Abstract

This paper is an attempt to study the scholars? network of Mandailing Ulama with those of Haramayn in the mid-19th  and early 20th century. Employing the content analysis method the research finds that the Mandailing scholars had made an intellectual encounter with the scholars in Haramayn, even some of the established networks with Egyptian and Indian scholars. The Mandailing scholars connote those who ethnically originated from Mandailing clan and data reveals that Mandailing scholars come from the residencies of Tapanuli and East Sumatera, both of which are parts of the modern era North Sumatera province. This not to deny that some of the Mandailing scholars were also born in Makkah. From the aspect of the duration of the study, some scholars studied religion intensively and settled in Makkah, while others only learned the Islamic religion by meeting the scholars of Makkah only during the Hajj period. The last group of scholars only studied religion intensely in Nusantara, but while performing hajj they met the scholars and learned religion in very limited time. Mandailing scholars studied Islamic sciences, especially Quranic exegeses, had?th, and Sufism to a number of such scholars from Arab and Nusantara as Ahmad Khatib al-Minangkabawi, ?Abd al-Qadir b. Shabir al-Mandili (Nasution) and Hasan Masysyath. Ideologically, they studied Islamic sciences in the context of the Sunn? school of thought, especially Ash?ar?yah and Sh?fi??yah. This study then fills the gap of the study of other researchers about the Nusantara Ulama Network with Middle Eastern scholars.

Abstract

Al Jam’iyatul Washliyah was founded in 1930 in Medan North Sumatera, a plural region religion-wise. Many consider Al Washliyah maintaining moderate understanding of Islam. Its Fatwa Council produced considerable number of fatwas in recent years, including fatwas that test Al Washliyah’s position on difficult issues, including issues on terrorism, non-Muslims, Islamic sects, women leadership, and LGBTs. By reviewing the organizational documents using the content analysis method, results showed that not all fatwas issued by the organization reflected its moderate claim. Regarding jihad and terrorism, Al Washliyah’s fatwa certainly against using terror in achieving religious goals. Likewise, they consider Shi’ah as orthodox as Sunni, although this decision is contentious inside Al Washliyah since many ulama within the organization opposed it. However, its fatwas in respect to religious pluralism and Islamic sects hints its conservative stance as echoed from their fatwas on interreligious marriage, non-Muslim leader, Ahmadiyah and LGBTs. This shows that such issues remain difficult test for many Indonesian Muslims as religious moderatism increasingly erodes in recent times.

Abstract

Digital imagery from digital image cameras often has some disturbances that may occur, such as lenses not focusing, spots appear caused by the imperfect capture process. This ineptness can be caused by uneven lighting resulting in uneven intensity, low image contrast and the appearance of noise in the image. Of course all these negative effects will reduce the quality on digital imagery. To overcome the noise, efforts need to be made to improve the quality of that image. One of them is by filtering the image both linearly and non-linearly. There are many methods that can be used to perform linear and non-linear filtering. Images that contain noise can limit the valuable information needed when image analysis is done. Gaussian filter is one of the linear filters that serves to smooth and eliminate noise in an image. Mean Filter is very simple and easy to implement and is very useful for reducing the variation in value of a pixel with the next pixel. This filter works by replacing the intensity of the pixel value with the average the neighboring pixels.

These scholars include Ahmad Khatib al-Minangkabawi, ‘Abd al-Qadir b. Shabir al-Mandili (Nasution), and Hasan Masysyath. Ideologically, they studied Islamic sciences in the context of the Sunnī school of thought, especially Ash‘ariyya and Shāfi‘iyya.

