Abstract

PT. Medan Industrial Area (Persero) is a state-owned enterprise engaged in industrial estate management services. PT. Medan Industrial Estate (Persero) as management rights holder can submit parts of the land to third parties according to the requirements of management rights holders which cover allotment, use, time period, and compensation with provisions for granting land rights to third parties, especially building usufructuary rights. on land management rights carried out by authorized officials based on legislation. The problem raised in this study, namely how the legal provisions for granting management rights over land from the Regional Government of Deli Serdang Regency to PT. Medan Industrial Area (Persero), the implementation of the surrender of parts of the land from PT. Medan Industrial Area (Persero) to third parties, especially the building rights for land management rights, and the accountability of PT. Abstract

The legal consequences for land title certificates with the same object, due to inaccuracy, inaccuracy, and negligence of the head of the land office, the consequence of issuing double certificates is legal uncertainty regarding ownership rights to property or land. ownership, so that the position is weakened and the double certificate can be overturned by the court. Legal protection for holders of land rights certificates, namely rights holders, namely the plaintiffs get legal protection as in Government Regulation Number 24 of 1997, and Article 19 paragraph (2) letter c, Article 23 paragraph (2), Article 32 paragraph (2). and Article 38 paragraph (2) of the UUPA, that documentary proof of rights acts as a strong means of proof. Analysis of the Supreme Court Decision Number 1820 K / Pdt / 2017 which states that the Property Rights Certificate is no longer valid no. 535 Pananjung Village is now Pangandaran Village, which was previously under the name YY changed to the name of Mr TAPT. The specification of this research is descriptive analysis, descriptive analysis means that this research is expected to obtain a detailed and systematic description of the problems to be studied. Due to the legal consequences of multiple land rights certificates with the same object, due to inaccuracy, inaccuracy, and negligence of the head of the land office, the result of the issuance of a double certificate is legal uncertainty regarding ownership of rights over ownership or control of land, so that the status of the certificate becomes weak and a double certificate can be canceled by the court, the next result is the revocation of the certificate. Legal protection for holders of land title certificates, namely rights holders, namely the plaintiffs receive legal protection as in Government Regulation no. 24 of 1997, and Article 19 paragraph (2) letter c, Article 23 paragraph (2), Article 32 paragraph (2) and Article 38 paragraph (2) of the UUPA, that letters of proof of rights act as a strong means of proof. Analysis of the Supreme Court Decision Number 1820 K / Pdt / 2017 which states that canceling the Freehold Certificate no. 535 Pananjung Village, now Pangandaran Village, formerly on behalf of YY, transferred to on behalf of Tuan TAPT, it can be seen that legal certainty and legal protection for land title certificate holders have not been fully realized

Abstract

The legal analysis of the cooperative establishment where the founders are represented by a power of attorney without an intermediary of a legal official is stated in Law No. 25 of 1992 concerning cooperatives.There is no single paragraph that requires that a Statute of a cooperative must be authentic, meaning that the establishment of a cooperative is only required in a written form (deed), that is, it can be a deed without intermediary legal officials and can also be an authentic deed.This is regulated in paragraph (1) of Article 7 of the Cooperative Law.Provisions regarding the establishment and amendment of the articles of association stipulated in the Cooperative Law provide freedom to those who will establish cooperatives to choose whether to use deeds without the intermediary of a legal official or authentic deed

Abstract

Abstrak. Hukum bisnis yang menjadi perhatian adalah masalah kontrak pengikatan barang bergerak sebagai jaminan hutang yang banyak terjadi di masyarakat. Kontrak merupakan barometer kegiatan bisnis yang dapat menimbulkan konflik kepentingan antara pelaku usaha dengan konsumen. Lembaga bisnis yang bergerak dalam memberikan fasilitas pinjaman uang antara lain lembaga bisnis perbankan dan lembaga non perbankan (leasing, asuransi, gadai). Dua lembaga bisnis ini sering diminati masyarakat konsumen atau debitur untuk meminjam kredit. Masing-masing lembaga bisnis tersebut dengan cara-cara tertentu bersaing untuk merebut pangsa pasar menarik para konsumen. Tentunya kedua lembaga itu memiliki perbedaan dalam prosedur pemberian kredit tetapi ada kesamaannya yaitu dalam pemberian pinjaman kepada para debiturnya, pihak penyedia pinjaman selalu meminta adanya jaminan berupa harta kekayaan debitur.Kata Kunci : Benda Bergerak, Hutang, Leasing.

Abstract

Corporate social responsibility is a corporate commitment to sustainable economic development in an effort to improve the quality of life and the environment. So that this commitment is not only the obligation to budget funds, but also how to care for the environment and the community as part of the strategic plan of each company's activities. Corporate social responsibility and environment are expected to not merely refer to the financial budget inputs provided, but include the appropriateness and fairness of the company's overall activities as a realization of its concern for the environment and society. This writing used descriptive analytical research methods complemented by literature and comparative studies, as well as normative juridical approaches. The results showed that corporate social and environmental responsibility (corporate social responsibility) must be carried out in partnership with the stakeholders followed by transparency and accountability and all parties.

