Abstract

Regulations regarding serious human rights, especially regarding state officials in thedefense sector, are regulated in Law Number 26 of 2000 concerning Human Rights Courts,however, in this regulation there is a problem where there is no distinction between theimposition of criminal sanctions between state officials and the public. in general. This canbe seen in article 42 paragraph (3) which regulates the punishment of state officials in thesecurity sector who commit crimes against humanity. This article refers to article 37 as thebasis for the punishment of state officials.This type of research can be classified as normative research which examines legalprinciples, namely the principle of criminal responsibility. This research uses secondary databy elaborating on primary, secondary and tertiary legal materials that are relevant to theresearch topic.Based on the results of the research, it can be concluded that firstly, the absence ofdifferences in the imposition of criminal sanctions between state officials in the defensesector who commit crimes against humanity and ordinary people makes the currentregulations weak. This can be seen in Article 42 paragraphs 1 and 3 of Law Number 26 of2000 concerning Human Rights Courts which have been the source of law for resolvingserious human rights cases and in Article 599 of Law Number 1 of 2023 concerning theCriminal Code which has many problems in the regulations. This means reducing theminimum criminal sentence for someone who commits crimes against humanity. Secondly, informing regulations it is actually necessary to consider philosophical, sociological andjuridical factors. In the case of Brigadier General TNI M. Noer Muis in the East Timor case,he was acquitted of all charges against him and Infantry Major Isak Sattu in the Panai casewas deemed not guilty of the actions he committed, the results of this verdict show that justicehas not been implemented in society. Therefore, it is necessary to reform the criminal law inincreasing punishment for state officials in the defense sector who commit crimes againsthumanity in Indonesia.Keywords: Criminal Law Policy, Sentencing, State Officials, Crimes Against Humanity

Abstract

Sejak awal Korporasi belum dikenal sebagai subyek hokum, hal tersebut sesuai dengan asas societas delinquere non potest atau Universalitas Delinquere non potest,sehingga pertanggungjawaban pidana oleh korporasi selalu dibebankan kepada pengurus korporasi, Namun karena kemajuan yang terjadi dalam bidang keuangan, ekonomi, dan perdagangan, terutama diera globalisasi serta berkembangnya Tindak Pidana yang terorganisasi, baik yang bersifat domestik maupun transnasional, mengharuskan koperasi diakui sebagai subyek hokum dan mempertanggungjawabkan perbuatannya. Oleh sebab itu persoalan pokok dalam tulisan ini terkait kedudukan Korporasi sebagai subjek hukum pidana dalam KUHP Baru dan bagaimana pertanggungjawaban pidana korporasi dalam KUHP Baru. Penelitian ini menggunakan analisi kualitatif, sehingga dengan keluarnya UU Nomor 1 tahun 2023 tentang Kitab Undang-Undang Hukum Pidana(KUHP), pada pasal 45 bahwa korporasi adalah subjek tindak pidana, sehingga dalam hal ini korporasi bisa bertindak layaknya sebagai manusia dan dapat pula dimintakan pertanggungjawaban atas perbuatan tindak pidananya

