Abstract

The proliferation of digital communication platforms, particularly family WhatsApp groups, has facilitated interpersonal connectivity while simultaneously introducing ethical dilemmas such as ghibah (backbiting). This study investigates the manifestation of ghibah within family WhatsApp groups from the perspective of Islamic law. Employing a qualitative descriptive methodology through literature review and content analysis, the research draws upon primary Islamic legal sources—including the Qur’an, Hadith, scholarly interpretations, and fatwas issued by institutions like the Indonesian Ulema Council (MUI). The findings reveal that despite the private and informal nature of family WhatsApp groups, ghibah remains categorically prohibited and is considered a major sin in Islam. It typically manifests through behaviors such as criticizing absent members, disseminating private information without consent, or making demeaning remarks masked as humor. These actions not only compromise individual dignity but also jeopardize familial harmony and trust. The study emphasizes that digital media do not exempt individuals from adhering to Islamic ethical standards. The enduring nature of digital communication exacerbates the repercussions of ghibah, thus underscoring the necessity of digital literacy grounded in Islamic ethics. This research contributes to the development of ethical guidelines for digital conduct within familial contexts and calls for the reinforcement of Islamic values in private online interactions.

Abstract

This article explores social cohesion among Muslim groups in the village of Sragen, which is home to five distinct groups: NU, Muhammadiyah, MTA, LDII, and Salafi, as well as some individuals identified as abangan. Masjid Rohmat serves as the focal point for religious events, such as Eid al-Fitr and Eid al-Adha. This research is based on field research conducted in 2023. The data was then analyzed using a qualitative approach. This research has found, despite their differing interpretations and practices of faith, the residents of this village coexist peacefully and harmoniously. Key factors that contribute to this social cohesion include family ties and community activities. Many villagers share familial connections, even if they hold different religious affiliations. For instance, one mother regularly participates in Yaasin and tahlil gatherings, while her son is a member of LDII. In another household, the husband is affiliated with Muhammadiyah, while the wife attends MTA public congregations. Additionally, community members collaborate on various social activities, transcending their religious differences.

Abstract

Abstract: Halal certification for micro and small food enterprises in Indonesia has become a legal obligation and a strategic requirement for Muslim consumer protection. The article examines how the regulatory framework for halal product assurance, the legal awareness and compliance of fried chicken MSMEs, and the normative discourse of Maqāṣid al-Shariah and Fiqh Muʿāmalāt interact in practice. Using a sociological juridical approach, the research combines normative analysis of Undang-Undang Jaminan Produk Halal (Halal Product Assurance Law) and its implementing regulations with qualitative data from observation and indepth interviews with fried chicken MSME owners in Mejobo Village. The findings show that some business actors understand halal certification as both a religious obligation and a business asset that strengthens consumer trust and access to formal markets, yet a significant gap remains between awareness and concrete compliance. Perceptions of procedural complexity and costs, limited socialisation of facilities such as the SeHATI free certification and self declare schemes, weak local supervision, and inconsistent consumer demand for visible halal proof all contribute to the persistence of uncertified operations. Read through Hashim Kamali’s Maqāṣid framework, halal regulation and certification can be seen as instruments for protecting hifz al dīn and hifz al māl, although their actualisation at village level remains partial because institutional wasāʾil do not yet fully match the capacities and conditions of small businesses. The analysis indicates that strengthening halal compliance among MSMEs requires closer alignment between legal design, ethical formation, and community based support within the development of Islamic Business Law in Indonesia. Abstrak: Sertifikasi halal bagi UMKM di sektor pangan di Indonesia telah menjadi kewajiban hukum sekaligus tuntutan strategis bagi perlindungan konsumen Muslim. Artikel ini mengkaji bagaimana kerangka regulasi jaminan produk halal, tingkat kesadaran dan kepatuhan hukum pelaku UMKM ayam goreng, serta wacana normatif Maqāṣid Asy-Syariʿah dan Fikih Muamalah saling berinteraksi dalam praktik. Pendekatan yang digunakan bersifat yuridis sosiologis yang memadukan analisis normatif terhadap Undang-Undang Jaminan Produk Halal dan peraturan pelaksananya dengan data kualitatif hasil observasi dan wawancara mendalam dengan pemilik UMKM ayam goreng di Desa Mejobo, Kudus, Jawa Tengah. Temuan menunjukkan bahwa sebagian pelaku usaha memaknai sertifikasi halal sebagai kewajiban keagamaan sekaligus aset bisnis yang memperkuat kepercayaan konsumen dan membuka akses ke pasar formal, namun masih terdapat jarak yang nyata antara kesadaran dan kepatuhan konkret. Persepsi mengenai kerumitan prosedur dan biaya, terbatasnya sosialisasi fasilitas seperti Sertifikasi Halal Gratis (SeHATI) serta skema pernyataan pelaku usaha (self declare), lemahnya pengawasan di tingkat lokal, dan belum konsistennya tuntutan konsumen terhadap bukti kehalalan yang jelas turut mempertahankan praktik usaha tanpa sertifikat. Jika dibaca melalui perspektif Maqāṣid menurut Hashim Kamali, regulasi dan sertifikasi halal tampak sebagai instrumen perlindungan ḥifẓ al-dīn dan ḥifẓ al-māl, namun aktualisasinya di tingkat desa masih parsial karena wasāʾil (instrument/sarana) kelembagaan belum sepenuhnya sejalan dengan kapasitas dan kondisi usaha kecil, sehingga penguatan kepatuhan halal menuntut keterkaitan yang lebih erat antara desain hukum, pembentukan etika, dan dukungan berbasis komunitas dalam pengembangan Hukum Bisnis Islam di Indonesia.

