Abstract

This study was intended as a response to the egg freezing phenomenon, a growing issue among contemporary society, through the formulation of fiqh of reproduction. As seen in the culture of contemporary society, technological advancement affecting the culture of people is an inevitability. Along with the advancement of technology in today's contemporary era, the phenomenon of egg freezing and its impacts cannot be ignored. As in the study of Islamic law (fiqh), every action is always considered to have an impact caused by the act, both positive and negative. This study used a literature review with data on the phenomenon of egg freezing as a new reproductive phenomenon in contemporary society. The data then became the basis for interpreting the concept of the principle of maqashid sharia in the study of ushul fiqh as the basis for the formulation of fiqh of reproduction. The findings in this study show that egg freezing according to the study of fiqh of reproduction may be performed with the right reasoning of benefit for women.

Abstract

Etimologically, the word kafa’ah means egalitarian, equivalent, comparable, orsimilar. In the constellation of the Islamic thought, kafa’ah is meant that a prospective husband is expected to be comparable to the prospective bride in terms of religion, education, social status, profession, descent/ancestry, independence status, physical-spiritual conditions, wealth, position, degree and so on. It is intended to guarantee the relation between a husband and his wife as well as ensuring a harmony oftheir family life in the future. This article describe about kind of Moslem’s thinker perspective, especially about kafa’ah concept. Some of the recommend a strict implementation of kafa’ah from the point of religion to the factor of wealth that the prospective groom must meet all the detailed requirements; but some others do not give much regards to it. The latter grounds their views on a reason that any Moslem, as long as he is not an adulterer, has the right to marry any Moslem’s woman he want. Kafa’ah secara etimologi berarti egaliter; sepadan; sebanding; semisal. Dalam konstalasi pemikiran Islam, kafa’ah dimaksudkan bahwa seorang calon suami diharapkan sebanding dengan calon istri dalam agama, tingkat pendidikan, status sosial, profesi, keturunan, kemerdekaan, kondisi jasmani-rohani, kekayaan, jabatan, derajat dsb. Hal ini dimaksudkan agar terjaminnya keharmonisan pergaulan suami istri dalam berumah tangga di kemudian hari. Artikel ini coba menguraikan beragam pandangan para pemikir Muslim mengenai konsep kafa’ah. Ada yang mensyaratkan secara ketat pelaksanaan kafa’ah, sejak poin agama sampai poin kekayaan; di mana kriteria calon mempelai laki-laki harus memenuhi secara terinci persyaratan di atas. Namun ada juga yang sama sekali tidak melihat kepentingan kafa’ah ini, dengan alasan Muslim mana saja, asal tidak pezina, memiliki hak untuk menikahi Muslimah yang diinginkannya.

Abstract

Abstract: The phenomenon of selfie among the millennial generation has become a very common thing to do. In the study of contemporary Islamic law, the approach of maqâshid syarî‘ah that seeks to gain mashlahât (benefits) and avoids mafsadât (harms) in human life may be used as a special consideration for dealing with the said phenomenon. This literature-based study was aimed to uncover the said phenomenon by reviewing it using mashlahât and mafsadât approaches. The results of the study indicate that the said approaches have urgency as a means of control against the selfie phenomenon practiced by the current millennial generation. Selfie should only be done if it brings benefits and goodness (mashlahât), otherwise, it must be avoided.Keywords: selfie, millennial generation, Islamic law, mashlahât, mafsadât

Abstract

This article explores early marriage in Madura. Early marriage causes psychological problems and physical and material losses that are not in line with the purpose of family formation in Islam. Using a mixed method approach, this article utilizes questionnaires, interviews, observations, and documentation obtained using Structural Equation Modeling with the Partial Least Square approach equipped with qualitative analysis. The achievement of family formation goals is measured using Maqāsid Al-Usrah indicators by Jamal Al-Din 'Atiyah Muhammad. The measurement results indicate that early marriage families in the Madura Muslim community achieve family formation goals to ensure human life continuity, regulate male-female relationships, maintain lineage clarity, and preserve religiosity within the family. At a methodological level, this research contributes to various models for measuring family resilience in establishing and building a family. Based on reliability and validity tests, all indicators of maqāsid al-usrah’s Jamal Al-Din ‘Atiyah Muhammad are declared valid and reliable so that they can be used to measure the achievement of family formation goals in other subjects in further research studies.