Abstract

Undang-undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan menyebutkan Pasal 291 ayat (1) setiap orang yang mengemudikan sepeda motor tidak mengenakan helm standar nasional Indonesia sebagaimana dimaksud dalam Pasal 106 ayat (8) dipidana dengan pidana kurung paling lama 1 (satu) bulan atau denda paling banyak Rp.250.000,00 (dua ratus lima puluh ribu rupiah), ayat (2) setiap orang yang mengemudikan sepeda motor yang membiarkan penumpangnya tidak mengenakan helm sebagaimana dimaksud dalam Pasal 106 ayat (8) dipidana dengan pidana kurung paling lama 1 (satu) bulan atau denda paling bayak Rp.250.000,00 (dua ratus lima puluh ribu rupiah). Namun pada kenyataannya masih banyak para pengendara sepeda motor yang melakukan pelanggaran dengan tidak mengenakan helm saat berkendara sehingga dapat mengancam keselamatan apabila terjadi kecelakaan. Tujuan penelitian ini untuk menjelaskan penegakan hukum oleh kepolisian terhadap pelanggaran lalu lintas yang tidak mengenakan helm, kendala yang dihadapi kepolisian, dan upaya yang dilakukan kepolisian dalam melakukan penegakan hukum terhadap pelanggaran lalu lintas yang tidak mengenakan helm di Wilayah Kota Pekanbaru. Jenis penelitian ini dapat digolongkan dalam jenis penelitian sosiologis, karena penulis langsung mengadakan penelitian ke lokasi atau lapangan tempat yang diteliti guna memberikan gambaran secara lengkap dan jelas tentang masalah yang diteliti. Penelitian ini dilakukan di Kepolisian Resor Kota Pekanbaru sedangkan populasi dan sampel adalah merupakan keseluruhan pihak yang berkaitan dengan masalah yang diteliti. Dalam penelitian ini sumber data yang digunakan data primer dan data sekunder dan data tersier, dan teknik pengumpulan data dalam penelitian ini dengan wawancara, observasi dan membagiakn kusioner. Hasil penelitian ini menjelaskan bahwa penegakan hukum yang dilakukan pihak kepolisian adalah dengan melakukan operasi pada satu tempat (stasioner) dan operasi yang dilakukan secara bergerak (hunting) dengan melakukan penegakan secara preventif maupun represif. Upaya-upaya yang dilakukan kepolisian adalah memberikan sosialisasi kepada masyarakat dan pelajar. Kendala-kendala yang dihadapi kepolisian adalah kurangnya kesadaran hukum masyarakat, kurang tegas dan disiplin aparat kepolisian dalam melakukan penegakan hukum. Disarankan kepada penegak hukum untuk lebih bekerjasama dengan organisasi-organisasi dan tokoh-tokoh masyarakat serta pihak sekolah dalam melakukan sosialisasi. Disarankan kepada penegak hukum untuk lebih tegas dan disiplin dalam melakukan penegakan hukum terhadap pelanggar yang tidak mengenakan helm. Diharapkan kepada masyarakat Kota Pekanbaru untuk lebih peduli lagi dengan keselamatan dalam berkendara agar meminimalisir dampak kecelakaan yang terjadi pada anak

Abstract

Tindak pidana pembakaran hutan atau lahan merupakan kejahatan yang harus diperangi secara komprehensif oleh setiap pihak. Salah satu upaya untuk membalas pelaku pembakaran hutan atau lahan adalah dengan mengenakan hukuman pidana penjara dan denda semaksimal mungkin, untuk membuat jera dan menjadi pelajaran bagi yang melakukan perbuatan tersebut. Masalah pokok dalam penelitian ini Penegakan Hukum Terhadap Pelaku pembakaran Hutan dan Lahan di wilayah Polsek Tanah Putih Tanjung Melawan dan hambatan dalam menerapkan sanksi tindak pidana lingkungan bagi tersangka pembakaran hutan di wilayah Tanah Putih Tanjung Melawan. Penelitian ini tergolongan penelitian hukum sosiologis. yaitu penelitian yang hendak melihat korelasi antara hukum dan masyarakat dengan adanya kesenjangan antara dass sollen dan das sein. Sedangkan dilihat dari sifatnya, penelitian ini bersifat menggambarkan dari suatu kenyataan secara lengkap, rinci, dan jelas. Penelitian ini dilakukan di wilayah Kecamatan Tanah Putih Tanjung Melawan Kabupaten Rokan Hilir, sedangkan populasi dan sampel adalah Kapolsek, Kanit, Penyidik. Sumber data yang digunakan ialah dari data primer, data sekunder dan data tersier dengan teknik pengumpulan data dengan cara melalui wawancara dan kajian kepustakaan. Dari hasil penelitian, ada tiga hal pokok yang dapat yang dapat disimpulkan. Pertama, Penegakan Hukum Terhadap Pelaku pembakaran Hutan dan Lahan di wilayah hukum Polsek Tanah Putih Tanjung Melawan dilakukan dengan cara preventif (pencegahan), refresif (penindakan), Adapun tahapan preventif dilakukan dengan cara: melaksanakan sosialisasi Karhutla, Mapping daerah rawan kebakaran hutan dan lahan, pemberdayaan masyarakat adat, upaya Mitigasi, melakukan patrol Karhutla, dan Persiapan Pemadaan api. Sedangkan pada tahap refresif dilaksanakan dengan melarang apa yang bertentangan dengan hukum dan memberikan penegakan hukum kepada pelaku. Kedua, Faktor penyebab yang membuat aparat penegak hukum tidak bisa menemukan tersangka di Kecamatan Tanah Putih Tanjung Melawan ada lima faktor yang mempengaruhi penegakan hukum yang pertama, kaedah hukum atau peraturan itu sendiri, petugas atau penegak hukum, fasilitas dan kondisi geografis hutan di lokasi kebakaran, masyarakat masih menganut budaya membuka lahan dengann cara di bakar. Ketiga, Kendala dalam penegakan hukum terhadap pelaku pembakaran Hutan dan Lahan di wilayah hukum Polsek Tanah Putih Tanjung Melawan adalah Pertama, Faktor Alam, Faktor Undang-undang, Faktor Sarana dan Prasarana

