Abstract

 The basis for freedom of religion in Indonesia is regulated in Article 28E, Article 28I, Article 29 of the 1945 Constitution and Article 4, Article 22 of Law Number 39 of 1999 concerning Human Rights. However, this freedom is not absolute and must be limited to maintain religious harmony in Indonesia. This study aims to determine the actions that often trigger religious disputes with blasphemy or blasphemy of religion either directly or through various online media. This type of research is doctrinal or normative. In this study, all norms, legal principles, legal documents, court decisions, laws and regulations related to religious freedom in Indonesia will be studied. Based on the results of research to maintain religious harmony, the government issued Law Number 1 of 1946 concerning the Criminal Code, Law Number 1/PNPS/1965 concerning the Prevention of Abuse and/or Blasphemy of Religion, Law Number 40 of 2008 concerning the Elimination of Race and Religious Blasphemy. Religion. Ethnic Discrimination, Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Electronic Transaction Information. In addition to legal action against perpetrators of blasphemy, the government and the community must work together to maintain religious tolerance and prevent fanaticism towards their respective religious identities so that it has the potential to cause horizontal conflicts between religious adherents in Indonesia.

Abstract

Children need affection which is a psychic need as the most basic need in human life, especially for a child. It is different for minors who must be held accountable for their mistakes for 5 (five) years on the Decision of the Judges of the Takengon District Court. The purpose of this study is to determine the criminal liability of children who participate in murder and to know the legal protection of children who participate in murder according to Article 340 of the Criminal Code. The method used in completing this research is normative juridical. This study uses a conceptual, statutory, and comparative approach. The nature of this research is descriptive, which aims to describe a problem that occurs by interpreting legal materials for problem solving. The results of this study found that in principle children are still subject to criminal responsibility. In the consideration of the Judges of the Takengon District Court, it stated that there was no justification and excuse for abolishing the crime against children, so that children were considered capable of being responsible and found guilty. However, as a child, their rights will still be protected as stipulated in Law Number 35 of 2014 concerning Child Protection (UUPA) where the State, Government, Regional Government, Community, Family, and Parents or Guardians are obliged and responsible for the implementation of Child Protection. Protection of children against perpetrators of crime is very important to do in order to anticipate prevention in the future there will be no more children committing the same crime. Abstract

Permasalahan narkoba di Indonesia masih merupakan sesuatu yang bersifat urgent dan kompleks. Dalam kurun waktu satu dekade terakhir permasalahan ini menjadi marak. Terbukti dengan bertambahnya jumlah penyalahgunaan narkoba secara signifikan. Penyalahgunaan narkotika di kalangan pelajar sebagai persoalan serius karena mereka adalah kelompok usia produktif dan menjadi generasi penurus bangsa. Badan Narkotika Nasional (BNN) menyebutkan bahwa 3.2% pelajar di Indonesia pernah mengonsumsi narkotika Oleh karena itu, kegiatan penyuluhan hukum kepada pelajar terhadap penyalahgunaan narkoba sangat dibutuhkan secara berkelanjutan. Menyahuti permasalahan tersebut, Dosen Fakultas Hukum Universitas Malikussaleh telah mengadakan penyuluhan hukum tentang penyalahgunaan narkoba di Sekolah Menegah Atas (SMA) Negeri 1 Sawang Kabupaten Aceh Utara. Kegiatan ini merupakan salah satu bentuk Tridarma Perguruan Tinggi dimana setiap insan civitas akademika melakukan pengabdian kepada masyarakat untuk memberikan solusi setiap permasalahan sedang dialami masyarakat.

Abstract

The 1945 Constitution of the Republic of Indonesia states that a good and healthy environment is a human right and a constitutional right for every Indonesian citizen. Therefore, the state, government and all stakeholders are obliged to protect and manage the environment in the implementation of sustainable development so that Indonesia's environment can remain a source and support for life for the Indonesian people and living things other. This community service is carried out using socialization methods, lectures, discussions, question and answer and practice of field crops as well as legal counseling on the Importance of Learning to Protect and Preserve the Environment for Students of State Elementary School 7 Syamtalira Bayu, North Aceh District. The result of this counseling is that students know how to practice planting plants and cleaning their school environment, there is an increase in student awareness of the cleanliness of the surrounding environment. The enthusiasm of the children to participate and care for the environment in protecting plants, plants and living things around them.

Abstract

Corporate crime is often referred to as a crime committed by a legal entity or organization. Corporate involvement in criminal activity can enable criminal access to methods of production, storage, distribution, or trading. In the context of narcotics crime, corporations could play a significant role in the trafficking of narcotics through a variety of modus operandi including production, distribution, and sales to the general public. Therefore, corporation as a legal subject can be held accountable. This study uses a statutory approach and is normative (doctrinal). It solely employs secondary data and is processed qualitatively to describe facts, documents, information, and other data related to criminal liability for corporations as perpetrators of narcotics trafficking in Indonesia. The embodiment of criminal liability towards corporations as perpetrators of narcotics trafficking is regulated in several provisions, including Article 130 of Law No. 35 of 2009 concerning Narcotics as well as Articles 60 to 64 and Article 70 of Law No. 5 of 1997 concerning Psychotropics. The crime of narcotics distribution through corporation involves businesses or legal entities such as hospitals, health clinics, pharmacies and others. Revocation of business licenses can be used as punishment for those companies, while the management may also face further legal repercussions.
