and secondary data using primary legal materials, secondary legal materials and tertiary legal materials, then the data obtained from both Secondary legal materials and tertiary legal materials will be analyzed. The results of the research show that the authority to manage mineral and coal mining in the Aceh Province area is managed by the Aceh government in accordance with statutory regulations, this authority is an attributive authority granted directly by Law Number 11 of 2006 concerning the Aceh Government, so that in terms of mineral mining and coal, the central government does not have full rights in controlling it because the central government's mining regulations exclude the Aceh government in its regulation, namely in article 137A of Law Number 3 of 2020 concerning amendments to Law Number 4 of 2009 concerning mineral and coal mining. The granting of special autonomy to Aceh, especially in the management of natural resources in the mineral and coal mining sector, has not been fully respected by the central government. It is recommended that the central government needs to pay attention to the authority possessed by the Aceh government as one of the special and special regions, as explained in the constitution that the Indonesian State recognizes and respects regional government units which are special and given special authority based on the principle of decentralization. , to create legal certainty in the management of mineral and coal mining in the special autonomous region of Aceh.
