Abstract

This study explains that Paradigms are a concept of thought that is acquired in certain problems or cases so that the delivery can be understood and understood, the problem being examined is the main factor of divorce what happened to the community, not through the judiciary and the role of Islamic religious instructors in responding to the new marriage process in the community of the Buku Raya village in the Belang District that did not have proof of divorce. The researcher approached qualitative research (case study) in order to obtain data in the field validly and aimed to describe and analyze critically what happened in the field so as to produce data that the role of Islamic religious instructors in providing understanding to society must be truly understood by the community itself so that they are not easy to make decisions, and religious educators are also present from people who have good religious understanding. This research is expected to be able to provide advice and thoughts to the Community and the Government specifically the Ministry of Religion in selecting and sorting extension workers in the religious affairs office.

Abstract

Gama in the Mongondow Muslim community is considered mandatory to determine a marriage’s validity. Therefore, this study aims to examine in depth the relevance of customary and Islamic law to the tradition of gama in the Muslim community of Mongondow, North Sulawesi. The study was conducted in the Bolaang Mongondow area of North Sulawesi using a juridical-sociological approach. Data were collected using observation, interviews with traditional and religious leaders, as well as document study. The steps in data processing include data collection, presentation, reduction, and verification. Furthermore, analysis was carried out using the concept of urf and receptie a contrario. The results showed that even though the gama tradition predates the arrival of Islam in Bolaang Mongondow area, its implementation has Islamic values, otherwise known as urf shahih. The community upholds the noble values of traditions passed down by their ancestors. Islam teaches that the gama tradition has a symbol of respect for women. This indicates that customary and Islamic law play a joint role in shaping the life of the Bolaang Mongondow people. Conclusively, respect for the existence of women is a noble value in the Customary law of the Mongondow people.

Abstract

This study aims to explore the law enforcement of age of marriage in Bugis community, Islamic law and national law, and pemmali culture as one of the most crucial reasons for marriage dispensation. This study method used a sociological juridical research with normative and formal juridical approaches, socio-anthropological and case studies. Data analysis techniques used positivist theory of legal system, law enforcement, and sociology of legal system. The results showed that the enforcement of age of marriage in Bugis community does not have an age standard determination unless the daughter is menstruating, the application of pemmali culture causes daughter to become victims of underage marriages, they are blind to knowledge of age of marriage in Law Number 16 of 2019. The application of marriage age for children are still debated by the majority of fiqh scholars as long as girls have not menstruated, they do not question child marriage if it is menstruating, but Indonesian national law there is no way to legalize child marriage before getting a marriage dispensation. Pemmali culture can be determined as one of the reasons for the sharp increase in marriage dispensations in Religious Courts due to the mindset of parents in Bugis community when their daughters are underage and are proposed three times by men. A mayor implication of these findings is to reduce the amount of marriage dispensation recommended the next research on the effectiveness of socialization of Law Number 16 of 2019.

Abstract

Penelitan ini mendeskripsikan upacara pra-perkawinan masyarakat Kampung Arab Kota Manado dan dan mengidentifikasinya dari sisi Hukum Islam. Metode penelitian ini adalah kualitatif dengan pendekatan yuridis-sosiologis. Peneliti melakukan wawancara kepada tokoh agama dan masyarakat dan studi observasi serta dokumentasi untuk menunjang data penelitian ini. Analisis dilakukan melalui reduksi data, penyajian dan penarikan kesimpulan. Hasil yang ditemukan adalah tradisi hamdolo dibentuk oleh para pendatang dari Yaman Hadramaut. Prosesi hamdolo dilakukan pada saat malam sebelum upacara perkawinan yang bertujuan untuk menghilangkan rasa gugup dari pihak laki-laki ketika memasuki upara pernikahan besok harinya. Kemudian dari tiap-tiap prosesi diiringi dengan musik dan tarian-tarian khas keturunan bangsa Arab. Dalam Islam kita mengenal tradisi yang dilakukan dalam sebuah kelompok masyarakat sebagai urf, tradisi hamdolo hukumnya boleh jika dikaitkan dengan syarat urf. Meskipun begitu prosesi yang dilakukan masih terdapat hal-hal mistis dan masih terdapat perdebatan dengan hukum Islam, sehingga butuh penyesuaian atas prosesi hamdolo untuk menghindari kekeliruan masyarakat Kampung Arab yang notabene adalah Muslim dalam menjalan tradisi ini.

