Abstract

Pekalongan Regency is one of the regions that has held the title of child-friendly City in the Central Java Province region since 2015, the primary criteria for which this award was directly given by the Ministry of Women's Empowerment and Child Protection of the Republic of Indonesia in Semarang, after carrying out an intensive assessment in 2014 In 2021, Pekalongan Regency succeeded in winning the Child Friendly City (CFC) award again with intermediate criteria and won the Parahita Ekapraya Award (APE) five times. Pekalongan Regency has received the Child Friendly City (CFC) awards with average criteria from 2015, 2017, 2018, 2019, 2021, 2022 and 2023. However, the high number of children's rights that have not been fulfilled, stunting, children not in school (ATS), Ownership of children's birth certificates in Pekalongan Regency is still said to be quite high. This research uses empirical juridical research using a qualitative approach. The data obtained are primary data and secondary data. Meanwhile, data collection techniques emphasize observation, interviews and documentation. The results of this research have not been implemented well because it has not run ideally and not all related fields or departments can be equal in terms of fulfilling children's rights. Several departments that carried out research included the Education Service, Health Service, Population and Civil Registration Service, Women's Empowerment and Child Protection Service and the Regional Development Planning Agency. In this case, the fulfillment of children's constitutional rights within the Child Friendly Regency (CFC) framework in the Regency Pekalongan can run ideally if the three elements of the Welfare State theory are fulfilled.

Abstract

Online gambling in Indonesia increasingly exposes women and children to financial-based violence, making them vulnerable groups. Despite the rise in online gambling, current legal policies and rehabilitation programs have failed to fully address its harmful social effects. This study analyzes the criminogenic factors that contribute to victimization among women and children and evaluates the effectiveness of criminal law policies and rehabilitation programs in safeguarding them. Through a normative legal research method, utilizing legislative analysis, criminology, and case studies, the findings reveal that existing policies are inadequate and overlook the complexity of financial violence in this context. Rehabilitation programs also tend to be less effective, focusing primarily on legal and therapeutic approaches while neglecting broader social, economic, and cultural influences. This research proposes a more comprehensive and rehabilitative policy framework that not only seeks to punish offenders but also prioritizes prevention, reducing violence recurrence, and enhancing social reintegration for victims.

Abstract

Violence against women occurs not only within households but also in pre-marital relationships, as exemplified by the ngemblok tradition practiced by the Muslim community in Rembang, Central Java. This tradition involves a marriage proposal process where the woman’s family presents goods (seserahan) to the prospective groom to symbolise the binding of their pre-marital relationship. This article aims to analyse the ngemblok tradition, examining the reasons and experiences of those involved, particularly women, and assessing the tradition from the perspectives of state law and human rights. Through in-depth interviews with 16 key informants, including participants in the tradition, the study found that ngemblok facilitates acquaintance between the bride and groom and their families through a matchmaker appointed by the woman’s family. The patriarchal culture grants the woman’s parents, especially the father, unilateral authority in selecting a partner for their daughter, often leading to sexual and psychological violence. Women frequently feel compelled to comply with their parents’ wishes to avoid social stigma and sanctions and to uphold ancestral traditions. This article argues that patriarchal cultural mechanisms render women powerless in ending pre-marital relationships, undermining gender equality and human rights, and perpetuating violence against women. [Kekerasan terhadap perempuan tidak hanya terjadi dalam rumah tangga, tetapi juga dalam hubungan pranikah. Fenomena tersebut terdapat dalam tradisi ngemblok yang dipraktikkan oleh komunitas muslim di Rembang, Jawa Tengah. Tradisi ini merupakan prosesi peminangan perkawinan yang diinisiasi oleh keluarga perempuan dengan memberikan sejumlah barang (seserahan) kepada calon pengantin laki-laki sebagai simbol pengikatan hubungan pranikah antara kedua calon pengantin. Artikel ini bertujuan untuk menganalisis tradisi ngemblok, alasan dan pengalaman para aktor, terutama perempuan, dalam mempraktikkannya serta bagaimana perspektif hukum negara dan Hak Asasi Manusia terhadap tradisi tersebut. Melalui wawancara secara mendalam dengan 16 informan kunci yang terdiri dari sejumlah aktor yang terlibat dalam tradisi ini, penelitian ini menemukan bahwa tradisi ngemblok bertujuan untuk memfasilitasi kedua calon pengantin dan keluarga untuk saling mengenal dengan perantara mak comblang yang ditunjuk oleh keluarga perempuan. Budaya patriarki mengakibatkan orang tua dari perempuan, terutama ayah, memiliki otoritas sepihak dalam mencarikan pasangan bagi putrinya. Bahkan berkontribusi terhadap kekerasan seksual dan psikologis yang dialami perempuan mereka dalam hubungan pranikah tersebut. Para perempuan sering kali terpaksa mengikuti keinginan sepihak orang tuanya untuk menghindari stigma dan sanksi sosial dari masyarakat serta menjaga tradisi yang telah diwarisi oleh nenek moyang. Artikel ini berargumentasi bahwa mekanisme budaya berbasis patriarki menyebabkan ketidakberdaayaan perempuan sebagai korban dalam mengakhiri hubungan pranikah yang tidak hanya mencederai prinsip-prinsip kesetaraan gender dan Hak Asasi Manusia, tetapi juga pembiaran terhadap perlakuan kekerasan terhadap perempuan.]

