Abstract

The phenomena of radicalism, including in religiosity, occur in any country and have become a global trend. Their fast widespread is supported by technological development especially in communication and information fields. One of effective ways to deal with radicalism is strengthening the family institution and optimizing its function in shaping the family members’ personality. Sadly, many families become less aware of their importance in exercising such noble function and task. Worse still, some recent radical actions in Indonesia even involved wives and children which reflect the failure of family institution in creating a peaceful and tranquil society where they live in. This paper tries to recall and re-understand the urgency of family institution to educate the family members in facing radicalism. This study is a library research employing the discourse analysis method. The results show that indeed the family institution plays a significant role in shaping their members’ personality and can contribute determinately in brushing radicalism aside and creating a peaceful society.

Abstract

Etimologically, the word kafa’ah means egalitarian, equivalent, comparable, orsimilar. In the constellation of the Islamic thought, kafa’ah is meant that a prospective husband is expected to be comparable to the prospective bride in terms of religion, education, social status, profession, descent/ancestry, independence status, physical-spiritual conditions, wealth, position, degree and so on. It is intended to guarantee the relation between a husband and his wife as well as ensuring a harmony oftheir family life in the future. This article describe about kind of Moslem’s thinker perspective, especially about kafa’ah concept. Some of the recommend a strict implementation of kafa’ah from the point of religion to the factor of wealth that the prospective groom must meet all the detailed requirements; but some others do not give much regards to it. The latter grounds their views on a reason that any Moslem, as long as he is not an adulterer, has the right to marry any Moslem’s woman he want. Kafa’ah secara etimologi berarti egaliter; sepadan; sebanding; semisal. Dalam konstalasi pemikiran Islam, kafa’ah dimaksudkan bahwa seorang calon suami diharapkan sebanding dengan calon istri dalam agama, tingkat pendidikan, status sosial, profesi, keturunan, kemerdekaan, kondisi jasmani-rohani, kekayaan, jabatan, derajat dsb. Hal ini dimaksudkan agar terjaminnya keharmonisan pergaulan suami istri dalam berumah tangga di kemudian hari. Artikel ini coba menguraikan beragam pandangan para pemikir Muslim mengenai konsep kafa’ah. Ada yang mensyaratkan secara ketat pelaksanaan kafa’ah, sejak poin agama sampai poin kekayaan; di mana kriteria calon mempelai laki-laki harus memenuhi secara terinci persyaratan di atas. Namun ada juga yang sama sekali tidak melihat kepentingan kafa’ah ini, dengan alasan Muslim mana saja, asal tidak pezina, memiliki hak untuk menikahi Muslimah yang diinginkannya.

Abstract

E-money merupakan  modernisasi metode pembayaran non tunai berbasis teknologi yang saat ini lazim digunakan oleh masyarakat. Perkembsngsn  metode pembayaran berbaasi e-money ini tentunya harus sejalan dengan prinsip-prinsip agama. Penelitian ini bertujuan untuk mengetahui apakah dengan adanya e-money ini sejalan dengan kosep maqashid syariah fi al-muamalah. Jenis penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan kualitatif, teknik pengumpulan bahan hukum yang digunakan ialah studi dokumen atau sudi pustaka dengan menggunakan metode deskriptif kualitatif. Hasil penelitian menunjukan jika hukum bertransaksi dengan e-money adalah mubah atas dasar kaidah “Al ashlu fil mua'malati al ibahah hatta yadullu ad-daliilu ala tahrimiha”, namun kemubahan ini hanya terbatas pada e-money dengan prinsip syariah yang berpedoman pada Fatwa Dewan Syariah Nasional. Adapun e-money kovensional dianggap tidak memenuhi prinsip syariah sebaiknya kita menghindari penggunaannya karena ditakutkan adanya unsur riba, gharar, dan maitsir yang dapat merugikan pihak-pihak dalam e-money tersebut.Kata Kunci: E-Money, Maqashid Syariah Fi Al-Muamalah, Maslahah.

