Abstract

ABSTRACT Caregivers and community stigmatize People With Schizophrenia (PWS). This phenomenon causes a very detrimental impact, including low reintegration of PWS into society and worsening of their social function. Anti-stigma-based psychoeducation is needed to de-stigmatize caregivers of PWS and community, but previous research has not clearly identified this. This scoping review protocol will guide the authors to map previous research related to anti-stigma based psychoeducation on caregivers of PWS and community. Scoping review uses the Arksey & O'Malley approach. Literature search keywords are based on Population, Content, and Context (PCC). The flow of literature screening followed the PRISMA ScR flowchart. The types of literature used were clinical trial, meta analysis, randomized controlled trial, review, and systematic review, in English from PubMed, CINAHL (Ebsco), and ScienceDirect databases. Year of publication: Last 10 years (January 2013 - January 2023). In the final stage, the authors conducted an analysis, namely basic numerical analysis and then continued with thematic analysis. Keywords: schizophrenia, psychoeducation, anti-stigma, caregivers, and community

Abstract

Youtube content as a creative economy work has been recognized as Intellectual Property that can be used as collateral. This, of course, can optimize the potential of creative economy actors to increase their business. However, this also still raises debate about the legal certainty of Youtube content as a guarantee for creative economy business actors from the perspective of guarantee law. This research is normative juridical research with an emphasis on secondary data. The research specification is descriptive-analytical, using a qualitative normative analysis method using a deductive approach to conclude. The results showed that the facilitation mechanism for intellectual property-based financing schemes begins with copyright registration of YouTube content, verification and assessment of collateral by a bank or non-bank financial institutions, financing or credit agreements followed by guarantee charging contract, and recording in the financing facilitation system for creative economy business actors. The legal certainty of YouTube content as a guarantee for creative economy actors from a legal perspective, guarantees do not protect creditors. This is because the value of intellectual property is uncertain which can change. The relevant ministries are expected to immediately issue technical regulations related to intellectual property-based financing so that they can serve as guidelines and provide legal certainty in implementing intellectual property-based financing for creative economy actors.

Abstract

Nowadays, student internship programs are increasingly being held by start-up companies. However, in practice there are still many students participating in internships who have not received their rights as agreed in the internship agreement. Apart from that, there is no clear regulation regarding student internship programs in labor regulations in Indonesia, especially in Law of the Republic of Indonesia no. 6 of 2003 concerning Employment and Regulation of the Minister of Manpower of the Republic of Indonesia Number 6 of 2020 concerning the Implementation of Domestic Apprenticeships. This research aims to analyze the legal relationship between student interns and start-up companies and to find appropriate legal protection for student interns to defend their rights. This research was written using a normative juridical approach. The research results show that there is no employment law relationship between student interns and start-up companies. The legal relationship that occurs is a legal relationship that arises because of an internship agreement which is civil in nature and is subject to the Civil Code agreement law. Intern students whose rights are not fulfilled can seek repressive legal protection to defend their rights through non-litigation dispute resolution through negotiation. If non-litigation efforts are not achieved, litigation efforts can be pursued by filing a lawsuit, with the basis of the lawsuit being default and prioritizing mediation efforts in court first.

Abstract

The Prita Mulyasari case in 2008 highlighted the challenges of protecting consumers from strategic lawsuit against public participation (SLAPP) suits. SLAPPs aim to stop and prevent individuals or non-governmental organisations from exercising their right to voice their opinions publicly. However, specific regulations addressing SLAPP in the realm of consumer protection in Indonesia are still lacking. The Prita Mulyasari case underscores the need for further attention to establish clear and specific rules to protect consumers from SLAPP practices. This research will further examine how the Supreme Court Decision No. 300K/PDT/2010 in the Prita Mulyasari case can serve as a benchmark in upholding consumer rights within the Indonesian legal framework, especially given the absence of a legal umbrella that protects consumers from lawsuits aimed at limiting public participation in the form of SLAPPs by businesses. This research will employ a normative juridical approach, focusing on primary, secondary, and tertiary legal materials. The study will analyze data gathered from literature reviews using a qualitative normative data analysis method. The research findings indicate that although the Supreme Court granted Prita Mulyasari’s appeal, the legal reasoning in Decision No. 300K/PDT/2010 did not explicitly address the concept of SLAPP. The Supreme Court’s considerations largely focused on the fulfilment of the elements of tort under Article 1365 of the Civil Code. However, the Supreme Court’s use of Article 28F of the 1945 Constitution to justify Prita Mulyasari's conduct is a crucial step in strengthening the legal position of those who express criticism or complaints, as well as their status as consumers.

Abstract

Abstract

Banks, as financial institutions, have an essential role in the economy, including in terms of providing credit. In the process of granting credit, collateral is one of the main elements that guarantee the debtor's ability to fulfil his obligations. One form of collateral that is often accepted is land rights, which are bound through mortgage rights based on Law Number 4 of 1996 concerning Mortgage Rights. This research aims to analyze the legal certainty related to the use of the power of sale by banks in relation to AYDA (repossessed collateral), as well as examine the legal aspects that need to be considered in its implementation. The research method used is a normative juridical approach, focusing on the analysis of relevant laws and regulations and related legal principles. The result of this research is that the position of a power of attorney to sell has a vital role in resolving bad debts, primarily related to the sale of collateral objects used as collateral in credit agreements. This power of attorney must meet the legal requirements of the contract stipulated in Article 1320 of the Civil Code and can take the form of a deed under the hand or an authentic deed. Legal certainty is critical in resolving bad debts through AYDA. The power of attorney to sell benefits the Bank by facilitating the execution of collateral, but it must also be balanced with strict supervision to avoid abuse of authority. This legal certainty also protects the rights of debtors, ensuring a transparent and fair process in the sale of assets. This increases public confidence in the banking system and provides protection for both parties. This research is expected to give a clearer understanding of the legality and legal implications of the use of a power of attorney to sell in the settlement of bad debts through AYDA.
