Abstract

To borrow or lend money is one example of an economic and financial transaction that often involves a contractual agreement. Collateral is an object that the debtor (borrower) gives to the creditor (lender) in exchange for a loan. "Pawned" describes the thing that serves as collateral. A creditor may sell a pawned item to recover a debt in the event that the debtor does not make their loan repayment as agreed upon. Consensus agreements reached under pressure tend to be unjust and hurtful to one side. The concepts of fairness and equilibrium in contracts are violated by this. Consequently, we must investigate the means by which agreements entered into under duress may be rescinded or rectified, as well as the laws that govern the protection of parties in such situations.

Abstract

Study This discusses the implementation execution decision of the Court Industrial Relations (PHI) Bandung-related dispute Termination Connection Work (PHK) through mechanism bankruptcy. PHI decisions often face​ constraints in implementation, especially in unsolved layoff disputes that can quickly be executed. Bankruptcy is one of the instruments used​ to ensure workers' rights are fulfilled when the Company has financial trouble. Research This is to study how the bankruptcy process can be used as a road alternative for finishing layoff disputes and challenging the law's implementation. The research uses a legal normative approach supported by case PHI Bandung decision studies. Research results show that although Bankruptcy can become a practical solution, it requires synergy between the court and curator so execution can run optimally.

Abstract

Bank loans play a vital role in supporting economic activities in Indonesia. One important instrument in managing credit risk is a personal guarantee, which involves a third party or the debtor himself to guarantee repayment of the loan in the event of default. This study analyzes the legal position of personal guarantees in the structure of bank credit agreements in Indonesia, identifying the effectiveness and risks associated with the use of personal guarantees. The normative juridical research method is used to explore conceptual and statutory approaches, and compare practices in the field. The results show that although personal guarantees provide an additional layer of security for banks, their utilization must be followed by an in-depth assessment of the guarantor's financial condition and the legal agreement made. Strict regulations and the application of prudential principles by banks are important to ensure that personal guarantees are effective in reducing credit risk, while supporting sustainable economic growth.

Abstract

Fiduciary guarantees in Indonesia are regulated in Law Number 42 of 1999. This guarantee provides security for creditors by binding movable property, both tangible and intangible, as well as immovable property, especially buildings that cannot be encumbered with mortgage rights. Debt collectors have an important role in the debt settlement process through parate execution, which is a direct execution of the fiduciary guarantee object without the need to go through court. The purpose of this research is to identify and analyze in depth the challenges faced in the implementation of existing laws, particularly in the context of parate execution by debt collectors. This research aims to document the weaknesses in the law that allow such violations to occur and explore more effective legal solutions. This research uses a legal research method that uses normative juridical research, which is research intended to conduct a study of the application of rules or norms in positive law. The result of this research is that the implementation of parate execution in fiduciary guarantees often involves debt collectors who have an important but controversial role, often causing abuse of authority and violations of human rights. Although regulations already exist, challenges still arise such as human rights violations, lack of legal understanding among debt collectors, and suboptimal supervision and law enforcement.

Abstract

Mortgage is defined as a security right imposed on land rights. On 19 April 1996, Law Number 4 of 1996 on Mortgage Rights over land and objects related to land (UUHT) was enacted. This system is regulated in PMATR/KBPN Number 5 of 2020 concerning electronically integrated Mortgage Rights Services, which aims to provide certainty and legal protection in utilising land as an object of Mortgage Rights. This research examines how the registration of Mortgage Rights that exceeds the time limit at the ATR / BPN Office based on UUHT Number 4 of 1996 in Tasikmalaya City and what are the legal consequences if the registration of the Deed of Granting Mortgage (APHT) exceeds the time limit at the Agrarian and Spatial Planning Office / National Land Agency.The research method used is Empirical Juridical, with data sources from the ATR / BPN Office of Tasikmalaya City, PPAT, and Mortgage Rights Applicants in Tasikmalaya City. The data collection technique uses primary and secondary data. The results show that the process of encumbering Mortgage Rights in Tasikmalaya City often exceeds the time limit of 7 working days stipulated by UUHT article 13 paragraph (2), with an average delay of 0.28% during January to July 2024. The legal consequences are administrative sanctions in the form of verbal warnings. This delay does not cause the cancellation of Mortgage Rights, but the law cannot provide optimal protection to creditors according to the purpose of the certificate of mortgage rights.

