Abstract

Dalam proses jual beli indicator-indikator sering dianggap remeh oleh Masyarakat. Anggapan remeh ini sering terjadi karena ada beberapa kemungkinan yaitu Masyarakat yang tidak tahu proses jual beli tanah yang benar atau memang kurangnya penegak hukum untuk memberikan sosialiasi terkait hal tersebut. Sehingga hal-hal tersebut dapat mengakibatkan konflik atau sengketa. Seperti Pada Putusan No. 14/Pdt.G/2021/Pn Bkl yang terjadi antara Niwan (Penggugat) dengan Bu Sama sebagai (Tergugat), Kepala Desa Sobih (Tergugat 1), Kepala Kantor Pertanahan Kabupaten Bangkalan (Tergugat 2). Dalam penelitian ini akan meneliti tentang dasar pertimbangan hakim serta akibat yang ditimbulkan dari putusan tersebut. Metodologi yang digunakan dalam penelitian ini adalah normative dengan menggunakan bahan hukum primer dan bahan hukum sekunder serta menggunakan Teknik analisis prespiktif.

Abstract

Abstrak Notaris mempunyai tanggung jawab hukum secara perdata berkenaan dengan jabatannya, serta notaris bertanggung jawab apabila objek (SHM) yang ia simpan rusak ataupun hilang dari penguasaannya. Permasalahan antara Handoko Juwono melawan Dedy Wijaya pada putusan PN Nomor 877/Pdt.G/2022/PN Sby merupakan contoh perbuatan melawan hukum yang dilakukan dedy Wijaya selaku Notaris. Hal ini disebabkan karena notaris tidak melaksankan tugas dan kewajibannya dalam menyimpan sertifikat hak milik yang dititipkan kepadanya dalam perjanjian pengikatan jual beli tanah yang disepakati oleh para pihak. Namun perbuatan yang dilakukan oleh Notaris yaitu menghilangkan sertifikat hak milik atas tanah tersebut dapat merugikan pihak yang memberikan kepercayaan kepadanya, yaitu handoko Juwono tidak dapat membalik nama sertifikat tersebut dari pemilik lama menjadi nama sendiri. Penelitian ini menggunakan yuridis normatif. Yaitu penelitian ini ditujukan untuk menganalisis pertimbangan hakim dan akibat hukum dari Putusan No. 877/Pdt.G/2022/PN Sby mengenai tanggung jawab Notaris dalam menyimpan sertifikat. Penelitian ini menggunakan metode pendekatan perundang-undangan (statute approach), pendekatan kasus (case approach), dan pendekatan konseptual (conceptual approach). Metode analisis atas bahan hukum yang terkumpul adalah Metode Analisis Deskriptif guna untuk mengetahui benar atau salah pertimbangan hakim pada putusan PN nomor 877/Pdt. G/2022/PN Sby. Hasil dari penelitian ini sependapat dengan apa yang menjadi pertimbangan hakim dalam memutuskan perkara a quo bahwa tergugat menghilangkan sertifkat hak milik, perbuatannya telah memenuhi unsur-unsur perbuatan melawan hukum sebagaimana pasal 1365 KUH Perdata, akibat atas perbuatan Notaris yang merugikan orang lain dikenakan sanksi perdata yaitu mengganti kerugian materiil maupun immateril

Abstract

One of the plantation land conflicts that remains problematic and has yet to reach a consensus on the criminalization of agrarian conflicts is the Rotorejo Kruwuk Plantation in Gadungan Village, Gandusari District, Blitar Regency, and the Kelud Makmur Farmers Association. This study uses empirical legal research methods. The aim of the study is to identify facts related to the author's problem. The results indicate that legal resolution efforts in this agrarian conflict include mediation. Meetings held by several agencies such as the Village Head, Blitar Regency National Land Agency (BPN), the Company, the Regional Office Head, the Sub-district Head, the KPA Chair, the GTRA Team, the Gadungan Village Head, the Ministry of ATR/BPN, the Blitar City Police and the Blitar City Government in 2022 and 2023 resulted in ease in obtaining redistribution because the land status was designated as a Priority Location for Agrarian Reform. Despite the land redistribution, farmers still face obstacles in doing so, including: (1) the lack of clarity from the authorized agency regarding the legality deed; (2) the location of the proposed control does not match the PPKM's wishes; (3) the existence of land leases to other parties; (4) the existence of clashes in information and communication regarding extension of HGU; and (5) the boundary between residents' land and HGU land is not yet clear .

