Abstract

Asas kepatutan dalam sebuah perjanjian memengang peran penting dan menjadi salah satu syarat sahnya perjanjian. Dalam pelaksanaannya, mewajibkan para pihak mengindahkan kepatutan dan kepantasan sehingga menciptakan rasa keadilan dalam masyarakat. Penelitian ini merupakan penelitian hukum empiris (empirical research). Penelitian ini akan dilakukan di Kantor Notaris/PPAT di Kota Makassar dan Pembiayaan Konsumen di Kota Makassar. Populasi dalam penelitian ini adalah Notaris/PPAT di Kota Makassar, Pembiayaan Konsumen, dan para pihak dalam Perjanjian. Penentuan sampel dilakukan dengan teknis purposive sampling. Hasil penelitian menunjukkan bahwa pemberian kuasa dari konsumen sebagai debitor kepada perusahaan pembiayaan sebagai kreditor merupakan inisiatif dari satu pihak saja yakni kreditor. Hal ini jelas tidak memenuhi asas kepatutan dalam Pasal 1339 KUHPerdata, karena dalam pelaksanaannya konsumen sama sekali tidak mengerti bahkan tidak mengetahui apa yang menjadi isi dari Akta Jaminan Fidusiayang telah mengikat dirinya sebagai pemberi fidusia. Untuk memenuhi asas kepatutan, sebaiknya pengunaan Surat Kuasa untuk Kuasa yang digunakan untuk pemberian jaminan fidusia haruslah ditiadakan.

Abstract

The existence of legal auditors as a certified profession in carrying out legal audits is essential and strategic in developing a legal compliance system in Indonesia. However, statutory regulations specifically in UUJN (regulation of notary position) does not regulate the prohibition of a dual notary position as a legal auditor. This study adopts an empirical juridical approach which was conducted in the Special Capital Region of Jakarta. The results of the study showed that there were no statutory provisions regarding the ability of a person who had served as a notary to become a legal auditor. Although, the Notary Position Law and the code of ethics bindthe notary public which do not also prohibit a notary from occupying the position of legal auditor. In the case of a notary and a legal auditor, the potential for a conflict of interest is immense. This was based on the consideration a legal auditor which has the duty to examine and/or assess legal issues related to a company, including the validity of authentic deeds made before a notary official.

Abstract

Guarantee law is very important in sustaining development and economic recovery which is being actively implemented in Indonesia. The land guarantee institution is one of the guarantees that has the ability to provide legal certainty in protecting the guarantor and the guarantee recipient, or commonly called the mortgage right. This study aims to analyze the implementation of electronic mortgage registration in Gorontalo District. This research is an empirical legal research that uses primary legal data and secondary legal sources. The data obtained, both primary data and secondary data, were then analyzed qualitatively. The results of the study show that the implementation of electronic mortgage registration has several obstacles in the socialization process. There are still many people who have not received information regarding the process and implementation of registration of mortgage rights electronically. Abstract

The rapid advancement of Artificial Intelligence (AI) presents significant opportunities and considerable challenges for the Indonesian financial sector. This paper examines the urgent need for a comprehensive regulatory framework and adaptive oversight mechanisms to govern AI applications in digital financial services in Indonesia. Currently, existing regulations are fragmented and insufficient to address the complexities of AI, including algorithmic accountability and potential biases that could lead to consumer detriment and systemic risks. This research employs a normative legal method, utilizing statutory, conceptual, and comparative approaches by benchmarking Indonesia's legal landscape against international best practices in the European Union, the United States, and Singapore. The study identifies a critical regulatory gap concerning legal liability for AI-induced losses, currently reliant on general civil code provisions (Article 1367 KUHPerdata) that may not adequately cover the autonomous nature of AI. It argues for the necessity of specific AI regulations focusing on risk-based approaches, transparency, accountability, and robust consumer protection, drawing insights from frameworks like the EU AI Act. The paper concludes by recommending institutional reforms and the strengthening of AI governance, grounded in Pancasila principles, to foster a secure, ethical, and inclusive digital financial ecosystem in Indonesia. This will ensure that AI innovation proceeds responsibly, safeguarding the public interest and national financial stability.

Abstract

This study explores the legal position and implications of forum selection clauses and alternative dispute resolution (ADR) mechanisms in contemporary sharia-based property disputes. Although statutory regulations have governed the forum for Sharia economic dispute resolution—generally designating Religious Courts or Sharia Arbitration—practical implementation still raises interpretative challenges, particularly in cases involving third parties or property rights. Using a qualitative method with statutory, comparative, and case study approaches, the research reveals that forum choice clauses in sharia contracts are legally valid and binding, as supported by Supreme Court Circular Letter (SEMA) No. 4 of 2016. However, in practice, disputes involving secondary agreements or third-party claims over property often shift jurisdiction from the Religious Court to the District Court. This occurs especially when the primary issue concerns ownership or property rights tied to sharia-based transactions, such as murabahah, ijarah, or rahn contracts. The findings underscore a dissonance between normative legal frameworks and judicial practice, leading to overlapping authorities and legal uncertainty. The study also identifies a tendency among judges to prioritize the object of dispute (e.g., property or collateral) over the contractual nature, thereby affecting the determination of appropriate forum jurisdiction. This research contributes academically by offering a clearer understanding of how forum selection clauses operate within Indonesia's dual court system and by advocating for a more integrated legal interpretation that aligns Islamic legal principles with national procedural law. Ultimately, it highlights the urgency of harmonizing jurisdictional boundaries to strengthen the enforcement and credibility of sharia economic law in resolving property-related disputes.

