Abstract

Penelitian ini bertujuan untuk mengetahui dan menganalisis akibat hukum peralihan hak atas tanah karena pewarisan yang tidak didaftarkan pada Kantor Pertanahan menurut Pasal 42 Peraturan Pemerintah Nomor 24 Tahun 1997 dan wujud perlindungan Hukum bagi ahli waris yang peralihan hak atas tanah karena pewarisannya tidak didaftarkan pada Kantor Pertanahan. Jenis Penelitian ini merupakan penelitian Yuridis Normatif (Normatif Legal Research) dengan menggunakan pendekatan perundang-undangan yang bersifat koseptual. Kemudian dibantu dengan bahan-bahan hukumyang diuraikan, dideskripsikan, dan dianalisis keterkaitan satu sama lain. Peralihan hak atas tanah karena pewarisan yang tidak didaftarkan pada Kantor Pertanahan berakibat hukum: Ahli waris sebagai pemegang hak atas tanah tidak mendapat jaminan kepastian hukum. Ahli waris yang peralihan hak atas tanah karena pewarisannya tidak didaftarkan di Kantor Pertanahan, pada dasarnya mendapat perlindungan hukum karena secara materiil hak dan kewajiban. Pewaris langsung beralih ke ahli waris sebagai pemegang hak atas tanah dan sampai saat ini masih menguasai tanahnya. Akan tetapi, wujud perlindungan hukum yang diberikan berbeda kepada ahli waris yang sudah mendaftarkan peralihan hak atas tanah karena pewarisannya. Hal ini disebabkan karena ahli waris sebagai pemegang hak atas tanah telah mendapat perlindungan hukum yang kuat berupa sertifikat sebagai surat tanda bukti hak.

Abstract

Penelitian ini adalah penelitian hukum yuridis sosiologis, yang berarti bahwa dalam melakukan penelitian, komposer akan meninjau dan dari segi hukum dan juga akan melihat efek dan gejala yang ada di masyarakat dari sumber data yang digunakan. sumber data primer dan sumber data sekunder. Sedangkan teknik pengumpulan data yang digunakan adalah teknik wawancara dan studi dokumentasi. Berdasarkan hasil penelitian dan pembahasan peneliti menyimpulkan bahwa, tanggung jawab PT. Kereta Api sesuai dengan yang diatur oleh UU RI No. 13 tahun 1992 tentang mobilitas mengatakan bahwa PT. Kereta Api (Persero) sebagai pengangkut bertanggung jawab atas semua kerugian yang diderita oleh penumpang karena kelalaian dalam melakukan transportasi. Sehingga jika terjadi kecelakaan maka penumpang dan ahli waris yang terluka yang seharusnya meninggal dapat menuntut PT. Kareta Api (Persero) selama kecelakaan itu disebabkan oleh kesalahan atau kelalaian dan pembawa. Sedangkan jumlah kompensasi yang diberikan oleh PT Kereta Api (Persero) kepada korban kecelakaan kepada penumpang baik kelas ekonomi maupun kelas eksekutif tidak ada perbedaan, karena premi yang dibayarkan oleh PT. Kereta Api (Persero) ke PT. Jasa Raharja (Persero) sebagai penjamin adalah sama.

Abstract

The government has the power to intervene in all aspects of people's lives through public power, including areas not regulated by law. This condition then causes the state to need its own initiatives and policies. This is what is called the concept of discretion in administrative law. However, the exercise of discretion also tends to detect abuse and arbitrariness of duties, which can result in criminal acts of corruption as referred to in Article 3 of the Anti-Corruption Law. Because the discretionary authority is for the public interest or the public interest, then if the discretionary authority is used for purposes other than the public interest or the public interest, then the discretionary act becomes a criminal act of corruption in terms of crime. This could be considered the abuse of influential work.

Abstract

Corruption is one of the high-level crimes (ordinary crime), because corruption is not only detrimental to state finances, but also harms the wider community. Corruption crimes themselves are mostly committed by people who have positions or authorities, such as ASN (State Civil Apparatus), Regents, Governors, and other government officials. With the position or position and authority possessed, government officials have many ways and opportunities to abuse their authority in committing corruption crimes. There are two authorities of government officials, namely bound authority and free authority (discretion). Parameters to find out whether the actions carried out by government officials are a form of abuse of authority in corruption crimes or not, namely using laws and regulations consisting of laws and regulations consisting of laws, provincial regulations or regency/city regulations, especially for bound authority, while for free authority the parameters are good general principles such as principles of good governance (AAUPB) and general principles others outside the AAUPB; general principles of state governance (AAPN); Principles of State Governance (APPN); Principles of Village Government Management (APPD).

Abstract

Wherever the health industry is viewed as essential to human survival, it is the subject of heated debate. The term "health" refers to the dynamics of a healthy lifestyle, which can be viewed from various perspectives, including a fulfilling social life, a strong spiritual foundation, an understanding of the significance of health, the use of scientific disciplines to strike a work-life balance, and so on. Whenever the topic of health is brought up, it's hard to avoid referring to medicine. It is expressly stated in Health Law 36 of 2009 that persons involved in the distribution of drugs must be licensed. Of course, you know that there are many different categories of pharmaceuticals in the pharmaceutical industry; however, the distribution of hard drugs, also known as G-list drugs, requires special care. The current system for distributing hard narcotics is lax because in some locations, such medications can be acquired without the need for a prescription. Many people and organizations have been exposed as dealers and distributors of illicit substances. As a result, the author intends to elaborate on the nature of the laws governing the illegal distribution of hard drugs, the relative ease with which such substances can be purchased, the spectrum of abuse that can result from their use, and so on

Abstract

Abstract: So far, the concept of a recall occurring in Indonesia is fully controlled by political parties and is seen as injuring the spirit of people's sovereignty. Yet according to the constitution, the people have sovereignty. In the end, equality is realized only in the process of selecting political officials. But the people are not given the right to recall elected political officials. Precisely political parties have this right so that the sovereignty of the people shifts to the sovereignty of political parties. As a result, political officials will be more submissive and obedient to political parties than their voters. Purpose: This research aims to open updated insights regarding the concept of constituent recall or referendum recall in an effort to strengthen people's sovereignty. Design/Methodology/Approach: In this research uses the type of normative legal research. Using a statutory approach and a conceptual approach. In other words, this research aims to solve a problem over existing legal issues, of course, supported by a statute approach related to the issue raised, as well as raising cases that have permanent legal force, and using a conceptual framework that is guided by views and doctrines. legal in law. Findings: Political parties are seen as hampering the process of channeling people's aspirations within the legislature, often carrying out recalls without asking for the approval of the people and giving the main delegation to members of the DPR and DPRD. As stated in the 1945 Constitution regarding the sovereignty of the people, therefore, in the recall process, members of the legislature must include the people. This writing aims to change the process of replacing members of the legislature with the constituent recall process to involve the people dirctly in the withdrawal or replacement of members of the legislature, especially members of the DPR and DPRD in a democratic manner by prioritizing people's sovereignty so that the process becomes transparent and democratic. Originality/Value: Several research have raised the issue of recall, but what is novel in this research is the construction of recall constitutions which involves the people in order to realize people's sovereignty.
