Abstract

Small Micro Enterprises in retail sector is currently faced many problems, declining sales, difficulty in obtaining supplies, impeded dilivery and distribution, lack of information technology knowledge and business network barriers. This study aims to determine the business management strategies of Ali Murah Shop Madinah post Covid-19 pandemic as retail practice description in Madinah, Saudi Arabia. The study refers to Henry Mintzberg strategy (position, plan, perspective, project, dan prepare). Research type is descriptive and data collection methods using structured interviews conducted to 3 informan. This research also used social learning approaches to get deeply analysis. The data analysis technique used descriptive qualitative. The results of the study explained that business management strategy post pandemic Covid-19 Ali Murah Shop Madinah can be implemented in order to get improvement and sustainable development attached by management strengthening in marketing, human resources, finance and operations field as strategic steps to create an efficient and effective business existence. Furthermore, regarding social learning approaches, Ali Murah Shop Madinah are required to have good knowledge management and absorptive capacity especially in protocol which prevent Covid-19 transmission. Future research is expected to get empiricaly analysis for objective result obtaining that also supported by quantitative and qualitative analyze (mix methods).

Abstract

The advancement of artificial intelligence (AI) technology and social media has significantly influenced the dynamics of societal life, including women. Social media offers a space for the empowerment of women, but at the same time, it also presents various risks such as privacy violations, digital violence, and misuse of personal data. This community service activity aims to strengthen digital literacy among women, particularly in raising awareness of digital risks, protecting digital rights, and promoting safe and responsible social media use. The implementation methods of the activities include outreach in the form of workshops, discussion forums, and case simulations. The results of the activities indicate that there has been an increase in participants' knowledge about privacy in the digital world, forms of gender-based violence in the online realm, and strategies for preventing digital risks. This program is expected to serve as a model for empowering women through the enhancement of digital literacy in responding to the challenges of an increasingly digitalized era.

Abstract

Rancangan Undang-Undang Kitab Hukum Acara Pidana (RUU KUHAP) sebagai bagian dari agenda reformasi hukum di Indonesia semestinya tidak hanya menjamin prosedur hukum yang adil secara formal, tetapi juga harus responsif terhadap realitas ketimpangan sosial yang dialami kelompok rentan, khususnya perempuan. Penelitian ini bertujuan untuk mengidentifikasi bentuk-bentuk ketidakadilan gender dalam ketentuan RUU KUHAP, menelaah kegagalan pendekatan hukum formalistik dalam mengakomodasi pengalaman perempuan sebagai korban maupun tersangka, serta menawarkan rekonstruksi norma hukum acara pidana berdasarkan Feminist Legal Theory dan teori keadilan substantif. Dengan menggunakan pendekatan yuridis-normatif dan analisis kritis, ditemukan bahwa RUU KUHAP masih menyisakan bias struktural dan tidak memberikan perlindungan memadai bagi perempuan dalam proses peradilan pidana. Ketentuan hukum yang bersifat netral secara tekstual justru menciptakan ketidakadilan substantif, terutama dalam hal penahanan, pembuktian, dan perlindungan terhadap korban kekerasan berbasis gender. Oleh karena itu, dibutuhkan reformulasi norma hukum acara pidana yang mengintegrasikan pendekatan berbasis gender dan interseksionalitas demi terwujudnya sistem hukum yang inklusif dan berkeadilan.

Abstract

Kemajuan teknologi kecerdasan buatan (AI) telah menciptakan tantangan baru di area hukum pidana, terutama mengenai kejahatan siber yang menargetkan perempuan sebagai sasaran. Fenomena seperti pornografi deepfake, pemalsuan identitas digital, hingga algoritma predator menjadi bentuk kejahatan siber gender yang semakin rumit dan sulit untuk dilacak. Penelitian ini bertujuan untuk mengkaji tiga aspek penting yaitu tipe-tipe kejahatan siber yang didorong AI dengan perhatian pada perempuan sebagai korban; efektivitas perlindungan hukum pidana nasional bagi perempuan yang menjadi sasaran kejahatan siber berbasis AI; serta strategi penguatan penegakan hukum dan perumusan kebijakan digital dalam menangani fenomena ini. Metode yang digunakan yakni penelitian hukum normatif yakni melalui peraturan yang berlaku. Hasil analisis mengindikasikan kejahatan siber yang didasarkan pada AI memiliki ciri-ciri transnasional, terautomatisasi, dan tingkat bias gender yang tinggi. Sebaliknya, sistem hukum pidana di Indonesia, termasuk KUHP dan UU ITE, belum mampu mencakup aspek teknologis dan gender dari kejahatan tersebut secara efektif. Karena itu, diperlukan reformulasi hukum pidana yang peka terhadap kemajuan teknologi dan sudut pandang keadilan gender, serta penguatan kebijakan digital yang terkoordinasi antara negara, platform digital, dan masyarakat sipil. Studi ini menyarankan peneguhan lembaga siber nasional, reformasi norma hukum pidana yang berorientasi pada AI, serta penyatuan perlindungan perempuan dalam kebijakan teknologi dan keamanan digital

