Abstract

The existence of Pindul Cave has led to ongoing conflicts due to the involvement of multiple parties. This paper aims to analyze the underlying causes of conflict in the management of Pindul Cave and propose legal empowerment strategies to reduce these conflicts, using a legal systems theory approach. The research employs an empirical juridical methodology, focusing on a case study of Pindul Cave management, and gathers both primary and secondary data through interviews, observations, and documentation studies. The data analysis is conducted using an interactive model. The findings reveal that the primary source of conflict in the management of Pindul Cave tourism stemmed from a land ownership dispute between Atiek Damayanti and the previous tourism manager. This dispute escalated, involving multiple parties on a relatively large scale. The conflict was primarily fueled by a power struggle over the management of Pindul Cave. To address these issues, the legal empowerment model, approached from a legal systems perspective, suggests that by considering the law as an integrated system incorporating legal substance, structure, and culture. It may be possible to reduce conflicts in the management of Pindul Cave as a natural tourist attraction.

Abstract

The rapid expansion of Islamic banking in Southeast Asia has positioned Indonesia and Malaysia as central actors in the global Islamic finance landscape. However, despite their shared religious and economic foundations, structural differences in regulatory frameworks, financial innovation, and market development have produced varying levels of institutional performance and sharia compliance. This study aims to compare the financial and sharia performance of Islamic commercial banks in both countries by employing the Sharia Conformity and Profitability Index (SCnPI), which integrates sharia compliance indicators—Zakat Performance Ratio (ZPR), Profit Sharing Ratio (PSR), and Islamic Income Ratio (IIR)—with profitability indicators—Return on Assets (ROA), Return on Equity (ROE), and Net Profit Margin (NPM). Using a quantitative comparative design, the study analyzes secondary data from 25 Islamic commercial banks (12 from Indonesia and 13 from Malaysia) for the 2022–2023 period, selected through purposive sampling. Data were analyzed using the Shapiro–Wilk test for normality and either the independent sample t-test or Wilcoxon signed-rank test for mean comparison. The results indicate significant differences in PSR and NPM, with Indonesia showing higher PSR values due to dominant musyarakah-based financing, and Malaysia exhibiting higher NPM, reflecting stronger cost efficiency and profit management. Other indicators show no statistical difference. These findings emphasize the influence of governance systems and managerial focus on financial outcomes and suggest that improving transparency, risk-sharing mechanisms, and operational efficiency could enhance Islamic banking resilience across the region. Abstrak Efisiensi dan Kepatuhan Syariah dalam Perbankan Syariah: Analisis Komparatif dari Indonesia dan Malaysia. Perkembangan pesat perbankan syariah di Asia Tenggara menempatkan Indonesia dan Malaysia sebagai dua negara utama dalam industri keuangan Islam global. Namun, meskipun memiliki dasar ekonomi dan religius yang serupa, perbedaan dalam kerangka regulasi, inovasi keuangan, dan tingkat kematangan pasar menyebabkan variasi dalam kinerja institusional dan kepatuhan terhadap prinsip syariah. Penelitian ini bertujuan membandingkan kinerja keuangan dan kepatuhan syariah bank umum syariah di kedua negara dengan menggunakan Sharia Conformity and Profitability Index (SCnPI), yang mengintegrasikan indikator kepatuhan syariah—Rasio Kinerja Zakat (ZPR), Rasio Bagi Hasil (PSR), dan Rasio Pendapatan Syariah (IIR)—dengan indikator profitabilitas—Return on Assets (ROA), Return on Equity (ROE), dan Net Profit Margin (NPM). Penelitian kuantitatif ini menggunakan data sekunder dari 25 bank umum syariah (12 dari Indonesia dan 13 dari Malaysia) periode 2022–2023 yang dipilih melalui metode purposive sampling. Analisis data dilakukan menggunakan uji normalitas Shapiro–Wilk dan uji komparatif t-test sampel independen atau uji peringkat bertanda Wilcoxon. Hasil penelitian menunjukkan perbedaan signifikan pada PSR dan NPM, di mana bank syariah Indonesia memiliki PSR lebih tinggi karena dominasi pembiayaan musyarakah, sedangkan Malaysia memiliki NPM lebih tinggi yang mencerminkan efisiensi biaya dan manajemen laba yang lebih baik. Indikator lainnya tidak menunjukkan perbedaan signifikan. Temuan ini menegaskan pengaruh sistem tata kelola dan orientasi manajerial terhadap kinerja keuangan serta pentingnya peningkatan transparansi, mekanisme bagi hasil, dan efisiensi operasional dalam memperkuat ketahanan perbankan syariah di kawasan.

