Abstract

Climate of increasingly tough competition makes the company seeks to improve efficiency of production costs (cost of production). Workers with a system of outsourcing in practice that outsourced workers are given only 1 hour resting of 12 hours of work, especially security, and is not given for a period of vacation time that has reached 1 (one) year or more. If the outsourced workers will ask leave of absence, the submission will not be considered on leave but permission kerja.Tujuan writing this essay, namely: First, to determine the legal reasoning of the Constitutional Court decision No. 27 / PUU-IX / 2011 in the case of petition for judicial review of Law No. 13 of 2003 on Employment of the Constitution of 1945. Second, to determine the legal implications of the decision of the Constitutional Court Number 27 / PUU-IX / 2011 on the legal protection for outsourced workers in Law No. 13 Year 2003 on Manpower.This research is descriptive analysis of legal research because of the results of this study are expected to be obtained data describing thoroughly, clearly and systematically on the Legal Protection Against Workers in Labor Agreement With Outsourcing System in Indonesia. Data source is the primary legal materials, secondary law, and tertiary legal materials. Data collection for the study of normative law used literature study method or documentary studies. Was analyzed qualitatively analyzed the data by not using statistics or mathematics, or the like.From the results of this study, there are two main things that can be inferred First, through the decision of the Constitutional Court provides protection to workers / labor outsourcing, in this decision reaffirms the rule against contract workers or workers must follow existing regulations by adding a guarantee continuity of workers in the contract. Decision of this Court is protective labor rights / labor, then the government needs strict monitoring of the implementation of outsourcing.Keywords: Protection Law, Outsourcing Workers' Rights, Constitutional Court.

Abstract

In a unitary State can use the system sentralistis or desentralistis in this Country Indonesia chose the United State desentralistis, it can be seen in chapter VI of the Constitution of the Republic of Indonesia in 1945 About local governance, in the formulation of article 18 paragraph (2) of the constitution of 1945. Another thing in Act No. 23 of 2014 on local governance as implementing Article 18, which lists the dekonsentrasi between the principle of autonomy and medebewind tasks. Then arose the question of whether the dekonsentrasi settings are not set in the Constitution 1945 can be arranged in the Act that in fact is the advanced settings over the constitution of 1945.The type of research that used the author is normative legal research. Normative legal research legal research which is doctrinal, also referred to as the research library or study emphasis is focused on documentary skunder data. The technique of data collection in this research is the study of librarianship, namely authors take an excerpt from the book, literature, or the supporting books relating to issues that will be examined. In the writing of this thesis, the author uses descriptive analysis (descriptive analisys) that aims to provide the task force on the subject of the research based on data obtained from the subject researched.The results of this thesis research States Country Indonesia is a unitary State desentralistik, it can be seen in the history of local government in Indonesia which is reviewed from before independence and the aftermath of independence, To anticipate it and then the Government implement political decentralization and deconsentrasition together in a big way, it is aimed at opening opportunities to the population to participate in organising and taking care of the interests of his household. Actually it doesn't include the word "deconsentrasition" in article 18 paragraph (2) of the constitution of 1945 remain unconstitutional according to the author, as long as deconsentrasition is meant as part of a decentralization commonly referred to as ambtelijk i.e. pelimpahan decentralisatie authority of State equipment (Center) to subordinate agencies (region) to carry out certain jobs in the Government.Keywords: Constitutionality – Deconsentrasi – Local Governance

Abstract

The right to life is protected by the constitution inspired by human values in Pancasila, but today, in the legal system in Indonesia is still valid regarding the death penalty. It seems contradictory to the concept of humanity in Pancasila. The purpose of this thesis, namely; First, How will the death penalty in the Act in force in Indonesia, Second, Do arrangement death penalty in accordance with Article 28 of the Constitution of the Republic of Indonesia Year 1945, Third, How implications of Article 28 of the Constitution of the Republic of Indonesia Year 1945 the implementation of the death penalty in Indonesia.This type of research can be classified in this type of normative legal research , legal research literature by researching legal principles , the data source used , primary data , secondary data and data tertiary , technical analysis of legal materials in this study with qualitative analysis , outlines descriptive and emphasis on deductive method. From the research there are three main issues that can be inferred . First , setting the death penalty in law prevailing in Indonesia that the death penalty is one of the special penalty is applied cautiously , selectively majored in certain cases. Setting the death penalty in law in Indonesia can be found in the Criminal Code , Law No. 1 Year 1946 on the draft Criminal Code , Act No. 35 of 2009 on Crime Narcotics , Law Number 26 Year 2000 Crime Against Human Rights , Law No. 20 of 2001 on Corruption , Law Number 15 Year 2003 on Anti Terrorism. Second , setting the death penalty in accordance with Article 28 of the Constitution of the Republic of Indonesia Year 1945. Because of its restrictions on the death penalty should preferably be set so as not to cause inconsistency and multiple interpretations. Third , the implication of Article 28 of the Law of 1945 on the implementation of the death penalty at least will have an impact on three (3) things: first, impact against the Constitution itself , which provides for the death penalty , that it would be difficult to implement consistently because it is constrained by arrangements contained in Article 28 of the 1945 Constitution so that it is possible for citizens to make a Judicial Review against the law . Abstract

