Abstract

The purpose of this study is to examine the skills of the seller who is currently in detention in making a sale and purchase deed, the validity of the sale and purchase deed if the provisions of Article 22 of Government Regulation Number 37 of 1998 concerning Position Regulations for Land Deed Making Officials in the form of reading the deed are not fulfilled and how it is implemented Article 22 Government Regulation Number 37 of 1998 concerning the Position Regulations for Land Deed Officials in the field. This study uses empirical juridical legal research methods, which examines the applicable legal provisions and what actually happens in society. The results of the study show that the seller who is currently in detention is legally competent to make a Sale and Purchase Deed as long as he is an adult and not under the supervision of another person. A sale and purchase deed is valid as long as it complies with Article 1320 of the Civil Code, although it does not comply with the provisions of Article 22 of Government Regulation Number 37 of 1998 concerning Position Regulations for Officials Making Land Deeds in the form of not being read out first by the PPAT before being signed by the parties. Implementation of Article 22 of Government Regulation Number 37 of 1998 concerning Position Regulations for Officials for Making Land Deeds in the form of reading the deed before signing can be done through a Power of Attorney or direct signing to the Penitentiary. Thus, even though one of the parties is currently under detention in this case the seller, the provisions of Article 22 PP Number 37 of 1998 concerning PPAT Position Regulations will still be fulfilled, not eliminating or violating the provisions of Article 22 PP Number 37 of 1998 concerning Regulations for the Position of Making Officials Land certificate.

Abstract

Abstract Introduction to the Problem: Health is a basic right guaranteed by the Indonesian constitution. The government, through BPJS Kesehatan, seeks to provide access to health services for all, including mothers and children. However, Independent Practitioner Midwives (BPM) often face obstacles in cooperation with BPJS. Purpose/Study Objectives: This study examines the implementation and constraints of the BPM health insurance system according to Law No. 40 of 2004. Design/Methodology/Approach: Primary data was obtained through observation and interviews with independent practicing midwives (BPM) in Surabaya. Secondary data came from legislation and legal literature. The analysis is done qualitatively by integrating empirical data and literature study to get a systematic conclusion. Findings: The health insurance system in independent midwives (BPM) provides access to maternal and child health in accordance with Law No. 40 Year 2004. BPMs are obliged to cooperate with BPJS Health to ensure affordable and quality health services. However, BPMs often face administrative and technical obstacles in establishing cooperation with BPJS, affecting the effectiveness of services.The implementation of the health insurance system in Independent Practitioner Midwives (BPM) in accordance with Law No. 40/2004 has improved access to maternal and child health in Indonesia. BPMs that cooperate with BPJS Health help reduce maternal and infant mortality rates. However, administrative, technical and financial constraints remain. Solutions include simplifying administration, improving facilities, and improving the claims payment system. Paper Type: Research Article

Abstract

This study was investigates the implementation of Law No. 3 of 1982 on Mandatory Company Registration in Surabaya, focusing on the corporate sector. Through comprehensive analysis, the research aims to evaluate company compliance with registration regulations, identify implementation issues, and formulate strategic recommendations for improvement. The methods include secondary data analysis and field surveys with company owners and managers. Findings reveal variations in compliance levels, with some companies adhering well to the regulations, while others face challenges such as lack of understanding of registration procedures. Recommendations include enhancing company owners understanding of Law No. 3 of 1982, providing procedural guidance, and strengthening collaboration between companies and authorities. This research is expected to contribute to improving corporate compliance and regulatory effectiveness in Surabaya.

Abstract

Perjanjian yang terjadi dalam pinjaman online pun harus didasarkan dengan undang-undang yang berlaku dalam segala aspek yang dilakukannya. Syarat sah suatu perjanjian yang dilakukan dalam transaksi tersebut haruslah sesuai dengan Pasal 1320 KUHPerdata. Sedangkan terkait pinjam meminjam sendiri harus sesuai dengan yang telah diatur oleh Pasal 19 ayat (1) POJK No. 77/POJK.01/2016. Maraknya masyarakat yang menggunakan pinjaman online membuat banyaknya perusahaan-perusahaan pinjaman online yang tersebar di masyarakat menjadikan penyebab dari banyaknya kasus penyalahgunaan kewenangan yang dimiliki oleh perusahaan pinjaman online. Kasus yang marak terjadi akibat pinjaman online illegal ini yaitu adalah ancaman dan juga penyebaran data pribadi. Perlindungan data pribadi itu sendiri telah diatur dalam Pasal 26 UU No. 19 Tahun 2016 Tentang Perubahan atas Undang-Undang Nomor 11 Tahun 2008 Tentang Informasi.
