Abstract

Sebagai agama dengan visi dan misi untuk membawa rahmat bagi alam semesta dan manfaat bagi umat manusia, Islam harus memiliki produk hukum yang responsif yang mampu menanggapi problematika manusia. Yurisprudensi Islam (fiqh) telah mengalami pergeseran dalam konstruksi dan perkembangan pemikiran. Karena paradigma tekstual telah runtuh dan digantikan oleh paradigma kontekstual, perkembangan pemikiran hukum Islam telah mengalami terobosan besar. Namun, perkembangan pemikiran hukum Islam selalu berjalan berdampingan dengan perkembangan jaman yang membawa berbagai masalah kehidupan bersamanya. Untungnya, muncul teori-teori baru tidak hanya dalam metode pembentukan hukum Islam tetapi juga dalam pendekatan hukum yaitu pendekatan untuk memperoleh manfaat (maṣlaḥah / maqāṣid sharī'ah) sebagai maksud dan tujuan dari penerapan hukum Islam. Penelitian ini adalah penelitian pustaka melalui tinjauan literatur yang ekstensif dan bertujuan untuk menyelaraskan dan menyatukan tiga elemen: tujuan syariah, produk hukum, dan realitas sosial. Temuan dalam penelitian ini diharapkan mampu dan relevan untuk menciptakan fiqih jalan tengah yang dapat berinteraksi dengan permasalahan manusia yang aktual dan kontemporer

Abstract

This study aimed to reformulate the ijtihad of gender-responsive fiqh. Such ijtihad model is needed in order to respond to the developments and dynamics of life in the current contemporary era. Moreover, current social reality and condition are often associated with empowerment of and justice for women. Movements and responses toward women’s issues recently has been occurring quite monumentally on social media. Such movements represent a response toward media development, especially on social media platforms. This literature-based study collected data from literature studies and descriptive critical analysis. Through the critical analysis, this study found an interpretation of gender fiqh ijtihad model initiated through social media platforms.

Abstract

The Omnibus Law Bill which has been passed into law number 11 of 2020 concerning Work Creation has generated a lot of controversy in the community. One of the articles that is most highlighted is related to foreign workers, in which the licensing is made easier. For this reason, this regulation needs to be studied from the perspective of maslahah. The purpose of this study is to determine the regulation of foreign workers after the work copyright law and its maslahah perspective. The research method used is normative juridical research with a statute approach and a conceptual approach. The results of this study indicate that Article 42 of the Job Creation Law contains a permit for the use of foreign workers using only RPTKA. In addition, the positions of foreign workers that do not require RPTKA are expanded and added to the positions of directors, commissioners and foreign workers needed in an emergency situation. Furthermore, details of the RPTKA were also deleted. In terms of maslahat, the regulation of foreign workers based on the Job Creation Law is not yet in accordance with the concept of maslahat, because the benefit is only for some people, not for the general benefit.

Abstract

The purpose of this study is to determine whether electronic money has an effect on the money supply and velocity of money in Indonesia. Technological developments that are increasingly developing affect payment systems that used to use cash to become e-money. E-money is starting to develop and is in demand by the public because it is considered more efficient and effective. The increasing use of electronic money (e-money) by the public has an impact on the money supply (M1) in Indonesia and the velocity of money. This study uses a quantitative approach with the type of associative research. This study uses secondary data sources. The sample in this study is the value of the volume of electronic money, the value of the money supply and the value of the velocity of money in Indonesia in 2012-2021. This study uses secondary data sources. The data analysis method used in this research is simple linear regression analysis. The result of this research is that e-money has a significant effect on the money supply. Electronic money contains float funds that are highly liquid which can be used to make legal payment transactions. So when the value of float funds increases, the amount of money in circulation in the community also increases. Electronic money has a significant effect on the velocity of money, when many people use e-money, fewer people use cash to make transactions.

Abstract

Women's participation in Indonesian politics gives its own color for the democracy of the nation. The number of female voters in the DPT of General Election 2019 is greater than the number of male voters, becoming an important key to the future direction of Indonesia's politics, democracy, and governance. This causes women's voices to become significantly valuable as the entry gate for the struggle and the development of the face of Indonesian politics, democracy, and governance. In this study, descriptive qualitative method was used with the Secondary Data Analysis (ADS) approach which utilized secondary data as the main research data related to the phenomenon of women's choice in the 2019 Presidential Election. The main objective of the current research is to see and analyze the level of adherence, pragmatism, fanaticism, and political intelligence of Indonesian women in making decisions to give their vote in the Presidential Election 2019 in a philosophical study. In terms of democratic presidential elections, philosophically if we believe in a democratic system as a form of sovereignty in the hands of the people, it is appropriate that the people directly elect the executive authorities, which in this case are the president and vice president. The elected president and vice president will further be responsible for the people who choose them, in this case is taking care, protecting, and guaranteeing the welfare of all people, including women. Therefore, there are several factors behind women's decisions in determining or voting which pair of president and vice president they think is ideal.

Abstract

Hak-hak konsumen seringkali tidak disadari oleh konsumen itu sendiri,sehingga dalam pelaksanaan transaksi sering mengalami ketidakadilan dan kerugian yang meliputi materi maupun non materi. Tingkat keberdayaan konsumen aliansi Lembaga Perlindungan Konsumen Swadaya Masyarakat masih rendah, sehingga membutuhkan pemberdayaan untuk meningkatkan keberdayaan konsumen. Salah satu hak yang tidak dipenuhi oleh pelaku usaha kepada konsumen adalah hak untuk berpendapat dalam membuat perjanjian, sehingga isi perjanjian cenderung tidak adil. Abstract

This study aims to formulate the paradigm of fiqh (Islamic law) in predicting various impacts of postgenderism by exploring postgender preferences according to MUI (Indonesian Council of Ulema) and KUPI (Indonesian Women Ulema Congress) scholars. This qualitative research begins with examining the perceptions of ulema (Muslim scholars) of both organizations regarding postgenderism. Primary data about perceptions and preferences on postgenderism were explored through in-depth interviews with four ulema, two from each organization. Secondary data were obtained through literature exploration from primary books and articles on postgender. Data analysis techniques employed spiral analysis equipped with content, comparative, and critical analysis. The findings show that: 1) based on maqāṣid sharī'ah (Islamic laws’ objectives), the ulema view that postgender ideologies and movement threaten human existence and risk the establishment of ḥifẓ al-dīn, ḥifẓ al-nasl and ḥifẓ al-‘irḍ (preserving one’s religion, offspring, and dignity respectively) and 2) postgenderism is considered as an ideology that allegedly violates sunnatullah (God’s laws) and threatens human existence and humanity. Therefore, every activity, facility, infrastructure, and opportunity born from it that threatens the existence of humanity must be avoided as much as possible. One of the preventive paradigms against postgenderism is formulated through uṣūl fiqh iftirāḍi (preventive Islamic law’s fundament) method as an anticipatory ijtihād (intellectual exercise) towards its various possible harms.