Abstract

This article discusses the mangundu mantu custom from the perspective of Islamic law in Tanamon Village, Sinonsayang District, South Minahasa Regency. The main problem is how are the customary procession of mangundu mantu in Tanamon Village and the view of Islamic law regarding the mangundu mantu custom from the perspective of Islamic law. This study uses descriptive qualitative research methods where researchers will go directly to the field to conduct interviews, observations, and documentation with those who know and understand the mangundu mantu custom and what Islamic law’s perspective is regarding the mangundu mantu business in Tanamon Village, Sinonsayang District, South Minahasa Regency. The research results in this thesis discuss the custom of mangundu mantu, a ceremony for welcoming the bride who comes to the house or sabuah (canopy as a gathering place for the groom's family). In carrying out the wedding procession for the Bantik community in Tanamon Village, the main party is held at the bride's house. After that, the bride and groom (both women and men) go to the groom's house, if the house is far away, they can use a vehicle, but at a distance of approximately 200 meters, the bride and groom must go down together with the bridal procession. Then wait for the groom's family to take turns pulling the bride by shaking hands and giving gifts in the form of money or other valuables and walking step by step until they are correct at the entrance to the groom's house. Keywords: Islamic law; Mangundu Mantu; Tradition. ABSTRAK Artikel ini membahas tentang adat mangundu mantu dalam perspektif hukum Islam di Desa Tanamon Kecamatan Sinonsayang Kabupaten Minahasa Selatan. Masalah utamanya adalah bagaimana prosesi adat mangundu mantu di Desa Tanamon serta pandangan hukum Islam tentang adat mangundu mantu dalam perspektif hukum Islam. Dalam penelitian ini menggunakan metode penelitian kualitatif deskriptif dimana peneliti akan terjun langsung ke lapangan untuk melakukan wawancara, observasi dan dokumentasi. Kepada mereka yang mengetahui dan menguasai masalah adat mangundu mantu serta bagaimana perspektif hukum Islam tentang adat mangundu mantu di Desa Tanamon Kecamatan Sinonsayang Kabupaten Minahasa Selatan. Hasil penelitian dalam skripsi ini membahas tentang adat mangundu mantu adalah suatu upacara penyambutan pengantin wanita yang datang ke rumah atau sabuah (kanopi sebagai tempat berkumpulnya keluarga mempelai pria). Dalam pelaksanaannya prosesi pernikahan masyarakat Bantik Desa Tanamon, pesta utamanya dilaksanakan dirumah mempelai wanita. Setelah itu, kedua mempelai (baik wanita dan pria) pergi ke rumah mempelai pria, jika rumahnya jauh bisa menggunakan kendaraan tetapi pada jarak kurang lebih 200 meter kedua mempelai harus turun bersama dengan iring-iringan pengantin. Kemudian menunggu keluarga mempelai pria yang secara bergantian menarik mempelai wanita dengan berjabatan tangan dan memberikan hadiah berupa uang maupun barang berharga lainnya dan berjalan selangkah demi selangkah hingga tepat di pintu masuk ke rumah mempelai pria.

Abstract

Penelitian ini membahas perlindungan hukum terhadap praktik arisan online sistem menurun dalam kerangka hukum positif dan hukum Islam. Fokus penelitian ini adalah akun Instagram @arisanku_ sebagai studi kasus. Metode penelitian yang digunakan adalah pendekatan kualitatif dengan pendekatan yuridis empiris. Hasil penelitian menunjukkan bahwa dalam hukum positif, perlindungan hukum terkait dengan perjanjian arisan online dengan sistem menurun melibatkan penyelesaian sengketa melalui gugatan inkar janji atau wanprestasi. Namun, pembuktian dalam konteks arisan online merupakan tantangan tersendiri. Untuk memperkuat hukum dalam perjanjian, penting untuk memenuhi unsur-unsur yang diperlukan sebelum mengambil langkah hukum. Jika langkah-langkah tersebut tidak berhasil, tindakan hukum dapat dilakukan. Dalam perspektif hukum Islam, praktik arisan online dengan sistem menurun di akun Instagram @arisanku_ tidak sesuai dengan prinsip-prinsip Islam. Praktik ini melibatkan unsur riba, ketidakadilan, dan kezhaliman. Prinsip-prinsip dalam Al-Quran dan Sunnah secara tegas melarang praktik seperti ini dalam praktik qardh (utang piutang). Meskipun terdapat kesepakatan awal untuk saling meridhakan dan mengikhlaskan, hal ini tidak mengubah hukum karena transaksi ini tetap diharamkan karena melanggar aturan syariat Islam, termasuk dalam kategori riba. Artikel ini memberikan pemahaman mendalam tentang perlindungan hukum terhadap praktik arisan online sistem menurun dari perspektif hukum positif dan hukum Islam. Implikasi penelitian ini dapat digunakan sebagai referensi dalam mengatasi permasalahan hukum yang mungkin timbul dalam praktik arisan online dan memberikan wawasan tentang ketidaksesuaian praktik arisan ini dengan prinsip-prinsip hukum Islam. Dengan demikian, artikel ini memiliki relevansi yang signifikan dalam memahami perlindungan hukum dalam konteks praktik arisan online dengan sistem menurun.