Abstract

This research explores the regulatory framework of BPJS Employment tariffs, focusing on workers whose wages fall below the Regency/City Minimum Wage (UMK). The study aims to examine how BPJS Employment regulates contribution payments between employers and workers earning below the UMK, as well as to analyze the legal implications arising from discrepancies in reported wages during BPJS registration. The research adopts a normative juridical method, grounded in the logic of legal science from a normative perspective. It views the law as a structured system of norms, principles, and statutory rules used to resolve legal issues. The study identifies a normative void in existing regulations, stemming from the unclear articulation of the wage components subject to BPJS contributions. To address this, the research applies legal reasoning by analogy. It concludes that in the absence of an official wage suspension, employers must comply with Article 32 paragraph (2) of Presidential Regulation Number 64 of 2020, which mandates adherence to the prevailing minimum wage standard. Moreover, companies that fail to register their employees with BPJS Employment are subject to administrative sanctions, including formal warnings, cessation of business operations, or revocation of business licenses. The study recommends regulatory clarification on wage components used in calculating contributions and stricter enforcement mechanisms to ensure compliance, particularly for vulnerable low-wage workers.

Abstract

The BPJS Law in article 14 states, "every person, including foreigners who have worked for a minimum of 6 (six) months in Indonesia, is obliged to become a participant in the Social Security program".  The partnership relationship means that there is no obligation for application companies to register their drivers with BPJS Employment. Therefore, work partners at the Gojek company must register themselves as BPJS participants independently. According to the Minister of Manpower Regulation Number 5 of 2021 in Article 32, it is stated that non-wage earners are required to take part in 2 programs, namely work accident insurance and death insurance. This research aims to find out the legal awareness of online motorcycle taxi drivers regarding their participation in work accident insurance and death insurance in the city of Surabaya. To achieve this goal, this research will use empirical legal research and an empirical juridical approach or legal sociology. The research results show that there are four indicators that can be used to measure the level of public legal awareness, including legal knowledge, legal understanding, legal attitudes, and legal behavior patterns. Each indicator shows a certain level of legal awareness, ranging from whether it is low or high. Based on the research results, Gojek online motorcycle taxi drivers in Surabaya who became informants were divided into those with very high legal awareness and those with moderate legal awareness. The level of legal awareness of Gojek online motorcycle taxi drivers is influenced by several factors.

Abstract

In Article 1 paragraph (11) of Law Number 2 of 2004 concerning Industrial Relations Dispute Settlement, Industrial Relations Mediation hereinafter referred to as mediation is the settlement of disputes over rights, interest disputes, employment termination disputes, and disputes between labor unions only within one company through deliberations mediated by one or more neutral mediators. According to this article, mediation at the Labor Office of Gresik Regency is led by one mediator totaling 6 industrial relations mediators. This study was conducted to find out first, how is the implementation of industrial relations dispute settlement between workers and employers through mediation at the Labor Office of Gresik Regency in 2021-2023? Second, what are the obstacles faced by industrial relations mediators in conducting mediation at the Labor Office of Gresik Regency in 2021-2023? This research uses empirical legal research methods with a socio-legal approach which is an approach from the perspective of society with data collection methods through interviews with mediators and workers, observations, and documentation. The research results indicate that: First, the implementation of mediation at the Labor Office of Gresik Regency has been carried out well with a success rate in mediation of over 50%, both through collective agreements and recommendations. Second, the obstacles encountered in the mediation process are due to various factors, namely the employer factor who is often late or absent from mediation sessions, the worker factor of lack of evidence and understanding of applicable regulations, and the mediator factor of insufficient number of mediators and facilities.

Abstract

The purpose of this study is to analyze the legal protection for the Parties against the Deed Minute as part of the Notary Protocol that was destroyed by fire and efforts to obtain a copy of the Deed as an interest for the Confronters after the Deed Minute was destroyed by fire. The research method used is normative research using a research approach in the form of a statutory approach using Article 28D paragraph (1) of the 1945 Constitution, Article 1889 paragraph (1) and paragraph (2) of the Civil Code, and Article 16 paragraph (1) letter b of the UUJN-P constructed by the method of legal discovery, namely Argumentum per analogiam and using a concept approach. The result of the research is that there is no regulation related to legal protection for the Parties if the Minute of Deed is damaged or destroyed due to fire or force majeure. Furthermore, regarding efforts to obtain a second or subsequent copy of the Deed for the Faces after the destruction of the Deed Minute due to fire.