Parking levy is payment for the use of the service organization and use of the parking lot, which is contained in each of the places visited such as shopping centers, restaurants and entertainment venues, good parking space provided by the local government and on the edge of the public road. as there is in the area of the districts Handsome Pekanbaru order to increase revenue (PAD), One implementation Levy Parking On the Edge of the existing public road in Regional District of handsome Pekanbaru City Regional Regulation No. 3 of 2009 on Retribution Pelyan in the Field of Communications Army. The purpose of this study is: First To determine pelaksanann roadside Levy Parking In general, based on Regional Regulation No. 3 of 2009 in the District Handsome Pekanbaru. Second, to determine barriers for the implementation of the parking levy based on the edge of the public road Based on Local Regulation No. 3 of 2009 in the District Handsome Pekanbaru. Third, To know the effort that can be done to overcome the obstacles in the implementation of roadside parking levies generally based on Regional Regulation No. 3 of 2009 in the District Handsome Pekanbaru.This study is a kind of sociological research or empirical jurisdiction. Location of the study is the Regional District of Handsome Pekanbaru. Source of data, supported by the primary data source, secondary data sources, data source tartier, while the data collection techniques are interviews, questionnaires and library studies. After the data collected was then analyzed qualitatively using the deductive method to analyze the problems of a general nature and is then drawn to a conclusion in particular based on existing theory.From the research problem there are three things that can be inferred, first implementation of curbside parking fees in general, based on Regional Regulation No. 3 of 2009 in the subdistrict of Pekanbaru City Handsome not performing as it should be because of the lack of socialization of the local government to arkir officers and lack of coordination between government the field coordinator. This is because of the barriers faced by local governments. Both the obstacles faced in the implementation of roadside parking levies common in Pekanbaru City Regional District of Handsome operational shortage of officers involved in the supervision and inspection of the field to the parking attendant who sometimes banyaak parking attendant who do not have official permission to carry out their duties.Keywords:Retribusi- Local Revenuelocally-generated revenue

Abstract

Since regional outonomy era, the local boundary has meaning which is important as boundary of local government authority in implementing the government function in a certain areas which is regulated by regulations and has implication to appear the conflict of interregional about affirmation of area border because it’s related to uphold existence and the sovereignty on each local governments. But originally, the process of dispute resolution has regulated in Permendagri Nomor 76 Tahun 2016 which solves the conflict through administration route, it doesn’t solve the problems, even the parties can take legal effort in constitutional court justice in this process of dispute resolution so that changed the conflict patterns which initially among a region with another one become a region with state institutions. In this research, the writing purpose is not just to describe the conflict solution process through administration process only, but also is concerned with the solution process through judicial review against Undang-Undang Dasar Republik Indonesia Tahun 1945 by Constitutional Court.The type of this research can be classified in the type of normative law research is literature. In this normative law research, the author make the research against principles of law. Then, in this research concludes that Peraturan Menteri Dalam Negeri Nomor 76 Tahun 2012 is the true regulation which is able to solve the conflict of boundary area. Administration process which regulated in Undang-undang Nomor 23 Tahun 2014 could not solve the conflict problems of boundary area yet even though the decision was final decision but also have a legal effort as judicial review in constitutional court. The author recommends that will be formed a regulation which more have legal certainty and also engages the constitutional court in solving the conflict of boundary area, because is also about constitutionality.

Abstract

Traffic violations often occur in various places, not just in Pekanbaru, but almost in all regions of Indonesia, Act No. 22 of 2009 about traffic and road transport, in the implementation of the final cost is still not running optimally, it is related to traffic offences, for example not to wear a helmet, or not using a seat belt that occur in everyday life. Results achieved in this study that in the application of fines speeding tickets for traffic violations and Court in your State road transport Soweto according to Act No. 22 of 2009 about traffic and road transport, is still not running optimally, the reality of the situation in the application of fines speeding tickets do not seseuai with the existing legislation, although Act No. 22 has long been enacted, for example someone who got speeding tickets by Polantas because it does not carry a license plate Number of the vehicle (VEHICLE REGISTRATION) If following the law number 22 Years 2009 should he pay a fine of Rp 250,000, a speeding ticket but after following the trial only Rp. 50.000,-for two wheels, four wheels as for Rp 80,000,-and a six-wheel for over 100,000, application of fines tilang differences that now the District Court in pekanbaru, skyrocket by economic, that is not yet ready will cost fines so great for diterapan, so that the State Court judge pekanbaru in deciding fines speeding tickets is still not in accordance with the legislation Number 22 in 2009 about traffic and roads.