Abstract

Abstrak Diskursus ekonomi pembangunan berbasis interdisipliner merupakan terobosan yang relatif baru untuk mencapai beberapa dimensi antara lain: keseimbangan material dan spiritual, serta keseimbangan moralitas seluruh pemangku kepentingan. Pendekatan interdisipliner awal mulanya diprakarsai oleh Harun Nasution hingga sekarang semakin masyhur seiring laju era modern. Harus disadari corak kajian doktrinal tradisional tidal lagi memadai dalam kajian ekonomi Islam, sehingga perlu kolaborasi disiplin ilmu yang terpadu (interdisipliner) dalam meresponi dan menyahuti pembangunan ekonomi Islam. Peneliti akan mencoba menyumbangkan pemikiran tentang konstruksi ekonomi Islam berbasis interdisipliner yang dikaji dari sudut pandang maqashid al-syariah dan studi Islam. Untuk menjawab permasalahan tersebut, peneliti menggunakan penelitian kepustakaan dengan pendekatan deskriptif dan data yang diperoleh tentunya bersifat dharuriyat dengan cara pengumpulannya melalui analisis isi yang bersifat pembahasan mendalam. Hasil penelitian adalah pelaksanaan pembangunan ekonomi Islam harus didasarkan pada prinsip-prinsip seperti pandangan dunia, manusia sebagai pelaku pembangunan, Sifat Ruh, dunia dan akhirat sebagai skala waktu, ilmu sebagai pedoman, ibadah sebagai landasan pembangunan, sumber daya alam sebagai sarana, dan ridho Allah sebagai tujuan. akhir pembangunan.

Abstract

This study was motivated by a phenomenon that contrasts with justice for children, especially adulterous or born-out-of-wedlock children who cannot receive their basic rights, which should become both parents' responsibilities to fulfill. The responsibilities include the right to get recognition as children, to have their daily life needs fulfilled, to be protected, and to be legally borne. In addition, there is a phenomenon that the children do not get guardianship and inheritance rights. This problem needs to be revealed through a study using a qualitative method with a multi-site model. The research location is at the cities’ religious courts of Mojokerto, Malang, and Surabaya. Through a comprehensive study, it was found that 1) juridical implications of determining the civil rights of born-out-of-wedlock children at the Religious Courts of Mojokerto, Malang, and Surabaya showed that they have not been able to accommodate the principle of justice and the best interests of the child and have not fully implemented the principle of legal progress and 2) from the progressive fiqh (Islamic jurisprudence) perspective, legislative decisions, and juridical implications of determining born-out-of-wedlock children at the related Courts require renewal to formulate a proof mechanism of istilḥāq (children origin determination) and strengthen the Courts to carry out istilḥāq based on justice.