Abstract

The problem of the Qibla direction of the mosque is still one of the things that often occurs in society. In the modern era that has been equipped with sophisticated tools in determining the Qibla direction, there are still mosques and musala that are not facing the Qibla, moreover mosques that are hundreds of years old with traditional equipment. Pekalongan has three historical mosques: Aulia Sapuro Mosque, Jami' Mosque of Pekalongan City and Wakaf Mosque, which was the beginning of the spread of Islam in Pekalongan. This article aims to find out the history of the oldest mosque in Pekalongan and determine the accuracy and tolerance of its Qibla direction. This research is a qualitative research and data collection uses the field through interviews and observations. The data analysis technique uses comparative descriptive. The results of this article are as follows: The determination of the Qibla direction by 3 methods (Compass, Compass and magnetic declination, Local Ra?du Qiblah) shows the largest inclination in the Qibla direction of the Aulia Sapuro Mosque used the Local Ra?du Qiblah method and the smallest inclination in the Qibla direction of the Wakaf Mosque used the compass method. The inclination of the Qibla direction of the 3 mosques is still included in the category of Qibla direction tolerance, so it is valid to pray in the mosque.

Abstract

The online gambling industry in Southeast Asia has become a strategic platform for transnational criminal syndicates to commit crimes such as money laundering, labor exploitation, and human trafficking. This study uses an interdisciplinary approach—including legal analysis, criminology, and social studies—to examine the involvement of Indonesian citizens (WNI) as the main victims in exploitation networks operating in countries such as Cambodia, Myanmar, and Malaysia. Although most of the literature and discussions reflect the broader Southeast Asian regional context, this research focuses specifically on the situation of Indonesian migrant workers. The study highlights the criminal methods employed by syndicates, regulatory weaknesses at both national and international levels, and the challenges facing effective cross-border cooperation. In addition, important aspects of increasing the capacity of law enforcement, especially in tracking digital transactions and protecting victims, are also discussed. The findings show that exploitation of Indonesian citizens occurs systematically and involves various actors across jurisdictions. Therefore, a comprehensive legal approach, stronger regional cooperation under ASEAN, and policies for the protection of migrant workers based on human rights are needed. The policy implications of this study focus on concrete steps that the Indonesian government can take to effectively respond to the complexity of this crime.

Abstract

Criminal law is often built on the paradigm of giving suffering to perpetrators of crime. This paradigm is no longer in accordance with the concept of modern punishment which focuses on efforts to foster criminals so that they would no longer repeat their actions. The changes in the paradigm of punishment, to some extent, have been accommodated by Article 73 of the Criminal Code Bill which contains alternative provisions/criminal sanctions.in jail. With this provision, a prisoner with one year or under punishment is able to repay his sentence as long as there are certain emergency conditions leading to a precarious situation/worry to him if he has to undergo consecutive penalties. This study tries to examine the new provision, using a normative juridical approach from the perspective of Islamic law. This study concludes that the paradigmatic change in punishment as shown in article 73 of the Criminal Code Bill has conformity with the perspective of maqâshid al-syarî’ah which put forward the 5 (five) main objectives in the law, namely maintaining and nurturing religion (al-dîn), soul (al-nafs), descent (al-nasl), wealth (al-mâl), and mind (al-aql).

Abstract

This article examines the criminal law policy in Indonesia regarding the increasing incidence of sexual violence crimes, primarily affecting women. The study adopts a literature research approach, utilizing data from legal regulations in Indonesia and various scholarly works related to the subject. Employing a gender equality approach and maqāsid al-sharī'a, the article concludes that while Indonesia possesses legal regulations addressing sexual crimes, these laws are dispersed across different statutes, resulting in diminished effectiveness. The enactment of the Law on Sexual Violence (UU TPKS) in 2022 signifies a noteworthy development in Indonesia's legal framework concerning sexual violence. This legislation is structured in a more organized and comprehensive manner, incorporating several reforms. Consequently, it instills optimism for enhanced endeavors to eliminate and prevent sexual violence. From an Islamic standpoint, the regulation of sexual violence aligns with the fundamental principles and objectives of Islamic law (maqāsid al-sharī'a). These principles aim to actualize the well-being and benefit of humanity while simultaneously preventing crimes that pose threats to human existence and dignity.   Artikel ini mengkaji kebijakan hukum pidana di Indonesia dalam mengatasi praktik tindak pidana kekerasan seksual yang cenderung meningkat dari waktu ke waktu dan perempuan adalah pihak yang paling banyak menjadi korban tindak kejahatan ini. Artikel ini merupakan penelitian kepustakaan yang sumber datanya didasarkan pada peraturan-peraturan hukum di Indonesia dan sejumlah karya ilmiah yang berkaitan dengan topik kajian ini. Menggunakan pendekatan kesetaraan gender dan maqāsid al-sharī’a artikel ini menyimpulkan bahwa Indonesia sebenarnya telah memiliki sejumlah peraturan hukum tentang tindak pidana kejahatan seksual. Namun demikian, aturan-aturan hukum tersebut disusun secara parsial dan tersebar di berbagai peraturan perundang-undangan sehingga menjadikannya kurang efektif. Lahirnya Undang-undang Tindak Pidana Kekerasan Seksual (UU TPKS) pada tahun 2022 menandai adanya perkembangan baru dalam pengaturan hukum tindak pidana kekerasan seksual di Indonesia. Undang-undang ini disusun secara lebih sistematis dan komprehensif dengan sejumlah pembaruan yang ada di dalamnya sehingga ia telah memberikan harapan baru bagi upaya pemberantasan dan pencegahan terhadap praktik kekerasan seksual. Dalam perspektif Islam, pengaturan tentang tindak pidana kekerasan seksual ini selaras dengan prinsip dasar dan tujuan disyariatkannya hukum Islam (maqāsid al-sharī’a), yang ingin mewujudkan kebaikan dan kemaslahatan umat manusia dan sekaligus mencegah terjadinya tindakan kejahatan yang bisa mengancam eksistensi dan kehormatan manusia.