Abstract

Al Washliyah is a moderate Islamic organization in Indonesia. Ulama (Islamic scholars) have obtained honorable and strategic positions in Al Washliyah organization. As an elite group in Al Washliyah organization, the ulama have responded to socio-religious problems in Indonesia, including issues of radicalism and terrorism. Their responses to these problems should be understood as the Ulama's reflection and a foundation in counteracting  radicalism and terrorism in Indonesia. This paper is mainly written to get an insight into the ulama’s responses towards the four issues indoctrinated by the radical and terrorist groups such as the Islamic State, jihādī, takfīrī, and suicide bombers. This research highlights that Al Washliyah ulama give different interpretations of those four doctrines, by prioritizing moderation in religion and firmly rejecting radicalism and terrorism in actions or ideas.Abstrak:Al-Jam’iyatul Washliyah merupakan sebuah organisasi Islam moderat di Indonesia. Para ulama sejauh ini mendapatkan kedudukan terhormat dan strategis dalam organisasi ini. Para ulama sebagai kelompok elit dalam organisasi Al Washliyah memberikan respons terhadap persoalan sosial keagamaan di Indonesia, termasuk masalah radikalisme dan terorisme. Respons mereka terhadap masalah ini perlu diketahui dan menjadi salah satu landasan bagi upaya menangkal paham dan gerakan radikalisme dan terorisme di Indonesia. Artikel ini mengkaji respons para ulama Al Washliyah terhadap radikalisme dan terorisme. Kajian artikel ini difokuskan pada respons mereka terhadap empat isu yang menjadi doktrin kelompok-kelompok radikalis dan teroris yakni negara Islam, jihādī, takfīrī, dan bom bunuh diri. Artikel ini mengajukan temuan bahwa para ulama Al-Washliyah yang menjadi informan terpilih memberikan interpretasi yang berbeda mengenai keempat isu tersebut. Studi ini menunjukkan bahwa ulama Al-Washliyah mengedepankan moderasi dalam kehidupan beragama dan berbangsa, dan secara tegas mereka menolak paham dan gerakan radikalisme dan terorisme.

Abstract

Abstrak: Hukum Acara Islam: Analisis Kitâb al-Qâdhî ila al-Qâdhî dalam Literatur Hukum Islam. Telah jamak diterima di sementara kalangan ilmuwan bahwa hukum Islam tidak memiliki prosedur, dan memiliki jejak akar kemunculannya pada sistem yang dikenal dalam sistem hukum sekuler. Esai ini menganalisis asal usul gagasan prosedur hukum dengan menelusuri konsep awal yang ditemukan dalam genre Kitâb al-Qâdhî ilâ al-Qâdhî yang tergabung dalam literatur hukum fuqaha' atau ahli hukum Islam. Penelitian ini adalah penelitian kualitatif dengan menganalisis materi hukum pada surat hakim kepada hakim lain yang ditemukan dalam karya-karya berbagai ulama hukum Islam. Temuan penelitian ini mengimplikasikan bahwa meskipun ada penyederhanaan beberapa ilmuwan pada hukum pembuktian Islam, ada diskusi yang sangat kompleks tentang masalah ini dalam karya ulama hukum Islam. Selanjutnya, catatan sejarah hukum pembuktian dalam Islam ini telah menjadi bagian integral dari praktik sosial dan hukum pada masa awal, yang sejarahnya dapat dianggap sebagai konsepsi awal hukum pembuktian dalam Islam.Kata Kunci: Hukum Islam, prosedur, bukti, dokumenter, sejarah hukumAbstract: It has been commonly accepted amongst some scholars that Islamic law lacks of procedure and that it had indebted greatly to the system known in the secular system of law. This essay attempts to analyze the origin of the idea of the law procedure by tracing the very early concept found in the genre of Kitâb al-Qâdhî ilâ al-Qâdhî (a letter form one judge to another judge) incorporated in the legal literature of fuqahâ’ or Islamic jurisprudents. The study is a qualitative research by in depth analysis on legal materials on the letter of a judge to another judge found in the works of various Islamic law scholars. The finding of this study implies that despite the over-simplication of some scholars on the Islamic law of evidence, there exist a very complex discussion of the issue in the works of Islamic law scholars. It is conceivable to assert that this historical record of law of evidence in Islam had become an integral part of the social and legal practices of the early time that could be regarded as the early inception of law of evidence in Islam. Keywords: Islamic law, procedure, evidence, documentary, legal history

Abstract

Salah satu perdebatan paling serius tentang al-Qur’an adalah mengenai kemukjizatannya yang muncul pada abad ketiga Hijriah sebagai respons terhadap penyangkalan berkelanjutan terhadap wahyu yang diterima oleh Nabi Muhammad saw. Sejak itu berbagai studi dilakukan tentang aspek i’jâz. Tulisan ini mendiskusikan pendapat al-Zamakhsyârî dan Sayyid Quthb, sehingga akan terungkap sejauhmana persamaan dan perbedaan pendapat mereka terhadap i’jâz. Penulis menemukan bahwa keunggulan pendekatan al-Zamakhsyârî terdapat pada aspek pemahaman bahasa dan retorika yang menunjukkan keistimewaan teks al-Qur’an yang tiada tara. Sebaliknya, Sayyid Quthb secara eksklusif menekankan pada elaborasi karakteristik penting al-Qur’an yang terabaikan oleh ilmuwan dan ahli hukum Muslim, sehingga tujuan utamanya bukan untuk pembuktian validitas i’jâz. Pendekatan mereka terhadap al-Qur’an membuktikan metode baru dengan kualifikasi masing-masing.

