Abstract

In decision No. 1243/Pid.Sus/2022/PN.Sby the defendant was declared legallyand convincingly guilty of committing the crime of class I Narcotics abuse for himself.The Defendant was given a criminal sanction in the form of imprisonment for 2 (two)years but the Judge did not order or implement rehabilitation for the Defendant.Whereas in Article 127 paragraph (3) of Law No. 35 of 2009 clearly states that: "In theevent that the abuser as referred to in paragraph (1) can be proven or proven to be avictim of narcotics abuse, the abuser is required to undergo medical rehabilitation andsocial rehabilitation." Thus the judge's decision does not reflect legal certainty.The type of legal research is normative legal research. The data used issecondary data. Meanwhile, if seen from the nature of this research is descriptive.The results of this study are that the provision of rehabilitation sanctions fornarcotics abusers based on Article 127 is linked to Article 103 of Law Number 35 of2009 concerning Narcotics, namely judges often do not give rights to narcotics users tocarry out rehabilitation, even though in Law Number 35 of 2009 concerning Narcoticsthere is a guarantee rehabilitation for drug abusers. This article should be used as abasis for judges deciding cases of narcotics abuse for users and addicts to undergomedical rehabilitation and social rehabilitation aimed at recovering perpetrators fromnarcotics addiction. Legal certainty regarding the imposition of rehabilitation sanctionsbased on Article 127 is linked to Article 103 of Law Number 35 of 2009 concerningNarcotics against abusers and perpetrators of criminal acts, namely Law Number 35 of2009 concerning Narcotics has provided legal certainty for the sanctions given, namelyin the form of imprisonment (prison) and rehabilitation sanctions (medical and social)for each perpetrator. Law Number 35 of 2009 concerning Narcotics has 2 sides, namelya humanist side for narcotics addicts and abusers, and a tough and firm side fordealers, syndicates and narcotics dealers. However, what needs attention in itsimplementation is that imprisonment given to narcotics abusers is not an effective wayto repair damage.Keywords: Sanctions, Rehabilitation, Narcotics Abuse

Abstract

Kasus kekerasan dan pelecehan seksual semakin meningkat dan meresahkan. Sebelum adanya Undang-Undang Nomor 12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual, tidak ada payung hukum yang secara khusus mengatur mengenai sanksi dari tindakan pelecehan seksual. Selain itu korban pelecehan seksual umumnya dialami oleh perempuan dan anak-anak walaupun tidak menutup kemungkinan laki-laki dapat menjadi korban pelecehan seksual. Artikel ini akan membahas mengenai tindakan preventif yang dapat dilakukan untuk mencegah terjadinya kekerasan dan pelecehan seksual dengan harapan meningkatnya kesadaran hukum tentang tindak pidana kekerasan dan pelecehan seksual.

Abstract

Money laundering now covers many aspects and is developed in such a way and in linewith technological developments. Perpetrators of money laundering crimes use technologicaladvances as weapons and banking financial service providers as a place to store the proceedsof money laundering. One of them is the Cryptocurrency Mode which is currently widelycirculating in society. The development of Cryptocurrency has given rise to new methods inCryptocurrency as a new phenomenon in terms of payment transactions.This research is normative legal research. This is based on library research which takesquotations from reading books, or supporting books that are related to the problem to beresearched. This research uses secondary data sources consisting of primary, secondary andtertiary book materials. This research also uses qualitative data analysis and producesdescriptive data.From the results of the research and discussions carried out, several conclusions wereobtained, namely: First, the importance of additional regulations related to the criminal act ofmoney laundering using Cryptocurrency mode in Indonesia is considered important because itis currently widely used by Indonesian society. Second, the ideal regulation regarding thecriminal act of money laundering using the Cryptocurrency mode is to include elements of thelaw on money laundering. The author's suggestion is that there is a need to strengthen theauthority of law enforcement officials in eradicating criminal acts of money laundering usingCryptocurrency mode as well as giving more concrete attention to the formation of special lawsthat regulate Cryptocurrency as part of criminalization in Indonesia.Keywords: Reformulation, Money Laundering, and Cryptocurrency

