Abstract

Illicit trafficking and narcotics abuse cause many victims and social problems. In implementing legal protection policies, the National Narcotics Agency (BNN) of Banyumas Regency undertakes rehabilitation efforts for narcotics abuse by collaborating with the Nurul Hikmah Islamic Boarding School in Cilongok. This study aims to analyze the form of legal protection for narcotics abusers in the Banyumas district, and the rehabilitation process for narcotics abusers based on Islamic boarding schools at Nurul Hikmah Islamic Boarding School, Cilongok Banyumas. This research is a type of empirical normative research. This study found that the BNN provides legal protection for narcotics abuse by placing them in institutions or rehabilitation centers. Based on the theory of victim protection, the steps and actions taken by the Banyumas Regency BNN are correct, namely separating the criminal offender (narcotics trafficker) from the victim (addicts and victims of narcotics abuse). In terms of carrying out rehabilitation, BNN Banyumas Regency has collaborated with the Nurul Hikmah Islamic Boarding School in Cilongok. The rehabilitation process at Nurul Hikmah Islamic Boarding School in Cilongok is an indicator that the government has carried out its obligations (in accordance with the UU No. 35/2009 about: Narcotics) in carrying out legal protection for victims of narcotics abuse in the form of pesantren-based social rehabilitation so that they can return to live a good life according to religious rules and principles.

Abstract

ABSTRAKStudi agama, kususnya Islam, selalu memunculkan persoalan objektivitas antara peneliti dan objek yang dikaji sekaligus terhadap pihak lain, di mana masalah objektif atau subjektifnya suatu penelitian sangat bergantung terhadap pendekatan sekaligus metodologinya. Studi Islam bukan saja menyangkut persoalan fenomenologi, terutama jika dikaitkan dengan studi Islam di masa modern (kontemporer) sekarang ini. Studi Islam selalu dipengaruhi oleh perkembangan ilmu pengetahuan, sehingga pendekatan apapun yang digunakan untuk melakukan studi Islam, tidak dapat mendorong seseorang untuk cenderung mengukuhkan dan melahirkan truth claim terhadap pendekatannya dan menafikan yang lainnya. Selain itu, paradigma baru yang sesuai dengan perkembangan ilmu pengetahuan, khususnya ilmu-ilmu sosial, perlu mendapat tempat agar dapat menawarkan pandangan baru dalam mengkaji agama yang lebih terbuka dan berpandangan ke depan dengan mengakomodasi nilai-nilai universal.Kata Kunci: Rekonstruksi, Studi Islam, Studi Agama, Kontemporer, Modern

Abstract

Abstract: The politics of law that ignore the aspirations of society has led to inconsistency in the application of the law because of the differences between the will of the people with the legislation. This study specifically examines the political law in terms of the application of Islamic law in Indonesia which is envisaged in Law No. 1/1974 on Marmage and the Law 7/1989 on Religious Courts (and its amendment Law No. 3/2006). The political situation that characterizes the formation of the Marriage Law and the Law on Religious Courts clearly show trends and policy direction of the state law. It can be seen from the political aspects of the legal establishment, the political aspects of the content of the law (principles and the rule of law), and political aspects of law enforcement. These three aspects have made Islamic law practiced by the Indonesian Muslim community (the living laws) in conflict with formal legal rules defined by the state. The conclusion from this study is that the legal provisions in the Mariage Law that conflict, namely: Article 2 paragraph (1), Article 7 (1), Article 31 paragraph (3) and Article 34 paragraph (1) and (2), as well as Article 42 and 43 paragraph (1). Abstract

Following the Constitutional Court’s dismissal of the judicial review of Article 2, Paragraph 1 of the Marriage Law, the Jakarta Central District Court granted approval for the registration of inter-religious marriages. The issue of inter-religious marriage has once again become a hot topic of social discussion. Following the controversy, the Supreme Court issued a circular ordering the court not to grant marriage registration applications for interfaith couples. This study draws on normative legal research and empirical analysis of interfaith marriages to answer the question of how states (through courts) view and negotiate interfaith marriages from state, legal, and religious perspectives. The objective of this study is to examine the arguments presented by proponents and opponents of interfaith marriage in Indonesia, particularly focusing on the discourse surrounding human rights principles and the adherence to religious teachings within the realm of marital practices. The study concluded that Islamic law remains one of the most fundamental elements of contemporary Muslim family life practices in Indonesia. All religions, including government officials and judges, generally consider interfaith marriages illegal and prohibit them under the Marriage Act. The Constitutional Court's decision to deny judicial review of the provisions governing interfaith marriage reinforces the argument that, in terms of the relationship between religion and the state, Indonesia falls into the category of countries with religiously governed enclaves.

