Abstract

This study aims to examine the legal policy on halal products for micro, small, and medium enterprises (MSMEs) after the enactment of Government Regulations in lieu of Law No. 2 of 2022 concerning Job Creation. To meet the demand for halal products, government policy is needed to simplify the halal product submission system while maintaining its production by MSMEs in Indonesia. Based on data from the Indonesian Statistics Agency, Indonesia is a Muslim country with 237.53 million Muslims, accounting for 86.9% of the total population. This indicates a significant need for halal products. MSMEs are one of the sources of halal products; hence, the government needs to enact laws that facilitate their production procedures. Objectively, the requirement to have halal certification, as mentioned in Article 4A of Government Regulation in Lieu of Law No. 2 of 2022 concerning Job Creation, is based on halal declarations from MSME actors. These actors make halal declarations based on the guidelines set by the Halal Product Guarantee Agency (BPJPH). The ratification of this regulation aims to strengthen MSMEs and support the increase in halal products. Therefore, a legal approach based on primary legal materials related to legislation and secondary legal materials based on documents that support this study was adopted. In addition, data from the Ministry of Cooperation, Micro, Small, and Medium Enterprises reveal that there are 8.71 million MSMEs in Indonesia. This potential needs to be facilitated by policies to simplify the production of halal products with a measurable process based on statutory provisions.

Abstract

This research focuses on the state policy towards the development of Islamic business which is part of the existing Islamic economic system. In the current development, the Islamic economy is growing significantly through various policies issued by the government, such as in the field of banking, small and medium enterprises and various kinds of Islamic business products as a form of fulfillment of rights in carrying out basic religious principles. State policy through the Law of the Republic of Indonesia Number 21 of 2008 concerning Sharia Banking is a form of state policy towards the development of Islamic business in society through the fulfillment of regulations and implementation of Islamic business. This research focuses on qualitative research methods by managing data as a source of analysis.

Abstract

This research issue relates to land ownership as a function of the state to provide legal certainty to the community. Land registration as a procedure for land ownership is inseparable from efforts to protect the rights of every citizen to obtain land through various processes, therefore land ownership procedures must be fulfilled by every citizen, so as not to give birth to administrative defects in land ownership. Cancellation of land certificates based on article 29 of the Regulation of the Minister of Agrarian Affairs and Spatial Planning / Head of the National Land Agency of the Republic of Indonesia Number 21 of 2020 concerning Handling and Settlement of Land Cases, that one of which can cancel land certificates due to administrative defects in land registration. This research focuses on administrative defects and cancellation of land certificates, using a legal approach in this analysis.

Abstract

Study Purpose: This research focuses on state legal policies regarding efforts to fulfill the right to health through a social security system within the budget. Materials and Methods: This study employed qualitative research with an approach to government policy, including legislation, which serves as the basis for the analysis. Results: State policy regarding the fulfillment of every citizen's constitutional right to health is inseparable from government policy in preparing regional budgets for health. Health spending, as mandatory spending, is clearly stipulated in law and must be met by the government. In the 2026 Financial Note and Draft State Budget, the health budget is set at IDR 244 trillion. This figure represents a 15.8% increase compared to the 2025 outlook of IDR 210.6 trillion. This budget must be a government priority in fulfilling the right to health for every citizen through health insurance. The World Health Organization (WHO) has agreed to achieve Universal Health Coverage (UHC) by 2014. UHC is a health system that ensures that every citizen in the population has equitable access to quality promotive, preventive, curative, and rehabilitative health services at affordable costs. Therefore, the State Budget, which focuses on health, must be able to reduce the burden on society. Conclusion: Mandatory spending in the health sector must be the basis for the government to fulfill the right of every citizen to health insurance and align with Universal Health Coverage (UHC), which is oriented towards the state's strategic role in fulfilling citizens' health rights.