Abstract

This paper attempts to shed lights on the performance of  the obligations to a valid contract that can be frustrated by events beyond human control. Such events may have considerable impact on various designated legal principles and rules which is widely known as force majeure. The doctrine of unforeseen circumstances in contemporary legislation, on the main, is expressed in the same term which understandably as result of  the origin derivation of  the French law le theorie de l’imprévision. Although it is true that there is no such general principle of  force majeure in classical Islamic law, the author argues that significant efforts have been made in synthesizing both the Islamic and Western law concepts. Accordingly, despite the fact that the traditional Islamic legal system has its own mechanism to deal with such events at the time of contract, to a certain extent, it has influenced its contemporary form of  the concept of  intervening conti- ngencies (nazariyyat al-jawa’ih ) as reflected in the Civil Codes of  the Arab states. In addition, in response to the exigencies of the ever-increasing problems of modern life which brings with it alien concept, force majeure does not contradict with the provisions of the Shari‘ah since the views of Islamic jurisprudents (fuqahâ) can justifiably be referred to.

Abstract

Abstrak: Studi ini mengkaji biografi dan gerakan Shaykh Ali Hasan Ahmad ad-Dary yang biasa disebut Tuan Hasan. Studi ini penting dilakukan mengingat studi yang dilakukan peneliti selama ini mencitrakan sosok ulama asal Mandailing ini sebagai sosok yang berjiwa terbelah akibat kajian mereka yang terlalu spesifik. Studi ini menunjukkan bahwa Shaykh Ali Hasan merupakan ulama yang berafiliasi dengan organisasi Nahdlatul Ulama (NU) dan ahli dalam sejumlah bidang ilmu-ilmu keislaman. Sementara beberapa studi tentang Shaykh Ali Hasan lebih memfokuskan hanya pada gagasannya dalam bidang hadis dan tasawuf. Studi ini merupakan hasil dari sebuah penelitian kepustakaan dimana data diperoleh dari kegiatan telaah dokumen. Karya-karya Shaykh Ali Hasan dan hasil kajian para ahli tentang dirinya dijadikan sebagai referensi yang akan dianalisis dengan metode analisis isi. Kajian ini akan menunjukkan bahwa Shaykh Ali Hasan menampilkan sosok yang mumpuni dalam bidang ilmu-ilmu keislaman dan aktif dalam dunia pergerakan di Nusantara. Wajah ganda inilah yang membuat dirinya menjadi berbeda dengan sejumlah ulama yang kurang aktif dalam dunia pergerakan. Studi ini diharapkan dapat menjadi referensi utama dalam kajian Islam di Mandailing. Abstract: Ulama NU di Tanah Mandailing: Biografi Syekh Ali Hasan Ahmad ad-Dary. This study examines the biography and movements of Shaykh Ali Hasan Ahmad ad-Dary, popularly known as Tuan Hasan. This study is important because the study conducted by researchers thus far has portrayed the figure of the ulama from Mandailing as a split-minded person because their studies are too specific. This study shows that Shaykh Ali Hasan is an ulama affiliated with the Nahdlatul Ulama organization and an expert in many fields of Islamic sciences. Up to the present time, studies of Shaykh Ali Hasan exclusively focuse on his ideas in the realm of hadith and sufism. This study is the result of a literature study where data is obtained from document review activities. Shaykh Ali Hasan’s works and a number of research findings and important studies are used as references to be analyzed by the content analysis method. This study shows that he presents a distinctive figure in the field of Islamic sciences and is active in the world of movement in the archipelago. It is this double faceted roles that makes him different from most scholars who are less active in the world of movement. This study is expected to become the main reference in Islamic studies in Mandailing. Kata Kunci: NU, Mandailing, ulama, hadis, tasawuf, hukum Islam