Abstract

Islam–Christian relations at the village level are often shaped by a long history of coexistence, yet they remain vulnerable to identity anxiety, conversion concerns, and symbolic competition. In the context of Kudus, the legacy of Sunan Kudus commonly narrated as accommodative da‘wah and an ethic of respect toward other groups can function as cultural capital that stabilizes interfaith encounters. This article aims to explain how the historical context of colonialism, the development of zending/missionary activities and Islamic preaching, and the collective memory of Walisongo Islamization (particularly Sunan Kudus) have shaped patterns of Islam–Christian relations in Dukuh Kayuapu, as well as how Nahdliyin residents practice “layered tolerance” through NU/Aswaja cultural strategies (tahlil, berjanjen/shalawat, pengajian, and TPQ) within this contact zone. The study adopts a qualitative approach with a case study design in Dukuh Kayuapu, Gondangmanis Village, Bae Subdistrict, Kudus; data were collected through limited participant observation, semi-structured interviews with purposively selected informants (NU figures, cross-generational residents, church council/pastor, and village officials), and document analysis, and were analyzed thematically. The findings show that tolerance in Kayuapu operates as a governance of difference: social harmony is maintained through everyday contact (neighborly interaction, bereavement solidarity, and collective work), while theological boundaries are selectively managed through relatively subtle boundary maintenance. Aswaja traditions function as a “protective infrastructure” that strengthens internal cohesion and reduces conversion anxiety without provoking open conflict, while the legacy of Sunan Kudus serves as cultural legitimation for an ethic of interfaith respect. The study recommends strengthening cross-community humanitarian social-contact spaces, formulating mutually agreed codes of encounter for sensitive issues, reinforcing moderate religious literacy within each community, and activating the narrative of Sunan Kudus’s legacy as a public moral language to prevent the escalation of friction in interfaith contact zones.

Abstract

Artikel ini ditulis bertujuan mendeskripsikan upaya warga penghayat di Kudus dalam pemenuhan pelajaran penghayat di sekolah dan respon atas putusan Mahkamah Konstitusi No 97/PUU-XIV/2016. Data riset dengan wawancara, observasi, dan kajian literatur dengan analisis deskriptif kualitatif. Ada delapan penghayat di Kudus, yang mengubah kolom agama menjadi penghayat yakni Sapto Darma dan Sikep Samin. Dalihnya, mengubah khawatir pemakaman di makam umum desa ditolak. Ada pula, penghayat sebagai organisasi rohani, tak terkait status agama dalam KTP. Penghayat Sapta Darma yang anaknya di SMAN 1 Kudus belum mendapat pelajaran penghayat di kelas, meski tersedia guru penghayat. Hal ini akibat Kepala SMAN 1 Kudus belum memfasilitasi ruang kelas dalam pembelajaran, hanya materi pelajaran dari guru penghayat Pada Siswa Dan Ujian Dinilai Gurunya.