Abstract

The issue of Rohingya refugees has gained significant attention globally and within Indonesian society, especially as many seek refuge in Aceh to escape persecution in Myanmar. The 1951 Vienna Convention and the 1967 Refugee Protocol form the global legal framework for refugee protection. However, Indonesia has not formally endorsed these statutes, so it is not legally bound to fulfill refugees’ basic needs. Despite this, Indonesia is obligated by the principle of non-refoulement, a customary international law or jus cogens, to manage Rohingya refugees entering its territory. This study examines Indonesia’s approach to refugee management through international law and maqāṣid al-sharī’ah, representing Islamic humanitarianism. Islamic scholarly discourse, specifically Fiqh al-Siyar, linked with maqāṣid al-sharī’ah, provides a foundation for contemporary humanitarian efforts. The study concludes that, under international law, Indonesia must protect refugees as part of implementing jus cogens. Additionally, from the maqāṣid al-sharī’ah perspective, Indonesia’s decision to welcome Rohingya refugees, despite not ratifying the 1951 Convention and the 1967 Protocol, exemplifies Islamic humanitarianism and acknowledges refugees’ inherent human rights.

Abstract

Nazhir's professionality in Jekan Raya District is not optimal, because there are still some who do not carry out their duties after becoming Nazhir, one of which is not reporting the implementation of waqf assets to the Indonesian Waqf Board (BWI), did not receive any prior guidance or training related to the management and development of waqf, and that is one of BWI's duties regarding its duties and authorities which has not been implemented until now. This community service activity carried out by the Zakat and Waqf management study program FEBI IAIN Palangka Raya, aims to strengthen Nazhir's competence and professionalism through reporting assistance carried out with outreach activities and FGD in Jekan Raya sub-district.t. 100% of participants attended the activity and followed until the activity was finished. The results showed that participants gained new knowledge about the development of waqf management and realized the importance of waqf reporting, this became an increase in knowledge professionalism and competence for nazhir. Participants are interested in trying to practice it in the implementation of waqf management. It is hoped that this activity can increase waqf, especially in the Jekan Raya sub-district, Palangka Raya City.

Abstract

Sharia advocates (Sharia lawyers) in Indonesia face the challenge of maintaining their significant role amidst the dominance of general advocates. This research evaluates the professionalism of Sharia advocates in the Banyumas region, focusing on the Banyumas Religious Court, Banyumas District Court, Purwokerto Religious Court, and Purwokerto District Court. This study used a qualitative and constructivist approach and collected primary data through interviews with Sharia advocates and secondary data from documents. Findings indicate that legislation recognizes Sharia advocates as professional advocates eligible to practice in all courts, akin to general advocates. However, Islamic universities, especially Sharia faculties, need to prepare graduates to compete with general law graduates for advocacy roles. In the Banyumas region, Sharia advocates provide legal services primarily in civil law cases under religious court jurisdiction across four courts. The main challenge for Sharia advocates is the public perception that they only handle Islamic legal cases and only practice in religious courts. Furthermore, there is a strong negative stigma among legal practitioners regarding the low proficiency of Sharia advocates in positive law, leading to their limited involvement in handling cases in District Courts (Civil Courts).

