Abstract

Penjualan makanan dan minuman kemasan rusak kepada konsumen merupakan pelanggaran terhadap ketentuan dalam Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Tujuan dilakukannya penelitian ini adalah untuk mengetahui bagaimana pelaksanaan pengawasan BPOM terhadap penjualan makanan dan minuman kemasan rusak serta akibat hukum bagi pelaku usaha yang menjual makanan dan minuman kemasan rusak ditinjau dari Hukum Perlindungan Konsumen. Penelitian ini dilakukan dengan menggunakan metode yuridis normatif dengan pendekatan deskriptif analitis. Teknik pengumpulan data yang digunakan adalah studi kepustakaan dan studi lapangan dengan melakukan wawancara. Berdasarkan penelitian yang dilakukan, dapat disimpulkan: Pertama, pengawasan pre-market dan post-market yang dilakukan BPOM belum dapat melindungi konsumen dari peredaran makanan dan minuman kemasan rusak. Kedua, akibat hukum bagi pelaku usaha yang menjual makanan dan minuman kemasan rusak dapat dikenakan sanksi administratif dan sanksi pidana berdasarkan UUPK dan UU Pangan, serta dapat dimintai pertanggungjawaban berdasarkan prinsip product liability. Kata kunci: BPOM; Makanan; Minuman; Konsumen.

Abstract

The Resolution of consumer disputes involving many consumers will be effective and efficient if carried out jointly through a class action mechanism. Class action is generally a lawsuit filed by a number of people who have the same interests and the same legal events and legal basis. The Objective of this community services is to increase consumer understanding of class action lawsuits in consumer protection law. The approach used in this community service is legal counseling using a participatory action research (PAR) approach. The results of this community service have increased consumer and public understanding of class action lawsuits in consumer protection. The understanding of consumers regarding class action lawsuits is expected to provide consumer with an effective and efficient means of resolving disputes, in addition to filling lawsuits individually. The increased understanding of consumer regarding class action lawsuits is expected to raise awareness and understanding among consumers, thereby realizing consumer protection.

Abstract

Standard clauses in consumer protection are terms or conditions unilaterally determined by business actors. Standard clauses are regulated in Article 18 of the Consumer Protection Act. Understanding standard clauses is essential for consumers and business actors, so legal counseling is needed to increase awareness and understanding for consumers and business actors. The Consumer Protection Act does not prohibit the inclusion of standard clauses in agreement documents between consumers and business actors. The Consumer Protection Act only prohibits the inclusion of standard clauses contrary to Article 18, paragraphs (1) (2) of the Consumer Protection Act. Article 18 paragraph (3) of the Consumer Protection Act determines that the standard clause that contradicts Article 18 paragraph (1), (2) of the Consumer Protection Act is declared null and void. In addition, the legal consequences for business actors for the inclusion of standard clauses that are contrary to Article 18 paragraph (1), (2) of the Consumer Protection Act based on Article 62 paragraph (1) of the Consumer Protection Act are threatened with imprisonment for a maximum of five years or a maximum fine of two billion. In including standard clauses in documents or agreements with consumers, business actors must pay attention to the provisions of Article 18 of the Consumer Protection Act. This legal counseling activity increases the awareness and understanding of consumers and business actors regarding standard clauses based on consumer protection laws, which can ultimately realize consumer protection.

Abstract

Nowadays, student internship programs are increasingly being held by start-up companies. However, in practice there are still many students participating in internships who have not received their rights as agreed in the internship agreement. Apart from that, there is no clear regulation regarding student internship programs in labor regulations in Indonesia, especially in Law of the Republic of Indonesia no. 6 of 2003 concerning Employment and Regulation of the Minister of Manpower of the Republic of Indonesia Number 6 of 2020 concerning the Implementation of Domestic Apprenticeships. This research aims to analyze the legal relationship between student interns and start-up companies and to find appropriate legal protection for student interns to defend their rights. This research was written using a normative juridical approach. The research results show that there is no employment law relationship between student interns and start-up companies. The legal relationship that occurs is a legal relationship that arises because of an internship agreement which is civil in nature and is subject to the Civil Code agreement law. Intern students whose rights are not fulfilled can seek repressive legal protection to defend their rights through non-litigation dispute resolution through negotiation. If non-litigation efforts are not achieved, litigation efforts can be pursued by filing a lawsuit, with the basis of the lawsuit being default and prioritizing mediation efforts in court first.

Abstract

The position of business actors and consumers often becomes unequal. Consumers are often the object of business activity to get the maximum profit by business actors and in the end the consumer becomes the aggrieved party. Cases of business actors harming consumers are found in BPSK Garut Regency Decision Number 18/Pdt.S-Brg/BPSK-GRT/IX/2020 regarding the sale of expired vegetable cheese wafers at the Asia Garut Department Store. In this case, there were legal issues regarding BPSK's authority and the judge's considerations in deciding compensation. The research objective is to determine whether BPSK has the authority to decide this case; and analyzing the judges' considerations in the BPSK Decision of Garut Regency Number 18/Pdt.S-Brg/BPSK-GRT/IX/2020 in deciding compensation. This study uses research methods with a normative juridical approach based on applicable legal concepts and theories. Based on the research results, it can be concluded 2 (two) things. First, the settlement process in this case has not provided legal certainty because the choice of dispute resolution method is directly determined by the Garut Regency BPSK Assembly and not based on the agreement of the parties to the dispute and this case should have been tried at the District Court after mediation failed. Second, the Garut Regency BSPK Assembly has not been right in deciding on compensation because the Assembly has confused the duties and responsibilities of producers and supermarkets and does not understand the intent of Article 52 letter (k) of the Consumer Protection Act.