Abstract

This study examines the alignment between Pancasila values and religious moderation in Indonesia's criminal law reform. The old Criminal Code, inherited from the colonial era, has been criticized for its lack of social justice and religious freedom. The key problem addressed is how the new Criminal Code can embody Pancasila values while preventing religious radicalism and extremism. Observations focus on articles in the old code that are seen as unresponsive to human rights and plurality. A juridical-normative approach is employed, analyzing the new Criminal Code's relationship with Pancasila and religious moderation principles. The analysis includes primary legal documents, such as the new Criminal Code, and relevant secondary literature. Philosophical, historical, and normative methods are used to develop legal logic aligned with Pancasila, aiming to solve the problem of religious intolerance. The results indicate that the new Criminal Code introduces significant reforms to protect religious freedom, focusing on preventing radicalism and enhancing rehabilitative sanctions. These reforms represent a major step towards a more inclusive and just legal system. The conclusion drawn is that the new Criminal Code is expected to harmonize criminal law with Pancasila values and religious moderation, providing more humanistic and preventive approaches to religious issues. This research contributes by offering a new perspective on criminal law reform that emphasizes national values and presents a legal model more suited to Indonesia’s diverse society.

Abstract

                                                      AbstrakTulisan ini mengkaji tentang uji akurasi deklinasi matahari yang merupakan salah satu data syarat untuk menentukan waktu sholat, titik koordinat tempat, rukyatul hilal dengan menggunakan I-zun Dial. Salah satu alat untuk menentukan deklinasi Matahari pada era kontemporer adalah penemuan baru karya M. Ihtirozun Ni’am yang bernama I-zun Dial. Penelitian ini dilakukan untuk menjawab bagaimana metode penentuan deklinasi Matahari dengan menggunakan I-zun Dial dan relevansinya jika diimplementasikan, serta  bagaimana akurasi metode penentuan deklinasi Matahari dengan menggunankan I-zun Dial. Jenis penelitian ini adalah penelitian kualitatif. Hasil penelitian ini menunjukkan metode penentuan deklinasi Matahari dengan menggunakan I-zun Dial. Dilihat dari cara penggunaannya, dalam metode ini, harus terlebih dahulu diketahui titik koordinat tempat, waktu kulminasi, titik arah utara sejati, dan jarak zenith Matahari dengan bantuan gnomon dan satuan ukuran sentimeter pada bidangnya, sehingga praktis dan mempermudah penggunanya. Akurasi metode penentuan deklinasi Matahari menggunakan I-zun Dial dikategorikan akurat, karena jika hasilnya dibandingkan, data deklinasi Matahari yang ditampilkan I-zun Dial, Almanak Nautika dan Ephemeris setelah melalui proses pengujian menunjukkan selisih yang hanya berbeda pada nilai menitnya saja, dibuktikan dengan  kesepuluh uji coba dalam penelitian ini, semuanya menunjukkan selisih menit.Keywords: Uji Akurasi, Deklinasi dan I-zun Dial

Abstract

Legal protection for children must begin as early as possible, so that one day they can participate optimally for the development of the nation and state. Child protection is an embodiment of justice in a society, which must be endeavored in various fields of state and community life. This study aims to understand and examine the legal protection of children in the study of legislation outside the Criminal Code. This type of research used in this paper using the normative juridical approach method considering the problems studied and studied in addition to holding on to juridical aspects that is based on norms, regulations, legal theories. The specifications used in this study are analytical descriptive because this study is expected to obtain a clear, detailed and systematic picture. The results showed that the legal protection of children in the study of legislation outside the Criminal Code is regulated in Law Number 35 of 2014 concerning Amendments to Law Number 23 of 2002 concerning Child Protection and Law of the Republic of Indonesia Number 11 of 2012 concerning Juvenile Justice System. Protection that is obliged to be given is legal protection both preventively to prevent disputes and repressively to resolve problems that occur. In addition, legal protection is given to children starting from the investigation stage to the implementation phase of decisions in Penitentiary.