Abstract

This paper aims to map the public perception of the existence of pop up markets in driving the local economy and to explain the SWOT analysis of the prospects for the sustainability of pop up markets in Pekalongan City. The research used a qualitative approach by using primary data sources and secondary data sources. Primary data was obtained through  in-depth interviews with stakeholders which were determined by purposive sampling and observation. Secondary data sources were obtained from library studies. The data obtained was then analysed using an interactive model. The findings show that the perception of stakeholders about the existence of the tiban market in driving the local economy is quite diverse although some assess it negatively, but most of the public thinks that the existence of the tiban market is considered positive. Meanwhile, from the SWOT analysis, the existence of pop up markets to drive the local economy in Pekalongan City is considered quite prospective with several requirements that must be met, including strengthening synergy and cooperation between stakeholders and providing adequate attributes and legal policies.

Abstract

A justice is the essence of the law, but its presence is often overlooked in the name of legal certainty. These loopholes are often manipulated by parties to serve his own interests. The judge's decision is basically a representation of the legal behavior of judges in deciding cases. The judges' verdict is a legal non-sterile products of interest, so sometimes nuanced decision sharply downward and upward blunt. As a result, the practice of law becomes increasingly brighten commodity of judicial mafia practices. To cut commodity of law, the role of judges into a strategic entrance to spread spirituality progressive law in order to achieve social justice.

Abstract

The tradition of the legal system is actually a human product based on the three ordinates. There are human, environment and law, and then the legal traditions that exist in the world become diverse. The development of Indonesian law traditions is a timeless and dynamic project. Therefore, although the dominance of civil law is thick in the tradition of Indonesian, but the creativity, innovation and synthesis method can make the tradition of Indonesian legal system is tradition of campursari (mixed). As a result, the Civil law tradition, the common law tradition and the Islamic law tradition are easily found in the practice of law in Indonesia. The tradition of constructing a campursari-style legal system needs to be established and developed to create an Indonesian law system based on Pancasila, but does not ignore the present aspect.

Abstract

Anggaran Responsif Gender (ARG) adalah salah satu alat kebijakan publik yang dapat mendorong perubahan sosial secara massif yaitu terwujudnya berkeadilan gender, dan perempuan memiliki potensi untuk mewarnainya, tetapi realitasnya tidak demikian. Tujuan paper ini adalah mengungkapkan fakta tentang nilai-nilai serta faktor-faktor yang menyebabkan partisipasi perempuan dalam perencanaan anggaran responsif gender di Kelurahan Bumirejo yang masih rendah, padahal jumlah perempuannya lebih banyak dibanding laki-laki. Fakta ini menarik dalam prespektif teori budaya hukum dan teori pertukaran sosial. Analisis memperlihatkan bahwa budaya hukum bernuansa negatif, karena ada nilai-nilai budaya serta pertimbangan individu berbasis pada dimensi rasionalisasi untung rugi perempuan itu sendiri. Adanya konflik serta pertarungan ideologi maupun nilai-nilai praxis tertentu yang dikukuhi. Mereka memandang keikutsertaan dalam musrenbang adalah kegiatan yang mubazir (sia-sia), mereka bukan siapa-siapa dan aspirasinya sudah terwakili oleh PKK. Sedangkan faktor-faktor yang mempengaruhi adalah kuatnya budaya patriarkhi dan rasionalitas pertimbangan untung rugi dari aspek finansial (ekonomi). Riset ini bertradisi penelitian kualitatif dengan pendekatan socio legal. Riset ini mengunakan sumber data primer maupun skunder yang diperoleh melalui obvervasi, wawancara mendalam serta studi dokumentasi. Untuk mengecek keabsahan data digunakan triangulasi sumber data dan metode dan analisisnya dengan mengunakan model interaktif.

