Abstract

Children are a particularly vulnerable age group to the effects of drug abuse. When they are exposed to and try illicit substances, it can disrupt their physical health, education and social life. Prolonged use can even cause permanent damage to the body. Given their vulnerability, children have special rights guaranteed by legislation, including protection from the dangers of drugs. This paper examines two main issues: first, the impact of drug abuse on children as victims; second, the role of the state in protecting children from this threat. This study aims to understand the level of vulnerability of children to drug abuse and the forms of legal protection that can be provided. The research used is normative research. Repressive approaches such as criminalization are not the main solution. The state needs to prioritize a restorative approach through physical and mental health recovery and social reintegration. The goal is to ensure that children can return to live a healthy, productive life and have a bright future

Abstract

Abstract: Working abroad or what is called Migration is a step taken by workers in Indonesia to improve the quality of life, so as to obtain a decent life. The current PMI number has positive and negative values. Problems regarding PMI will continue to arise if PMI abroad are not given any protection. This Normative Research discussesProtection of Indonesian Migrant Workers as an indicator of fulfilling human rights according to International Law, The role of the ILO in implementing Employment Standards related to Social Security Protection for Migrant Workers, Social Security Program Policy for PMI in Malaysia. The method used in writing this thesis is Normative Juridical research, namely research using secondary data which is primary, secondary and tertiary legal materials through international agreements, legal regulations, legal books and the internet. The data analysis used is a qualitative data analysis method. Based on this, the author can conclude that International Law provides protection for social security rights as an indicator of fulfilling human rights for every migrant worker by ratifying the UDHR which specifically addresses human rights issues. In the international scope, protection is also provided through international organizations that collaborate with various multilateral institutions to establish employment standards for workers. Indonesia has a policy to provide protection for PMI in the form of Law no. 18 of 2017 concerning the Protection of Indonesian Migrant Workers which contains provisions that placement and protection are integrated within the authority of the Ministry of Manpower as well as providing more in-depth guidance and advocacy regarding the Agreement between workers and employers in order to increase legal awareness and better legal protection for prospective PMI’s.

Abstract

Artikel ini menggunakan metode Penelitian Normatif, artinya meneliti secara doktrinal dengan literatur dan buku-buku dari segi perspektif normatif hukum, yang berguna memberikan pengetahuan tambahan tentang informasi, dan gambaran umum mengenai apa yang diteliti dalam penelitian ini. Dari penelitian ini dapat kita simpulkan bahwa hukuman mati bagi bandar narkotika merupakan suatu langkah yang terbaik dari penegakan hukum, disebabkan tanpa adanya suatu pengendalian dan pengawasan yang extra ketat, maka penyalahgunaan peredaran narkotika yang dilakukan oleh bandar-bandar akan merugikan dan menimbulkan bahaya yang sangat besar bagi kehidupan berbangsa, dan bernegara. Dan hendaknya pemerintah melakukan upaya pencegahan penyalahgunaan dan peredaran narkotika dengan melakukan sosialisasi tentang narkotika ke masyarakat, karena potensi penyalahgunaan dan peredaran narkotika merupakan ancaman nyata yang perlu segera di berantas.

Abstract

The decision of the Panel of Judges in the State Administrative Court Decision at the Jakarta State Administrative Court Number 424/G/TF/2022/PTUN.JKT, contradicts with many human rights law, especially related to the right to communicate and obtain information and economic rights. The right to communicate and to access and obtain information is a right guaranteed and recognized by the Indonesian Constitution as stipulated in Article 28F of the 1945 Constitution, and regulated in Articles 14 of the Human Rights Act. In addition, the right to communicate and obtain information is also regulated internationally in the provisions of Article 19 of the Universal Declaration of Human Rights, and Article 19 of the International Covenant on Civil and Political Rights (ICCPR) which has been ratified in the provisions of the Law Number 12 of 2005 concerning the Ratification of the ICCPR (KIHSP Law). The right to economy and employment is a human right guaranteed in the Indonesian constitution, as stipulated in Article Article 27 paragraph (2) UUD NRI Tahun 1945, and regulated internationally in the provisions of Article 1 Number 2, Article 5 paragraph (2), and Article 6 of International Covenant on Economic, Social, and Cultural Rights (ICESCR) that has been ratified in the provisions of Law Number 11 of 2005 concerning the Ratification of the International Covenant on Economic, Social, and Cultural Rights (KIHESB Law).

Abstract

This article examines the legal status of non-civil-servant employees appointed by rectors at Indonesian State Universities with Legal Entity Status (Perguruan Tinggi Negeri Badan Hukum, PTN-BH). The issue is legally significant because PTN-BH institutions are autonomous public legal entities that perform state functions in higher education while simultaneously exercising managerial authority comparable to that of employers in ordinary employment relationships. Using normative legal research with statutory, conceptual, and prescriptive approaches, this study analyses whether rector-appointed non-civil-servant employees should be governed by the Civil State Apparatus (Aparatur Sipil Negara, ASN) regime or by Indonesian labor law. The analysis shows that these employees fall outside the formal scope of Law Number 20 of 2023 on the Civil State Apparatus because the ASN regime recognizes only Civil Servants (PNS) and Government Employees under Employment Agreements (PPPK), both of whom are appointed through the national civil-service management system. By contrast, the relationship between PTN-BH and rector-appointed employees contains the cumulative elements of an employment relationship under Indonesian labor law: work, wages, and command or subordination. The article argues that the problem is not a direct conflict between two statutes, but a regulatory vacuum arising from the hybrid institutional position of PTN-BH. Pending the enactment of a specific statutory framework, labor law provides the most coherent legal basis for protecting these employees' rights, including remuneration, social security, termination protection, and industrial dispute settlement. The article recommends regulatory harmonization to clarify their legal status while preserving the institutional autonomy of PTN-BH.