Abstract

The Makassar City Government has carried out government functions by demonstrating the realization of measurable programs and regulations in handling the Covid-19 pandemic in Makassar City. Several strategic steps have become examples for other local governments, such as procuring isolation places on ships in collaboration with PT—Indonesian National Shipping (Pelni) for Covid patients in the mild category. The level of legal compliance of the people in Makassar City in implementing health protocols as an Effort to Prevent and Control Corona Virus Disease in 2019, the majority are at the Compliance level (fulfillment of wishes) due to fear of being penalized. At the identification level, namely, compliance to maintain good relations with enforcement officials law enforcement, some of them have law enforcement relatives, and very few are at the level of internalization who comply with the rules because they know the purpose of the regulations for implementing health protocols and know the dangers of transmitting the Covid-19 virus. Factors that become obstacles in implementing health protocols in handling the Covid-19 pandemic are a) Community saturation factor. b) The inconvenience factor of using a mask. c) The factor of public knowledge of the dangers of Covid-19 is limited

Abstract

Protection of the laws of intellectual property of the coconut oil bone in a geographical point of view (guided by paserangi and marwah). The purpose of this study is: to know, understand and analyze (i) how the character is present in pure bone coconut oil (vco) so that it is potentially protected intellectual property rights (geographic indications) and (ii) to know, understand and analyze the efforts of local governments and communities in promoting the legal protection of pure bone coconut oil (VCO). The kind of research carried out using empirical research methodology conducted interviews with primary source of information and data collection of craftsman ( vco ) pure coconut oil, the district government bone and the ministry of justice and human rights south sulawesi. The results of this study show that: (i) pure coconut oil ( vco) bone potential to register geographical indications for having a reputation, the quality and characteristic of its distinctive flavor.Based on a pure coconut oil laboratory test ( vco ) bone meets 5 (five) parameters to register geographical indications, which is the content of 81854 fatty acid, peroxide number 0.4996, Burial number 210.92 mg koh/gr, shit number 0.0002 %, and water number 0.1908 %. The government of the bone district is expected to make an effort to register geographically on pure coconut oil (Vco) as a step in order to obtain legal protection and legal certainty as well as to obtain exclusive rights and economic benefits, As set up in the 20-year law of 2016 about brands and geographical indications.

Abstract

This study aims to identify and describe the characteristics of sanrego wood so that it can be protected by the intellectual property rights act in the form of legal protection for geographical indications and to examine local government efforts for legal protection for geographical indications for sanrego Bone wood. This research uses the type of empirical research. Legal research is carried out by examining existing facts in line with observations in the field so that they can reveal in detail and explore the object being observed. This research was conducted in Bone Regency, South Sulawesi Province an the Ministry of Law and Human Rights of South Sulawesi.The data obtained was colleted through this study by data processing, both primary data and secondary data, all data were analyzed qualitatively. The results of the study show that: (1) Sanrego wood has the potential to obtain legal protection for Geographical Indications because of its reputation, quality and characteristics. Based on Laboratory Tests, Sanrego wood contains active compounds, namely, flavonoids, alkaloids, and steroids ehich function as aphrodisiacs. Sanrego wood has also met standardization as a traditional medicine according to the Decree of the Director General of Drug and Food Control Number: 03726/B/SK/VII/89. (2) The Government of Bone Regency is expected to make efforts to legally register the geographical indications of sanrego timber as a step to obtain legal protection and legal certainty as well as to obtain exclusive rights and economic benefits, as stipulated in Law Number 20 of 2016 concerning Trademarks and Geographical Indications.

Abstract

The implementation of a mortgage auction carries a high potential for lawsuits to cancel the auction due to objections from the debtor. This study analyzes the rights of heirs over assets encumbered with a mortgage based on credit agreements, aiming to provide legal certainty for auction winners and protection for mortgage auction winners. The research is normative with a legislative and conceptual approach. The findings show that inherited property mortgaged by the deceased, the heirs must fulfill the obligations. If they refuse, the bank can auction the property. However, auction winners often face legal disputes from heirs. For example, in Case No. 453/Pdt.G/2021/PN Mks, heirs sued Bank BRI and the auction winner, claiming ownership of the mortgaged property, despite the auction winner having valid proof. A similar issue occurred in Case No. 240/ Pdt.G/2019/PN Mks, where heirs sued PT Penanaman Modal Madani and the auction winner over a mortgaged asset due to non-performing loans. In both cases, auction winners encountered conflicts and difficulties in executing their rights despite winning the auction legally. This highlights that auction winners often lack adequate legal protection, especially in disputes with heirs. Despite existing auction regulations, legal uncertainty remains, and protection for auction winners needs improvement.