Abstract

AbstractThe Constitutional Court is a state institution that has the authority for reviewing laws against the Constitution (Judicial Review). Several times in issuing its decisions, the Constitutional Court has acted as a Positive Legislator. The potential for a legal vacuum as the implication of revoking a law is large. and also the slow formation of laws by the legislative body (DPR) and the lack of quality of regulations. The current law-making does not pay attention to legal ideals based on Pancasila so that the resulting legal products lose their meaning. This has resulted in many people whose constitutional rights have been violated. The state should be present to give full constitutional rights to its citizens. The Constitutional Court needs additional authority to maintain the supremacy of the constitution. additional authority as a preventive mechanism is Judicial Preview. The French state places Judicial Preview as an authority of the Constitutional Council. Austria and Germany apply Judicial Preview as a preventive measure for losses that can occur if the Draft Law is passed. A renewal of the Constitutional Law to perfect existing ones makes the prospect of Judicial Preview in Indonesia an Urgency for immediate implementation.Keywords: Constitutional Court, Authority, Judicial Preview AbstrakMahkamah Konstitusi merupakan lembaga negara yang memiliki kewenangan pengujian Undang-Undang terhadap Undang-Undang Dasar (Judicial Review). Dalam mengeluarkan putusannya Mahkamah Konstitusi beberapa kali bertindak sebagai Positif Legislator. Potensi terjadinya kekosongan hukum sebagai implikasi dicabutnya suatu Undang-Undang sangatlah besar. Ditambah dengan lambatnya pembentukan Undang-Undang oleh lembaga legislatif (DPR) serta kualitas peraturan yang kurang. Pembuatan Undang-Undang saat ini tidak memperhatikan cita hukum yang berakar pada Pancasila sehingga produk hukum yang dihasilkan kehilangan maknanya. Hal ini mengakibatkan banyak masyarakat yang dilanggar hak konstitusionalnya. Negara seharusnya hadir untuk memberikan hak konstitusional secara penuh kepada warga negaranya. Untuk mencegah hal tersebut maka Mahkamah Konstitusi membutuhkan suatu kewenangan tambahan untuk menjaga tegaknya supremasi konstitusi. Kewenangan tambahan sebagai mekanisme preventif tersebut berupa Pengujian Rancangan Undang-Undang (Judicial Preview). Perancis menempatkan Judicial Preview sebagai kewenangan dari Constitutional Council. Austria dan Jerman juga memberlakukannya sebagai tindakan pencegahan. Pembangunan Hukum Konstitusi untuk menyempurnakan yang sudah ada menjadikan prospek Pengujian Rancangan Undang-Undang di Indonesia menjadi urgensi untuk segera diterapkan.Kata Kunci: Mahkamah Konstitusi, Kewenangan, Judicial Preview АннотацияКонституционный суд - это государственное учреждение, которое имеет право проверять законы на предмет соответствия Конституции. Вынося свои решения, Конституционный суд несколько раз выступал в качестве позитивного законодателя. Потенциал правового вакуума как последствия отмены закона огромен, особенно в сочетании с медленным формированием законов законодательным органом (DPR) и отсутствием качественных нормативных актов. Текущее формирование законодательства не обращает внимания на идеалы права, укоренившиеся в Pancasila, так что получаемые легальные продукты теряют свое значение. Это привело к тому, что конституционные права многих людей были нарушены. Государство должно присутствовать, чтобы предоставить своим гражданам полные конституционные права. Чтобы этого не произошло, Конституционному суду необходимы дополнительные полномочия для защиты верховенства конституции. Дополнительные полномочия в качестве превентивного механизма представлены в форме судебного предварительного надзора (Judicial Preview). Франция помещает судебный предварительный надзор в ведение Конституционного Совета. Австрия и Германия также приняли его в качестве меры предосторожности. Разработка Конституционного закона с целью усовершенствования существующего делает перспективу судебного надзора в Индонезии неотложной его реализацией.Ключевые Слова: Конституционный Суд, Власть, Судебный Надзор