Abstract

The issue of women in politics becomes important as Indonesia begins to reform political institutions or political processes due of democracy. The purpose of this study is to find out women’s representation in Banyumas Regency, Central Java, in relation to cultural and Islamic values. Islam and Penginyongan cultural values promote traditional gender roles, which may limit women’s participation in politics. However, these values also promote social harmony, community participation, and religious morality, which may encourage women’s participation. Meanwhile, Indonesia’s political system includes a quota system for women’s political representation to increase the number of women in parliament. Data in this research comes from the number of women represented in political positions and their role in representing women’s interests, the meaning of Islamic values and Banyumas’ Penginyongan cultural values. Methods of data collection use interviews, observation, and documents. Using sociological approach, this study concludes that according to David Easton’s theory of systems, the influence of Islam and Penginyongan cultural values on women’s political representation in Banyumas is complex and shaped by a range of factors that interact with each other. Understanding these dynamics is crucial for developing strategies to promote gender equality and women’s political empowerment in the region.

Abstract

Legal politics are inextricably linked to power politics. Political dynamics in Indonesia are always colored by the dynamics of Islamic politics, as most Indonesians' political aspirations are influenced by Islamic views. This paper examines the evolution of Islamic law in the modern Indonesian democratic system, particularly after the reform era. Indonesia's democratisation gave rise to freedom of expression and opinion. Even today, Islamic conservatism is growing in Indonesia, but this does not mean that radical Islamist groups are gaining strength. Many political organisations, including Islamic parties and other Islamic movements, have liberated themselves and broadened their organisational philosophies in order to address broader issues and concerns. While maintaining their Islamic identity, some Islamic groups are turning towards the secularization of their goals and objectives as a means of adapting to the changing political environment. Political analysts refer to this development as post-Islamism. The current direction of Islamic politics is more accommodating aspects of democracy but still highlights its Islamic sides. This makes the government more accommodative to laws and regulations based on Islamic teachings.Politik hukum tidak lepas dari aspek-aspek politik kekuasaan. Di Indonesia, dinamika politik juga tidak lepas dari politik Islam, karena aspirasi politik sebagian besar masyarakat Indonesia dipengaruhi oleh pandangan Islam. Makalah ini membahas tentang perkembangan hukum Islam dalam sistem demokrasi Indonesia kontemporer, terutama setelah masa reformasi. Demokratisasi Indonesia memunculkan kebebasan berpendapat dan berekspresi. Bahkan saat ini konservatisme Islam di Indonesia semakin meningkat, namun hal itu bukan berarti menguatnya kelompok Islamis radikal. Banyak organisasi politik termasuk partai Islam dan gerakan-gerakan Islam lainnya melakukan pembebasan diri dan melakukan keterbukaan filosofi organisasi mereka untuk mengakomodasi berbagai masalah dan keprihatinan yang lebih luas. Sambil mempertahankan identitas keislamannya, beberapa kelompok Islam beralih ke arah sekularisasi tujuan dan sasaran mereka sebagai sarana untuk beradaptasi dengan lingkungan politik yang berubah. Analis politik menyebut perkembangan ini sebagai post-Islamisme. Arah politik Islam saat ini lebih mengakomodasi aspek-aspek demokrasi namun tetap menonjolkan sisi keislamannya. Hal ini membuat pemerintah lebih bersikap akomodatif terhadap peraturan perundang-undangan yang berlandaskan ajaran Islam.

Abstract

Indonesian legislation stipulates that individuals from foreign countries residing in Indonesia and foreign legal entities with representatives in the country are expressly barred from possessing land. This provision poses challenges for individuals in marriages involving different nationalities, particularly when one spouse is an Indonesian citizen, as it complicates the process of acquiring ownership rights and building usage rights for a property. This research explores the legal regulations pertaining to marital property in marriages involving individuals of distinct nationalities, navigating the intersection between national law and Islamic law. Employing qualitative research methods with a normative approach, the study relies on legal materials as primary data sources. The findings of this study indicate that, in accordance with national law, assets acquired during the course of marriage are deemed joint property. Nonetheless, it is noteworthy that this provision does not extend to marital assets in the form of land and buildings for foreign spouses. Conversely, Islamic law does not explicitly delve into this matter. Nevertheless, it delineates that the resolution of joint property in marriages encompassing individuals of diverse nationalities is governed by national laws pertaining to citizenship rights. In the case of foreign citizens, the relevant statute is the Agrarian Law, which specifically governs ownership rights concerning land and buildings.