Abstract

In the era of globalization the rapid development and progress ofinformation technology has led to changes in human life activities in various field.The development of information technology has influenced the development ofnow forms of crime that are more modern in nature namely the rise of fake news(hoaxes). In the name of freedom netizens feel they have right over their personalaccounts. Firm action needs to be taken in the form of imposing criminal penaltieson those who carry out the dissemination in order to give a warning not to actarbitrarily on social media. On the other hand there is no need to undermine thespirit of freedom of expression in a democratic system. The purpose of writing thisthesis is : first, to find out criminal responsibility related to those who spread fakenews (hoaxes) on social media. Second, to find out who is responsible for fakenews (Hoaxes) on social media.The type of research conducted by the author is normative juridicalresearch because it makes library materials the main focus in conductingresearch. This research is descriptive, in nature namely a study that describesclearlyand in detail about a problem.From the result of research problems there are two main things thatcan be concluded. Firsty, criminal liability for perpetratpors of criminalacts of spreading fake news (Hoaxes) on social media can be heldaccountable by being imposed by two legal regulations, namely law number19 of 2016 concerning amendments to law number 11 of 2008 concerninginformation and electronic transactions in article 45A paragraph 1 and inthe criminal code in article 360. The two,Every person who spreads fakenews (Hoaxes) is obliged, such as the Ministry of Communication andInformation, which handles the initial action. If there is fake news(Hoaxes)yhat spreads, the Indonesian Police also begins to follow up on thereport fake news (Hoaxes) in the hope that the news can be known morequickly whether it is true or a Hoax.Keyword : Criminal Liability – Fake News (Hoaxes) – Social Media

Abstract

With the rapid development of technology, the law must also be able to keep up withtechnological developments and the times, but this advancement in information technology hasnegative consequences for creators of scientific works, this is because there are no specificlaws or rules that can protect creators of scientific works from accusations of defamation, sofar many creators of scientific work have been subject to defamation articles related to theirscientific work. Criminal sanctions should be used as a last resort in resolving a legal issue,this is in accordance with the principle of ultimum remedium, there should be other sanctionsimposed on the creation of scientific works if the scientific work is deemed incorrect.This study uses a normative juridical research type, namely research that is focused onexamining the application of the rules or norms in law to legal principles. The data collectiontechnique in this research is literature study. The approach used in this research is to use anormative approach, namely library law research.The results of the research conducted by the author are first, the urgency of legalprotection for creators of scientific works from accusations of defamation can be said to beurgent/important, this is because scientific works are the result of studies or scientific facts inthe field and also so far there are many creators of works science which is sanctioned bycriminal law.Secondly, in overcoming problems related to the large number of creators of scientificworks who are charged with defamation, regulations are needed that regulate legal protectionfor creators of scientific works. Suggestions in resolving the problem regarding the largenumber of creators of scientific works being subject to defamation sanctions, the governmentand the House of Representatives must form a law to provide legal protection for creators ofscientific works.Keywords: Defamation, Creator of Scientific Work.

Abstract

Women are creatures of God Almighty, just as men have natural rights that are inherent and must be protected. In the Islamic legal system, women get a glorious position and many letters in the Qur'an tell about women. Yet today's tendency, many violations of women's human rights, especially occur in the domestic so-called domestic violence.This study raises the problem of how the protection of women victims of domestic violence according to the Indonesian legal system and Islamic legal system and how the ideal future form of protection of women victims of domestic violence. This type of research is normative juridical, using secondary data types. The results showed that the protection of women victims of domestic violence in the legal system of Indonesia already has a legal umbrella that is Law No. 23 of 2004 on the Elimination of Domestic Violence, but there are still weaknesses, while the protection of women victims of domestic violence in the Islamic legal system refers to Al Quran and Hadith especially in the Surah An Nisa but need to be interpreted contextually not just textual. The ideal form of protection of women victims of domestic violence in the future that is the articles in the Act abolition of domestic violence should apply the principles of marriage in Islamic law, so as to create peaceful, peaceful and eternal home forever