Abstract

Penelitian ini bertujuan untuk mengkaji peran hukum jaminan dalam mendukung pembiayaan infrastruktur hijau di Indonesia. Melalui analisis kendala regulasi, teknis, dan operasional, serta strategi penguatan hukum jaminan, studi ini berusaha memberikan wawasan tentang bagaimana meningkatkan daya tarik investasi dalam proyek infrastruktur hijau. Studi kasus penerapan hukum jaminan dalam proyek Pembangkit Listrik Tenaga Surya (PLTS) di Bali menunjukkan bahwa hukum jaminan yang efektif dapat memberikan keamanan dan kepastian hukum bagi investor dan pemberi pinjaman. Namun, proyek infrastruktur hijau di Indonesia menghadapi berbagai kendala, termasuk kompleksitas perizinan, ketidakjelasan regulasi, keterbatasan teknologi, kurangnya keahlian, serta manajemen proyek yang buruk. Untuk mengatasi kendala tersebut, penelitian ini merekomendasikan strategi-strategi seperti penyempurnaan regulasi dan kebijakan, peningkatan kapasitas penegakan hukum, pengembangan infrastruktur dan teknologi pendukung, penguatan skema jaminan dan asuransi, serta promosi dan edukasi tentang pembiayaan hijau. Implementasi strategi ini diharapkan dapat meningkatkan kepercayaan investor dan pemberi pinjaman, mempercepat pelaksanaan proyek, dan memastikan keberlanjutan operasional proyek hijau, sehingga mendorong pembangunan berkelanjutan di Indonesia.

Abstract

Land Deed Making Officers are government partners in exercising authority in terms of making Land Transfer Deeds. This study aims to analyze the role and function of Land Deed Making Officers in the digital transformation of certificate services. In the perspective of protection and legal certainty. This study uses a normative legal research approach or also called library legal research. The results of the study show that the government in making policies needs to be balanced with efforts to strengthen human resources and technology. These efforts can be made by building an internet access network that reaches all regions of Indonesia and providing training to Civil Service employees at the Ministry of ATR/BPN and other supporting parties such as Land Deed Making Officers and notaries. Abstract

Economic Development is the most important part of National Development which seeks to improve all aspects of community, nation and state life to realize the National Goals of the Republic of Indonesia as stated in the 1945 Constitution of the Republic of Indonesia (1945 Constitution). In realizing National Development, quite a bit of capital is needed. One way to fulfill capital comes from banking sector credit. To provide this capital, banks require collateral to guarantee the return of funds from the credit that has been disbursed. Collateral is required if there is a default on the part of the debtor, then the bank as a creditor can sell the collateral to pay off the outstanding balance of the debtor's loan. The collateral most preferred by banks is usually in the form of fixed assets such as land because they have a fixed value and tend to increase from year to year. In reality, the land pledged by debtors to banks as creditors has the status of abandoned land. Abandoned land is land of rights, land of management rights and land obtained on the basis of land control, which is intentionally not cultivated, not used, not exploited and/or not maintained. As a result, if the debtor defaults, there is no special guarantee for the creditor as the holder of the mortgage rights.

Abstract

Dwaling is a defect of will that can lead to the invalidation of an agreement if one party gives consent based on misinformation. This study uses the juridical analysis method to assess 50 fiduciary deed cases, of which 20% contain dwaling elements. The results show that dwaling often occurs due to the lack of in-depth verification by the notary and unclear communication between the relevant parties. As a result, fiduciary deeds containing dwaling are often declared null and void, causing financial losses for creditors and legal risks for debtors. This research highlights the importance of due diligence, transparency, and strict supervision of the notary profession to prevent dwaling and ensure legal certainty in fiduciary agreements. Recommendations include strengthening regulations, improving understanding of related parties, and stricter enforcement of notary ethical standards. This research aims to provide greater insight into the importance of integrity in fiduciary deed making and the steps needed to mitigate the risk of dwaling.
