Abstract

The application of the Online Single Submission (“OSS”) is implemented by the government in order to streamline the business licensing process which has been considered very inefficient and requires a lot of time and money, requiring all Limited Liability Companies (“PT”) established under the laws of the Republic of Indonesia to obtain a Business Identification Number. (“NIB”) and further adjust the permits previously obtained by each of the PT, both those related to operations and non-operations, with the permits issued by OSS. As a result of the implementation of the OSS, companies that have applied for and obtained a Business Permit (Target Business Registration Certificate) but have not yet become effective, must fulfill other commitments, one of which is the Certificate of Feasibility of Function (“SLF”). The formulation of the problem in this study: (i) Application of the arrangement of the Function Feasibility Certificate (SLF) for buildings in the Province of Bali, (ii) the urgency of the implementation of the Commitment to the Certificate of Feasibility of Function (SLF) in the Province of Bali. This research uses normative legal research methods, with a statutory approach and legal concept analysis. The theory used in examining the problems in this research is the theory of economic law, the theory of state sovereignty and the conception of law as a policy process. Through this research, it can be determined the urgency of implementing the commitment to the Certificate of Functional Worth (SLF) for buildings in Denpasar City. Consistency of professional application based on justice, certainty and legal benefits by the government is needed so as to create economic growth through ideal and sustainable tourism in Bali. The benchmark for implementing the SLF commitment is by taking into account various legal factors and the efficiency of government policies in a deep, structured and systematic manner.

Abstract

Culture-based tourism is one of the sustainable tourism assets that contains unique cultural and natural traditions in an area. If we explore it more deeply, each village must have its own charm that contains various objects as noble values that can inspire tourists to village-based destinations, known as sustainable tourism. Bali as a tourism destination, known for its strong culture, pays serious attention to the sustainable tourism. One of the tourist villages in the area is Carangsari Village, which is located in Badung Regency. The village is trying to restore the tourism sector which has become the focus of the village community after it was stopped due to the spread of the corona virus. Motivated by the condition, this study is made to discuss the ideal recovery strategy for a sustainable tourism sector in the Carangsari village, Bali. This study makes use of an empirical legal research method with a statutory approach and an analysis of legal concepts. The results of this study indicate that a simple ideal recovery strategy is to add a schedule of sacred rituals in the tourist calendar in addition to the schedule of festivals existing in Bali.

Abstract

The potential for spiritual tourism in Bali, especially in the Gianyar district, is very high, bearing in mind that the traditions and culture of most people in Bali have never been separated from the concept of tri hita karana. Gianyar as one of the regional cultural icons with very thick customs. Spirituality as a community identity is still preserved and passed down from generation to generation from ancestors to the present day. Since the last two decades, the need for spiritual tourism has been increasingly in demand by foreign and domestic tourists. Melukat is a symbol of the Balinese ritual system which is believed to invoke safety, health, welfare and cleanse the body and spirit so that humans can purify themselves to carry out their daily activities peacefully and peacefully. The tourist attraction of melukat has not been specifically regulated in local regulations. Bali Province No. 5 of 2020 concerning Standards for Implementing Balinese Cultural Tourism. If spiritual tourism is not managed properly by local village managers, these destinations can easily be damaged and polluted by tourists who do not understand the sacred meaning of these destinations. Therefore the specific target of this research is to see how the regulation regarding melukat spiritual tourism as a research method used is an empirical research method to find out if there are gaps that occur in the application of these regional regulations in the field. While the problem approach used, namely the statutory approach, conceptual approach, analytic approach. The results of the research show that the development of the spiritual tourism attraction of Melukat has not been optimally implemented in several places because there is no adequate information on the history, functions, program of annual ritual activities at the Melukat DTW, as well as provisions and entry ticket categories for foreign, domestic, and student tourists. and researchers who can be accessed online through a special spiritual DTW website.