Abstract

The background of the concept of rechterlijk pardon is rooted in theprevalence of defendants who have actually fulfilled the burden of proof, butsentencing them would result in a conflict between legal certainty and justice. Onthe other hand, the qualification procedure for rechterlijk pardon must be strictlyregulated to ensure that pardons are not granted without guidelines, given thewide discretion available to judges. Rechterlijk pardon in the penal systemprimarily concerns the imposition of penalties where judges may decide not toimpose a sentence on proven guilty defendants based on the goals of sentencing.The analysis employs normative research using a qualitative approach,specifically conceptual and legislative approaches, to uncover how judges weighdecisions and the constraints that govern judges in rechterlijk pardon rulings.The findings of this research suggest that legal reasoning by judges mustalign with moral reasons consistent with Pancasila values and civilized law, andshould focus on individualizing punishment and subsociality in formulatingsentencing goals. Sentencing guidelines are intended as a controlling function.The highly individual characteristics of criminal cases should be autonomouslyjustified with sufficient consideration of legal principles and the principle of culpain causa.Keywords: Rechterlijk Pardon, Verdict, Penal System

Abstract

One thing that can explain the power of the police in carrying out theirduties is the discretion or authority given by law to act in special situationsaccording to the judgment and conscience of the police themselves. Given thatthis authority is very broad, it requires requirements that must be possessed byofficers, especially in assessing a case, especially cases that threaten propertyand even the safety of one's life. Nevertheless, the authority to declare someoneguilty of committing a criminal offense is the panel of judges through a courtdecision. However, there are cases that researchers analyze where victims whomake defense efforts are forced to have a different final settlement from the lawenforcement process in previous similar cases.This type of research can be classified into empirical sociologicalresearch. With the research location located in Bekasi City, especially in thejurisdiction of the Bekasi City Metropolitan Police, while the population andsample are all parties related to the problem under study. This research uses datasources in the form of primary data and secondary data, and data collectiontechniques are carried out by interview.From the results of the problem research, there are 3 main things that canbe concluded. First, Noodweer is the authority of the judge who assesses, so thereis no rule that authorizes the police to stop the investigation or not continue acase due to applying the reasons for criminal erasure, Indonesian National Policeofficers in carrying out their duties and authorities can act according to their ownjudgment. However, the case of Muhammad Irfan Bahri proves the ability of lawenforcement officials to convince the public that these institutions can providemaximum protection and ensure the safety of victims. Third, the ideal idea of theinvestigator's action in applying the reason for criminal nullification according tothe concept of noodweer for the future is to limit discretion to prevent arbitraryactions with consideration of the principle of necessity, the principle ofstraightforwardness and integrity, the principle of benefits and objectives and theprinciple of balance.Keywords: Forced Defense, Investigator, Discretion.

Abstract

Good management of regional assets is also key in improving financial capabilities and services to the community. The legal basis for regional asset management is regulated in Government Regulation Number 27 of 2014, which emphasizes the importance of administrative, physical and legal security for regional property. Thus, regional heads have a big responsibility in managing regional assets to avoid disputes and maximize the potential of assets as regional wealth. Management of regional assets, especially land, often faces various challenges, including unclear ownership status, lack of adequate documentation, and protracted legal conflicts. This study aims to identify the factors that cause disputes over regional land assets and evaluate the effectiveness of administration and control carried out by the regional government. In this research we will examine the problems of administering and controlling regionally owned land which is the object of dispute in court (goods management study belonging to a region in the province of Riau, the type of research used is research in the form of an empirical study which is to find theories regarding the process of occurrence and operation of law in society which finds facts according to what happened as they are, the conclusion of this research is Problematics The administration and control of BMD in Riau Province is caused by a lack of commitment from the relevant institutions and the high interest of third parties who have bad intentions, which often results in disputes in court. Although the courts generally uphold the rights of the Riau Provincial Government, this problem still affects the recording and reporting of regional assets