Abstract

Abstrak[English]: Millennial era is always synonymous with the advancement of various lines of technology, including the development of modern telecommunications tools that lead to social media activities. Different groups almost enjoy today’s social media activities without exception. However, the impact of social media activities has led to various aspects of positive progress as well as an effect on harmful elements in the form of mutual ridicule, hoax news, and so forth. Maqashid syari’ah as the final value of the provisions of the Islamic law that carries the amount of protection of personal interests and the public interest is expected to be a response to social media activities today. As a literature-based study and literature review, this paper is expected to be able to contribute ideas and provide a solution to the various negative impacts of social media activities that occur at this time.Abstrak[Indonesia]: Era milenial selalu identik dengan kemajuan berbagai lini teknologi, tidak terkecuali berkembangnya alat telekomunikasi modern yang menimbulkan aktivitas media sosial. Aktivitas media sosial hari ini hampir dinikmati oleh berbagai kalangan tanpa terkecuali. Namun demikian, dampak dari aktivitas media sosial telah menimbulkan berbagai aspek kemajuan yang positif maupun berdampak pada aspek negatif berupa saling mencemooh, berita hoax dan lain sebagainya. Maqashid syari’ah sebagai nilai akhir dari ketentuan hukum Islam yang mengusung nilai perlindungan terhadap kepentingan pribadi dan kepentingan umum diharapkan bisa menjadi sebuah respon atas aktivitas bermedia sosial hari ini. Sebagai kajian berbasis literatur dan kajian pustaka, tulisan ini diharapkan mampu memberikan sumbangan pemikiran dan memberikan sebuah solusi atas berbagai dampak negatif dari aktivitas media sosial yang terjadi saat ini.

Abstract

In the fiqh of Shāfi‘ī, a humanistic philosophical analysis on women existence is given serious attention, particularly in his investigation on the matters of women. It is very vivid in his magnum opuses entitled al-Umm (The Mother), al-Risālah fi Us\ūl al-Fiqh and his periodicals qawl qadīm (old view) and qawl jadīd (new view). This article seeks to provide thorough analysis on the women empowerment through humanistic values from methodological and legal products aspects generated by Shāfi‘ī. In the aspect of methodology (us\ūl fiqh), the use of qiyās (analogy) is an indication of the humanistic value in the development of the mas\lah\ah\ (beneficial) principles. The legal products aspect can be explored through the following three classifications. Firstly, humanistic values of women in the law regarding the properties. Secondly, the humanistic values of women in the state law on economic issues related to religious conversion and social relations in political settings. Abstract

The Covid-19 pandemic has brought various significant impacts on the cultural shift in the society, one of which is the culture of using social media. This is based on the fact that in the Covid-19 pandemic situation there has been a very significant cultural shift in the use of social media, so that in practice, social media culture in the Covid-19 pandemic era has various impacts, both positive and negative impacts. With these various problems, this study aims to look at social media culture in the era of the Covid-19 pandemic from an Islamic perspective. As an effort to answer the problems above, this study uses a literature review with data sources from books, journal articles, and various online newspapers with data analysis methods using content analysis. The findings in this study indicate that the culture of society in the use of social media in the era of the Covid-19 pandemic has experienced a very significant increase. This increase in the view of Islam is supported when humans explore the ability to increase their knowledge and abilities in their fields. On the other hand, if the increasing culture of social media in the era of the Covid-19 pandemic leads people to a crime, then Islam has the consequence of giving a ban.

Abstract

The use of social media by women is oftentimes understood as a detriment to family sustenance. As a result, the stigmatization of social media user and social media misuse aspects is often associated with women. In addition, in family structures, men hold a very strong position. The men’s authority then has implications for the control and intervention against their wives in the use of social media. Based on this phenomenon, this qualitative study with a case study on women's activities on social media in Tulungagung Regency aimed to formulate an ijtihad model of the fiqh of social media with maqashid sharia and social reality as the basis. The findings of this study show that: 1. The intensity of women’s activities in social media in Tulungagung Regency, in essence, is adjusted to the needs and goals in the use of social media, 2. Women’s activities in social media in Tulungagung Regency, in essence, has implication for creating harmony in the family, 3. Women’s activities in social media in Tulungagung, in essence, is an actualization of social media fiqh, and 4. The implications of women’s social media activities in Tulungagung are the embodiment of social media fiqh.