Abstract

National development towards Indonesia 2045 is massively carried out, based on the Coordinating Minister for Economic Affairs Regulation Number 21 of 2022 that Indonesia has 210 development projects and 12 programs, in December 2022 a total of 152 projects have been implemented and are fully operational. Realizing national development, Construction Service Business Entities require Construction Workers to certify so that the quality and qualifications of the workforce can be recognized and professional accountability is formally clear. However, the security of the professional certificate of construction services is not guaranteed. The research uses normative juridical methods by examining all regulations related to the issues discussed. Determining the qualifications of construction service business entities that are assessed, one of which is the availability of construction labor. The procedures and flow of procedures for implementing construction work competency certificates are regulated in the Regulation of the Minister of Public Works and Public Housing Number 8 of 2022 concerning Procedures for Implementing the Fulfillment of Construction Service Standard Certificates in order to support the ease of business licensing for construction service business actors. Repressive efforts in cybercrime are guaranteed by Law No. 27 of 2022 on Personal Data Protection. To prevent cybercrime in the LPJK data storage system, it can cooperate with the Ministry of Communication and Information Technology regarding the policy of using Blockchain.

Abstract

Introduction to the Problem: The Internet of Things (IoT) has enabled the use of medical devices in the healthcare sector while presenting challenges in regard to the security and privacy of patients’ medical data. This article conducts a systematic literature review to evaluate the existing regulations related to the security and privacy of the patient’s medical data in real-time data collection through IoT in the context of a Smart City.Purpose/Study Objectives: This study aims to identify gaps in the existing regulations, analyze the implementation of these regulations in practice, and evaluate the impact of IoT technology on the privacy and security rights of patients’ medical information in the healthcare sector.Design/Methodology/Approach: The research employed a systematic literature review, by analyzing relevant articles, legal documents, and regulations. Data were examined from a case study of the implementation of IoT devices for healthcare in Smart Cities as well as interviews with legal experts in the field of healthcare services.Findings: The existence of the Electronic Information and Transaction Law, Personal Data Protection Law, and the latest Health Law provides the initial regulatory foundation for ensuring the security of personal data in the integrated governance of Smart Cities, especially in telemedicine services. Implementing regulations for these laws are necessary to technically accommodate the needs for the security of the patients’ data, ensuring that there is no imbalance between the provisions of the laws that are enacted and their implementation in the community.Paper Type: Research Article

Abstract

This article examines violations related to trademarks in the metaverse, which are reviewed from the perspective of intellectual property rights and examines the law enforcement that is applied in the metaverse itself in the event of a trademark violation that is claimed by another person who is not the owner of the rights to the trademark. The type of research used is normative juridical, in which the discussion of this research prioritizes the study of the application of positive legal norms or legal principles applied in Indonesia and approaches through related laws and regulations. The study in this research is an analysis of the first-to-file principle in registering trademarks used in the metaverse and studying the classification of trademarks so that they can be registered in the metaverse so that other people do not use these trademarks. Based on the study in the discussion in this study, it is concluded that the legal protection of trademarks in the metaverse, seen from the perspective of intellectual property rights, still needs to be under the provisions of the applicable laws and regulations. This is marked by the many legal cases against trademark violations in the metaverse itself because trademarks registered in the real world will not automatically be registered in the metaverse unless the rights owner or company registers their trademark through a trademark registration service application on the metaverse.

Abstract

The rapid development of artificial intelligence (AI) on e-commerce platforms brings new risks for digital consumers that Indonesian criminal law has not fully addressed, especially when algorithmic decisions cause harm without a clear human actor. This article assesses the effectiveness of Indonesian criminal law in protecting digital consumers and evaluates the role of internal operational management such as fraud detection, data protection, and algorithm governance in risk mitigation. Using a normative-juridical method and comparative analysis, the research identifies legal gaps regarding criminal liability for damages caused by AI systems (liability gap), and also demonstrates the limitations of the mens rea principle in the algorithmic context. This article proposes an integrative model that combines criminal rule reforms to clarify corporate and developer liability and mandatory operational governance standards (compliance by design) to enhance prevention, detection, and recovery. The findings confirm the need for regulatory and operational synergy to strengthen digital consumer protection in an increasingly autonomous digital market era.
