Abstract

One of the fundamental problems of a cultural shift in the contemporary era today is the existence of a phenomenon that is contrary to the norm. One of them is the childfree phenomenon with the main goal being the voluntary choice not to have children in a family. Seeing this phenomenon, it seems that it has brought about a shift that must be answered from the perspective of religion, Islamic law, and the reality of society. This is because so far the position of children in religion, law, and the reality of society is a group that must be protected. With the above problems, this study aimed to formulate an approach to the childfree phenomenon from the point of view of Islamic law, particularly the objectives of Islamic law (maqāshid sharī'ah) and the reality of society. Through literature review and literature study, this study finds that the main dimensions of the Islamic law approach model based on maqashid shari'ah and the reality of society are based on the benefit to be addressed and are in line and tandem with the reality of society. The phenomenon of being childfree is contrary to the mission and objectives of maqāshid sharī'ah and the reality of society. The conclusion of this study has strengthened the discourse of an Islamic Law study on the childfree phenomenon as one of the contemporary phenomena that should be responded to by using the perspective of benefits to people. Salah satu problem mendasar dari pergeseran budaya di era kontemporer saat ini adalah adanya fenomena yang berseberangan dengan kelaziman. Salah satunya adalah adanya fenomena childfree dengan tujuan utamanya adalah peniadaan anak dalam sebuah keluarga. Melihat fenomena tersebut, nampaknya membawa arus pergeseran yang harus dijawab oleh kaca mata agama, hukum Islam, dan realitas masyarakat. Hal ini dikarenakan selama ini posisi anak dalam agama, hukum, dan realitas masyarakat merupakan kelompok yang harus dilindungi. Dengan problem di atas, kajian ini bertujuan untuk merumuskan pendekatan terhadap fenomena childfree dengan kaca mata hukum Islam, terkhusus tujuan hukum Islam (maqashid syari’ah) dan realitas masyarakat. Melalui kajian pustaka dan studi literatur, kajian ini menemukan bahwa dimensi utama model pendekatan hukum Islam berbasis maqashid syari’ah dan realitas masyarakat didasarkan oleh kemaslahatan yang hendak dituju dan sejalan serta beriringan dengan realitas masyarakat. Terhadap fenomena childfree, childfree bertentangan dengan misi dan tujuan maqashid syari’ah dan realitas masyarakat. Kesimpulan dalam kajian ini telah menguatkan diskursus kajian hukum Islam bahwa fenomena childfree merupakan satu dari fenomena kontemporer yang harus direspon dengan kaca mata kemaslahatan dalam masyarakat.

Abstract

Dewasa ini muncul pemikiran yang berupaya mendekonstruksi konsep Kafa’ah karena dinilai bias dan sudah tidak memadai untuk kondisi masyarakat saat. Padahal, sebagian ulama tradisional menempatkan Kafa’ah pada wilayah sakral, sehingga tidak mungkin didekonstruksi. Artikel ini akan membahas konsep Kafa’ah dalam perspektif al-Qur’an dan Hadis serta implikasinya dalam pernikahan. Kafa’ah mengandung makna seorang calon suami diharapkan sebanding dengan calon istri dalam agama, tingkat pendidikan, status sosial, profesi, keturunan, kemerdekaan, kondisi jasmani-rohani, kekayaan, jabatan; derajat dan sebagainya. Untuk mengembangkan progresifitas egalitarianitas-muslimah di satu sisi dan terhindarnya liberalitas laki-laki di sisi lain, maka ukuran Kesepadanan Kualitas Mempelai (kafa’ah), perlu disederhanakan menjadi dua saja, yaitu; pertama penilaian soal agama, dan yang kedua Hasil Kesepakatan unsur mempelai. Al-Qur’an memberi tuntunan hanya agama yang tidak dapat ditawar-tawar, sedangkan yang lain bersifat relatif. Seharusnya wanita berperan utama dalam menetapkan usulan kriteria kafa’ah selain agama. Ini semua diperlukan sebagai upaya mencapai kemaslahatan, sekaligus untuk mengembangkan progresifitas muslimah..