Abstract

Women are a group or group that is vulnerable to violence that occurs in society. To overcome various issues of violence that occur against women, special attention is needed from all groups, both community groups and government circles, consisting of the central government and regional governments. This certainly has an impact on the existence of women's groups in the social order amidst demands for achieving Sustainable Development Goals (SDG's). If we refer to the concept of "mainstreaming" itself, it can be interpreted as a process that is carried out to bring aspects that were previously considered unimportant or marginal into the decision-making and management of main institutional activities and work programs. This series of strategies was prepared based on insight, critical awareness and data obtained from gender analysis. Therefore, this study is considered important to look at gender representation in Siak Hijau policies.

Abstract

A legally aware village is a form of orderly and obedient society from the lowest level, so that it will further increase compliance with applicable laws and regulations. It is considered more appropriate for villages to empower the community so that a village will be aware of the law. This empowerment was carried out in Batu Belah village, Naumbai village and Ranah Baru village, Kampar District, Kampar Regency. The aim of this empowerment is to increase legal awareness and improve the economy of the community in the village so that the village can be more advanced than before and more prosperous. This activity is carried out through legal outreach, training and assistance which includes techniques for drafting village regulations, and legal assistance. The method used is a participatory approach, where the community is actively involved in every stage of the activity. The results of this service show an increase in community knowledge about the village's readiness to be aware of the law. This effort not only aims to create order and security, but also to improve the local economy. With collaboration between the government, community and the private sector, it is hoped that Batu Belah Village, Naumbai Village and Ranah Baru Village can become models for other villages in integrating legal awareness with sustainable economic development, so that community welfare can be realized as a whole.

Abstract

Stunting is a problem caused by a child's lack of nutritional intake for a long time, resulting in growth disorders in children, namely a height that is lower than the age standard. Based on the results of monitoring nutritional status and measuring stunting at the village level in 2023, it was recorded that in Kampar District, Ranah Baru Village is the village with the largest number of stunted children, namely 5 (five) children. Through the Community Service activities of the Ministry of Education, Culture, Research and Technology, the University of Riau Community Empowerment Scheme (PMM), seeks to carry out various stunting prevention programs and activities to make the village 0 (zero) stunting by increasing the community's knowledge regarding stunting prevention. and increasing self-grown food crops to fulfill children's daily nutrition, organizational management and entrepreneurship training. Not only the community, these programs and activities must also involve various parties and cadres in the village, including the village government, health workers, community leaders and families to work together to prevent and reduce the number of stunted children in the village. The aim of this service is to change people's habitual patterns so that they are more responsive to stunting. As a result of this service activity, the community can utilize all the potential that exists in their village in the form of local wisdom appropriately and wisely so that they can overcome the problem of stunting either before or after

Abstract

The salak business community is struggling with marketing due to a lack of awareness about salak plantations in Banjar Seminai and skepticism regarding the existence of pondoh salak in Dayun Siak Riau. A potential solution is to empower the community during the harvest season by processing the abundant snake fruit into products like chips, diamonds, dodol, jenang, syrup, bakpia, candied fruit, and other innovative foods. The initiative aims to empower the salak farming community in Banjar Seminai Village, Siak Regency, by enhancing their marketing skills for salak products. This includes training and mentoring in manual and online marketing, packaging, and branding. The participatory approach engages farmers at every stage, resulting in improved knowledge and skills in marketing salak products and increased income. This empowerment aims to promote salak products from Banjar Seminai Village and positively impact the local economy.