Abstract

Abstract The purpose of this research is to know the implementation of the formation of customary village governance based on Siak District Regulation No 2 of 2015 on Stipulation of customary village in Siak District, following the obstacles and efforts made to overcome obstacles in the implemetation of the formation of customary village. Based on Law No 6 of 2014 on Villages, Siak District Government has established Siak District Regulation No 2 of 2015 on Stipulation of customary village in Siak District which is a typical local government system based on the right of origin and traditional rights of society in Siak District. Although in its formation has been in accordance with the prevailing regulation, but in its formation is still found weaknesses that affect the effectiveness on the implementation of this regulation, so it needs improvement efforts for better governance of customery village. Abstrak Tujuan penulisan ini ialah mengetahui pelaksanaan pembentukan Pemerintahan Kampung Adat berdasarkan Peraturan Daerah Kabupaten Siak Nomor 2 Tahun 2015 tentang Penetapan Kampung Adat Di Kabupaten Siak, berikut hambatan serta upaya yang dilakukan untuk mengatasi hambatan dalam pelaksanaan pembentukan Pemerintahan Kampung Adat. Berdasarkan Undang-Undang Nomor 6 Tahun 2014 tentang Desa, Pemerintah Kabupaten Siak telah membentuk Peraturan Daerah Kabupaten Siak Nomor 2 Tahun 2015 tentang Penetapan Kampung Adat di Kabupaten Siak yang merupakan sistem pemerintahan lokal yang khas berdasarkan hak asal usul dan hak tradisional masyarakat di Kabupaten Siak. Meskipun dalam pembentukannya telah sesuai dengan peraturan perundang-undangan yang berlaku, namun ditemukan kelemahan yang mempengaruhi efektivitas pelaksanaan Peraturan Daerah ini, sehingga diperlukan upaya perbaikan guna penataan Pemerintahan Kampung Adat yang lebih baik.

Abstract

Disclose information is a kind of democracy that can be realized as people right as form of acknowledgement to human right and is a kind of goverment accountable to the people. Historically, the birth of reformation in Indonesia brough the spirit of revolution in every part of goverment’s system, including revolution to open all accesses information from goverment that previously is closed and manipulated. With birth of law No. 14 year 2008 and the formed of committee of information in Indonesia is expected to be a forum for people as a warranty to get the right of getting information, claim for goverment to open all accesses information, and provider of information to public.However, the implementation of task and authority of the commission of information still have many weaknesses. Abstract

The use of the constitutional interpretation method by the judges of the Indonesian Constitutional Court (MK-RI) in their decision’s consideration (ratio decidendi) determine the decisions quality, therefore it must be chosen appropriately. In the context of Indonesian rule of law, the use of constitutional interpretation method should be implemented holistically, integrative, and using a dynamic approach, that must be harmonized with the Pancasila. This article is aimed to explain and analyze the use of constitutional interpretation method in the Constitutional Court Decision Number 91/PUU-XVIII/2020 regarding the Formal Constitutional Review of Law Number 11 of 2020 concerning Job Creation, as well as its theoretical implications. This article also proposes a new approach for constitutional interpretation method which is expected to strengthen the normative legitimacy and justification of the MK-RI decisions in the future. The method of analyses used in this article is the legal normative analyses with a conceptual approach. Finally, this article concludes that the method of constitutional interpretation in the Constitutional Court Decision Number 91/PUU-XVIII/2020 is considered as eclecticism. Using the new approach, the decision has also fulfilled the principles of holistic, integrative and dynamic constitutional interpretation based on Pancasila. For this reason, the Constitutional Court Decision Number 91/PUU-XVIII/2020 deserves to be used as one of the Landmark Decisions at the Indonesian Constitutional Court. However, the eclecticism approach wich is used by Indonesian Constitutional Court to interpret the constitution still needs to be developed in order to increase the normative of legitimacy and justification of decisions quality. In addition, that approach must also be linked to Pancasila both as a rechtsidee and staatsfundamentalnorm of the Indonesian state.

Abstract

Election of Governor and Deputy Governor in Law Number 32 of 2004 which is elected directly by the people. From the results of this study concluded that there are several principles. First, the background is applied to the election of the governor and vice governor directly in Law Number 32 of 2004 on Regional Government, philosophically motivated to carry out direct elections is partly due to indirect mechanisms of democracy does not guarantee accommodation in choosing future leaders. Second, the strengths and weaknesses of the election for governor and vice governor directly in Law Number 32 of 2004 on Regional Government, the benefits are local elections in person an opportunity for political education, the system of checks and balances between the legislative and executive more balanced, as a means to strengthen regional autonomy. As for the cost of the funds needed in the election for governor and lieutenant governor are relatively higher, opening the possibility of conflict and elite, activities of people with disabilities, especially during the campaign.
