Abstract

The purpose of writing this scientific journal, among others, is to find out how the authority and discretionary weaknesses of the Police are as sub-elements of the structure of the criminal justice system in Indonesia, as well as the professionalism of the police in dealing with the weakness of discretionary authority based on the criminal justice system in Indonesia. A legal power known as discretion allows law enforcement officials, particularly police officers, to take action in unique circumstances in line with their own judgments and moral code. With an administrative and comparable approach, this paper employs an empirical legal research methodology. The results of the study show that the practice of applying discretion by the police is highly dependent on the subjectivity in question. Police professionalism is needed in order to carry out their duties properly as maintainers of security and order in society and as law enforcers.

Abstract

The Attorney General's Office is an institution that plays an important role in law enforcement in Indonesia, it is also an institution that can provide a sense of justice for people who commit crimes. In this journal, the issue raised is how the Genah Adhyaksa house or the Restorative Justice house can provide principles of justice for perpetrators of crimes and can reduce crime rates, especially in the area of the Gianyar District Attorney's Office. The purpose of writing this journal is to find out how the crime rate existed in the Gianyar district attorney's office before and after the existence of the Genah Adhyaksa House or the Restorative Justice House, whether it increased, according to, or was static. The research method used is the empirical research method. The results of this study are that the crime rate in the Gianyar District Prosecutor's Office has decreased slightly when compared to previous years before the existence of the Genah Adhyaksa Restorative justice house. However, until this writing was written, the crime rate at the Gianyar State Prosecutor's Office was still quite high because these crimes arise from the personal conscience of the person who committed the crime. Abstract

The present existence of information technology dramatically affects people's lives. Technology with all the programs and conveniences offered makes it possible for people to be able to use the technology. Its users often ignore security for themselves. Cyberbullying is an immoral act committed through electronic media, one of which is body shaming. Body Shaming is an aggressive and repeated behavior by individuals and groups to comment on a person's body shape by using electronic technology as a medium to attack others. Body shaming cannot continue to be left alone because the impact the victim has can damage one's mental health and is also dangerous because it can be done anywhere and anytime. With the main discussion on this study, Do Legal Protection Forms Against Victims of Body Shaming Crimes on Social Media and Urgency of Legal Protection for Victims of Body Shaming Crimes on Social Media. Research results show that legal protection against victims of body shaming crimes on social media can be seen from the provisions of Law No. 1 13 of 2006, LPSK Regulation Number 6 of 2010, and article 27 paragraph 3 of the ITE Law. However, the current regulations are not yet effective in solving the body shaming problem on social media.

Abstract

The purpose of this study is to analyze the new paradigm in the protection of crime victims in Indonesian criminal law through the implementation of restorative justice, by identifying and comparing the laws of countries that have successfully implemented it, to determine the extent to which the principle has been accommodated in the national legal system. The research method used is normative legal writing with a statutory regulatory approach, legal concept analysis, and comparative law. The results indicate that the paradigm for protecting crime victims in Indonesian criminal law remains dominated by a retributive approach focused on perpetrators, while victims tend to be passive and lack comprehensive recovery. Although regulations such as the Criminal Procedure Code and the Law on Witness and Victim Protection exist, their implementation has not systematically integrated restorative justice principles. This study highlights the need for a new paradigm that places victims as the main subject through a restorative justice approach based on dialogue, recovery, and active participation. Through comparative analysis of practices in New Zealand, Canada, and the Netherlands, it is shown that restorative justice can be effectively implemented if supported by clear regulations, institutional support, and awareness among law enforcement officers. Therefore, the Indonesian criminal law system needs to be updated by formulating a contextual, just, and sustainable restorative justice-based victim protection model, to create a justice system more responsive to victims’ needs.

Abstract

Penelitian ini menelaah pertanggungjawaban pidana atas penyalahgunaan dana di Lembaga Perkreditan Desa (LPD) dengan fokus pada batas penerapan tindak pidana korupsi terkait keuangan negara. LPD merupakan lembaga keuangan milik desa adat dengan dana berasal dari kontribusi masyarakat, sehingga secara formal tidak termasuk dalam APBN maupun APBD. Namun, praktik peradilan kerap mengaitkan kasus penyalahgunaan dana LPD dengan delik korupsi, menimbulkan perdebatan mengenai relevansi unsur kerugian keuangan negara. Penelitian ini menggunakan pendekatan yuridis normatif melalui analisis peraturan perundang-undangan, putusan Mahkamah Konstitusi, serta doktrin hukum pidana dan keuangan negara untuk menegaskan kerangka konseptual pertanggungjawaban pidana. Hasil penelitian menunjukkan bahwa tidak semua penyalahgunaan dana LPD otomatis termasuk tindak pidana korupsi, terutama jika tidak terbukti adanya kerugian nyata terhadap keuangan negara sebagaimana diatur Pasal 2 dan 3 UU Tipikor. Aset LPD lebih tepat dipandang sebagai aset komunitas adat, sehingga pelanggaran lebih relevan dikualifikasikan sebagai penggelapan atau penggelapan dalam jabatan menurut Pasal 372 dan 374 KUHP. Penelitian ini menegaskan pentingnya pembedaan antara kerugian negara dan kerugian komunitas adat agar penegakan hukum sejalan dengan asas legalitas dan prinsip proporsionalitas. Selain itu, diperlukan regulasi yang lebih spesifik mengenai mekanisme pertanggungjawaban pidana dan perdata bagi pengelola LPD, guna menjamin keberlanjutan fungsi LPD sebagai lembaga ekonomi adat sekaligus memastikan akuntabilitas pengelolaan dana masyarakat.