Abstract

The diverse society of Indonesia permits interfaith marriage but the challenge lies in the legal recognition under Islamic law. The primary issue pertains to the legal aspects and the jurisprudence from the perspective of Maqāṣid Sharīa. Therefore, this research aimed to analyze the legal objectives of interfaith marriage as well as the execution and status of the concept from the perspective of Maqāṣid Sharīa. A thorough examination of literature from primary, secondary, and tertiary sources is carried out, including legislation, court judgments, books, journals, and other relevant materials. Meanwhile, the analysis is performed using a juridical, syar'i, and philosophical perspective. The results show that the judge approved the application for the legality of interfaith marriage, citing Law Number 1 of 1974 on Marriage, Human Rights, and Law Number 23 of 2006 on Population Administration. Similarly, when considering Maqāṣid Sharīa, marriage between individuals of different religions is not allowed, particularly in matters of Aqidah and Iman. This prohibition upholds the objectives of Islamic marriage law since the values obtained from the religion are not easily reconciled in the unions. According to the principles of Maqāṣid Sharīa, interfaith marriage should be avoided due to potential harm.

Abstract

In multicultural societies, the regulation of worship loudspeakers, particularly those affecting the Muslim community, has sparked significant debate, ranging from strong support to outright rejection. This study seeks to explore the social tensions arising from these regulations, focusing on the culturally diverse regions of Bali and Manado. Employing a qualitative approach, interviews were conducted with religious leaders, community figures, and local government officials to gain insight into the community's reactions. The findings reveal two predominant responses. On one hand, some view the regulations as unnecessary, believing that the established tradition of tolerance has allowed diverse religious practices to coexist peacefully without significant issues related to loudspeakers. On the other hand, others feel that the loudspeaker use is excessive, disturbing their rest and seeking quieter times. Some members of the Muslim community perceive the regulation as discriminatory, noting that other religious groups might also use loudspeakers at higher volumes. This study offers valuable insights for policymakers on how regulatory interventions can influence social harmony in diverse environments, highlighting the importance of adjusting regulations to respect religious diversity and equitably manage public auditory spaces.

Abstract

In response to escalating divorce rates in Indonesia, particularly within its Religious Courts, this study explores the limitations of current mediation practices. It proposes local wisdom-based mediation as an alternative approach. Traditional mediation within these courts often fails to prevent divorces effectively, prompting the need for innovative solutions that integrate cultural insights. This research aims to assess the effectiveness of mediation processes within Indonesia's Religious Courts and investigate the potential role of religious leaders in improving mediation outcomes. Specifically, it highlights how local wisdom can be leveraged to mitigate divorce rates by fostering reconciliation and resolving disputes outside formal legal procedures. Using an empirical approach, researchers collected data by interviewing 50 informants, namely judges, religious leaders, and the government, related to the increasing divorce rate. The findings that can be presented are that religious figures, as locals, can reconcile divorced parties without the need to go to religious courts. The Religious Court is seen as a formal facility to certify the divorce of both parties, but has yet to be able to prevent divorce optimally. That is, the high divorce rate in religious courts requires the involvement of religious leaders in reconciling parties who want to divorce. This study accepts the potential for integrating local wisdom in mediating to reduce divorce rates. With an emphasis on cultural sensitivity and community involvement, this approach aims to go beyond the limitations of conventional legal frameworks and promote more meaningful outcomes in resolving marital conflict.