Abstract

Domestic violence remains a persistent social problem in Indonesia despite the enactment of the Law on the Elimination of Domestic Violence (Law No. 23/2004). The persistent discrepancy between legal norms and their enforcement, evidenced by low reporting levels and reliance on non-legal dispute resolution, signals a crisis of legal legitimacy. This study aims to identify public meaning distortions regarding domestic violence in Pekalongan, Central Java Indonesia and analyze their implications for the delegitimization of the law. Employing a socio-legal approach, data were collected through interviews, observations, and questionnaires involving 50 informants in Pekalongan. The findings identify four principal forms of distortion: domestic violence is perceived as a private family matter (38%), a means of discipline or instruction (20%), a source of social disgrace (18%), or an act that is not considered criminal (14%). Only 10% of informants defined it as a legal crime. Consequently, respondents preferred family mediation (34%) or divorce (26%) over court proceedings (10%). Symbolic Interactionism analysis reveals that social interactions prioritize symbols of family harmony and honor over victims' rights, diverting cases from the judicial system. Viewed through the perspective of Symbolic Interactionism, the study finds that social interactions often prioritize family harmony and social honor over the rights of victims, which ultimately diverts cases from the formal justice system. The study concludes that legal ineffectiveness stems from deep semiotic conflicts, underscoring the need to reconstruct public meanings to align domestic violence with criminal justice principles.

Abstract

After the breaking off of Banjarsari market of Pekalongan City, the small vendors of the market came up and did not give up with the condition. They made an institution called PARTI or PASTI –standing for pasar tiban – to hold a temporary market to make them survive economically. The problems to be answered in this research are what the social capital values that are acknowledged and institutionalized among the vendors; how they struggle to survive; and what factors that support and hamper their struggle. To answer those problems, this research used qualitative approach by observation and in-depth interview to collect data. Key informants were selected purposively using snowball sampling. Data triangulation was used to validate the collected data. The result of this research shows that social capital values i.e. trust, values-norms, participation, and structure based on Islamic values and built up through social interaction between the vendors and their stakeholders can put the society’s economic wheel in motion and also build social structure more effective, efficient, and communicative. The ability strategy done by them to survive and exist is that they are able to maintain their ability in increasing their turnover, number of costumers, capital, and family’s welfare, and their ability to make good relationship among them, and between them and local community and administration. In fact, the existence of temporary market has not only support factors but also hamper factors.

Abstract

Pasca pemberlakuan UU No 23 Tahun 2004 tentang Penghapusan Kekerasan Dalam Rumah Tangga (PKDRT) ternyata tidak otomatis mengurangi jumlah angka KDRT di wilayah hukum PN Pekalongan. Konstruksi hakim dalam memutus kasus KDRT dalam perspektif legal hermeneutic menjadi poin penting, mengingat putusan hakim memiliki posisi yang sangat strategis sebagai law as a tool of social control dan law as a social engineering. Permasalahan yang diangkat: pertama bagaimanakah konstruksi hukum hakim untuk memutus kasus KDRT di PN Pekalongan dalam perspektif legal hermeneutic; kedua, faktor-faktor apa sajakah yang mempengaruhi konstruksi hukum hakim dalam memutus kasus KDRT tersebut?; Hasil penelitian menunjukkan bahwa 1). Putusan Hakim PN Pekalongan dalam memutus pekara KDRT telah melakukan 3 tahapan dalam legal hermeneutic, yakni teks, konteks dan kontekstualisasi meskipun sangat sederhana dengan metode interpretasi gramatikal, dan 2). Putusan hakim PN Pekalongan ternyata selain mempertimbangkan faktor-faktor hukum (yuridis) ternyata juga memperhatikan faktor-faktor non hukum, yakni sikap dan penampilan dari terdakwa dan saksi.

Abstract

This sociolegal research was aimed to understrand the judgeís comprehension toward mediation in private lawsuit procession. This comprehension was so urgent in order to understand how pragmatism practice could infiltrate in law court. To do so, I used symbolic interaction approach and model to analyze the data, that snowball-purposively gathered from the Judges. The locus of this study located in Pekalongan District Court (Pengadilan Negeri). The study showed some divergences opinion among judges in understanding the laws/norms/statutes of mediation both, textually and contextually (as they applied the text of norm in their cases). So, it effected on the implimentation of enforcement and made them tend to pragmatic in doing mediation as formalistic-routine procedure. The roots of this attitude came from internally factors such pragmatism itself and externally ones, pragmatism among the parties of lawsuit and their advocaats.