Abstract

This article discuss about an application at Google Play Store that appears along with the rise of smartphone usage. It's also take effect to Muslims live style and religious practice, for example in reading Quran.  There are many Quran applications are available on the Play store, its raises questions on religious authorities because anyone can upload an Android-based Quran application on the Play store. A descriptive qualitative approach use to analyze Qur’an apps in Google Play store. The apps are chosen based on the numbers of download and comments from the users. The results show that the growth of digital Quran applications raises new styles of worship such as reading the Quran on smarthphone application.

Abstract

This study examines the dynamics of religious moderation between Sunni and Shia Muslims in Jepara City, Central Java, highlighting the unique context of Shia as a minority facing significant challenges in Indonesia. The research addresses four primary questions: the nature of Sunni resistance to Shia, the manifestations of religious moderation in Jepara, the teachings that threaten Sunni-Shia coexistence, and the impact of Sunni understanding on their attitudes towards Shia across Indonesia. Data gathered through interviews, observations, and literature reviews in 2024 reveal a historical backdrop of Sunni resistance to Shia, including political struggles, persecution, and the issuing of fatwas. Despite this, the study underscores a notable absence of conflict in Jepara since the 1980s, when a culture of moderation emerged. However, concerns remain regarding the potential for immoderation due to doctrinal differences. Initial findings indicate that, while Sunni citizens may refrain from attending Shia activities involving internal Shia doctrine, they are open to participating in non-doctrinal events, suggesting a complex interplay of acceptance and resistance within the community.

Abstract

This article discusses about the practice of child marriage in Grobogan and its factors. he factors supporting child marriage in Grobogan include; economic, education, socio-culture and the understanding of religious manuscripts. Meanwhile, from the analyzed copy of the judge's decision on the application for marriage dispensation, the reason often put forward by the applicant is that marrying is to prevent committing adultery. From the socio-cultural perspective, the condition of the people of Panunggalan village plays an important role in the occurrence of child marriage. Owing to the condition of an agrarian society that relies on rainwater for agriculture and low levels education and income, child marriage is considered as a way out of poverty and life's difficulties. In the theory of patriarchal connectivity, family members have a very close relationship so they always try to help each other and together maintain family values. In such conditions, children do not feel oppressed when they are married at a child's age because it is a form of maintaining family collectivity. Keywords: child marriage, factors, women

Abstract

With the rapid development of technology, an application for online shopping (marketplace) was born. One of the largest in Indonesia is the Shopee marketplace. In the Shopee application there is a payment feature that can be made in stages, known as Spaylater. In this study, the theory used is the sale and purchase contract, loan contract, hiwalah contract and usury. This research uses the type of field research or field studies using a qualitative approach. This research was conducted on the Shopee application, where in the Shopee application there is an online loan feature called Spaylater. This feature makes it easy for users to make transactions, because Spaylater itself offers bailouts for users who want to transact but do not have cash. Then the researchers used primary data obtained from interviews with informants in accordance with the research problem. While secondary data, researchers obtained from books, journals, articles from the internet, DSN-MUI Fatwa and theories related to Islamic law. Then for the data collection method using observation, interviews and documentation. The results of this study indicate that if the activation of the Spaylater user is successful, the user can use the limit that has been given. Then regarding the view of Islamic law, looking at Spaylater, namely in the Spaylater mechanism there are conditions for contracts that are not fulfilled in Spaylater. Because in it there is a late fee given by the Spaylater, this late penalty is included in usury jahiliyah. Therefore the practice of Spaylater is not allowed in Islam because it contains elements of usury.

Abstract

Harta wakaf secara normatif adalah hak milik umat Islam yang pemanfaatannya harus semata-mata untuk kepentingan umat. Akan tetapi lemahnya pengelolaan tanah wakaf menjadikan banyak tanah wakaf yang terbengkalai. Selain itu banyak tanah wakaf yang belum bersertifikat sehingga menimbulkan konflik di kemudian hari.  Artikel ini membahas tentang pemahaman tentang pentingnya sertifikasi tanah wakaf kepada masyarakat, khususnya para pemangku kepentingan, sangat penting untuk dilakukan guna menjamin kepastian hukum obyek wakaf serta legalitasnya serta untuk menghindari sengketa dan penyimpangan atas obyek wakaf.