Abstract

The essence of law is to provide welfare to society. Law as a tool of social engineering for society makes people obey it. Dynamic legal developments encourage progress towards society from various aspects of people's lives. One of them, the enactment of Law No. 11 of 2020 on Job Creation, encourages changes to the order of setting norms that affect other laws that are affected by it. One of those affected by the Job Creation Act is the establishment of BUMDes (Village-Owned Enterprises). Through the provisions of Article 117 and Article 185 b of Law Number 11 of 2020 concerning Job Creation, the government needs to establish a derivative norm that regulates Village-Owned Enterprises. In this provision, it is stated that Village Owned Enterprises, hereinafter referred to as BUMDes, are legal entities established by the village and/or together with villages to manage businesses, utilize assets, develop investment and productivity, provide services, and/or provide other types of business for the maximum welfare of the Village community. In a nutshell, the existence of Village-Owned Enterprises aims to prosper the village community, with the type of business sector owned and support the productivity of rural communities based on village community empowerment. In this study, a legal approach was used with the aim of exploring legal policies towards BUMDes with the enactment of the Job Creation Act.Keywords: Job Creation Act; BUMDes; welfareKebijakan Hukum Pada Badan Usaha Milik Desa Setelah Berlakunya Undang-Undang tentang Penciptaan Lapangan Kerja Dalam Rangka Kesejahteraan Masyarakat DesaAbstrakAdanya hukum sebagai alat rekayasa sosial bagi masyarakat. Karenanya, eksistensi hukum menjadikan masyakat taat terhadap hukum. Perkembangan hukum yang bersifat dinamis, mendorong kemajuan terhadap masyarakat dari berbagai aspek kehidupan masyarakat, salah satunya dengan disahkannya Undang-Undanag Nomor 11 Tahun 2020 tentang Cipta Kerja mendorong perubahan terhadap tatanan pengaturan norma-norma yang memberikan pengaruh terhadap undang-undang lain yang terdampak dengan Undang-Undang cipta kerja tersebut. Salah satu yang terdampak dengan adanya Undang-Undang Cipta Kerja adalah tentang pembentukan BUMDes (Badan Usaha Milik Desa). Melalui ketentuan  Ketentuan Pasal 117 dan Pasal 185 huruf b Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja, maka pemerintah perlu membentuk norma turunannya yang mengatur tentang Badan Usaha Milik Desa. Dalam ketentuan peraturan tersebut bahwa Badan Usaha Milik Desa yang selanjutnya disebut BUMDes adalah badan hukum yang didirikan oleh desa dan/atau bersama desa-desa guna mengelola usaha, memanfaatkan aset, mengembangkan investasi dan produktifitas, menyediakan jasa pelayanan, dan/atau menyediakan jenis usaha lainnya untuk sebesar-besarnya kesejahteraan masyarakat Desa. Penelitian ini menggunakan metode penelitian kualitatif dengan pendekatan peraturan perundang-undangan dan literatur, dengan tujuan mengeksplorasi kebijakan hukum terhadap BUMDes dengan disahkannya Undang-Undang Cipta kerja. Hasil penelitian menyatakan bahwa keberadaan Badan Usaha Milik Desa bertujuan untuk mensejahterakan masyarakat desa, dengan jenis bidang usaha yang dimiliki dan menunjang produktivitas masyarakat desa dengan didasarkan kepada pemberdayaan masyarakat desa.Kata Kunci: UU Cipta Kerja; BUMDes; Kesejahteraan Правовая политика в отношении сельских предприятий после принятия Закона о создании рабочих мест для благосостояния сельских общинАннотацияСуществование права является инструментом социальной инженерии для общества. Следовательно, существование закона заставляет людей подчиняться закону. Динамичное правовое развитие, способствующее прогрессу в направлении общества из различных аспектов жизни людей, одним из которых является ратификация Закона № 11 от 2020 года о создании рабочих мест, поощряющего изменения в порядок регулирования норм, которые влияют на другие законы, на которые распространяется закон о создании рабочих мест. Одним из факторов, затронутых законом о создании рабочих мест, является создание BUMDes (сельских предприятий). В соответствии с положениями статьи 117 и статьи 185 буква b Закона № 11 от 2020 года о создании рабочих мест правительству необходимо установить производную норму, регулирующую деятельность сельских предприятий. В положениях постановления сельские предприятия, далее именуемые BUMDes, являются юридическими лицами, учрежденными деревнями и/или вместе с деревнями для управления предприятиями, использования активов, развития инвестиций и повышения производительности, предоставления услуг и / или предоставления других виды бизнеса для наибольшего благополучия деревенской общины. В этом исследовании используется качественный метод исследования с законодательным и литературным подходом с целью изучения правовой политики в отношении BUMDes с принятием Закона о создании рабочих мест. Результаты исследования показали, что существование сельских предприятий направлено на процветание деревенской общины с помощью частного сектора бизнеса и поддержки производительности сельских общин на основе расширения прав и возможностей деревенских общин.Ключевые слова: Закон о создании рабочих мест; BUMDes (сельские предприятия); социальное обеспечение.