Abstract

As a first step in extracting Islamic law, namely through the study of texts, qawa'id al-uṣūliyyah al-tasyri’iyah in this way has an important position in the discourse of studying Islamic law. Unfortunately, in today's situation, al-qawā‘id al-uṣūliyyah al-tashrī'iyyah seems to be ruled out. This position is taken by ijtihād models based on a progressive approach rather than an approach to the text. This study is a discourse analysis using a qualitative method with a normative approach. In this study, the author examines the concept of al-qawā‘id al-uṣūliyyah al-tashrī'iyyah which is then formulated in several issues and problems of contemporary Islamic law. The findings in this study indicate that: first, the al-qawā'id al-uṣūliyyah al-tashrī'iyyah model in determining and establishing Islamic law places more emphasis on the substance of fundamental values in Islamic law, second, reformulation of al-qawā'id al -uṣūliyyah al-tashrī'iyyah in the settlement of contemporary Islamic law puts forward the protection of mafsadat rather than the taking of maṣlaḥah.

Abstract

The high number of pedophilic incidences in Indonesia is partly due to the lack of community’s social control and the weak supervision of the litigation and penological processes. Considering the impact of pedophilia to victims including long-term trauma, injury, and socio-moral damage that tends to be acute and dangerous, intensive monitoring of both litigation and penological processes must be carried out on a massive scale to ensure and maximize the sustainable protection for children which guarantees and protects their rights so they can live, grow, develop, and participate optimally appropriate to human dignity and integrity as well as get protection from any form of violence and discrimination act. This empirical-normative-juridical qualitative study uses emic and etic approaches; the data analysis refers to the explication technique developed by Von Eckartsberg, Wertz, and Schweitzer, starting with data interpretation and continuing with the integration of interview results and normative-juridical analysis. The results of the study show that the litigation and penology of pedophilia are in line with the Indonesian conventional law and in accordance with the objectives of Islamic law (maqasid shari’ah) eventhough at its penological aspect it is not pretty optimal yet.

Abstract

Gender, human rights, and the advancement of science and technology with all their problems are some interesting and highly discussed contemporary issues, especially when they are related to Islamic teachings. This is inseparable from some people’s lack of understanding of Islamic teachings and baseless accusations of Islam as being old-fashioned on such contemporary issues. So, the basic question is how Islam views these issues. This study is library research with data analyzed using the maqāshid sharī’ah (objectives of Islamic law) approach. The findings of this study indicate that Islam upholds human rights; places gender issues proportionally while guaranteeing the dignity of each gender without discrimination, and encourages humans to develop, promote, and utilize science and technology as much as possible while still referring to moral reasoning in its utilization.

Abstract

Objective: This study aims to analyze the revitalization of government functions in the formulation of village regulations based on the theoretical framework of deconcentration and decentralization, with a multisite focus on Kendalbulur and Bendungan Villages, Indonesia. The research seeks to address the following questions:1. How do the authority and capacity of village governments influence the formulation of village regulations? 2. How is the involvement of public consultants integrated into the regulatory drafting process? 3. How is community participation manifested in the formulation of village regulations? 4. How do village regulations reflect the realization of good governance? Method: This study employs a qualitative approach with a multisite case study design, using in-depth interviews, participatory observations, and document analysis to explore the dynamics of village governance. Results: The findings show that the authority and administrative capacity of village governments play a crucial role in fostering good governance. The integration of deconcentration and decentralization theories, complemented by the moral perspective of Siyasyah Dusturiyyah, emphasizes the importance of ethical considerations in every stage of policy-making. The involvement of public consultants, although still limited by budgetary and administrative constraints, has proven effective in enhancing the technical quality, accountability, and transparency of village regulation drafting. Community participation remains largely symbolic, with limited impact on the substance of policy.  Novelty: This research offers novelty by integrating the perspectives of deconcentration, decentralization, and Islamic ethics of Siyasyah Dusturiyyah into the theoretical model of "Responsive and Equitable Governance", as a new framework in analyzing the formulation of ethical, participatory, and sustainable village policies.