Abstract

Pembuktian seorang pecandu dan korban penyalahgunaan narkotika untuk direhabilitasi terbilang cukup sulit sebagaimana diatur dalam Undang-undang Nomor 35 Tahun 2009 tentang Narkotika, merupakan hal yang sulit, karena harus melihat awal pengguna narkotika menggunakan narkotika dan diperlukan pembuktian bahwa pengguna narkotika ketika menggunakan narkotika dalam kondisi dibujuk, diperdaya, ditipu, dipaksa, dan/atau diancam untuk menggunakan narkotika. Dalam implementasinya Mahkamah Agung mengeluarkan terobosan dengan mengeluarkan Surat Edaran (SEMA) Nomor 04 Tahun 2010 yang menjadi pegangan pertimbangan hakim dalam memutus narkotika. Pemikiran Double Track System menginginkan adanya kesetaraan antara Sanksi Pidana dan sanksi tindakan, tentu saja ini sangat perlu diterapkan bagi pelaku penyalahgunaan narkotika sekaligus sebagai pecandu narkotika, sehingga tentu saja ada efek jera dan proses penyembuhan dari pelaku kejahatan narkotika tersebut dapat berjalan, sehingga bagi para pelaku kejahatan narkotika dan dengan proses ini dilksanakan akan mampu untuk sembuh dari ketergantungan penggunaan Narkotika dan jera karena adanya sanksi pidana. Namun jika korban penyalahgunaan narkotika hanya perlu diberikan tindakan penyembuhan/rehabilitasi dari pemerintah.

Abstract

Praktek jual beli yang melibatkan penjual dan pembeli barang/jasa di Indonesia sejatinya dapat meningkatkan perekonomian di Indonesia dan mensejahterakan masyarakat sebagai pelaku usaha sekaligus memenuhi kebutuhan hidup masyarakat sebagai pembeli. Prosedur yang digunakan untuk mengumpulkan data dalam penelitian ini berupa dokumentasi yaitu pedoman yang digunakan berupa catatan atau kutipan, pencarian literatur hukum, buku dan lain-lain yang berkaitan dengan identifikasi masalah dalam penelitian ini secara offline maupun online. Analisis bahan hukum dilakukan dengan menggunakan metode analisis isi (centent analysis method) yang dilakukan dengan mendeskripsikan materi peristiwa hukum atau produk hukum secara detail guna memudahkan interpretasi dalam pembahasan. Konsumen adalah setiap orang pemakai barang dan/atau jasa yang tersedia dalam masyarakat, baik bagi kepentingan diri sendiri, keluarga, orang lain, maupun makhluk hidup lain dan tidak untuk diperdagangkan. Sementara itu Perlindungan konsumen adalah segala upaya yang menjamin adanya kepastian hukum untuk memberi perlindungan kepada konsumen. Penyelesaian sengketa melalui jalur litigasi yang idealnya lebih memberikan kepastian hukum bagi para pihak terutama pihak yang dimenangkan karena putusan hakim yang telah berkekuatan hukum tetap bersifat mengikat, tidak ada upaya hukum yang lain dan harus dilaksanakan oleh para pihak. Namun pada kenyataannya justru kebalikannya yaitu konsumen/penggugat (pihak yang dimenangkan) tidak mendapatkan kepastian atas hak-haknya yang telah diatur dalam Pasal 4 UUPK.

Abstract

While the loan-receivable agreement is generally used by the public and is not related to the bank.This type of research is normative legal research. What is meant by juridical normative research is research used to study the application of legal norms or norms. Regulations Regarding Responsibility for Acts Against the Law on Credit Agreement Deeds, which are carried out by the board of directors are regulated in Article 1365 of the Civil Code regarding Acts Against the Law, the Code of Commercial Law, namely PT Regulations in the KUHD described in articles 36 to 56. The further discussion regarding PT as a legal entity is regulated in Law Number 40 of 2007, Article 1 point 2, namely the general meeting of shareholders, directors and commissioners who have their respective functions and duties as well as authority. And Article 52 of Law Number 30 of 2004 concerning the Position of Notary Public.

Abstract

The issuance of law number 4 of 2009 concerning mineral and coal mining provides a new authority in the world of the act does not close the gap of illegal mining which is rife in Indonesia. Although the law already exists, the fact is that mining without permits continues. This study aims to determine the forms of non-criminal illegal mining and accountability. Forms of illegal mining are criinal acts of mining without permission either UIP, IPR or IUPK. Criminal offenses submit false report data, criminal offenses of exploration without rights, criminal offenses as holders of UIP exploration without carrying out production operations activities, criminal acts of laundering mining goods, criminal offenses related to abuse of authority of the official of the licensing authority, criminal acts which is a legal entity. The criminal liability against companies that carry aut mining activities without a permit is by imprisonment and with a criminal fine. Besides that the leablity for companies that conduct mining with civi sanctions and also administrative sanctions by way of making a business.

Abstract

This study discusses the legal arrangements on land that are charged with mortgage rights to flats standing on the land, then analyzes the imposition of certificates of ownership rights to flats as collateral for bank credit and to find out the implementation of execution if one of the debtors breaks their promises related to the granting of mortgage rights to the flats. used as collateral for bank loans. The research empirical juridical type, namely research that emphasizes the use of legal norms in writing and is supported by data collected in the field and the results of interviews with sources and informants as supporting data. Based on the results the ownership rights of the apartment unit are simultaneous or concurrent in nature which contains joint rights and individual rights. The right of ownership of the apartment unit itself can be charged with mortgage rights as collateral for bank credit based on article 47 paragraph (5) of the Flats Law. Execution of the ownership rights of the apartment unit that is charged with mortgage rights as credit guarantees as a result of the debtor defaulting to the creditor, then the bank as the creditor of the Flats Unit does not directly execute the Mortgage on the creditor guarantee but the bank will take persuasive steps as well as non-litigation mediation to resolve non-performing loans so that no party feels aggrieved and if the non-litigation process reaches a dead end, then the litigation process is carried out.