Abstract

Penelitian ini menelaah peran intelijen kejaksaan dalam pengungkapan dugaan tindak pidana korupsi di Kejaksaan Tinggi Bali. Tujuan penelitian adalah menguraikan fungsi intelijen, mekanisme kerja, serta hambatan yang mempengaruhi proses identifikasi dan pengumpulan informasi awal. Pendekatan penelitian bersifat kualitatif dengan desain studi kasus. Teknik pengumpulan data meliputi wawancara semi-struktural dengan pejabat intelijen dan penuntut umum, kajian dokumen perkara, serta observasi kegiatan terkait. Analisis dilakukan secara tematik untuk mengungkap pola kerja, koordinasi antar-institusi, dan kendala sumber daya serta regulasi. Hasil menunjukkan bahwa intelijen kejaksaan berperan strategis dalam deteksi dini dan penyediaan bahan perkara, namun efektivitasnya terhambat oleh keterbatasan personel, akses informasi, dan prosedur hukum yang kompleks. Penelitian merekomendasikan peningkatan kapasitas teknis, mekanisme koordinasi terpadu, dan penyusunan pedoman operasional untuk memperkuat kontribusi intelijen dalam pemberantasan korupsi. Rekomendasi diarahkan pada peningkatan sumber daya manusia, akses informasi, dan harmonisasi prosedur antar-instansi penegak hukum untuk hasil yang optimal. Penelitian ini diharapkan dapat menjadi kontribusi akademik dan praktis bagi penguatan peran intelijen kejaksaan sebagai garda terdepan dalam upaya pencegahan serta pemberantasan tindak pidana korupsi di Indonesia.

Abstract

Tujuan dari penelitian ini adalah untuk menganalisis diskresi jaksa dalam penanganan perkara pidana, dengan focus pada dialektika antara asas kemanfaatan dan kepastian hukum. Diskresi jaksa merupakan kewenangan penting yang diatur dalam Undang-Undang Nomor 11 Tahun 2021 tentang Perubahan Atas Undang-Undang Nomor 16 Tahun 2004 tentang Kejaksaan Republik Indonesia dan Kitab Undang-Undang Hukum Acara Pidana (KUHAP). Penelitian ini menggunakan metode penelitian hukum normative dengan pendekatan perundang-undangan (statute approach) konseptual (conceptual approach), dan analitis (analytical approach) untuk mengkaji bagaimana jaksa menyeimbangkan kedua asas tersebut. Hasil penelitian menunjukkan bahwa asas kemanfaatan mendorong jaksa untuk mempertimbangkan dampak sosial dan rehabilitative, seperti dalam kasus diversi pada anak, sementara asas kepastian hukum menuntut konsistensi dan akuntabilitas. Ketegangan antara kedua asas ini Adalah inti dari tantangan dalam praktik kerja jaksa. Penggunaan diskresi yang tidak seimbang dapat menimbulkan ketidakpastian hukum, sementara kekakuan tanpa kemanfaatan dapat mengabaikan keadilan substantif. Maka dalam penelitian ini, terdapat hasil analisis dimana keseimbangan harmonis antara kemanfaatan dan kepastian hukum adalah kunci untuk menciptakan penegakan hukum yang adil dan responsif. Untuk mencapai keseimbangan ini, diperlukan penguatan kapastias jaksa melalui pelatihan, standardisasi pedoman yang lebih transparan, serta optimalisasi mekanisme dari pengawasan kinerja baik secara internal dan eksternal. Kejaksaan dapat mengadopsi pendekatan holistic yang tidak hanya berpegang pada teks hukum akan tetapi juga mempertimbangkan konteks sosial untuk mencapai keadilan yang lebih komprehensif.

Abstract

Penelitian ini dibuat dengan tujuan untuk dapat mengetahui berkenaan dengan penerapan dan pengaturan asas praduga tak bersalah dalam penyelesaian perkara pidana dan menjawab permasalahan yang dihadapi tersangka dalam memperoleh hak pada proses peradilan pidana. Adapun metode yang dipergunakan di kajian ini mempergunakan metode penelitian hukum normatif dan melalui pendekatan terhadap peraturan perundang-undangan yang berlaku. Berdasarkan temuan dari kajian ini memperlihatkan bahwasanya pengimplementasian dari asas praduga tak bersalah di Indonesia masih belum secara keseluruhan diterapkan dengan baik, sebab belum adanya pengaturan yang secara tegas mengatur hak-hak yang tersangka miliki pada proses perkara pidana, dikarenakan KUHAP sendiri hanya menegaskannya dalam penjelasan umumnya saja serta pengaturan lainnya diatur pada UU No. 48 Tahun 2009 Tentang Kekuasaan Kehakiman. Lebih lanjut, pada praktik penerapan asas ini ditemukannya berbagai permasalahan yang mengarah pada ketidakadilan atas hak yang tersangka miliki pada proses peradilan pidana, dan hanya menitikberatkan kepada kepentingan di satu pihak saja yaitu aparat penegak hukum, sehingga untuk dapat mewujudkan keseimbangan antara hak dari tersangka dan aparat penegak hukum perlu adanya suatu aturan yang jelas untuk dapat mengatur kedudukan dari antara keduanya serta agar tercapainya tujuan hukum.