Abstract

The restorative justice approach is a paradigm that is used as a framework for a criminal case handling strategy aimed at responding to dissatisfaction with the work of the current criminal justice system. Where the conventional criminal case settlement process is very complicated and takes a long time to arrive at a judge's decision, the litigants may not even necessarily get the justice or satisfaction they expect. Restorative justice is a concept of responding to the development of the criminal justice system by focusing on the need for community involvement and victims who feel excluded from the mechanisms that work in the current criminal justice system. The purpose of this study was to determine the application of customary law in the settlement of criminal cases through the concept of restorative justice in Cipang Kanan Village, Rokan IV Koto, Rokan Hulu Regency, Riau Province. This type of research is sociological and juridical, with an emphasis on field research; it is descriptive because it intends to describe the reality under study clearly and systematically. The community in Cipang Kanan Village always prioritizes deliberation in every activity, especially in matters relating to the resolution of disputes, so that every problem that occurs in the community always involves the role of traditional leaders in its resolution. This is a reflection of the custom that they have always implemented, where every dispute always uses peace efforts by mediation and is followed by customary sanctions that must be met by perpetrators who have violated customary provisions.

Abstract

Law Number 22 of 2009 concerning Road Traffic and Transport states inArticle 291 paragraph (1) every person who drives a motorcycle without wearingan Indonesian national standard helmet as referred to in Article 106 paragraph(8) shall be punished with a maximum imprisonment of 1 (one) month or amaximum fine of Rp.250 (2) every person driving a motorcycle who allows hispassenger not to wear a helmet as referred to in Article 106 paragraph (8) shallbe punished with a maximum imprisonment of 1 (one) month or a maximum fineof Rp.250.000,00 (two hundred and fifty thousand rupiah). However, in realitythere are still many motorbike riders who commit violations by not wearinghelmet when riding, whice can threaten safety if an accident accurs.This type of research can be classified as sociological research becausethe author directly conducts research at the location or field where it isresearched in order to provide a complete and clear picture of the problem understudy. This research was conducted at the Pekanbaru City Resort Police, wherethe population and sample were all parties related to the problem under study.The The results of this study explain that law enforcement is carried out bythe police by conducting operations in one place (stationary) and operationscarried out in motion (hunting) by carrying out preventive and repressiveenforcement. The efforts made by the police are to provide socialization to thecommunity and students. The obstacles faced by the police are the lack of publiclegal awareness and the lack of firmness and discipline of police officers inenforcing the law. It is suggested that law enforcers cooperate more withorganizations, community leaders, and schools in conducting socialization. It issuggested that law enforcers be more assertive and disciplined in enforcing thelaw against violators who do not wear helmets. It is hoped that the people ofPekanbaru City will be more concerned with safety when driving in order tominimize the impact of accidents that occur to children.Keywords: Law Enforcement, Traffic Violations, Children.

Abstract

Forest fires are no longer a rare phenomenon in Indonesia, especially inRiau Province. In fact, fires also occurred on small plots of land in communityvillages. Every year forest and land fires regularly occur in Riau Province andespecially in Rokan Hulu district. The rampant burning of forests and land inRokan Hulu Regency in particular is also caused by many people wanting to openoil palm plantations, because palm oil production is currently being sold at quiteexpensive prices compared to previous years. The perpetrators of forest and landburning got away with it without strict law enforcement by the Rokan Hulu Resortpolice. Various regulations regarding the criminal act of burning forests and landhave clear penalties starting from the Plantation Law, Forestry Law, and PPLHLaw.The method for writing this research was carried out by means ofsociological legal research. This research was carried out in the Rokan Huluresort police area, because from data obtained from the Rokan Hulu RegionalDisaster Management Agency (BPBD) cases of forest and land fires increaseddrastically, especially in 2022 The author took samples including the Head ofCriminal Investigation Unit of the Rokan Hulu Police, three investigators fromUnit 2 of the Criminal Investigation Unit of the Rohul Police, the Head of Head ofthe Rokan Hulu Regional Police Headquarters, and the community affected at thelocation of the fire.From the research results obtained from interviews, the first conclusioncan be drawn. The first way to enforce criminal law against perpetrators of forestand land fire crimes is to make adjustments to the applicable laws or carry outrepressive measures, namely by processes including carrying out inquiries andinvestigations. The two obstacles experienced by investigators in enforcing thelaw on forest and land fire crimes are remote crime scenes. Third, the efforts thathave been made by the Rokan Hulu Police to prevent forest and land fires havebeen coordinated with the government.Keywords: Law Enforcement-Forest and Land Fires-Crime.