لقد دون علم أصول الفقه من قبل مذاهب شىت بما فيها من تعدد مناهج االجتهاد واالستنباط. كما شهدت القرون الوسطى تطورا هائال حيث ظهرت ونشأت فيها نظريات ومقاربات يف جمال استنباط األحاكم أصوال وفقها. غري أن هناك فجوتني إقليمية وزمانية بني إندونيسيا والقطر العريب الواقع فيه ذاك اتلطور، األمر اذلي يعرقل تطبيق األحاكم املستنبطة وعالجا للقضايا الفقهية بإندونيسيا من ًّ بشلك اكمل شامل. فانطالقا من هذا، احلاجة ماسة إىل صياغة مقاربة أرخبيلية حل خالل صياغة منهج جديد يسىم بدمج املصدرين أو يقال بادلمج بني املصدرين. ويتم تنفيذه عرب دمج مصدرين هما مصادر الترشيع اإلساليم والترشيع القانوين حفاظا ىلع االستقرار وصيانة للبالد عن االنهيار. بناء ىلع احلجة السابقة، استند هذا ابلحث ىلع دراسة استقصائية بتحليل املقارب الفقيه يف العرب واندونيسيا. من خالل ذلك املنهج، قصد ابلحث يلكشف موضوع الفقه العرب كمرجع يف صياغة الفقه بمنهج االجتمايع واثلقايف للمجتمع اإلندونييس. استنتج هذا ابلحث بأن ً بني مصادر الفقه اإلساليم ومصادر القانون الشعب اإلندونييس كجهد إلنشاء منتجات الفقهية اتلكيفية هناك تكامل يف إندونيسيا. The methods of ijtihâd and istinbâth have been adopted and practiced by all schools of thought of Islamic jurisprudence (madzhab fiqh). The Middle Ages witnessed a tremendous development in which theories and approaches emerged in the field of istinbâth al-ahkâm (deducing legal provisions) both in ushûl (principles) and fiqh (Islamic jurisprudence). However, there are two gaps, regional and temporal ones, between Indonesia and Arabian countries where that development took place. These have been impeding the application of those developed provisions fully and comprehensively. From this point of view, there is an urgent need to formulate an archipelagic (Nusantara, Ind.) approach to solve the issues of jurisprudence in Indonesia through the formulation of a new approach by integrating or merging 2 (two) legal sources. It is implemented through the integration of two sources, the Islamic and Indonesian legislation sources with the purposes of preserving the country’s stability and preventing it from its collapse. According to the above argumentation, this study is carried out through a literature review with an analytical study on the fiqh approach in Arab and Indonesia. This is then intended to conduct a study of fiqh in Arab countries as the reference to formulate fiqh with the sociocultural approach of the Indonesian society. The findings indicates that there is an integration between the source of Islamic law and the Indonesian law as an effort to build an adaptive product of fiqh in Indonesia.

Abstract

Abstrak[English]: Millennial era is always synonymous with the advancement of various lines of technology, including the development of modern telecommunications tools that lead to social media activities. Different groups almost enjoy today’s social media activities without exception. However, the impact of social media activities has led to various aspects of positive progress as well as an effect on harmful elements in the form of mutual ridicule, hoax news, and so forth. Maqashid syari’ah as the final value of the provisions of the Islamic law that carries the amount of protection of personal interests and the public interest is expected to be a response to social media activities today. As a literature-based study and literature review, this paper is expected to be able to contribute ideas and provide a solution to the various negative impacts of social media activities that occur at this time.Abstrak[Indonesia]: Era milenial selalu identik dengan kemajuan berbagai lini teknologi, tidak terkecuali berkembangnya alat telekomunikasi modern yang menimbulkan aktivitas media sosial. Aktivitas media sosial hari ini hampir dinikmati oleh berbagai kalangan tanpa terkecuali. Namun demikian, dampak dari aktivitas media sosial telah menimbulkan berbagai aspek kemajuan yang positif maupun berdampak pada aspek negatif berupa saling mencemooh, berita hoax dan lain sebagainya. Maqashid syari’ah sebagai nilai akhir dari ketentuan hukum Islam yang mengusung nilai perlindungan terhadap kepentingan pribadi dan kepentingan umum diharapkan bisa menjadi sebuah respon atas aktivitas bermedia sosial hari ini. Sebagai kajian berbasis literatur dan kajian pustaka, tulisan ini diharapkan mampu memberikan sumbangan pemikiran dan memberikan sebuah solusi atas berbagai dampak negatif dari aktivitas media sosial yang terjadi saat ini.

Abstract

Maqāṣid syarī‘ah has a tremendous urgency to the process of Islamic law’s adaptability and modernization, especially in response to the increasingly complicated and crucial human problems where the treasures of classical fiqh are no longer capable to answer them. This paper studies a genealogical analysis to answer the question about the origin of the concept of maqāṣid syarī‘ah by uncovering its embryo and genes of this completely new concept. It was library research employing discourse analysis. Primary and secondary sources of works from previous and contemporary Muslim scholars discussing maqāṣid were studied and analyzed using Gadamer’s hermeneutics. The study found that from the historical perspective, maqāṣid syarī‘ah did not just emerge at the time of al-Syaṭibi, but, based on empirical data, it had been present long before his time. The literature analysis on uṣūl fiqh concluded that the figures before al-Syaṭibi had developed some works that were actually in the area of the essential and substantial values of maqāṣid syarī‘ah, however, they presented them using other words and terms so that they were considered as not of maqāṣid syarī‘ah.