Abstract

This study examines the integrity of general elections through the lens of prophetic journalism. A qualitative approach was employed to explore the perspectives and experiences of institutional administrators, community leaders, and local residents regarding electoral integrity grounded in prophetic journalism. This approach emphasizes the importance of relationships among various actors in the public policy process, including government institutions, non-governmental organizations, and the private sector. The research was conducted at the East Java Provincial General Election Commission (KPU), with data collected directly by the researcher through observation of words and actions. Data collection was carried out holistically and integratively, focusing on relevance to the study objectives. Data analysis involved systematically searching, organizing, and processing all interview transcripts while ensuring validity through careful verification procedures. The results indicate that electoral integrity can be maintained effectively through a combination of deliberative democracy and prophetic journalism. In this context, the media functions not only as an information distributor but also as a moral agent ensuring transparency, accountability, and fairness throughout the electoral process. Campaigns to validate and counter hoax news during elections are most effective when prophetic journalism is integrated with agenda-setting theory, allowing the media to shape public perception through information filtering, digital literacy education, and the delivery of objective and ethical reporting. Prophetic journalism also serves as a social control mechanism, reinforcing transparency and oversight by combining the press’s watchdog function with principles of honesty, responsibility, and wisdom, preventing electoral manipulation and safeguarding democratic integrity.

Abstract

Abstrak[English]: Millennial era is always synonymous with the advancement of various lines of technology, including the development of modern telecommunications tools that lead to social media activities. Different groups almost enjoy today’s social media activities without exception. However, the impact of social media activities has led to various aspects of positive progress as well as an effect on harmful elements in the form of mutual ridicule, hoax news, and so forth. Maqashid syari’ah as the final value of the provisions of the Islamic law that carries the amount of protection of personal interests and the public interest is expected to be a response to social media activities today. As a literature-based study and literature review, this paper is expected to be able to contribute ideas and provide a solution to the various negative impacts of social media activities that occur at this time.Abstrak[Indonesia]: Era milenial selalu identik dengan kemajuan berbagai lini teknologi, tidak terkecuali berkembangnya alat telekomunikasi modern yang menimbulkan aktivitas media sosial. Aktivitas media sosial hari ini hampir dinikmati oleh berbagai kalangan tanpa terkecuali. Namun demikian, dampak dari aktivitas media sosial telah menimbulkan berbagai aspek kemajuan yang positif maupun berdampak pada aspek negatif berupa saling mencemooh, berita hoax dan lain sebagainya. Maqashid syari’ah sebagai nilai akhir dari ketentuan hukum Islam yang mengusung nilai perlindungan terhadap kepentingan pribadi dan kepentingan umum diharapkan bisa menjadi sebuah respon atas aktivitas bermedia sosial hari ini. Sebagai kajian berbasis literatur dan kajian pustaka, tulisan ini diharapkan mampu memberikan sumbangan pemikiran dan memberikan sebuah solusi atas berbagai dampak negatif dari aktivitas media sosial yang terjadi saat ini.

Abstract

AbstractAn interdisciplinary-based development economics discourse is a relatively new breakthrough in achieving several dimensions, including: material and spiritual balance, as well as a balance of morality for all stakeholders. It must be realized that the traditional doctrinal style of study is no longer adequate in the study of Islamic economics, so there is a need for integrated (interdisciplinary) scientific disciplinary collaboration in responding to and responding to development economics. Researchers will try to contribute thoughts about development economics based on interdisciplinary studies from a perspective maqashid al-syariah and Islamic studies. To answer this problem, the researcher used library research with a descriptive approach and the data obtained was of course of a descriptive nature Dharuriat by collecting it through content analysis in the form of in-depth discussion. The results of the research are that the implementation of development economics must be based on principles such as tasawwur (worldview), humans are the conceptualizers and actors of development, the nature of the spirit, the world and the afterlife as a sign of time, knowledge as a guide, worship as the basis for development, natural resources as a means, and Allah's blessing as the final goal of development. Meanwhile, the economic concept of development is based on maqashid sharia offered by al-Syathibi is a basic requirement (Daruriyyah), comfort (Hajjiyyah), and luxury (tahsiniyyah). Meanwhile, what Akram offers are five components: wealth stability, wealth investment, community welfare, economic activity and legal ownership.Keywords: Reflection, Maqashid Sharia, Islamic Studies, and Development Economics