Abstract

The purpose of writing this article is to find out what the musyarakah muntahiyah bi al-tamlik contract is and how to implement it. Broadly speaking, this contract consists of two keywords, namely musyarakah and tamlik (ownership), which means that this contract is a contract that is carried out is a collaboration between two or more people who promise that at the end of the period it will end with ownership of capital or assets by one. one party in full. The implementation of this contract is carried out by making a syirkah contract first then the second contract can use a sale and purchase contract, a grant or other contract that is justified according to sharia, this is done to avoid the occurrence of multiple contracts in one transaction which usually will lead to the occurrence of gharar. This research is a normative study with a conceptual approach, namely the discussion of the musyarakah muntahiyah bi al-tamlik contract. The extraction of legal materials is carried out through literature studies related to the study of maqashid al-sharia and maslahah both classical and contemporary literature. In determining Islamic law, it often uses maqashid al-sharia which consists of five components, namely maintaining religion (hifdz al-din), guarding the soul (hifdz al-nafs), maintaining reason (hifdz al-'aql), maintaining descent (hifdz al -nasl) and safeguarding property (hifdz al-maal), so that in this transaction no party feels burdened because in the practice of the Islamic home ownership cooperation, they can occupy the house first and make repayments at the end of the contract period so that later the house will become the property. syarik as a whole.

Abstract

Abstract This article aims to explain the position of fiqh schools in Islamic law and. Many problems arise because of a lack of understanding of mazhab issues, such as taqlid attitudes, school fanaticism, and opinions about obligations to certain schools. As a result, due to different schools of thought, there was strife within Muslims. Even more extreme, because it is different from the Madzhab or the teachings of its ulama, the Koran and Hadith are rejected. The schools appeared after the third period of the initial generation, namely in the second century Hijriah and this period is called the Mujahideen period. Every school, like Shafi’i, Hanafi, Maliki and Hambali have their own uniqueness. The uniqueness lies in the methods and applications of the Istinbath law which are used of each school and the basis used. Such as Imam Syafi’i has a different method with the other mazhab priests in establishing the law, which greatly emphasizes Sunnah, nash, and ra’yu. In addition, in establishing the Shafi’i faith law has two opinions known as Qaul Qadim and Qaul Jadid. This study examines the faoundations of the scholars in performing ijtihad and istinbath methods of law. Keywords: madzhab, istimbath, and law.

Abstract

Abstract The science of Usul Fiqh developed along with the development of Islam to various areas in the Arabian Peninsula. Research by the Usul Fiqh, it is necessary because many cultures outside of the Arabian Peninsula, which are at odds with the local culture of the Arabian Peninsula. Of course, it is a requirement of local communities who do not know much about Islam. Therefore, the clergy continue to do a lot of efforts to resolve the various problems that exist. Where it is constituted by several methods for the formulation of Islamic law in addition to the "al-Quran", "Sunna", "Ijma’" and "Analogy" which has been agreed upon by both parties, namely al-urf. For Muslims, wherever they are, for the law of the provisions of the Quran and the Hadith of the Prophet is not violated, local customs can be declared valid. Legal ijtihadiyah derived from the "custom" and then set as Islamic law where if the "custom" is a source of that change, then the law ijtihadiyah will also change. The Compilation of Islamic Law contains a consideration of the customs law which is used as the legal basis that there was product fiqh of marital property which is distinct different with the corpus of jurisprudence outside Indonesia. The basic example is based on the reality if the law changes to suit the turn of time, place, and conditions. From here it looks that the nature of Islamic law that dynamic can be seen very clearly.