Abstract

Efforts to create a good government system are correlated with the government system built in government to achieve government goals through good employee management. Law no. 20 of 2023 concerning State Civil Apparatus. The main aim of having a merit system in positions is an effort to create a good service system for society. Therefore, the essence of Law no. 20 of 2023 in order to accelerate the implementation of the transformation of the state civil apparatus to create a state civil apparatus with high work results and behavior that is service-oriented, accountable, competent, harmonious, loyal, adaptive and collaborative, it is necessary to improve the implementation of the management of the state civil apparatus. Abstract

Tidak ada perlindungan hukum bagi direktur rumah sakit apabila terjadi kelalaian yang bukan disebabkan olehnya, namun direktur rumah sakit harus mempertanggungjawabkan kelalaian tersebut. Bentuk tanggung jawab yang diemban direktur akibat malpraktik juga belum diatur dalam Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan. Hasil penelitian menunjukkan: 1) Perlindungan hukum terhadap Direktur selaku penanggung jawab rumah sakit akibat malpraktik di Rumah Sakit Umum Daerah (RSUD) belum terpenuhi. Padahal tugas, fungsi dan wewenang direktur rumah sakit telah diatur dalam Pasal 7 ayat (3) Peraturan Presiden Nomor 77 Tahun 2015, Pasal 11 ayat (2) dan (4) Perwal Serang Nomor 20 Tahun 2022 dan Peraturan Menteri Kesehatan. Profil RSUD Kota Serang Tahun 2021, Hasil penelitian menunjukkan bahwa tugas, fungsi dan wewenang direktur rumah sakit tidak hanya sebatas pada hal-hal yang diatur dalam ketentuan tersebut, namun direktur rumah sakit juga harus bertanggung jawab secara hukum tidak tertulis apabila terjadi malpraktek di rumah sakit, karena penyelenggaraan rumah sakit itu sendiri berada di bawah tanggung jawab direktur rumah sakit; 2) Bentuk tanggung jawab hukum Direktur akibat malpraktek di Rumah Sakit Umum Daerah (RSUD) sebenarnya hanya sebatas tugas, fungsi dan wewenang direktur rumah sakit sebagaimana diatur dalam Pasal 7 ayat (3) Peraturan Presiden Nomor 77 Tahun 2015, Pasal 11 ayat (2) dan (4) Perwal Serang Nomor 20 Tahun 2022 dan Profil RSUD Kota Serang Tahun 2021, meliputi pembinaan, pengawasan, dan pengendalian pelaksanaan tugas dan fungsi unsur organisasi. Namun karena direktur rumah sakit merupakan pimpinan tertinggi di rumah sakit dan dianggap sebagai penanggung jawab rumah sakit, maka mengakibatkan direktur rumah sakit bertanggung jawab dan menanggung akibat malpraktek yang dilakukan oleh tenaga medis atau tenaga kesehatan. Seharusnya dari segi bentuk tanggung jawab hukum apabila terjadi malpraktik akibat kelalaian tenaga medis di rumah sakit, maka tenaga medis yang bersangkutan dan pihak rumah sakit wajib mempertanggungjawabkan segala kerugian yang diderita pasien sesuai dengan Pasal 193 UU No. Hukum Kesehatan Kata Kunci: Perlindungan hukum; Direktur; Penanggung jawab; RSUD; Malpraktek

Abstract

The state's responsibility for efforts to create a good health service system in order to provide welfare to the community. The social security law has placed a model of protection for the community with a legal approach through social insurance with the basic principle of mutual cooperation. In January 2023, the government spent around IDR 5.3 trillion to protect public health, an increase of 12% compared to last year (2022), making the Health Social Security Administering Agency abbreviated as BPJS Kesehatan as the manager of social insurance for medical assistance need to continue to develop to meet needs. The health insurance scheme managed by the state with the provision of health equipment as an effort to fulfill the state's constitutional responsibility. This study analyzes the state's responsibility in providing health insurance for the community as an effort to fulfill citizens' rights through a legal approach.
